RE: July Status Update
Dear Kari & Council Members,
We have made good progress in the collection of water asset locations for the City’s water system. We are currently finishing up the QA/QC of asset data and attributes. We are focusing right now on the presentation of the data and getting some input from City Staff.
Since the last status update we have worked on the following:
We are continuing to work on developing mapping layers for the GIS web application and creating presentable layers of information. We are also working on custom GIS reports that present available attributes.
We are currently requesting to review the data with the Water Department to make sure they are good with it.
If you have any questions or need any additional information please give me a call or email.
Sincerely,
Brian D. Glidden, P.E., L.S.
ITEM NO. CC 4
COUNCIL AGENDA ITEM
August 23, 2022
PREPARED BY: Fire Chief Jeremy Kosick
SUBJECT: STATE MANDATED FIRE INSPECTION REPORT FOR 2021/2022 BACKGROUND/ DISCUSSION:
On September 27, 2018, the Governor of the State of California signed Senate Bill No. 1205. The Bill mandates that every city fire department shall report annually, to its administering authority, its compliance with the Health and Safety Code, Sections 13146.2 and 13146.3. The Bill also states that the report shall occur when the administering authority discusses its annual budget, or at another time determined by the administering authority. The California State Fire Marshal, through the California Health and Safety Code, mandates that certain occupancy types shall be inspected annually. These mandated occupancy types include private and public schools, hotels, motels, lodging houses, and apartment/condominium buildings (3 or more attached units) in accordance with California Health and Safety Code Section 13146.2 and 13146.3. The purpose of annual fire inspections is to mitigate known hazards, reduce risk to the community and ensure reasonable compliance with the California Fire Code. It is the intent of the California City Fire Department to perform the mandated inspections annually, as well as annual inspections of other local businesses as part of the Department's fire inspection program. Full compliance between 2019-2021 was not achieved due to COVID19 restrictions and staffing issues that included a lack of a full-time Deputy Fire Marshal). The Fire Chief continues to fulfill the role of Fire Marshal in an attempt to maintain compliance with the mandates of SB1205 and performs all other development-related and new business inspections. The California Health and Safety Code Section 13146.2 mandates that the local fire department inspects all hotels, motels, and lodging houses once annually. The California City Fire Department inspected one (1) out of one (1) operating hotels, motels, and lodging houses, and four (4) out of four (4) school facilities during the 2022 calendar year. Apartment and condo inspections are not yet completed due to a lack of owner contact information and available inspection time (the total number of inspections required is not yet known).
Compliance is expected to reach 100% for all inspections in late November of 2022.
FISCAL IMPACT:
None. Fees for inspection will reimburse inspection costs.
COUNCIL OPTIONS:
Adopt by resolution to accept this report on all State mandated fire and life safety inspections in the City of California City in accordance with California Senate Bill No. 1205 and Section 13146.4 of the California Health and Safety Code.
RECOMMENDATION:
It is recommended that the City Council adopt by resolution to accept this report on all State mandated fire and life safety inspections in the City of California City in accordance with California Senate Bill No. 1205 and Section 13146.4 of the California Health and Safety Code.

SUBJECT: Council to Discuss and Consider a Solid Waste Rate Adjustment for Fiscal Years 2021/2022 and 2022/2023
BACKGROUND/ DISCUSSION
The City has entered into a franchise agreement with WM (formerly Waste Management) to provide all waste collection and disposal within the city limits. This franchise provides for annual adjustments to the rates charged by WM based on a multi-index rate methodology that includes changes in Consumer Price Index, Employment Cost Index, Fuel Index and disposal, processing, and fee components.
The City has not yet adopted the requested rate adjustment for 2021-2022, as submitted by WM on March 31, 2021 in the amount of 0.4%. The rate adjustment request for 2022-2023 which was submitted on March 21st is 9.2%. This year’s calculated rate adjustment is greatly affected by the Fuel Factor with an 87.8% increase compared to the -20.1% from the previous year as well as the increases to Kern County’s commercial bin fee and per ton gate rate for disposal.
If approved by the City Council, each residential, roll off (typically paid by commercial or industrial users) and commercial maximum rate currently in effect would increase by up to 9.6% above the rates previously approved by the City Council, effective on and retroactive to July 1, 2022. For example, the maximum rate for weekly residential 35-gallon cart service would increase from $15.20 to $16.66 per month and the maximum rate for weekly 64-gallon cart service would increase from $17.10 to $18.75 per month.
Staff has reviewed the rate increase proposal and find it to be in compliance with the franchise agreement which allows increases using a formula based upon changes to inflation, fuel costs, and labor costs.
FISCAL IMPACT
Per the terms of the franchise agreement, administrative fees received by the City would also be adjusted in accordance with service rates. City facilities and certain activities are covered within the agreement, but activities undertaken outside of the scope of services would be subject to the adjusted service rates. There are no environmental impacts associated with this request.
COUNCIL OPTIONS
1. Do Nothing
2. Direct Staff to send out and RFP for Solid waste Services
3. Approve the rate adjustment for 2021/2022 and 2022/2023.
RECOMMENDATION
Staff recommends that Council discuss and approve the rate increase of 0.4% from 2021 and 9.2% from 2022, for a total of 9.6% for residential, roll off, and commercial services.

