RE: June Status Update
Dear Kari & Council Members,
We have made good progress in the collection of water asset locations for the City’s water system. We are currently finishing up the QA/QC of asset data and attributes. We are focusing right now on the presentation of the data in the GIS computer application.

Since the last status update we have worked on the following:
 We are continuing to work on developing mapping layers for the GIS web application and creating presentable layers of information. We are also working on custom GIS reports that present available attributes.
 We recently demonstrated some of the capabilities to the City Manager and he was very happy with the functionality and looked forward to expanding on the systems capabilities.

If you have any questions or need any additional information please give me a call or email.

Sincerely,
Brian D. Glidden, P.E., L.S.

COUNCIL AGENDA ITEM
JULY 26, 2022
PREPARED BY: Miguel Rivera, Police Officer
Shannon Hayes, Acting Police Chief

SUBJECT: Council Consider Authorizing the City Manager to Enter into an Agreement with L. C. Action to Purchase New Glock 17 and Sell the Current Sig P220 to L.C. Action

BACKGROUND/ DISCUSSION
One vital piece of equipment that has not been updated in years is the Department Issued side arm. The Department Issue has been the Sig P220 .45 caliber pistol. While this was a fine weapon at one point, these guns are 15-20 years old. Much like the other aspects of Law Enforcement, evolution is necessary even when it comes to duty weapons. Most agencies have gone away from higher caliber rounds to save money, improve accuracy and be more universal in the field. Capacity is a huge issue especially for an agency that covers such a large area and fields no more than 2-3 officers per shift. Officers that could potentially find themselves in any sort of sustained shooting situation and carry the current department issue could find themselves at a disadvantage tactically given the limited magazine capacity of the Sig P220.

The Glock 17 MOS is a 9mm pistol which affords an officer the ability to carry 17 rounds per magazine as opposed to their current handgun (8 45ACP per magazine). The ballistics of a 9mm have also improved and evolved recently. The ballistic capability of a 9mm round gives an officer better velocity and reduced recoil, while still maintaining optimal stopping power. The Glock 17 MOS comes “optic ready” meaning it has a removable plate on the slide to mount an optic. Given the department has a policy allowing for the use of optics on handguns, this allows the modification to occur without the machining and altering of the slide on the current handguns. Many departments have gone to optics to increase the accuracy of the officer as well as the time to acquire a target.

Glock is the choice weapon for many Law Enforcement agencies throughout the United States and the world. Glock is known for reliability, even in rough terrain such as our desert. Our Department Range Masters are familiar with the Glock platform, and we currently have a certified Glock Armorer on staff so upkeep and maintenance on the weapons can be done in-house.

The Glock Model 17 is a 9mm pistol which affords an officer the ability to carry up to 17 rounds per magazine as opposed to their current 8 rounds per magazine. Glock is known for its reliability, even in rough terrain such as our desert. The department already has armorers that are trained in the upkeep of the Glock and are certified.

The Police Department requested quotes for the proposed purchase of 35 Sig P320, Glock 45 and Glock 17 9MM handguns. Quotes were received from 4 vendors and are summarized in the chart below and attached. *Total Quote includes trade in credit for current duty weapons and ammunition stock:

COUNCIL AGENDA ITEM
JULY 26, 2022
PREPARED BY: Kenny Cooper, Finance Manager
SUBJECT: Public Safety Only Parcel Tax—Annual Rate-setting

BACKGROUND
On July 31, 2018, the City’s voters approved a Public Safety Only Special Parcel Tax to be levied annually beginning in Fiscal Year 2018-19 and ending in Fiscal Year 2023-24.

The tax is governed by the California City Public Safety Only Special Parcel Tax Ordinance of 2018 (CCMC Sec. 3-2.1.501 et seq.) (the “Ordinance”). It is collected from property owners on the annual property tax bill prepared by the County. Section 3-2.1.505 of the Ordinance requires that the City Council annually determine the tax against each lot or parcel for the upcoming tax year.

The voter-approved maximum rate of the special parcel tax is 50 cents per day, or $182.50 per lot or parcel for Fiscal Year 2019-20. However, the ordinance requires that this amount be reduced by a mandatory reduction calculated pursuant to a formula set forth in Section 3-2.1.504 of the Ordinance.

