CITY COUNCIL
DATE: 05/10/2022
TO: City Council
FROM: Recreation Supervisor - Theresa Oaks CALIFORIIE
SUBJECT: Department Report for the Month of March
Events
Staff have concluded the Desert Tortoise Days Event which was a huge success.

Staff will be having a debriefing Tuesday afternoon. Staff and volunteers are now planning for our 4* of July event.

Operations
During the month of April, our staff have been focused on event prep, programming and planning for our summer camp. Staff has taken inventory of what we have to make lists for needs for future events and future programming.

Staff is continuing to partner with We Got Next (WGN) Sports, and is running an extremely successful basketball program for elementary aged kids. WGN Sports has become affiliated with an NFL program that will help support flag football and cheer programs. Adult aerobics is back with an average attendance of 3-4. The adult walking club is continuing with an average attendance of 6. The Strata Center also continues to be open to middle school basketball practice, and open gym. The Parks free art classes for kids were on hold for the month of April but will resume the first Wednesday in May. According to our sign in sheets we have had an average daily attendance of approximately 39 people using the Strata. 7 Programming
Programming continues to include the adult aerobics, adult walking club, and various activities on Wednesday evenings. Staff will also continue working with We Got Next Sports and bringing more sports including basketball, football and cheer. Staff continues to partner with the Art Commission and hosting art classes for kids of all ages. April saw our first session of the ABC Learning preschool time which was held on Tuesdays and Thursdays from 9-11.

Future Programming
Staff are currently preparing for Summer Camp with weekly themes i.e., Lego Week, Science Week, sports and fitness week etc. This summer staff are hoping to bring Adult Water Aerobics, Adult Open Swim, Special Needs Open Swim, swim lessons for all ages, and open swim into the late afternoon/evening. Staff are looking forward to bringing basketballs and board games to Balsitis, and beginning to offer programming and interaction with the community in the area.

CITY COUNCIL
DATE: 05/02/2022
TO: City Council
FROM: Park and Rec Commission -Terri Lucy Chair CALIFORIIE SUBJECT: Quarterly Report
Events -walking workshops
The Parks and Recreation Commission has taken a very hands-on approach. We feel that the only way to really understand the condition of the parks is to visit them, so every meeting is preceded by a Walking Workshop where we visit a park or area of Central Park to observe and discuss what is there. The public has been invited but so far no one has come. But on occasion we have conversed with the public we encountered there.

Areas visited are Par Three, Little League Fields, Central Park and pool, Central Park Lake and north section, Pocket Park at the Mobile Home Village trailer community, and Balsitis Park.

Parks and Recreation is not just about facilities improvements. It is about the effect on quality of life that comes from children at play, green space, gardens and fresh air, family activities, people working together and sharing life at the community garden, the community coming together in events like Holiday Village, Tortoise Days, Forth of July and more.

This Commission and the Parks and Recreation staff, needs to be thanked for what they have accomplished. Other cities have commissions who sit at meetings and do a lot of talking. These commissioners have gotten their hands dirty, by building a community garden, running a successful Little League program, running an arts program, planning, and facilitating the civic events of Holiday Village and Tortoise Days.

Operations
Parks are Recreation was instructed to look at opportunities to utilize the area which was formerly Par Three. Several meetings were focused on this task. Several things were proposed and discussed. These include improving and expanding the Dog Park, adding a Skate Park, Splash Pad, RC Track, Soccer/Football Field, Walking/Jogging Path, adding parking area to support any expansion of the area, and a recreation building and staff to supervise and support activities in the area.

During the discussions it has been brought up that to best utilize the area it may be beneficial to bring in a professional park planner.
9 Proposals for the 2022/23 Year
Remove the chain link fence around the pool and replace it with a more secure and esthetically pleasing security fence to discourage future vandalism.

Improve the dog park by dividing it into a large dog park and a small dog park, with separate entrances and facilities for each, and improving the irrigation system.