PREPARED BY: Doug Dunford, City Manager
SUBJECT: Council to Discuss and Give Direction to City Manager on the Future of Desert Jade and Legends
BACKGROUND/ DISCUSSION
Staff was requested to present this to Council regarding the future plans for Desert Jade and the Legends (Housing).
As Council is aware the housing situation is not in good shape. Currently, Staff is picking up the monthly rent checks from the office. Patrons of either facility are having to call in asking for repairs or general questions.
The City has demonstrated that we do not have the personnel to run this facility and it is unsustainable at this time for our current budget. It has become a drain on the current Staff due to their already heavy workload. Staff is asking for Council to give direction on what they would entertain as a road to travel to help Desert Jade and Legends.

AUGUST 23, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Council to Consider Adopting a Fee Waiver Policy
BACKGROUND/ DISCUSSION
Staff has been besieged with fee waiver requests that have been passed on to the Council for approval.
Staff has noticed an increase in requests for fee waivers, which in turn impacts the General Fund for costs that are not budgeted for by the individual departments.
Staff was directed by Council at the July 12, 2022, meeting to present a Fee Waiver Policy for Council. The Fee Waiver Policy will be a fair and impartial approach to the fee waiver requests that have increased over the last several years.
The attached document is the proposed Fee Waiver Policy. It contains areas of eligible events, fee reductions, waiver guidelines, sponsorships and levels of assistance directed through the City Manager. It also is specific regarding the procedure for requesting a fee waiver and the timelines regarding those issues.
In addition, this policy has the Council setting aside a specific amount in the budget for fee waivers that the City Manager must follow.

A. Draft Fee Waiver Policy
FEE REDUCTION AND WAIVER POLICY FOR SPECIAL EVENTS
GENERAL
This policy establishes parameters for reducing and waiving fees associated with special events (i.e., facility fees and/or encroachment permit fees).
DEFINITION
A “special event” is defined as any planned activity that requires use of public property which is not within the normal and ordinary use of the property or which, by nature of the activity, may have a greater impact on City services or resources, neighborhoods, businesses or the community as a whole than would have occurred had the activity not taken place, including, but not limited to, parades, gatherings, arts and crafts shows/fairs, festivals, and athletic events. The City Manager or his/her designee shall determine whether or not an activity is considered a special event.
PURPOSE
The purpose of this policy is to provide an equitable means for community organizations:
1. To access fee reductions and waivers,
2. To establish mutually beneficial partnerships between City and the community, and
3. To effectively control the manner in which the City provides event sponsorship to the community.
RESPONSIBILITY
• Fee reductions and waivers are determined by the City Manager or designee who shall ensure that staff follow the procedures set forth in this Policy.
• The City Council shall identify an annual budgeted amount for fee reductions and waivers under this Policy.
Once the budgeted amounts have been expended for a fiscal year, the City Manager may not grant any additional fee reductions or waivers without a budget adjustment approved by the City Council.
POLICY
Eligible Events/Activities:
Fee reductions and waivers are available to wide variety of events including sporting, tourism, cultural, general, and major community events.
The following projects and organizers are ineligible:
• Private functions.
• Political parties, lobby groups, or religious groups. • Organizations based outside the California City, city limits (unless the demonstrated benefits are primarily to the residents of California City).
• Projects or organizations who have not satisfactorily fulfilled their obligations following previous fee reductions, waivers, or City Council sponsorships.
Fee reductions and waivers:
Fee reductions and waivers are for encroachment permit, facility fees and staff time only. Direct costs including but not limited to insurance fees are not eligible for fee waiver or reduction under this Policy.
The following criteria must be addressed and will be taken into account by the City Manager in evaluating the application.
The event must:
• Be open to the public.
• Raise the profile of California City through prominent acknowledgement of its support and assistance in event marketing materials and at the event itself.
• Have a high number of expected attendees.
• Address City Council priorities and adopted General Plan policies. • Benefit the residents of California City.
Preference will be given to events that:
• Create revenue generating opportunities for local businesses. • Are reoccurring.
• Involve more than one California City community group (in event organization and/or participation). • Commit to tracking event attendance and vendor sales. • Demonstrate an inability to pay (if the event is not sponsored by a recognized 501(c)(3) or similar non-profit entity).
Acknowledgement:
All recipients of fee reductions and waivers shall acknowledge the City’s support in all publicity relating to the event or activity. This includes logos and statements in all advertising and promotional material, media releases and in other promotional contexts. Promotional opportunities should be detailed in the event application.
All recipients also agree to allow the City of California City to take photos of their booth and product free of charge.
Photos taken may be used for City of California City marketing purposes.
Additional Terms:
• Scheduling and use of City facilities are subject to the availability of the requested facilities. Events receiving fee waivers or reductions do not have preference over City programs and activities or previous commitments to third parties.
• Recipients are required to adhere to all applicable rules, regulations, laws, and ordinances of the City and other applicable governmental entities.
