RE: October Status Update
Dear Kari & Council Members,
We are still progressing in the collection and integration of water asset locations into the City’s new water GIS system. We are continuing with the QA/QC of asset data and attributes. We are focusing right now on the presentation of the data and getting some input from City Staff.

Since the last status update we have worked on the following:
 Began preparing for upcoming presentation to City Council regarding status and functionality.
 We are continuing to work on developing mapping layers for the GIS web application and creating presentable layers of information. We are also working on custom GIS reports that present available attributes.
 We are continuing to work on the training manual for users of the system.

If you have any questions or need any additional information please give me a call or email.

Sincerely,
Brian D. Glidden, P.E., L.S.

CITY COUNCIL
DATE: October 15, 2022
TO: Mayor and City Council
FROM: Jeremy Kosick, Fire Chief
SUBJECT: Resolution to apply for prop 64 grant funding
_____________________________________________________________________________________ BACKGROUND:

Proposition 64 Overview
• Award Ceiling: $3 million
• Project Period: 5 years (May 1, 2023 - April 30, 2028) • Cost Match from City: None
• Deadline: December 2, 2022
• Purpose: CA state law (f)(3)(C) states the BSCC will provide grant funds to local governments that assist with law enforcement, fire protection, or other local programming to address public health and safety associated with the implementation of the Control, Regulate and Tax Adult Use of Marijuana Act.

Proposed California City Program
The California City program will be led by a Task Force, under the direction of Fire Chief Jeremy Kosick. It will consist of a to-be-hired Deputy Fire Marshall, a Consultant to serve as the administrative auditing section, a Police Department-based youth educator, as well as additional help from the California City Fire Department. Salary expenses will be billed against the grant.

Under the grant, we will also apply for funding for protective equipment and tools for all team members engaging with cannabis businesses to ensure proper safety and health protocols, and training to help the Task Force deal with: human trafficking, code violations, environmental hazards, and youth education.

End Goals
• Increased tax revenue.
• Youth education on the dangers of marijuana usage.
• Reduce odor issues, water runoff, and other environmental hazards by doing more frequent inspections, increasing public safety for the entire community. • Improve the health and safety of Fire Department and Police Department officers who respond to issues, lead inspections, and deal with the marijuana industry in any way.

CC 3.
39 November 22, 2022
• Improve the health and safety of cannabis workers, while increasing the awareness and training of California City officers around human trafficking. • Improve the health and safety of residents.
• Decrease the time and effort from the state and county in California City, allowing California City to become more independent.

RECOMMENDATION:

Staff recommends approval to authorize the Fire Chief on behalf of the City to apply for Prop 64 grant funding.

FISCAL IMPACT:

No matching funds are required. Potentially increase tax revenue.

ENVIRONMENTAL IMPACT:

Potential to improve the local environment through more frequent inspections preventing environmental hazards.

CITY COUNCIL
DATE: November 22, 2022
TO: Mayor and City Council
FROM: Dr. Jim Hart, Interim City Manager
SUBJECT: Adoption of Resolution No. 11-22-2957, a Resolution of the City Council Ratifying the Proclamation of State of Emergency by Governor Newsom on March 4, 2020, and Making the Legally Required Findings to Continue to Re-Authorize the Conduct of Remote “Telephonic” Meetings During the State of Emergency for the Period from November 22, 2022, through December 22, 2022
_____________________________________________________________________________________

BACKGROUND
Since March 12, 2020, Executive Orders from the Governor have relaxed various Brown Act meeting requirements to allow remote meetings and to temporarily suspend the Brown Act provisions requiring the physical presence of Councilmembers at public meetings. Those authorizations expired on September 30, 2021.

On September 16, 2021, the Governor signed AB 361. AB 361 allows local agencies to continue to conduct remote (“Zoom”) meetings during a declared State of Emergency, provided local agencies make specified findings by Resolution. Absent this legislation, local agencies would have had to return to traditional meetings beginning on October 1, 2021, and traditional methods of remote participation by Councilmembers including the requirements of Government code 54953(b)(3).

Government Code 54953(b)(3) provides:
(3) If the legislative body of a local agency elects to use teleconferencing, it shall post agendas at all teleconference locations and conduct teleconference meetings in a manner that protects the statutory and constitutional rights of the parties or the public appearing before the legislative body of a local agency. Each teleconference location shall be identified in the notice and agenda of the meeting or proceeding, and each teleconference location shall be accessible to the public. During the teleconference, at least a quorum of the members of the legislative body shall participate from locations within the boundaries of the territory over which the local agency exercises jurisdiction, except as provided in subdivisions (d) and (e). The agenda shall provide an opportunity for members of the public to address the legislative body directly pursuant to Section 54954.3 at each teleconference location.

To utilize the exemption of AB 361 there must be a Proclamation from the Governor of a State of Emergency. On March 4, 2020, the Governor declared a State of Emergency which continues to this date.