Build a walking/Jogging path around the perimeter of Central Park proper. This would be a simple four- foot-wide path with landscaping borders and filled with compacted sand. This is considered a temporary improvement that would last only a few years. The hope is to improve and extend the path over the coming years to encompass much the lake and some of the Par Three Area, as well as adding exercise equipment along the path.

Build the Pocket Park at the Mobile Home Village trailer community. This is to replace the previous park which had deteriorated to such a point that it had to be removed. The park would include a small children's playground, Swings, Picnic table, bathroom facilities, and a basketball court.

Add a soccer/football field, Skate Park. The location has not been settled on, either Balsitis Park or Central Park or Par Three area.

Repair of the aquatic vegetation harvester and annual clearing of the top growth of the cattails, during the fall and winter season. This would improve the water quality by not allowing the materials to rot in the lake and return nutrients to the lake. It would also help to slow further encroachment into the lake.

Restore boating to the lake. Currently we are looking at canoes and kayaks. We have already developed a permitting process. The next steps are to begin periodic testing of the water to verify that it is safe for boating. Then we need to build a floating dock so boats can be accessed without wading into the water.

Repairing the North Bridge,
Restoring the lake is an urgent and expensive task. It is quickly being overcome by invasive aquatic vegetation. We need a workable plan and budget to restore the lake. The price tag has been so large that it seems unachievable but delaying action will only make the problem worse and more costly. Next year's budget needs a line item set aside to begin restoration.

Add a Splash Pad. The location is under discussion. Current locations being considered are Central Park near the base of Emerald Hill, Par Three, or Balsitis Park.

Future
Amphitheater for outdoor performances.

Water and mow Par Three. One of the most common complaints about from longtime residents sounds like this, "Why don't they do something about Central Park and the Lake?" "I remember when we used to go there, and it was great."
Their complaints are valid, we have allowed much of Central Park to deteriorate, in particular the lake.

Many of the residents that complain have not been to Central Park in years. They are unaware of the new playground and all the activities that are happening at the park and in the Strata Center and the 10 pool. What they see is dead grass on Par Three as they drive down California City Blvd. It is time we make it look like a park.

The Master Plan calls for a whole range of parks, Pocket Parks, Neighborhood Parks, Linear Parks, Regional Parks, and Specialty Parks. Currently the city parks system consists of two main parks, Central Park, and Balsitis Park. These are best described as Regional Parks. We need to establish neighborhood parks that are within easy walking distance of densely populated areas of the city. One piece of land has been identified and will be reviewed at future meetings. More need to be identified and the land secured for future parks.

It has been suggested looking into a grant writer whose sole job is to research and secure grants that best fit the city's needs. We know there are those in different department who know how to write grants within the city, but with everyone very busy doing their jobs it might be something to consider. 11 CALIFO RENT

Projects/Applications
This report includes the following items:

A summary of projects and revenue for the month of April 2022 • A list of approved, new, and open projects for April 2022 Core Civic EIR Review
The City has received no further communications from Cor Civic and no further efforts have been expended on the review of the CoreCivic Administrative Draft EIR. Staff has attempted to set multiple meetings with CoreCivic without success.
8 Minute Solar EIR Review
City review of 8 Minute Solar's Bellefield project is now complete and staff is reviewing 8 Minute Solar's second project, the Kudu Solar facility. Similar to Bellefield, the Kudu project is located on both City lands and unincorporated County lands. Kudu is located in the northwest portion of California City in general proximity to the California City Municipal Airport.

The Kudu project has been approved by Kern County and the County has certified the project Environmental Impact Report (EIR). While sharing many similarities with the Bellefield project, there are certain unique features of Kudu which City staff will be discussing with 8 Minute Solar. It is likely the Kudu project will be presented to the Planning Commission for review at its July meeting.