• Applicants and recipients that fail to abide by the policy and procedures set forth in this document will be ineligible to request fee waiver and or fee reductions for a period of at least one year.
PROCEDURES
• Applications must be submitted at least 30 days prior to the event, but not more than 12 months prior to the event. Applications must be made in writing and delivered to the City Manager or designee [along with a copy of the organization’s IRS 501(c) determination letter, financial statements from the prior year’s event, and the proposed budget for the current year’s event. Applicants sponsoring an event for the first time will only be required to submit the current year’s proposed budget. The City Manager or designee may develop a standard form for applications.
• The City Manager or designee shall evaluate the application based on the criteria set forth in this Policy and determine whether to reduce or waive fees and the amount of such reduction or waiver. The City Manager or designee shall provide a written determination to each applicant. The City Manager or designee shall provide such decision within 20 days of an application unless additional time is required, in which case the applicant shall be informed of the need for additional time.
• The decision of the City Manager or designee is final. No appeal to the City Council is permitted. • This Policy does not prohibit the City Council from deciding to sponsor any community event and to reduce or waive City fees as part of such sponsorship. Such sponsorship decision shall be made by the City Council, and no member of the party shall have the right to place a sponsorship request on the City Council agenda. Any decision to place an item on the agenda shall be made by the City Council or staff, consistent with City policies and applicable law.

COUNCIL AGENDA ITEM
AUGUST 23, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Council Consider Approval to Terminate CALPERS Health Contract Agreement to Participate in the Public Employees Medical and Hospital Care Act
BACKGROUND/ DISCUSSION
Staff has been looking at various costs and ways to adjust the outflow of monies and control budget costs. Staff is proposing an option to reduce the cost of medical benefits but still provide a competitive health benefit to City employees.
CALPERS Healthcare premiums for employees have increased between the range of 5% to 18% based on the plan selection. In addition to premiums increases, agencies participating in PEMHCA will tom experience an annual increase for the administration fee for participation in the plan.
CALPERS recently reported their biggest loss of over $70 Million due to the fluctuations of these stock market. These costs will be passed onto the cities to make up the difference. Some of the benefits of leaving CALPERS Medical are the following:
Plan Design Options
• Wide range of carriers
• Control over rate structure
• Alternate pooled opportunities
• Allow employees to purchase a range of healthcare services that best meets the needs of their family or themselves.
FISCAL IMPACT
The City provides a cafeteria healthcare plan and each employee is provided a set dollar amount to pay for the various benefits available. While reducing or stabilizing the cost of healthcare plans provides some benefit to employees all costs associated with this action are within budgetary allocations. Therefore, no additional funding is necessary.
COUNCIL OPTIONS
1. Do nothing
2. Stay with the higher cost of CALPERS Medical
3. Direct Staff to look at other options
4. Approve the Resolution to cease participation in the CALPERS Medical Act.
RECOMMENDATION
Staff recommends that Council adopt the Resolution declaring intent to terminate its participation from the Public Employees Medical and Hospital Care Act (PEMHCA) effective December 31, 2022.
ATTACHMENTS
a) Resolution
RESOLUTION no. 8-22-2944
A RESOLUTION OF THE CITY COUNCIL ELECTING TO CEASE TO SUBJECT TO THE
PUBLIC EMPLOYEES MEDICAL AND HOSPITAL CARE ACT
Intent of the parties and findings;

COUNCIL AGENDA ITEM
AUGUST 23, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Resolution Adopting a City Council Agenda Policy
BACKGROUND/ DISCUSSION
At Council’s direction at the July 26, 2022, meeting, Staff has drafted a policy regarding the placement of items on the agenda and other matters relating to the conduct of the City Council meetings. The draft policy is the result of a joint effort between Staff and the City Attorney.
Staff wanted to also take this opportunity to introduce the City Council to the idea of developing and adopting a comprehensive procedure manual at some time in the near future. While the proposed resolution covers the key agenda preparation items and rules for conducting meetings items. It does not address many other useful Council norms, protocols, policies or procedures.
Most City Councils in California have adopted some form of a comprehensive procedural manual to guide heir activities and communicate the governance process to the public. These come in almost as many forms as there are cities as each is tailored to the needs, policies and norms of that particular City Council. They are also usually posted on the City Council [age of the City’s web site for ease of access by the public. To provide the City Council with a sense of what a comprehensive procedural manual might contain, the procedural manual of Los Altos City Council is attached.
Please note that the sample procedural manual includes the agenda preparation and meeting guidelines and procedures contained in the proposed resolution, but bit also includes further policies regarding matters such as City Council organization, general powers and responsibilities, Council conduct and conflicts of interest, Council communications, Council interactions with Staff, Council compensation and Council commission and committees travel, expense and reimbursements policies. Some procedural manuals also include an overview of statutory requirements and regulatory requirements governing the City and Council actions, which further assist the public in understanding how their elected official’s function, as well as rules governing the conduct and activities of the City Council appointed commissions and committees. In addition, some City Councils elected and appointed while exercising their office, in a manner that will instill public confidence and trust in the fait operation and integrity of city government.