For Fiscal Year 2022-23, the mandatory reduction is $36.50 (See attached calculation). Consequently, the maximum rate for Fiscal Year 2022-23 is $146.00.

FISCAL IMPACT
Continued Funding of Public Safety and Reduction of Measure C Tax.

COUNCIL OPTIONS
Council can approve the special parcel tax rate per the calculations, or set a desired special parcel tax rate for Fiscal Year 2022-2023.

RECOMMENDATION
Approve Resolution Confirming Setting the Rate of the Public Safety Only Special Parcel Tax for Fiscal Year 2022-23 and Requesting Collection Services from Kern County.

ITEM NO. 2

COUNCIL AGENDA ITEM
July 26, 2022
Prepared By:Doug Dunford, City Manager

Subject: Council consider authorizing the City Manager to enter into agreement with Utility Service Partners for a non-royalty marketing agreement.

BACKGROUND/ DISCUSSION
Formed in 2003, Service Line Warranties of America Inc., a subsidiary of Utility Service Partners (USP), Inc., offers an insurance policy to residential property owners that covers the cost to repair or replace their utility service lines, primarily single-family houses and some multi-family dwellings (the “Program”). The company has over 1,000 utility, municipality, and association partnerships in North America.

The Program was endorsed by the National League of Cities (NLC) in 2010 and began serving California in 2012 (currently has 30 California partners). Cities have the ability to sign a partnership agreement with USP, to offer a low-cost warranty program to residents. California cities that are partners in the Program include; City of Culver City, Rialto, La Habra, San Bernardino MWD, San Diego, Laguna Beach, Oceanside, Cal Water Service Company and Golden State Water Company.

In summary, the warranties covered under the Program fall into three (3) categories: (1) Exterior Water Line Warranty, (2) Exterior Sewer Line Warranty, and (3) In-Home Plumbing Warranty.

The Water Line Warranty covers the buried, outside water line, which runs from the meter and/or curb box to the exterior wall of the home. The warranty provides coverages of up to $8,500 for each water line repair. Residents pay a $6.00 monthly fee (reflects royalty discount of $0.75).

The Sewer Line Warranty covers the buried, outside sewer line that runs from the mainline connection to the exterior wall of the home. The warranty provides coverage of up to $8,500 for each sewer line repair.

Residents pay a $9.00 monthly fee (reflects royalty discount of $0.75).

The In-Home Plumbing Warranty covers residential in-home water and in-home sewer lines and all drain lines connected to the main sewer stack that are broken or leaking inside the home after the point of entry.

Coverage includes broken or leaking water, sewer, or drain lines that may be leaking in walls and under the slab or basement floor. Coverage also includes the repair of clogged toilets. It does not cover the damage done to personal or household items normally covered by a homeowner’s policy. The warranty provides coverage of up to $3,000.00 for each in-home repair. Residents pay a $9.49 monthly fee (reflects royalty discount of $0.50).

Residents can cancel the warranty or warranties at any time.

Staff recommends the City Council to authorize the City Manager to enter into a Non-Royalty Marketing ITEM NO. NB 2

Page 115 of 152 ends

Agreement with USP for an initial term of three years, with an additional one-year renewal.

Following the execution of the Agreement, staff will work with work with USP to:
• Create resident marketing materials;
• Execute resident marketing campaign;
• Conduct additional marketing of the Program (up to three (3) times per year max of six (6) total mailings per year).
• Review and access to monthly reports; and
• Report back to the City Council of the Program.

USP sends each resident a campaign letter, which outlines the City’s participation, followed by a reminder letter two weeks later. USP only solicits through direct mail. There will be no telemarketing. The City would be considered a co-branded partner and would be required to agree to the use of the City logo/name on all marketing materials. The City may also market the Program through other means, if desired, to increase awareness and participation in the Program.

