CITY COUNCIL
DATE: November 14, 2023
TO: City Council
FROM: Recreation Supervisor – Theresa Oaks
SUBJECT: Department Report for the Month of September
______________________________________________________________________ Events
Staff is planning for our “Polar Express” themed Holiday Village event December 1st and 2nd.

Operations
During the month of October, our staff have been focused on creating new programming and bringing options other than sports to the California City rec department. The adult walking club is continuing with an average attendance of 3 to 4. The Strata Center also continues to be open to basketball practice, game room activities and open gym.

The maintenance staff continue to work extremely hard keeping up with trash and graffiti. We do request that the public take some responsibility by cleaning up after themselves and not tagging. Repairing these things takes time and money, which leaves less for the fun things we would like to make happen. Maintenance staff will be going to Balsitis twice a week to pick up trash and maintain all the hard work volunteers recently put in.

Staff are currently waiting for approval from Fish and Wildlife to start reed removal project. We should be able to start the end of November.

Staff are continuing to work with engineering and getting details squared away for the splash pad and skate park projects. We are currently putting together the specs for the bid package. The Balsitis Playground and Basketball court project is November 14, 2023 11 - 112
on hold while we apply for another round of CDBG funding to cover the increased cost.

Staff has been in contact with Pyro Spec and has brought City manager in as the city still has not been issued a refund. Staff are looking at next steps toward resolution.

CB. Special Parcel Tax Discussion

1. Review Historical Perspective by D.J. Twohig

2. Consideration of Alternative Funding Scheme

3. Recommendation (possible follow up action items)
On behalf of taxpayers in the agency, my office has proposed a strategic plan to end the special parcel tax dependency scheme as it is presently designed in California City and replace the measure with alternative more appropriate and less destructive funding scheme(s).

Dependency Scheme is the most expensive, regressive and destructive in state history.

Tens of thousands of properties lost at tax sale is a plague on assets and far too destructive scheme to continue. Alternative funding schemes must be organized. As of 12.31.22, the delinquency rate on special parcel taxes (and general property * Communications

I am requesting City Officials consider alternative, lawful funding schemes available to support general services as part of a fiscal sustainability model.

This sitting administration continues to erode trust of the voters, stakeholders and taxpayers of California City!

1. Multiple violations of the City Code of Ordinances 3-2.1.504 Measure C Special Parcel Tax Rate Reduction and 3-2.8 Cannabis Tax Collection have derailed economic policies previously adopted by Council to help establish the Cannabis Business Tax as a sustainable general tax revenue to help reduce and eliminate the special tax dependency scheme.

2. Failure to establish a strategic plan for fiscal sustainability and budget priority setting has led to budget inefficiencies and repeated fiscal insanity with taxpayer funds; high turnover, dysfunction in management, underserving the community.

3. Failure to establish economic development as a priority combined with the derelict of administration and management’s failure to expedite entitlements and permit processing historically has caused catastrophic erosion of industry attraction.

STOP REPEATING FISCAL INSANITY
I believe the only way to unify staff (including public safety), public, taxpayers, stakeholders is to organize a conscious, reasonable, and viable plan to sustain public safety in the general fund with general fund revenues – the direct result of improving economic policies and management team performances in industry attraction.

3 In the event Parks or Streets seek a funding scheme, is best to seek those funding sources separately - they should be funded in the general fund. NONE are special projects proposed. FOCUS on strategic plans to sustain general services in the general fund - by investing in attraction of job creating industries and growing the tax base.

I am asking KernTax and Howard Jarvis Taxpayers Association to consider supporting i) the end of the current special parcel tax scheme in California City as it is designed for public safety, levied flat rate per parcel, and ii) support for alternative funding schemes; a) ramp up economic development and b) ballot support for a special parcel tax levy VARIED PER CLASS OR USE as described in Government Code 53978, options to consider below.

My conclusions and recommended actions follow:

All five marching orders identified below must be assigned to an accountable management team with implementation targets clearly established as part of a strategic fiscal sustainability plan (and be honored by City Council and management teams).
i) CBT tax administrator impose, collect and report (w accurate and timely records), per Administrative Scope already in the Code 3-2.8. ii) Economic Development on steroids - Fast Track implementation, project tracking, and updating council and public.
iii) Budget priority setting, using GFOA best practices as a guide, iv) Strategic fiscal sustainability plan,
v) Special Tax (ST) Rate Reduction plan2
vi) End the ST dependency scheme to help restore equity (the future investment) in real properties in California City,

4 Amend Section 3-2.1.503 – Maximum rate.

The rate of the tax against each lot and parcel in any tax year shall not exceed the varied rates per year identified in Subsection below, less the parcel rate reduction for that tax year calculated pursuant to Section 3-2.1.504 (corrected to eliminate ‘rounding down’ gimmicks).