While Council procedural manuals can be lengthy, they do serve the purpose of consolidating all the City’s governance policies and procedures into one place, which enhances the ease of reference by the City’s Council and Commission members and Staff, and ensures the policies and procedures are up to date, consistent with current practice and consistent with the law.
Currently the City Council’s policies are distributed through numerous resolutions that have been adopted over the years, which increases the opportunity for confusion, errors, and conflicting out of date policies to exist. Most importantly a comprehensive procedural manual will provide an important tool for the public to understand how their government functions. Therefore, it is highly recommended that the City Council consider initiating a process to develop its own manual during FY 22/23.

Adopted by Resolution no. 8-22-2940 of the City Council On August 23, 2022
1. Purpose. This City Council Agenda Policy (Policy) is intended to establish a clear, transparent procedure for the City Council members, staff members, and members of the public to understand how City Council agendas are prepared, and to clarify how interested persons may request that items be placed on a future agenda, to ensure compliance with the Brown Act.
2. Rules for the Conduct of Council Meetings; agenda Procedures
2.1 Quorum and Voting Requirements. A majority of the City Council constitutes a quorum for the transaction of business. Some actions such as the passage of an urgency ordinance or adoption of a resolution of necessity, require a super-majority vote. Resolutions, ordinances and orders for the payment of money require an affirmative vote of a majority of the total membership of the City Council. Except for those specified circumstances, a majority of a quorum may generally act on behalf of the City. In accordance with the political Reform Act and the city’s conflict of interest policy, a Council member with a financial conflict of interest regarding a matter before Council must, prior to consideration of the agenda item, (1) Publicly identify the nature of the conflict; and (2) leave the room while that matter is discussed or acted upon. That member is not counted towards the quorum for that matter.
2.2 Decorum and Enforcement. Council members should preserve order and decorum. Among each other and among the public., while the Council is in session. The Council may exclude or expel all persons from a meeting at which a disturbance has been created that will mot allow the meeting to continue unimpeded. The Council may also take action to prohibit disruptive behavior and expel an individual who disrupts the meetings or engages in disorderly conduct. Action to prohibit disruptive behavior must be balanced against each individual’s right to petition their government and exercise freedom of speech.
Members of the public may be required to fill out a speaker card and submit it to the City Clerk, at the Council’s discretion, but no member of the public will be required to provide their name or other personal information in order to speak or attend the meeting.
2.3 Regular Meeting and Requests for Agenda Materials. The Council shall hold its regular meetings on the second and fourth Tuesday of each month at 6:00 PM. Meetings are held in the City Council Chambers at City Hall. Agendas may be accessed from the City’s website. Pursuit to state law, and subject to a fee for the cost of the service, members of the public may file a written request for the City to mail agendas or agenda packets to an address provided by the requester. Such a request is valid for the calendar year in which it is made and must be renewed annually to remain valid. Agenda packets may refer to bulky reports or documents that are not included for reasons of cost or inconvenience; the agenda will indicate where such materials are available for review.
2.4 Special, Emergency, and Adjourned Meetings.
a) Special Meeting. The Mayor, or Mayor Pro Tem in the Mayor’s absence, or a majority of the members of the Council, or the City manager may at any time call a special meeting. b) Placing Items on the Council Agenda. During the “Public Comment” portion of any meeting of the City council, or by providing a request in writing to the City Clerk at any time, members of the public may request that an item be placed on a future agenda. The City Council shall discuss such request, come to a consensus as to whether to place it on a future agenda, and direct staff accordingly. Any Council member may request that an item be considered on a future agenda during the “City Council Report” portion of any meeting; upon agreement by a consensus of the Council the item shall be placed on the soonest practical regularly scheduled Council meeting as determined by the City Manager. Staff reports shall not be prepared, nor staff time spent on Council member requested items until the City Council discussion has occurred and direction provided by the City Council, unless staff otherwise determines.

e) If appropriate, the Mayor will entertain a motion, including one that he or she may propose.
f) If a motion has received a second, the Mayor will call for a vote and the City Clerk will record the vote.
2.7 Duty of Council Members to Vote. Every Council member should vote on every item unless prevented from doing so by virtue of an actual or potential conflict of interest under applicable state law. Any Council member who believes he or she has a conflict or potential conflict of interest must announce that at the initiation of discussion on that item, or when such conflict or potential conflict becomes apparent, and must refrain from taking any part in the debate, deliberation, or vote on that matter, except as allowed by state law. If a Council member is not sure whether he or she has a conflict with respect to an agenda item, he or she should make every effort to obtain advice from the City Attorney on that subject prior to the meeting.
2.8 Roll Call and Voice Votes. At a teleconference or “hybrid” (partially in person and partially virtual) meeting of the City Council, all votes will be taken by roll call only. At an in-person meeting of the City Council, a roll call vote may be requested at the discretion of the City Clerk, but otherwise all motions and adoptions of legislative action may be passed by voice vote.
2.9 Introduction and Passage of Ordinances. Ordinances are legislative acts by the Council that establish permanent and enforceable rules. The Council has the power to pass ordinances pursuant to Government Code Section 37100, as long as those ordinances are not in conflict with the laws and Constitution of the State of California or the United States. Ordinances may be repealed or amended only by a subsequent ordinance.