FISCAL IMPACT
There is no fiscal impact to the City with regard to becoming a Non-Royalty Marketing partner in the Program. The non-royalty program passes on a reduction in premiums to policyholders by an amount equivalent to the royalty stipend payment waived by the City. The City waived-royalty stipend amounts of $0.75 per month for every resident who participates in the water line and sewer line program, and $0.75 per month on the in-home plumbing program.

1 RECOMMENDATION: It is recommended that the Utility authorize Administration, or their designee, to enter into the royalty Marketing agreement with Utility Service Partners, Inc. (USP) for an initial term of three (3) years, subject to Utility Attorney review with two additional (1) year renewals.

BACKGROUND: The National League of Cities (NLC) Service Line Warranty Program, offered by Utility Service Partners, a HomeServe Company, was conceived in partnership with the National League of Cities to educate property owners about their service line responsibilities and to help residents avoid the out‐of-pocket expense for unanticipated and potentially costly service line repairs and replacements. Our program, the only one of its kind endorsed by the NLC, will help the Utility of Cooper Utility to achieve its goals by:
• Providing homeowners affordable protection against significant and unexpected costs to remedy leaking/broken/ clogged water lines, sewer lines, and in-home plumbing lines • Ensuring the delivery of timely, high‐quality repair services in adherence to all applicable codes
• Providing exemplary service that reflects positively on the Utility • The program stimulates the local economy by using fully vetted local contractors to complete the repairs.

COVERAGE: NLC Service Line Warranty Program offers three complete and separate voluntary programs. There is never a service fee/deductible or annual or lifetime limit. Residents can cancel the warranties at any time.

Exterior Water Service Line: Includes service to locate, excavate and repair/replace a leaking exterior water service line. Covered repairs include, but are not limited to leaks, breaks, corrosion, blockages, root intrusion, and other types of damage (such as from freezing) that impair or limit the intended function of the system. Includes thawing of frozen water lines. Includes restoration of ground surface features after excavation for service line repair, including filling, raking, reseeding, reinstallation of existing soft landscaping and shrubbery, and patching of paved surfaces.

Exterior Sewer Service Line: Includes services to locate, excavate and repair/replace a leaking exterior sewer service line. Covered repairs include, but are not limited to leaks, breaks, corrosion, blockages (due to fats, oils and grease), root intrusion, and other types of damage (such as from freezing) that impair or limit the intended function of the system. Includes restoration of ground surface features after excavation for service line repair, including filling, raking, reseeding, reinstallation of existing soft landscaping and shrubbery, and patching of paved surfaces.

Internal Plumbing and Drainage: Coverage includes the emergency breakdown costs of repairing or replacing interior water, sewer, and drainage pipe materials, valves and other plumbing-related material, including unblocking, repair and replacement. Repair of clogged toilets.

IMPLEMENTATION: The NLC Service Line Program will utilize the Utility logo to brand the materials used to educate Utility residents/customers about our repair service plans. Program marketing literature clearly discloses that the Program and the Utility are separate entities and that the program is voluntary for residents. The NLC Service Line Warranty Program will create all marketing materials with input from the Utility and will submit all marketing/communications materials to the Utility for final approval.

ENROLLMENT AND BILLING: The NLC Service Line Program offers residents simple options if they choose to enroll either via mail, phone, or web. We handle all customer billing and residents can choose annual, quarterly, or monthly billing and may pay by check, direct debit/ACH, or credit card.

Once we receive the enrollment application, customers receive a welcome letter which includes their service agreement terms and conditions, their payment details, a reiteration of their policy coverage, and our toll‐free customer service number. Customers also receive a welcome call from customer service as an additional, personalized confirmation of the program. We handle all customer billing, and a homeowner can enroll or cancel at any time.

FINANCIAL IMPACT: No cost to the Utility to participate.

An important part of the Annual Conference is the Annual Business Meeting (during General Assembly) on Friday, September 9. At this meeting, Cal Cities membership considers and acts on resolutions that establish Cal Cities policy.

In order to vote at the Annual Business Meeting, your city council must designate a voting delegate. Your city may also appoint up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity.

Please complete the attached Voting Delegate form and return it to Cal Cities office no later than Friday, September 2. This will allow us time to establish voting delegate/alternate records prior to the conference.

