Adopt a Resolution Approving a Temporary Fee Schedule for Planning Applications, Building Permits, and Encroachment Permits until June 30, 2029.
Background:
Pursuant to Council direction, Staff has prepared an updated planning and building fee schedule with fees that are more affordable to the typical Calexico resident and/or business owner. Numerous City planning and building fees are high when compared to other jurisdictions in the Imperial Valley. The proposed building fee schedule targets common building permits requested by the public including permits for windows, doors, water heaters, air conditioners, fences, meter upgrades, solar panels, and re-roofs. Many residents and businesses have expressed their dissatisfaction with the high cost these permits and many may be discouraged from obtaining such permits due to the cost and, as such, may be completing unpermitted work that may be unsafe due to a lack of compliance with the building code One of the intended outcomes of the proposed reduction to building permit fees is that the increased affordability will result in less unpermitted work and increased permit activity. The proposed planning ano building fee schedule closely parallels past temporary fee reductions adopted in 2021 and revised in 2022 (Attachment No. 1).
The proposed temporary fee schedule would expire on June 30, 2029, absent any Council action to rescind or supersede the schedule. Staff intends to pursue the preparation of a comprehensive user fee study by a qualified third-party consultant specializing in these studies within this three-year period. The last comprehensive user fee study was completed in 2009, upon which the currently adopted planning and building fees are based, and may not reflect processing efficiencies and project streamlining that have been implemented since then. If a comprehensive user fee study is completed before this three- year period and the City Council adopts the fees recommended by this study, such fees would supersede this temporary fee schedule.
Discussion and Analysis:
In addition to incentivizing permitted work, the intent of the updated fee schedule is also to support economic development, which is a strategic goal of the City Council. The proposed planning fees will make development applications more affordable and competitive with surrounding cities and may encourage business and residential development in the City. As provided in a report to the City Council on May 21, 2025, most of the City's planning fees are higher when compared to other jurisdictions in the region (Attachment No. 2). The updated fees may also help drive away the stigma that the City is not business friendly, and, as such, would help with positive branding efforts for the City, which is central to any city's economic development efforts.
Some of the proposed building permit fee reductions are based on how fees are calculated, with several fees resulting in a reduction due to a change in the assessment to a per permit or project unit basis rather than on a quantity or size, such as a square or linear feet. Some fee reductions are based on a change to the absolute value of the fee. In addition, a selection of fee reductions are based on the elimination of an additional plan check fee. In the case of solar permits, fees would be reduced in accordance with the fee limits placed on photovoltaic systems by Assembly Bill 1124 (AB 1124). AB 1124 limits the fees that local jurisdictions can charge for the review of either a residential solar energy system or a commercial solar energy system. For residential solar energy systems, local jurisdictions may not charge a fee of more than $450 plus $15 per kilowatt for each kilowatt above 15-kilowatt hours. For commercial solar energy systems, jurisdictions have a cap of up to $1,000 for systems up to 50 kilowatts plus $7 per kilowatt between 51 kilowatts and 250 kilowatts, plus $5 per kilowatt for each kilowatt above 250 kilowatts.
These updated fees would be easier to calculate by staff as many would be calculated on a per permit basis rather than by square footage or linear feet, thus reducing the amount of time expended by staff on processing permits.
Although considered an engineering fee, a reduction in encroachment permit fees is also proposed with The existing encroachment fees are the highest in the region and are often criticized as excessive by residents, businesses and utilities. The proposed encroachment fee schedule would more closely align with the fees charged by surrounding jurisdictions, while still ensuring full cost recovery.
The temporary fee schedule will be effective upon adoption of the attached resolution. Such fees would not be retroactive, meaning that the adoption and implementation of the temporary fee schedule will not entitle any person who has already paid fees prior to adoption of the temporary fee schedule to receive a refund, credit or reimbursement of such payment.
Fiscal Impact:
Each permit fee proposed for reduction has been individually evaluated, with estimates on average times expended in processing each type of permit, which for building permits include anticipated plan check reviews by planning and building staff and inspections by the building inspector. The proposed fees reflect these anticipated staff times at fully-burdened rates, with the goal of ensuring full cost recovery on a cumulative basis. Revenues from building permits will be tracked on a biannual basis as part of the mid-year budget review with trends reported to the City Council. At this time, the full financial impact of the fee reductions is unknown, especially if there is an uptick in building permit activity as a result of the reduced fees. However, if a significant detrimental impact to the budget is determined as a result of this temporary reduction in fees, these fees could be rescinded by resolution of the City Council. In such a scenario, fees would revert to the currently adopted fee amounts.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALEXICO, CALIFORNIA,
APPROVING A TEMPORARY FEE SCHEDULE FOR PLANNING APPLICATIONS,
BUILDING PERMITS, AND ENCROACHMENT PERMITS
UNTIL JUNE 30, 2029
WHEREAS, the City Council of the City of Calexico conducted a meeting concerning processing fees for planning applications, building permits, and encroachment permits; and WHEREAS, staff has prepared a temporary fee schedule reflecting reduced fees for planning applications, building permits, and encroachment permits; and WHEREAS, a reduction in such fees supports the Council's strategic goal of economic development, and
WHEREAS, a reduction in building permit fees makes such permits more affordable and accessible to Calexico residents and businesses, where residents and businesses are more likely to apply for such permits, leading to more permitted and inspected work that meets codes and standards, thus supporting the public health, safety, and welfare; and WHEREAS, the fees in the temporary fee schedule do not exceed the reasonable cost of providing services; and
WHEREAS, the adoption and implementation of the temporary fee schedule is not retroactive and does not entitle any person who has already paid fees prior to adoption of the temporary fee schedule to receive a refund, credit or reimbursement of such payment; and
WHEREAS, staff intends to pursue the preparation of a comprehensive user fee study by a qualified third-party firm within the three-year period the temporary fee schedule would be in effect that reflects current practices, workflows, and processes; and WHEREAS, this resolution shall become effective immediately upon adoption by the City Council and end or be extended or superseded by June 30, 2029; and BE IT RESOLVED by the City Council, staff is directed to implement and utilize the Temporary Fee Schedule for Planning Applications, Building Permits, and Encroachment Permits as shown in Exhibit A.