In addition, to utilize AB 361, one of the following must also be true:

CC 4.
43 November 22, 2022
1) “[S]tate or local officials have imposed or recommended measures to promote social distancing”1; or
2) The legislative body is holding a meeting for the purpose of determining “whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.” That is, the legislative body will be determining whether there is such risk; or 3) By “majority vote”2 the legislative body determined that “as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.” That is, the legislative body already determined there is such risk.

State officials continue to impose and recommend social distancing and indoor masking measures supporting an appropriate finding. The Kern County Public Health Services news release from March 8, 2022, outlined the latest COVID-19 facts and guidelines, including referencing the State’s continued recommendation for indoor masking.

The Council has the option to either return to the traditional Brown Act provisions or continue to pass the required AB 361 Resolution and avail themselves of the modified Brown Act provisions. So long as the declared State of Emergency by Governor Newsom remains in place, along with the local recommendations by Kern County, the Council will have the necessary findings to continue holding meetings under the modified Brown Act rules made available under AB 361. While the Council is not obligated to pass the attached resolution, failure to do so will require the Council, along with all Boards and Commissions of the City to return to traditional Brown Act requirements.

To utilize the exemptions available under AB 361, the City Council must adopt a resolution making the required findings and renew the resolution every thirty (30) days.

RECOMMENDATION
Staff recommends that the City Council adopt Resolution No. 11-22-2957 reaffirming that the aforementioned conditions continue to be true and utilize the exemption from the requirements of the Government Code Section 54953(b)(3) for an additional thirty days.

ENVIRONMENTAL REVIEW
This Action is exempt pursuant to Section 15061(b)(3) of Title 14 of the California Code of Regulations.

ATTACHMENTS:

Resolution No. 11-22-2957
1 It is important to distinguish social distancing recommendations (e.g., stay 6 feet apart) from other safety protocols such as masking and vaccines. 2 This would include a majority of a quorum. If, for example, there are 5 members of a legislative body, but only 3 are in attendance at a meeting, then 2 would constitute a majority of those in attendance, and therefore may vote to conduct the meeting remotely.

STAFF REPORT
City Council
Council Meeting Date: November 22, 2022
TO: Mayor/City Council
FROM: Jesse Hightower, Police Chief
SUBJECT: Animal Shelter Fee Increase/ Master Fee Schedule Change BACKGROUND:

During the November 8, 2022, Council Meeting, I was asked to come back with numbers and figures for the Animal Shelter regarding how much money the city is potentially going to lose annually with the increase of the California City Pet Clinic spay and neuter fees. After receiving the adoption statistics from the animal control officer, I averaged the past two years. In 2020 there were 306 adoptions and in 2021 there were 346 for an average of 326. If most of these adoptions are large male dogs, the city is expected to lose at least $44,010 per year. If we were to assume these animals were large female dogs, the city is expected to lose $63,570. The average loss of these two amounts is $53,790. To make it even easier, if we assumed the city would lose $100 per animal, that is still $32,600. This figure is per year given the statistics given to me.

FISCAL IMPACT:

Significant fiscal loss if the animal shelter fees are not increased.

COUNCIL OPTIONS:
1) Do nothing.
2) Raise Animal Shelter fees to continue status quo.

ENVIRONMENTAL IMPACT:

None.

STAFF REPORT
City Council
Council Meeting Date: November 22, 2022
TO: Mayor/City Council
FROM: Jesse Hightower, Police Chief
SUBJECT: Discussion Regarding California City Boulevard BACKGROUND:

During the November 8, 2022, Council Meeting, I was asked to come back with numbers and figures for what it would cost to run overtime shifts on California City Blvd to deter speed and enforce other Vehicle Code sections. (New Business 2) Utilizing top step officer pay ($36.20), these are the values as requested with different scenarios:

Four hours per week or 16 hours per month at three months would be $2606.40.

Eight hours per week or 32 hours per month at three months would be $5212.80.

With four hours per week, that leaves limited time for the officer to go out during peak hours and to be effective. If the hours were extended, one officer could work four hours in the morning and a second officer could work four hours in the afternoon/evening during peak hours. Note that these hours are per week and not per day.

The values given are what were requested for a period of three months. After having listening to the community feedback, coupled with budgetary concerns, I would question this short-term solution, especially given that there currently is no approved operating budget and this is not a long term fixture.

FISCAL IMPACT:
1) No impact to the current budget if we continue as currently operating. 2) Up to $5212.80 spent in the next three months from a budget that hasn’t been approved.

COUNCIL OPTIONS:
1) Continue as currently operating with no impact to the budget. 2) Allow up to 32 hours of overtime per month not to exceed $5212.80 for an increased presence on California City Blvd. for the next three months.

ENVIRONMENTAL IMPACT:

None.