Please view Cal Cities’ event and meeting policy in advance of the conference. • Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council.

When completing the attached Voting Delegate form, please attach either a copy of the council resolution that reflects the council action taken, or have your city clerk or mayor sign the form affirming that the names provided are those selected by the city council. Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone. • Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration will open by June 1 on the Cal Cities website. In order to cast a vote, at least one voter must be present at the Business Meeting and in possession of the voting delegate card. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the Voting Delegate Desk. This will enable them to receive the special sticker on their name badges that will admit them into the voting area during the Business Meeting.

COUNCIL AGENDA ITEM
JULY 26, 2022
PREPARED BY: Doug Dunford, City Manager

SUBJECT: Council to Consider Authorizing the City Manager to enter into an Agreement with Arrow Engineering Services, Inc. to Provide Project Tracking Services With GIS

BACKGROUND/ DISCUSSION
Staff has contacted Brian Glidden of Arrow Engineering Services, Inc. (AESI) to further develop the project that he has been working on for the City. Originally, the City had contracted with AESI for GIS services for water line tracking. Staff in discussions with Mr. Glidden has discussed the possibility of expanding the project.

This would include the addition of monitors for citizens at the Planning and Building Department counters.

These would be used to help future developers or current with navigating our water and sewer lines within the City. In addition, the project would include the development of a tracking software to help the City and the citizens track their individual projects. This allows everyone to see the current status and location of the project through both the planning and building stages.

Staff is encouraged that this will help answer questions on both sides regarding what is needed next or where is my project and why isn’t it moving forward. The project will be evaluated each month to determine the if the goals are being met and what items need to be adjusted

FISCAL IMPACT
Staff is estimating the cost of the project not to exceed $25,000 through December 31, 2022.

COUNCIL OPTIONS

1. Do nothing

2. Direct Staff to look at other options

3. Approve the project

DETAILED SCOPE & BUDGET
City Project Layer Development
We are pleased to provide our proposal below to develop a City project layer for the GIS system.

This layer will graphically represent each project entered into the system. It will provide search and selection capabilities to locate the project graphically and to allow the user to bring up data that is associated with each project.

The long-term goal of this layer is to understand where each project is in the approval process and to help the City track projects. It will be a great planning tool since we can add so many layers of information to the GIS system. Currently the system has the City’s water system, but with this contract and following contracts it will allow planners, engineers, and managers to view parcels, water, sewer, zoning, etc. to help decisions and questions to be answered quicker and with less staff time and resources required.

The goal of the project layer is to tie as much information as possible to help the City manage projects and the related project data. It will also involve work between AESI and the City to determine what data will be stored and the development of checklists to aid staff with making sure all items are submitted for processing.

This is a robust goal and we will take small steps towards achieving the ultimate goal of the layer and system.

Project Assumptions
• The City will work on several check lists for submittals of project requirements. These checklists will be used to build data forms and a database to store the information. • Projects will be digitized by staff and assigned a project ID that will be used to track and search for information in the system. We will use a technique similar to what the City uses now like “SPR 21-15”. SPR stands for Site Plan Review and 21 the year and 15 the assigned sequential project number.
• Documents can be “attached” to projects in the system using a linking tool. This tool will allow almost any digital document to be tied to the project. • The system will be setup for internal staff to start with, but down the road some of the data could be provided to the public or developers to help them track or view their projects. • GIS Application is best viewed on a desktop or laptop device. Mobile device viewability varies per device (screen size, screen resolution, etc).

Scope of Services

1. Administration & Project Coordination

2. Review City’s Application Checklists and Coordinate with City

3. Develop City Projects Database

4. Develop City Projects GIS Layer

5. Update City Zoning Data Layer

6. Add Geographic Location Digitizer Tool for Project Layer Report

7. Add Linked Documents Tool for Project Layer Report

8. Training (Web Application)

Activity Schedule

Community Economic Resilience Fund: Kern County
Dear Kern HRTC Convener:
is pleased to inform you that we are in agreement with the goals of the Community Economic Resilience Fund (CERF) Kern High Road Transition Collaborative proposal for the Kern region developed by the Kern Coalition, the Regional Convener, and the Kern Community College District, the Fiscal Agent.

