CALIEGENIA AND MEXICO MEET
13 CITY COUNCIL

AGENDA STAFF REPORT
DATE: July 2, 2025
TO: Mayor and City Council
APPROVED BY: Armando Orozco, Interim City Manager/Police Chief PREPARED BY: Michael Coyne, Planning & Building Director SUBJECT: Housing Element Update Workshop - Consideration of Potential Rezone Sites for the 6th Cycle Housing Element Residential Sites Inventory =====================…:

Recommendation:

That the City Council accept public comment and deliberate on the merits of each of the selected preliminary housing sites and recommend whether or not each rezone site should be further considered for inclusion in a new Residential Sites Inventory for the 6th Cycle Housing Element.

Background:

As part of the 6* Cycle Housing Element cycle, which covers the period from October 15, 2021 through October 15, 2029, jurisdictions are required to develop a Residential Sites Inventory that identifies sites throughout the respective jurisdiction that provide enough land at various densities to accommodate housing for a range of household incomes including: very low, low, moderate and above moderate based on the County Area Median Income (AMI). The current AMi for the County of Imperial is $93,900. The RHNA is 4,868 total residential units:
• 1,279 units - Very Low Income (0 - 50% of County AMI) • 655 units - Low Income (51 - 80% of County AMI)
• 614 units - Moderate Income (81 - 120% of County AMI) • 2,320 units - Above Moderate Income (>120% of County AMI Staff has identified 53 sites throughout the City that may be suitable for inclusion on the Housing Element Residential Sites Inventory (Attachments No. 1 & 2). Of the 53 sites that would make up the inventory, 34 would need to be rezoned. Feedback from Council is requested on these 34 rezone sites, as the remainder of the sites have proper existing zoning, and, by default, would be included in the Sites Inventory. This Housing Element cycle must identify sufficient housing capacity that not only meets the

City's RHNA obligation, but creates a buffer that accounts for the viability of development on the identified sites in light of Senate Bill 166 (No Net Loss). This No Net Loss law requires that if a residential site is downzoned or rezoned, the City must maintain its residential capacity for the identified income level of the site being downzoned or rezoned. Having a buffer provides the City the flexibility to rezone or downzone sites as needed
This workshop provides the City Council with the opportunity to either maintain or eliminate rezone sites from consideration as part of the Residential Sites Inventory. All property owners of the 34 potential rezone sites were provided notice of the workshop.

Discussion and Analysis:

The Residential Sites Inventory is one of the major components of the Housing Element as it shows how a jurisdiction will meet its RHNA. A jurisdiction may meet the RHNA requirement using potential development on suitable vacant and/or underutilized sites within the community. A jurisdiction must document how zoning and development standards on the sites facilitate housing production. Most residential zone districts in the City establish a range of allowable density. For example, density within the Residential Condominium (RC) Zone is between 12 and 20 dwelling units per acre and Residential Apartment (RA) Zone is between 20 and 30 dwelling units per acre (du/acre). For purposes of calculating residential capacity of sites in the inventory, the midpoint of allowable density and net acreage is used.

For low-income capacity purposes, the State prefers sites that are a minimum of a half-acre and a maximum of ten acres in size. As such, most of the housing sites identified for low-income capacity are between a half-acre and ten acres.

The overall approach for the new inventory is to look at potential lots dispersed throughout the City that are infill in nature and have readily available services (i.e. sewer, water, electricity, adequate street access). Staff has identified potential residential sites for inclusion in the 6th Cycle inventory listed on Attachment No. 1 and depicted on Attachment No. 2. The Sites Inventory, as proposed, would yield 2,012 low income units, 997 moderate income units, and 2,957 above moderate income units, for a grand total of 5,966 dwelling units, which would adequately meet the City's RHNA.

Upon feedback from Council, Staff will finalize the Sites Inventory and present the Draft Housing Element (which would include the Sites Inventory) at a subsequent City Council meeting. Staff would then post the draft Housing Element on the City's website for an obligatory 6-day period before submitting it to HCD for review. The selected rezone sites would be further analyzed as part of the Program Environmental Impact Report (EIR) for which the City received a $250,000 SCAG grant. Certain infill sites are identified as by-right housing sites, which would be covered by the Program EIR and allow for their streamlined development. As much of the City is in an Airport Safety Zone, the draft Housing Element will also need to be submitted to the Imperial County Airport Land Use Commission, which will likely find many of the sites to be inconsistent with the Airport Land Use Compatibility Plan. The City Council, however, has the ultimate land use authority, and can overrule the Airport Land Use Commission.

This is a workshop, not subject to CEQA pursuant to Section 15306, titled "Information Collection".

Compliance with the Environmental Quality Act (CEQA) would be required for the adoption of the Housing Element and land use/zone amendments.

Fiscal Impact: Not Applicable.