Except for urgency ordinances, ordinances require two readings, which may be by title only, at separate City Council Meetings. An ordinance is introduced during the first reading and given final approval at a second reading. Except for urgency ordinances and ordinances relating to an election, taxes or street improvements ordinances become law thirty (30) days after the second reading. Matters that the Council determines warrant immediate action to preserve the public peace, safety, or health may be heard as urgency ordinances. An urgency ordinance may be adopted at first reading and will become effective immediately, as long as it is approved by a four-fifths (4/5) vote of the Council. The City Clerk will ensure the City complies with all publication requirements associated with ordinances passed by the Council.
2.10 Adoption of Resolutions. Resolutions are legislative acts by the Council that are not codified but are filed in the City Clerk’s Office. A resolution expresses the policy of the Council and may direct Certain types of procedural or administrative actions. It may be modified only by subsequent resolution.
Resolutions may be used to state the Council’s policy position on an issue or activity, and to formally document the Council’s action on items such as, but not limited to, City contracts. A majority vote of the total membership of the Council will pass or defeat the resolution.
2.11 Consent Items. Items on the agenda that are considered by the City Manager to be routine and/or non-controversial shall be grouped together under the heading “Consent Calendar” and approved by a single vote of the Council. At the request of any Council member or any other person, a consent item will be “pulled” from that portion of the agenda and considered separately after approval of the remaining consent calendar. Items approved under the consent calendar in their approved form. As if they had each been approved separately.
2.12 Reports. Under the agenda heading for “Reports”, the City Manager, department heads, and Council members may take reports on matters not appearing on the agenda. Also at this time, Council Members or staff may identify issues or agenda items that should be addressed by the City attorney or other staff and may propose future agenda items.

COUNCIL AGENDA ITEM
JUNE 22, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Job Description/Salary Schedule Update
BACKGROUND/ DISCUSSION
As different situations and circumstances arise around compensation and responsibilities, the City reassesses the salary schedule and different job classifications within the organization and finds it necessary to make adjustments, both for the betterment of the organization and to operate within the limits of the law.
While the City could benefit from a comprehensive compensation study of all classifications (which is on the list of accomplishments to realize after an HR Director is hired) there are three classifications requiring immediate attention: OHV Manager, Payroll Generalist, and Human Resources Generalist.
In July of 2021, two erroneous changes were made to the City’s published salary schedule for the positions of OHV Manager and Payroll Generalist. OHV Manager had previously been set at Range 53, $5432-6933 per month, and the Payroll Generalist had previously been set at Range 33, $4241-5413. The error changed Range 53 to a band topping-out at $9,513 and moved the Payroll Generalist to monthly Range 55, $5044- 6438, both of which were not properly authorized and approved by Council.
At the time, staff was not aware of the errors made, however they were reflected in a shared document that was subsequently sent to Council for approval with an authorized update for the Cannabis Compliance Manager position. The erroneous changes to OHV Manager and Payroll Generalist were also “technically” approved at that time on January 11, 2022. This agenda item partly seeks to correct Range 53 back down to its proper band, $5432-6933 per month and make a similar adjustment to Payroll Generalist.
The “generalist” series of classifications often require broad technical knowledge over a complex set of functions. For instance, the HR Generalist is expected to become proficient in Recruitment & Selection, Classification & Compensation, Employee & Labor Relations, Performance Management, Training & Development, Benefits Administration and areas of Risk Management, all of which have significant compliance components that can expose the City to liability if not followed. Some other organizations have analysts and technicians who focus only on one or two functions, while generalists are required to be a “jack of all trades.” The HR Generalist also acts in place of the HR Director when absent. Similarly, the Payroll Generalist is a high profile, technical position that often begets emotionally charged inquiries and challenges into one of the most important products of employee work – the paycheck. Like the HR Generalist, this position also requires attention to compliance and the broad range of complicated rules and interpretations of MOUs, State and federal laws that also can expose the City to liability for non-compliance. Hiring into the classification requires solid experience to maintain the integrity of accurate and timely payroll runs and mandated reports. It is differentiated from other clerk and assistant positions in that the subject matter is highly technical and generally more complex. The attached job description has been revised to accurately reflect the more complex duties of the payroll function.
The current ranges for the two positions (HR Generalist and Payroll Generalist) currently do not accurately reflect compensation commensurate with the duties. For the reasons above and to assist with recruitment and retention, Staff is recommending the Payroll Generalist position be reduced from its erroneous Range 55 down to Range 43, $4916-6274 monthly, which is an increase from the prior 2021 Range 33, and the HR Generalist position increase from Range 42, $4573-5835 to Range 52, $5411-6906.
FISCAL IMPACT
The fiscal impact will be a cost saving of $7,966.40

COUNCIL AGENDA ITEM
August 23, 2022
PREPARED BY: Doug Dunford, City Manager
SUBJECT: Council to Discuss and give Direction to the City Manager to reply to the 2022 Kern County Grand Jury report
BACKGROUND/ DISCUSSION
Staff was directed by Council to reply to the Kern County Grand Jury Report dated June 11, 2022, as well as Penal Code Section 933 (c ) and 933.05. According to the Grand Jury report, they made nine (9) recommendations to address the issues that they were investigating during their tenure. The following is a list of the recommendations with how the City of California City will be implementing changes to conform.