SB9 Housing Regulations
Staff is discussing practices for implementing the provision of SB9, a recently adopted housing law. SB9 supersedes local authority for certain approvals related to housing projects. Specifically, SB9 allows division of a residential lot to lot sizes less than allowed under City regulations and allows multiple dwellings on individual lots that are zoned for single family residential use. SB9 allows local agencies to adopt objective standards related to SB9 lot splits and SB9 housing projects. The Planning Department supports and encourages the City Council to consider adopting local SB9 related provisions in the Municipal Code.

Council and staff discussed the item.

Councilmember Macedonio - We have a problem in the Aspen mall with upkeep. We've talked about it for years and years and years. And these numbers make no sense. We're assessing, we're not spending, we've got expenditures way beyond the amount of assessed, how can we have a landscape and lighting district that can't take care of it. And the city is the general fund is stepping in $60,000 more than we're collecting. This is something we really need to talk about.

COUNCILMEMBER COMMENTS, AGENDA REQUESTS, AND AB1234 REPORTS Councilmember Creighton - Thanked Anne Ambrose for her service to the city. Thanked Theresa Oaks and staff for Tortoise days. Next year we need to have rides on Sunday as well. Yesterday there was a mobile spay neuter clinic hosted by Pastor Smith and Victory Baptist Church. We utilize their restroom and parking apron, and it was a huge success. 37 dogs 19 females and 18 males were altered. The clinic was funded by Traditional, Bissell, Greenstone and California City Animal Outreach Foundation. The cost was about $7,000 and the staff expressed the desire to come back. If anybody wishes to donate, whether it be an individual, nonprofit, or a business, you can contact them through the CCA web page, they will accept your donations.

Councilmember Kulikoff - Need to update the City Hall evacuation plan. Attended the Edwards TED talks recently. Overall, it was focused on recruiting future talent and did a really deep dive into the subject. I thought historically Tortoise Days occurred like in the first week of May, and I was asked by some several members of the community why it was at the end of April and not May and they were just not ready for it.

My other comment would be the zoning code for the airport district appears to be incorrect or creating a misunderstanding with the public. I would like to see the Planning Commission look into the residential zoning district code. It appears that some of the language is backwards and the municode is inconsistent with the Master Plan. Also, the Zoom meeting sound needs to be updated.

Councilmember Macedonio - I'm sending a message forward to our City Manager Doug Dunford, I want to talk about water. The current California standard for residential indoor use is 55 gallons per person per day. there is legislation going through the Senate that would lower that to 47 gallons per person per day in 2025 and 42 gallons per person per day in 2030. What's going to happen is we are going to end up with rates going up so that we use less water because of the drought. City Manager let's talk about the water rate study that needs to be completed. Let's talk about our water lines that need to be replaced. The easiest way to save water is lines that don't link don't leak. Let's talk about our city.

CITY COUNCIL
DATE: May 10, 2022 CALIFORALT
TO: Mayor and City Council
FROM: Doug Dunford, City Manager
SUBJECT: Adoption of Resolution No. 05-22-2921, a Resolution of the City Council Ratifying the Proclamation of State of Emergency by Governor Newsom on March 4, 2020, and Making the Legally Required Findings to Continue to Authorize the Conduct of Remote "Telephonic" M, eigs During the State of Emergency for the Period from May 10, 2022, through June

BACKGROUND
Since March 12, 2020, Executive Orders from the Governor have relaxed various Brown Act meeting requirements to allow remote meetings and to temporarily suspend the Brown Act provisions requiring the physical presence of Councilmembers at public meetings. Those authorizations expired on September 30, 2021.

On September 16, 2021, the Governor signed AB 361. AB 361 allows local agencies to continue to conduct remote ("Zoom") meetings during a declared State of Emergency, provided local agencies make specified findings by Resolution. Absent this legislation, local agencies would have had to return to traditional meetings beginning on October 1, 2021, and traditional methods of remote participation by Councilmembers including the requirements of Government code 54953(b)(3).

