BACKGROUND
The City is at a critical juncture and requires the expert guidance of experienced professionals to ensure that it continues on the path to efficient management and operation. The City Council recently appointed Douglas Dunford as City Manager with an anticipated start date of May 2, 2022. Given the substantial amount of work that is ahead for the City, including the recruitment and selection of a Chief of Police, Human Resources Director, Finance Director and Public Works Director, Mr. Dunford needs significant support.
One of those experienced professionals is Greg Greeson, a CaPERS retiree, who has over 24 years of experience in the management and operation of municipal governments. Given that significant experience, staff is recommending that the City Council appoint Mr. Greeson on a limited-term basis to as an extra-help retired annuitant to support Mr. Dunford in a variety of functions as requested by Mr. Dunford.
Although there are currently four department head vacancies at the City, it would not be appropriate for the City Council to appoint Mr. Greeson to any of the miscellaneous department head positions on an interim basis because in his functions in supporting the City Manager will be broader than the specific functions of the Human Resources, Finance Director or Public Works Director positions. For example, in addition to assisting with the recruitment and selection of appointments to the vacant department head positions, Mr.
Greeson will also assist in evaluating and, if necessary, restructuring each of these departments. He will also negotiate contracts with firms in key industries that are anticipated to generate substantial revenue for the City. As such, an appointment under Gov. Code section 21224 as a limited-term extra help retired annuitant is consistent with the work that Mr. Greeson will be performing.
Gov. Code section 21224 permits the limited-term appointment of CaPERS retirees to temporary positions subject to certain requirements, including limited hours, compensation, and duration of work. As a CaPERS retiree, Mr. Greeson can only work an aggregate of 960 hours in a fiscal year regardless of how many CaPERS contracting agencies he works for during such period. Further, he cannot be paid more than or less than what the City would otherwise pay an employee in a comparable position according to the City's published salary schedule. In this respect, the most comparable position for purposes of establishing an hourly rate within the parameters of Gov. Code section 21224 is that of the City Manager position as there is currently no deputy general manager or assistant general manager position at the City.
Mr. Greeson has been retired since 2018 and as such, a waiver of the 180-day waiting period is not needed. Although extra-help retired annuitant appointments can be made by City employees with authority to make appointments, City policy provides for all appointments to be made by the City Council.
It is anticipated that, if approved by the City Council, Mr. Greeson will begin on May 2, 2022, subject to receipt of written confirmation from CaPERS that Mr. Greeson may be appointed as an extra-help retired annuitant. A request for written confirmation has been submitted to CaPERS. 1 Staff recommends that the City Council approve by Minute Order the limited-term appointment of Greg Greeson as an extra-help retired annuitant to support the City Manager, as appropriate, and that it authorize the interim City Manager to sign the limited-term employment agreement with Mr. Greeson on behalf of the City.
RECOMMENDATIONS
Take the following actions in the order listed:
1. Approve by Minute Order the Limited-Term Appointment of Greg Greeson, a CaPERS Retiree, as Extra Help Retired Annuitant.
2. Authorize the Interim City Manager, Anne Ambrose, to sign the Limited-Term Appointment Agreement with CaPERS Retiree for the Position of Extra Help Retiree.
FISCAL IMPACTS
Mr. Greeson would be paid an hourly rate of $86.54 per hour, which is the hourly equivalent of the City Manager position which is the most comparable position to the work that will be performed by Mr. Greeson.
He is not entitled to any additional compensation, benefits, vacation, or holidays.

Re: CaPERS Retiree Conditional Limited-Term Appointment Agreement Dear Greg:
If accepted by you, this letter represents an agreement for a limited-term appointment as a CaPERS retiree with the City of California City ("City") in an extra-help capacity under the provisions of Government Code Sections 7522.56 and 21224 to provide support to the incoming City Manager in a variety of projects that are integral to the success of the City, including, but not limited to the following:
• Conducting a review of, and analysis of:
• staffing levels and efficiencies city-wide,
• internal processes for streamlining the provision of services to the community, • human resources rules and practices, and
• economic development practices.