R-1 The City Council should empower the City Manager to fill all director positions with permanent and qualified individuals by September 30, 2022.
The City Council has empowered the City Manager to fill the vacancies. However, the City nor any City can meet the deadline due to the employment shortage. The City has taken steps to help move forward by hiring an Interim Public Works Director, Interim Human Resources Director and a City Clerk.
The City is holding interviews for Chief of Police on August 29, 2022.
R-2 Outside of business meetings, the City Manager and City Council should schedule quarterly open town hall meetings, by September 30, 2022 with concerned citizens; the goal being to improve communications and separate fact from emotion anger.
R-3. By December 31, 2022, the City Council should complete in-service training on Proposition 218 legislation and review Proposition 13, the original Howard Jarvis Tax Initiative, which led to Prop 218. (Finding 3)
The City in in the process of scheduling training for the new incoming Council Members after the election on November 8, 2022.
R-4. By June 30, 2023, the City Council should complete the bidding process and hire a private contractor to finish the water line replacements. (Finding 4) The City is already in the process of releasing bids to get a number of water projects moving forward. These bids are being released this month and will continue.
R-5. Under the direction of a qualified Finance Director, the City Council should assure Cal City’s General Ledger is organized (per Generally Accepted Accounting Practices), so an independent financial audit can be completed by the end of every fiscal year. (Finding 6) The City has just completed their first audit from 2019/2020 at the last Council Meeting held August 9, 2022. The next audit 2021/2022 is due at the beginning of September to be presented to the Council.
R-6. By March 1, 2023, the City Council should commission a feasibility study to determine adequate green fees to charge TDS users. The study should also determine if private sponsorships and government/corporate grants are available. (Finding 7)
The City is actually engaging a firm to conduct a user Fee Study for the entire City to update the current fees and make sure that there is a nexus between what the City is charging and what it actually costs.
R-7. By March 2024, if the TDS financial picture is not on an upward trend, Cal City should prepare to lease, sell, or divest itself from the property. (Finding 7) The city will wait until the full financial picture is in before any decisions are made about the future of the golf course.
R-8. By March 2023, the City Council should complete an ethics course in human resource law and training in the California Fair Employment and Housing Act, the Fair Labor Standard Act, and the Americans with Disabilities Act. (Finding 9)
The City as stated before will be setting up training for all Council Members after the November 8, 2022 election to make sure everyone is trained at the same time and will be getting the same message on new laws and occurrences.
R-9. By December 31, 2022, the City Council should contract with a private agency that specializes in human resource/personnel matters, to advise their human resource employment and termination practices. (Findings 9 and 10)
The City has contracted with Beauchire Consulting to handle all Human Resources issues and currently have attorneys on staff from Buckalter to handle termination practices.

THE CITY OF CALIFORNIA CITY
A Time to Come Together, 2.0
SUMMARY:
The City of California City (Cal City) has endured much public scrutiny in regard to how it has been managed by various city managers, finance, public works directors and city council members. In fact, a 2018 newspaper article highlighted the acrimony at a farewell ceremony for the out-going mayor and the welcoming of the new mayor and council:
GAVEL DOWN: INCOMING MAYOR AND COUNCIL GET A TASTE OF WHAT AWAITS THEM WITH THE BUDGET:
…Last Tuesday night’s City council meeting was the last one that [out-going mayor] officially “gaveled in” to start and “gaveled out” to finish as [out-going mayor’s] tour of duty as mayor of California City comes to a close. …one might think that as a matter of appreciation and manners that might have spared [out-going mayor] a raucous next to last council meeting, but then one would be wrong. Of course there was the usual tit-for-tat back-and-forth…squabbles on the dais remain even down to the wire, as was evidenced last Tuesday as a condensed window into city management headaches opened for all to see.…Meanwhile, the incoming council members[names omitted]…sat in horror watching what awaits them in a mere two weeks.
The 2021-2022 Kern County Grand Jury (Grand Jury) has been tasked with investigating a compound complaint (Complaint) from a concerned resident. Indeed, the Complaint details 46 areas of concern which include water rates, water main replacement issues, missing water and sewer funds, accounting irregularities of the Tierra Del Sol Golf Course (TDS) and Proposition 218 (Prop 218) non-compliance. Concerned residents’ state City Officials do not respond to the issues they raise.
Preliminary research into the complaint reveals some areas of concern while other areas are readily explained. At the outset, one thing is certain—Cal City needs stability and strong, ethical, dedicated leadership.
PURPOSE OF INQUIRY:
California Penal Code §925(a), authorizes the Grand Jury to investigate complaints as well as the general organization and operations of cities in Kern County. To that end, the Grand Jury investigated this Complaint.
METHODOLOGY:
The Grand Jury conducted interviews with Cal City Officials and concerned citizens. Cal City agendas, minutes and financial statements were studied as well as previously published Grand 2021-2022 Kern County Grand Jury Report
Jury reports. Also reviewed was internet information regarding Prop 218 and California Waste and Sewer laws.
