AGENDA STAFF REPORT
DATE: July 154, 2026
TO: Mayor and City Council
APPROVED BY: Benjamin A. Martinez, City Manager
PREPARED BY: Benjamin A. Martinez, City Manager
SUBJECT: Adopt Resolution No. 2026- - - approving an Access Agreement for Regional Mobile CRV Collection Program and Anchor Recycling Center Support Activities Recommendation:

It is recommended that the City Council of the City of Calexico approves an Access Agreement for Regional Mobile CRV Collection Program and Anchor Recycling Center Support Activities.

Background:

The Imperial Valley Resource Management Agency (IVRMA) has developed a Regional Mobile California Redemption Value (CRV) Collection Program to improve access to beverage container recycling opportunities throughout Imperial County. The program is intended to increase recycling participation by providing convenient mobile collection events in rural, underserved, and convenience zone-impacted communities.

To facilitate the program, IVRMA is requesting participating agencies, including the City of Calexico, to enter into an Access Agreement that authorizes IVRMA to utilize mutually approved City-owned properties for temporary mobile CRV collection events and related public education activities. The Agreement has an initial term of five (5) years and may be terminated by any participating agency with thirty (30) days' written notice.

Discussion and Analysis:

The proposed Access Agreement establishes the respective responsibilities of IVRMA and the participating jurisdictions. Under the Agreement, the City's responsibilities are limited to providing reasonable access to mutually approved public properties, designating a staff contact for coordination, assisting with scheduling as necessary, and notifying IVRMA of any site restrictions or special conditions.

The City will also allow IVRMA to conduct public outreach regarding event locations.

IVRMA will be solely responsible for all aspects of the Regional Mobile CRV Collection Program, including program administration, staffing, event operations, collection and transportation of recyclable materials,

regulatory compliance, public outreach, and restoration of each event site following use. IVRMA will own and maintain all vehicles, equipment, technology systems, and collected materials associated with the program.

Additionally, the Agreement requires IVRMA to maintain specified insurance coverage, including commercial general liability, automobile liability, workers' compensation, employer's liability, and environmental pollution liability insurance. The City, its elected officials, officers, employees, and agents will be named as additional insureds under IVRMA's liability policies. IVRMA further agrees to indemnify, defend, and hold harmless the City from any claims, liabilities, damages, or expenses arising from the operation of the Regional Mobile CRV Collection Program.

Approval of the Agreement will allow the City of Calexico to participate in a regional recycling initiative that expands convenient recycling opportunities for residents while minimizing the City's operational responsibilities and risk exposure. Participation also supports regional sustainability efforts and encourages increased diversion of recyclable materials from local landfills.

Fiscal Impact:

There is no Fiscal Impact.