We have reviewed the initial governance model for the Kern High Road Transition Collaborative (KHRTC).

We understand that this governance model may change as the process evolves.

We agree to participate in the KHRTC CERF planning process that includes providing input and ideas for the development of a regional economic recovery and transition plan that focuses on bringing equitable economic, health, and environmental opportunities for disinvested communities. We are committed to working collaboratively with a wide range of regional stakeholders and agree to value the different mindsets and skillsets that they bring in co-creating a more inclusive, equitable, and competitive regional economy.

Collective Partnership Agreement Letter (CPAL)
Kern High Road Transition Collaborative
Dear Kern Coalition:

The Collective Partnership Agreement Letter (CPAL) is a good faith agreement between the regional convener (Kern Coalition) and diverse key stakeholders to work collaboratively and in support of the development and work of the initial Kern High Road Transition Collaborative (KHRTC), which will evolve throughout the planning and implementation phases into a formalized structure.

The KHRTC is an inclusive, participatory, non-voting collaborative with members from disinvested communities, labor, business, government, and other community stakeholders such as economic development, philanthropy, education and workforce partners. Membership on the initial KHRTC includes attending open public meetings, providing input, helping to elect representatives on the Governance Council, and may include serving on advisory and/or subcommittees.

The KHRTC designates the Kern Coalition–Imelda Ceja-Butkiewicz, Jeremy Tobias, Jessica Grimes, John Paul Lake, Norma Rojas, and Reyna Olaguez–as coordinators to execute the Community Economic Resilience Fund (CERF) initiatives, facilitate meetings, support and develop the regional economic and transition plan, and implement the outreach and engagement plan through participatory activities.

The Kern HRTC will reflect technical expertise and subregional representation. Areas of expertise will consist of Research, Equity, Industry, Labor, Business, and Workforce.

Representation will be from 5 subregional communities: East Kern, West Kern, Central Kern, South Kern, and North Kern. Membership in the KHRTC is inclusive of all Kern residents.

Governance Structure of Kern HRTC Governance Council
The initial Kern HRTC Governance Council is a democratic, representational, power-sharing voting council that includes a balanced representation from labor, business, disinvested communities, government, and other community stakeholders such as economic development, philanthropy, education and workforce partners. Its purpose is to implement transparent and inclusive processes to advance long-term shared prosperity by focusing on equity in health, the environment, and in economic opportunities. The Governance Council will review and approve investment proposals in accordance with the tenets of the CERF grant and will approve CERF documents, including the regional economic transition plan.

The KHRTC Kern Coalition coordinators–Imelda Ceja-Butkiewicz, Jeremy Tobias, Jessica Grimes, John Paul Lake, Norma Rojas, and Reyna Olaguez–shall serve as ex-officio members of the Governance Council to facilitate meetings, develop agendas, disseminate information through a variety of outlets, facilitate discussions, and elections. Representatives from the five subregions of the KHRTC shall be elected from the subregional community groups to represent labor, community/disinvested community, environmental and/or social justice, economic development/businesses, and workforce development/ education as follows: East Kern (3 representing mountain and desert), West Kern (3), Central Kern (5 representing one each-East Bakersfield, West Bakersfield, North Bakersfield, South Bakersfield, Central Bakersfield), South Kern (3), North Kern (3). In the event that there is insufficient representation from the Attachment B

stakeholder groups, the Kern Coalition coordinators shall appoint at-large members with priority given to those who live in, serve, or represent disinvested communities.

Decisions will be made by 55% of the Governance Council in accordance with the goals of CERF. Representatives will be onboarded on the structure and philosophy of the shared governance model: peaceful negotiation, collaboration, shared decision-making, embracing diverse ideas, active listening; and seeking compromise where differences occur. Ongoing professional development will be provided in conflict resolution, mediation, communication strategies, diversity, equity, and inclusion practices to nurture and maintain a culture of belonging.

Governance council representatives will commit to attending two hybrid meetings per month during the 18-24 months and will require approximately 3-5 hours to meet with community stakeholders and to document, review and comment upon ideas and proposals.