DISCUSSION OF FACTS:
Proposition 218
One recurring issue in the Complaint is that Cal City did not comply with Prop 218 when it raised water rates and failed to pay its water bill. In November 1996, California voters passed Prop 218, the “Right to Vote on Taxes Act.” This act protects taxpayers by limiting the methods by which local governments create or increase taxes, fees, and charges without taxpayer consent.
Prop 218 requires:
• All local governments to get majority voter approval for new and increased general taxes. • The use of general taxes requires majority voter approval, to general-purpose governments i.e., cities and counties. School districts are not allowed to levy a general tax.
• Stricter rules on benefit assessments so that, by definition, they must be calculated based on the benefit received by the parcel because of the project financed. Prop 218 created stricter rules for initiating or increasing benefit assessments. Now, an agency must determine the specific benefit the project will have on individual parcels. A general enhancement to property values can no longer serve as the benefit. • Agencies put all assessments, charges, and usage fees out to a vote prior to creation or increase. In most cases, the vote will require individual notices be mailed to affected property owners followed by a formal protest hearing, which is required to move forward with the charge or increase.
• Restrictions on Use of Fees. Prohibits local governments from imposing fees on property owners for services that are available to the public at large, i.e., garbage collection, sewer service. Fees charged may not exceed the cost of providing the service. • Government agencies i.e., cities and counties, must pay their fair share of a benefit assessment, if the property receives benefit from the project or service financed.
Essentially, cities and counties must pay for their water and sewer. • Government Agencies give voters the power to repeal. Allow voters the authority to reduce or repeal any existing local tax, assessment, or charge through the initiative process.
According to previous Cal City Officials, as cited in the 2014-2015 Kern County Grand Jury report, CALIFORNIA CITY, Proposition 218 and Water in the Desert:
Finding 2: Water engineering studies calling for a rate increase have been completed. The water customers were notified per Proposition 218 and given proper time to protest.
Approximately 20 letters of protest have been received. Several customers from the community protested at the City Council meetings. While there was a limited protest regarding the increased rates, most water customers were silent.
2021-2022 Kern County Grand Jury Report
On April 7, 2022, this Grand Jury attempted to verify Finding 2 and requested documentation from the Cal City Clerk’s Office that Prop 218 was complied with. No documentation or evidence of compliance has been produced. Cal City Officials state, to their knowledge as advised by their legal counsel, Prop 218 has been adhered to. As of May 1, 2022, Cal City has not been able to locate rate increase notices sent to residents and there are no City Council meeting minutes that document the protest votes.
The City Council members are not well versed on Prop 218 and is not aware of how it must be adhered to.
Per Prop 218, cities must pay for their water and sewer. Since 2014, Cal City has paid for water and sewer, but there is no documentation that sewer and water were paid prior to that.
The Grand Jury also noted the following:
Water Line Replacement
A. Cal City has water, lots of it. It sits on a natural aquifer that is estimated to provide water to residents for several generations. The problem is the pipes—steel water lines, installed in the early 1960s, have rusted, are failing and are desperately in need of replacement.
B. In 2002, a Master Water Plan was adopted by the City Council to replace the water lines and recommended that replacement be phased in over 10 to 15 years. $20.4 million in water standby fees was secured, half of which was intended for water main replacement. Additionally, the 2004-2006 Measure L parcel tax collected $1.278 million for water main replacement.
C. As of April 2022, twenty years later, only 10% of the water lines have been replaced.
Cal City Officials recognize that this is largely due to bad or incomplete management and lack of accountability because of constant turnover of city managers, finance directors and public works directors.
D. Cal City Officials state water line blowouts are another contributing factor for the slow water line replacement process:
• A blow out is a line hemorrhage that takes approximately five hours to repair. • Cal City is averaging three blowouts per week. In one week, they had 10. • Public Works has approximately 30 positions, 16 are devoted to water line maintenance and repair, and on call 24/7.
• The water line blowouts and maintenance issues consume the majority of person-hours, leaving little time for water line replacement.
E. The Cal City Council is in the process of taking bids from private contractors to complete the water line replacements. This will be a dedicated work team, not employed by the city, whose sole purpose would be to replace the water lines. 2021-2022 Kern County Grand Jury Report
Accounting and Financials
F. The Complaint also alleges there is inappropriate General Ledger accounting practices, missing and the comingling of funds:
• The 2017-2018 and the 2019-2020 Grand Jury reports on Cal City detailed accounting irregularities.
• An independent audit of Cal City’s finances has not been conducted since 2019.
• In 2020, the Certified Public Accountant (CPA) firm retained by Cal City to conduct the annual audit, advised that Cal City’s books were unauditable.
This was due to constant turnover of the City Manager and Finance Director positions. The CPA firm has been working, in the capacity of advisor, to bring the Cal City books up to par. The CPA advisor states Cal City should be auditable by June 1, 2022.
• In May 2021, Cal City was seized by a ransomware cyber-attack, which lasted seven weeks. Accounting systems were affected, and debits and credits were not properly kept.