• Review and update job descriptions and prepare a recruitment strategy for the vacant department head positions of Police Chief, Finance Director, Human Resources Director and Public Works. • Assist with labor negotiations between the City and its collective bargaining units. • Provide assistance to the City with development agreement negotiations. • Provide assistance to the City with negotiations between the City and a local energy company.
Mr. Greeson will also perform additional functions as assigned by the City Manager:
This agreement is made because we have determined that your extensive career in city management will be helpful as the City continues to work towards efficient operation and management.
The terms of this agreement include:
• The term of your appointment will be from May 2, 2022, through May 1, 2023, unless the City or you elect to terminate this agreement on an earlier date by providing written notice to the other party.
• Rate of pay for this temporary appointment will be $86.54 per hour. • No further payments or benefits other than the hourly rate will be provided unless required by state or federal law.
• Hours worked shall not exceed 960 hours in a fiscal year (inclusive of all hours worked for any CaPERS employer).
Conditional Limited-Term Appointment Agreement (CaPERS Retiree) Greg Greeson
The City and you make this agreement with the mutual understanding that the appointment complies with the requirements applicable to the employment of CaPERS retirees, as codified in Government Code Sections 7522.56 and 21224. Specifically, an appointment under Sections 7522.56 and 21224 is permissible if all of the following requirements are met:
1. The appointment must be to a temporary position.
The appointment is of limited duration.
3. The appointment is either during an emergency to prevent stoppage of public business or because the retiree has specialized skills needed in performing the work.
4. The total hours worked by the retiree in a fiscal year, for all CaPERS employers, cannot exceed 960 hours.
5. The compensation received by the retiree is not more than the maximum, nor less than the minimum, monthly base salary paid to other employees performing comparable duties as listed on the City's publicly available pay schedule, reflected as an hourly rate by dividing the monthly base pay by 173.333.
6. The compensation paid to the retiree is limited to the hourly rate and no other benefits may be provided.
7. For any retirees with a retirement effective date on or after January 1, 2013, the appointment must occur at least 180 days following the date of retirement unless the employer certifies that the appointment is necessary to fill a critically needed position before 180 days have expired and the governing body approves the appointment in a public meeting.
8. The retiree cannot have received unemployment insurance payments in the prior 12-month period arising from work performed as a retiree for any public employer.
9. If the retiree is less than normal retirement age (i.e., the highest age under any retirement formula that the retiree accrued benefits under with any CaPERS employer), at least 60 days must have passed since the retiree's retirement. This waiting period cannot be waived.
The City, in good faith, has determined that your appointment meets (1) - (6) of the foregoing requirements as follows:
1. The appointment will be to a temporary position.
2. The appointment is of limited duration because it is anticipated to last one year.
3. This appointment is made because you possess the specialized skills, as identified in the first paragraph of this appointment offer, necessary for the purpose of the appointment.
4. The appointment will not exceed 960 hours in a fiscal year (inclusive of all hours worked for any CalPERS employer).
5. The compensation you will receive is no more nor less than the hourly rate paid to other employees performing comparable duties as listed on the City's publicly available pay schedule.
6. Your compensation consists of the hourly rate only; no further benefits will be provided.
By executing this agreement, you are also, in good faith, determining that your appointment meets each of the nine (9) requirements noted above, including the unemployment insurance requirement. That is, while the City is not in a position to do so, by executing this agreement you are confirming the fact that you have not received unemployment insurance payments within the past 12 months arising from work performed as a retiree for any public employer.

By signing this agreement, you are also confirming that the bona fide separation rule described in (9) above and the 180-day waiting period as specified in (7) above do not apply because you retired in 2018 Notwithstanding (4) above, the City has no way of monitoring the hours that you work for another CaPERS employer. As such, it is your responsibility to ensure that the total hours worked in a fiscal year (July 1- June 30) for the City and any other CaPERS employer do not exceed 960 hours in the aggregate.