Varied rate class (use) options (a-c) for consideration:
(a) i) $150 per improved parcel, and ii) $75 per vacant parcel, subject to reduction plan, initially generating estimated $3.25M annually, or
(b)i) $125 per improved parcel, and ii) $50 per vacant parcel, subject to reduction plan, initially generating estimated $2.3M annually, or
(c)i) $100 per improved parcel, and ii) $50 per vacant parcel (similar special parcel tax imposed by Desert Hot Springs), subject to reduction plan, initially generating $2.2M Amend Section 3-2.1.504 – Rate Reduction.

Eliminate goofy gimmicks such as “rounding down to the nearest cent” (a) For each tax year, the Finance Director shall calculate a per parcel varied (use) rate reduction. He or she shall present his or her calculation of the varied rate reduction to the City Council as part of the budget process and consistent with tax assessor’s timeline necessary to levy the tax.
(b) The per parcel varied rate reduction shall be the amount, calculated equally on a per parcel basis, that would be necessary to raise an amount of revenue equal to ninety percent of "new revenue."
(c) For purposes of this section, "new revenue" means the amount calculated by subtracting the "qualified revenue" collected in Fiscal Year 2023-2024 from the "qualified revenue" collected (or projected by the Finance Director to be collected less estimated property tax defaults and delinquencies) during the fiscal year immediately prior to the current tax year. For example, for purposes of calculating the rate reduction applicable to the tax levied in Tax Year 2025-2026, "new revenue" would be calculated by subtracting the "qualified revenue" collected in Fiscal Year 2024-2025 from the "qualified revenue" collected in Fiscal Year 2023- 2024.
(d) For purposes of this section, "qualified revenue" means all tax receipts from (i) the ad valorem property tax; (ii) the sales and use tax imposed pursuant to the Uniform Local Sales and Use Tax Law of the City of California City; and (iii) the cannabis business tax imposed pursuant to Section 3-2.8.050 of this Code.

Note: ** Do not confuse the importance of the past ballot measure rate reduction plan with the convoluted and irresponsible ‘invalid math formula’ used by FINANCE DEPT. Eliminating the “rounding down to the nearest cent” convolution (and amount projected to be collected) language cited during rate setting found in Code Section 3-2.1.504(b) will eliminate the invalid math formula used by November 14, 2023 23 - 112

A preliminary redline draft of proposed corrections to Code 3-2.1 has been attached for reference.

In the event further analysis of VARIED RATE PER CLASS OR USE has merit to the City Council for consideration, a follow up discussion may be scheduled to review available analysis on the relevancy of proposed special parcel tax scheme as described in Government Code 53978, and the possible draft ballot measure and draft Ordinance corrections relating thereto.

COUNCIL AGENDA ITEM
NOVEMBER 14, 2023
PREPARED BY: Victor Ponto, City Attorney
Robert F. Messinger, Esq.

SUBJECT: Public Services Special Parcel Tax
______________________________________________________________________

BACKGROUND
In 2018, the California City electorate approved the California City Public Safety Only Special Parcel Tax Ordinance of 2018 (the “2018 Tax Ordinance”) by a two-thirds vote.

The proceeds of the tax is divided evenly to fund police services and fire services within the City. The 2018 Tax Ordinance contains a sunset provision and will expire following the 2023-2024 tax year.

If it is the desire of the City Council to place a special tax ordinance before the voters to replace the expiring 2018 Tax Ordinance, the City Council may call a Special Municipal Election to be held on March 5, 2023 for the purpose of submitting to the voters a ballot measure on a special parcel tax. Prior to the holding of an election, the City must adopt two resolutions in relation thereto.

The first resolution calls and gives notice of holding an election, directs the City Attorney to prepare an impartial analysis, and adopts regulations for ballot arguments. Priority for arguments is given to the City Council, or members thereof. The due date for submittal of direct arguments to the City Clerk would be Tuesday, November 28, 2023, by five p.m., followed by a public review period, with rebuttal arguments filed no later than five p.m. on Friday, December 8, 2023.

The second resolution requests the Kern County Board of Supervisors to allow consolidation with the Statewide election being held on the same day and to direct the County Elections Division to render services.

DISCUSSION
The draft vacancy tax ordinance presented with this agenda report reflects the input and direction from the City Council from its meeting of October 24, 2023, with respect to the preferences for a special tax to be placed on the March 5, 2024 ballot. As a preliminary matter, a special parcel tax may be enacted only as a special tax requiring a two-thirds vote and the proceeds dedicated to a special purpose.

The draft special parcel tax ordinance amends the existing Measure C special tax ordinance by extending its effectiveness for another five (5) years, adding additional accountability requirements, and establishing an appropriations limit. The maximum PH 1.