• A letter from a concerned resident to the City Council states there was $475,000 missing from the Water and Sewer Enterprise Fund for May 2021.
However, the CPA contracted advisor states, the money is not missing but appears to be missing due to accounting irregularities. The ransomware attack also complicated the problem.
• The 2021-2022 budget was not adopted until December 2021; however, the fiscal year began July 1, 2021, and ends June 30, 2022. Cal City Officials state, the budget was late due to changes in city manager and finance director positions and because there was disagreement amongst the individual City Council members on how the monies should be allocated. The difficulties with the unauditable state of Cal City’s books were also a factor. • As of June 30, 2021, the Fire Department is over budget and supplemented with reserves.
• As of June 30, 2021, the Airport is over budget and supplemented with reserves.
• As of June 30, 2021, the Police Department is over budget and supplemented with reserves.
• As of June 30, 2021, TDS is $450,000 over budget and has an overall arears of $2.46 million:
o TDS is managed by a volunteer who organizes the green fees in an attempt to help salvage TDS.
o TDS has a clubhouse but no restaurant.
o The current green fee activity is not enough to support TDS.
G. The Complaint also expressed concerns about a real estate purchase authorized by the City Council in 2021. On September 3, 2021, in anticipation of expanding the city’s 2021-2022 Kern County Grand Jury Report
Wastewater Treatment Plant (WWTP) to accommodate the local prison expansion, the City Council voted to purchase 120 acres of land for $450,000 that had an assessed value of $116,900. The appraised value, at the time of purchase, is not known. Prison authorities confirmed there are no plans to expand the prison; that in the past two years there have never been plans to expand.
H. In the past ten years, Cal City has had a high turnover in department heads beginning with the City Manager. On April 28, 2022, the Cal City Fire Chief was the only permanent department head on staff. The City Manager, Finance Director, Public Works Director, and City Attorney were all filled with “interim” personnel.
I. In the past three years, Cal City has paid approximately $3 million in wrongful termination settlements and attorney fees.
J. On May 2, 2022, the City Council swore in a new City Manager.
FINDINGS:
F1. To describe Cal City’s leadership as being in “crisis mode,” is an understatement.
The City of California City’s leadership must be stabilized with qualified department heads for Cal City to survive. The practice of filling leadership positions with interim staff is not sufficient for long-term good governance.
F2. The new City Manager and the current City Council must bridge the communication divide that exists between them and the concerned residents. Cal City would benefit if all comments, concerns, or complaints were addressed and discussed by the City Council and the City Manager, for fact and truth to prevail over anger and emotion.
F3. The City Council’s lack of knowledge regarding Proposition 218 must be remediated. It is the City Council’s responsibility to assure that Prop 218 is followed and implemented.
F4. Cal City’s water line replacement program can only be described as derelict and incompetent. Previous City Officials have continually passed the buck. The “buck” needs to stop somewhere.
F5. The current City Council and the City Manager believe, the “buck” must stop with them. They are in the process of adopting a good plan that will eventually complete all the water line replacements.
F6. To describe Cal City’s general ledger and financial position as unauditable is shocking. Cal City must move on from past mismanagement and solve this dilemma.
2021-2022 Kern County Grand Jury Report
F7. The TDS golf course may be an unrealistic dream. However, dreams must be separated from reality. Mired in debt and low green fee revenue, a grass-roots effort from the community may be needed to save it. As it stands, TDS may not be salvageable.
F8. It appears the land purchase for the WWTP expansion was done on a rumor that local prison expansion was imminent; that the WWTP expansion was necessary to accommodate its growth. In essence, an if we build it, they will come reasoning was incorporated into the land purchase.
F9. The $3 million in wrongful termination settlements and attorney fees paid by Cal City demonstrates a major shortcoming in Cal City’s hiring and termination policies.
Cal City management and the City Council would benefit from basic Human Resource law training.
F10. The lack of an experienced Human Resources Director has contributed to the large wrongful termination settlements.
COMMENTS:
In this report, three previous Grand Jury reports were referenced; a fourth is needed for context and balance. The 2018-2019 Grand Jury report, THE CITY OF CALIFORNIA CITY, “A Time to Come Together,” looked into resident complaints of fraud and collusion regarding the Measure “C” parcel tax election. The Grand Jury conducted numerous interviews, researched election law, and traveled to Cal City to observe the ballot counting procedure, and concluded Cal City ran a well-organized, legal, stand-alone election. Resident complaints of fraud and collusion, although well intended, were unfounded.
It must be stressed, communication between concerned residents and City Officials must improve in order to separate fact from anger and emotion. The subtitle for this current report is, “A Time to Come Together, 2.0.” The City Manager’s office and the City Council realize the “buck” must stop with them—they must make every effort to respond to each complaint they receive. Equally, the residents of Cal City, especially those who regularly criticize and complain, must agree to thoroughly listen and give the new City Manager and new department heads a chance to rectify the problems Cal City faces.
RECOMMENDATIONS:

Outside of city business meetings, the City Manager and City Council should schedule quarterly open town hall meetings, by September 30, 2022, with concerned residents; the goal being to improve communication and separate fact from emotion and anger.