Government Code 54953(b)(3) provides:
(3) If the legislative body of a local agency elects to use teleconferencing, it shall post agendas at all teleconference locations and conduct teleconference meetings in a manner that protects the statutory and constitutional rights of the parties or the public appearing before the legislative body of a local agency. Each teleconference location shall be identified in the notice and agenda of the meeting or proceeding, and each teleconference location shall be accessible to the public. During the teleconference, at least a quorum of the members of the legislative body shall participate from locations within the boundaries of the territory over which the local agency exercises jurisdiction, except as provided in subdivisions (d) and (e). The agenda shall provide an opportunity for members of the public to address the legislative body directly pursuant to Section 54954.3 at each teleconference location.

To utilize the exemption of AB 361 there must be a Proclamation from the Governor of a State of Emergency. On March 4, 2020, the Governor declared a State of Emergency which continues to this date.

In addition, to utilize AB 361, one of the following must also be true:
37 1) "S]tate or local officials have imposed or recommended measures to promote social distancing"'; or
2) The legislative body is holding a meeting for the purpose of determining "whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees." That is, the legislative body will be determining whether there is such risk; or By "majority vote"? the legislative body determined that "as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees." That is, the legislative body already determined there is such risk.

State officials continue to impose and recommend social distancing and indoor masking measures supporting an appropriate finding. The Kern County Public Health Services news release from March 8, 2022, outlined the latest COVID-19 facts and guidelines, including referencing the State's continued recommendation for indoor masking.

The Council has the option to either return to the traditional Brown Act provisions or continue to pass the required AB 361 Resolution and avail themselves of the modified Brown Act provisions. So long as the declared State of Emergency by Governor Newsom remains in place, along with the local recommendations by Kern County, the Council will have the necessary findings to continue holding meetings under the modified Brown Act rules made available under AB 361. While the Council is not obligated to pass the attached resolution, failure to do so will require the Council, along with all boards and commissions of the City to return to traditional Brown Act requirements.

At the April 12, 2022, City Council meeting, the Council approved Resolution No. 04-22-2913 that made the findings to authorize the conduct of remote "telephonic" meetings during the State of Emergency.

However, the findings only last for a period of thirty days. To continue this exemption, the Council must adopt a new resolution making such findings every thirty days to continue to utilize the exemptions of AB 361. Given that Resolution Number 04-22-2913 expires on May 12, 2022, staff recommends the City Council adopt the attached resolution before the existing resolution lapses.

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 05-22-2921 reaffirming that the aforementioned conditions continue to be true and extend the exemption from the requirements of the Government Code Section 54953(b)(3) for an additional thirty days.

ENVIRONMENTAL REVIEW
This Action is exempt pursuant to Section 15061(b)(3) of Title 14 the California Code of Regulations.

ATTACHMENTS:

Resolution No. 05-22-2921
It is important to distinguish social distancing recommendations (eg., stay 6 feet apart) from other safety protocols such as masking and vaccines.
2 This would include a majority of a quorum. If, for example, there are 5 members of a legislative body, but only 3 are in attendance at a meeting, then 2 would constitute a majority of those in attendance, ands therefore may vote to conduct the meeting remotely.

SUBJECT: EMERGENCY MATERIALS PURCHASE UPDATE - Pace - SCADA System - Wonder Acres RIO Panel
BACKGROUND:

The Remote Input Output (RIO) Panel for the Wonder Acres Chlorination System (WACS) that was installed in WACS is designed to be a part of our SCADA system, which is the monitoring and alarms system for the wells, pumps and chlorination analyzer systems. The SCADA system monitors and notifies the water personnel if any of our wells, pumps or analyzers lose power or experience large power surges. This is especially helpful for our appurtenances that are in outlying areas. By having this system, we are notified immediately of any issues versus The RIO panel was ordered April of 2021 and installed in Aug of 2021 under the purview of the previous Public Works Director. We have tried to locate the original staff report to allow us to pay this invoice to no avail. Therefore, we are presenting this staff report to authorize and ratify the purchase so PACE can be paid for the equipment.