However, please note that consistent with the requirements of Section 21220(d) and (e), the City will enroll you in CalPERS solely for administrative recordkeeping purposes (you will remain in retired status) and will report both your hours and pay pursuant to this agreement.
While the City and you make this agreement because we believe that it is authorized under Sections 7522.56 and 21224, CaPERS could disagree. If CaPERS disagrees, there is a risk that you will be required to do the following: (1) return any retirement allowance you received during the period of the appointment; (2) pay an amount of money equal to the employee contributions that should have been made, plus interest, during the appointment; and (3) pay CaPERS' administrative expenses incurred as a result of its audit of the appointment. You will also be subject to reinstatement from retirement.
By executing this agreement, you waive any claims against the City arising from an adverse determination by CaPERS associated with this appointment that is attributed to any misrepresentation made by you in this agreement or any violation of these rules caused by employment with any other CaPERS employer Please contact CaPERS if you have any questions regarding the requirements of Sections 7522.56 and 21224 or this appointment.
There is no right to public employment expressed by this agreement. All limited-term appointments are subject to the business necessity of the City and are at-will; therefore, the appointment may end with or without cause or advance notice.

Approve Resolution 4-22-2918 to adopt the revised publicly available pay schedules effective January 25, 2022, and May 2, 2022.
BACKGROUND
As a public agency that contracts with CaPERS, the City must comply with statutes and regulations contained in the Public Employees' Retirement Law. The risk of not doing so entails audits, administrative and legal costs, retirement delays, and possible reductions in employees' anticipated retirement calculations.
California Code of Regulations, Title 2, Section 570.5 for classic members and Section 571.1 for new members defines the requirements for a Publicly Available Pay Schedule needed to substantiate base salary for use in pension calculations and for other purposes.
At this point in time, the City requires revised Publicly Available Pay Schedules to reflect new positions and updated salaries as previously approved by City Council after January 11, 2022, in accordance with City policy and in compliance with applicable public meeting laws. As required by Sections 570.5 and 571.1, the revised Publicly Available Pay Schedules themselves must also be approved by City Council in accordance with public meeting laws.
Staff recommends that the City Council approve by Resolution the revised Publicly Available Pay Schedules.
FISCAL IMPACTS
There are no fiscal impacts beyond what has been previously approved by the City Council.
However, failing to approve revised Publicly Available Pay Schedules could result in additional fiscal impacts.

RESOLUTION NO. 4-22-2918
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CALIFORNIA CITY, CALIFORNIA, APPROVING PUBLICLY AVAILABLE PAY SCHEDULES EFFECTIVE JANUARY 25, 2022 AND MAY 2, WHEREAS, the City of California City ("City") first entered into a contract with the California Public Employees' Retirement System ("CalPERS") effective September 1, 1967 to provide retirement benefits to employees; and
WHEREAS, CaPERS provides pensions to eligible employees pursuant to the Public Employees' Retirement Law, Government Code section 20000 et seq. ("PERL"); and WHEREAS, CaPERS regulations require that employee salaries be included on a Publicly Available Pay Schedule as defined in California Code of Regulations, Title 2, Section 570.5 for classic members and Section 571.1 for new members; and
WHEREAS, Sections 570.5 and 571.1 also require that the City's Publicly Available Pay Schedule be approved by the City Council in accordance with public meeting laws; and WHEREAS, salaries for City employees which have been previously approved by the City Council in accordance with City policy and in compliance with applicable public meeting laws must be identified on an updated Publicly Available Pay Schedule; and
WHEREAS, solely for the purpose of complying with Sections 570.5 and 571.1, it has been determined that it is in the City's best interest to have the Publicly Available Pay Schedule revised and approved by the City Council which is consistent with previously approved compensation amounts.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CALIFORNIA CITY DOES HEREBY RESOLVE AS FOLLOWS:
1. The City Council hereby approves the Publicly Available Pay Schedules effective January 25, 2022, and May 2, 2022.