The RIO panel is for the Wonder Acres Chlorination System.

RECOMMENDATION: Staff recommends the City Council authorizes/ratifies the purchase of the RIO Panel for Wonder Acres from Pace.

CITY COUNCIL
May 10, 2022
Consent agenda item
TO: Mayor and City Council
FROM: Douglas Dunford, City Manager
SUBJECT: Resolution Adopting a list of projects for Fiscal Year 2022-2023 funded by SB 1: The Road Repair and Accountability Act of 2017
Background:

Senate Bill 1(SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 to address the significant multi- modal transportation funding shortfalls statewide.

SB 1 includes accountability and transparency provisions that will ensure the residents of our City are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year. the City of California City must adopt by resolution a list of projects proposed to receive fiscal year funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project's completion, and the estimated useful life of the improvement.

This is the sixth year in which the City of California City is receiving SB1 funding and will enable the city to continue essential road maintenance and rehabilitation projects, safety improvements, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1.

The City of California City has undergone a robust public process to ensure public input into our community's transportation priorities/the project list, this segment of Catalpa Ave. provides access to the Elementary School and business center, the city has received numerous complaints of broken paved areas and citizens have requested to rehabilitate this road and others throughout the city.

The funding from SB 1 will help the City of California City maintain and rehabilitate the network of local roads infrastructure. Catalpa Ave. from 87h Street to 94th Street, has been targeted as priority for this Fiscal Year 2022-2023, safety pedestrian elements will be incorporated during the project's road design. Additionally, 12 similar local roads rehabilitation projects are planned into the future.

The 2018 California Statewide Local Streets and Roads Needs Assessment and the City's Pavement Management System (PMS) report found that the City's streets and roads are in an "at-risk/poor" conditior and this revenue will help us increase the overall quality of our road system and over the next decade wil bring many of our streets and roads into a "71 PCI" condition or better, thus increasing safety and mobility.

Recommendation:

Motion to adopt a resolution of the City Council of the City of California City Adopting a list of projects for Fiscal Year 2022-2023 funded by SB 1: The Road Repair and Accountability Act of 2017 Fiscal impact: The City of California City, will receive an estimated $321,861 in RMRA funding in Fiscal Year 2022-2023 from SB1 which will be budgeted in G/L 27-3353.

Environmental action: CEQA Notice of Exemption will be prepared and filed.

Therefore, we are requesting that we be allowed to hire a full-time temporary person from Sage Staffing to fill the position until August 12, 2022. We will use the existing budget for this position to the end of FY 21-22 and the first 6 weeks of the budget of FY 22-23 to pay for this person.

RECOMMENDATION: Staff recommends the City Council authorize the City Manager to direct Human Resources to hire the temporary personnel through Sage Staffing.

ATTACHMENTS: None
FISCAL IMPACT: The budget would not be adversely affected as the monies are already in the budget, GL 10-5117-120 for a full-time admin clerk and is available for this request.

SUBJECT: 4th of July Fireworks
BACKGROUND:
4th of July is a long-standing tradition for our community. Staff would like to continue this tradition by having our 4th of July Extravaganza culminate in a fireworks show.

RECOMMENDATION:

In March staff contacted 3 pyrotechnic companies that would come to our area and that offer fireworks shows. Those 3 companies were Fireworks America, Zambelli Fireworks and PyroSpectaculars by Souza. Fireworks America, and Zambelli were both booked. PyroSpectaculars is the company that we had used in the past, and has continued to be accommodating with the price they are charging. Staff recommends using Pyrospectaculars as they are available on the 4th of July, and they have done a fantastic job at a great price in the past.

FISCAL IMPACT:

Fiscal impact will be $22,000.00 out of 10-4561-429 for the fireworks show. The balance of the G/L is $35,000.