November 14, 2023 50 - 112
rate of the special tax will continue to not exceed fifty cents per day, less the daily per parcel rate reduction set forth in the Municipal Code. However, the requirement to round down to the nearest cent will be deleted.

The proceeds of the special tax will continue to be divided evenly for deposit into the Police Special Tax Fund, for the exclusive use for police equipment, vehicles, supplies, training, facilities, administrative expenses, operating expenses (including dispatch), maintenance expenses, personnel costs and associated overhead costs, and deposit into the Fire/EMS Special Tax Fund, for the exclusive use for fire, emergency medical services, code enforcement, equipment, apparatus, vehicles, supplies, training, facilities, administrative expenses, operating expenses (including dispatch); maintenance expenses, fire prevention program expenses, personnel costs and associated overhead costs.

The ordinance will retain the existing requirement for the filing of an annual report by the Finance Director and will add two additional accountability measures, including requirements for the City Council:
(1) to hold Town Hall meetings on a quarterly basis commencing in July 2024 and in each calendar quarter thereafter for the purpose of soliciting input from the residents, business owners, and property owners on the special parcel tax and related matters; and
(2) to cause to be prepared, within nine (9) months of the effective date hereof, an impartial and professional budget stabilization plan to identify potential solutions for resolving the City’s structural deficit, including but not limited to, a review of organizational structure, service delivery methodology, revenues, personnel costs, and constraints.

The ordinance provides that the special tax would sunset following the 2028-2029 tax year. The ordinance also increases the appropriation limit to account for the collection of the special tax.

Also presented with this staff report for City Council input is draft ballot question language. Ballot question language is limited by statute to 75 words. The draft language presented contains 58 words.

A Resolution calling and giving notice of the special municipal election for March 5, 2024, must be submitted to the County no later than 88 days prior to the election (December 8, 2023). A Resolution will be submitted to the County concurrently with the Resolution calling and giving notice of the special municipal election that requests the Board of Supervisors to consolidate the City’s election with other elections on the same date the County will conduct the Statewide Presidential Primary election and to permit the County Elections Division to take any and all steps necessary for the holding of the election. The services to be provided by the County Elections Division include, but are not limited to, the appointment of all required election officers and establishment of November 14, 2023 51 - 112
polling places; publishing the notice of appointment of election officers, preparing and mailing the official and sample ballots including arguments, process vote by mail ballots; supply all needed materials for polling places; conduct the election, canvass the election returns and certify the results. The City would reimburse the County for the costs of providing the services.

FISCAL IMPACT
The existing special parcel tax generates approximately $6.5 million in revenue. The City’s general fund as set forth in the FY 2022-2023 California City Adopted Budget was $7.6 million.

RECOMMENDATION
Staff recommends that the City Council:
(1) Conduct a public hearing to receive public input on the issue of a special parcel tax ballot measure, and
(2) Provide staff any further direction desired by the City Council, and (3) Adopt a Resolution Calling and Giving Notice of the Special Municipal Election, and
(4) Adopt a Resolution Requesting Consolidation of the Special Municipal Election with the Statewide Presidential Primary Election on March 5, 2024.

Section 3-2.1.508, “Accountability” is amended to read as follows:
“(a) For so long as proceeds of the tax remain unexpended, the Finance Director of the City shall file an annual report with the City Council stating the amount of taxes collected, the amount expended, and the purpose of the expenditures. CITY COUNCIL
DATE: November 14, 2023
TO: Honorable Mayor and City Council
FROM: Victor Ponto, City Attorney
SUBJECT: Interim City Manager Employment Agreement and Update to Salary Schedule _____________________________________________________________________________________

BACKGROUND
On October 19, 2023, the position of City Manager became vacant. To ensure a smooth and timely transition of a new City Manager, the City of California City (“City”) sought to appoint an Interim City Manager while it is searching for a permanent City Manager. After reviewing potential candidates for an interim appointment, during its special meeting on October 21, 2023, the City Council identified Michele Martinez as their top candidate.

During the October 21, 2023 special meeting, City Council appointed Ms. Martinez as Interim City Manager. The City and Ms. Martinez agreed that Ms. Martinez will hold the appointment as the Interim City Manager during the City’s search for a permanent City Manager. City Council directed staff to negotiate a contract for Ms. Martinez’ employment and present at the next regular City Council meeting on November 14, 2023.

Ms. Martinez has served for twelve (12) years as Councilmember in the City of Santa Ana (2006-2018).

During this time, she became the first councilmember to serve as President of the National Association of Latino Elected and Appointed Officials (NALEO), the first council member to serve as President of the Southern California Association of Governments (SCAG), and the youngest woman to serve as the Mayor Pro Tem for the City of Santa Ana.

Given her experience working with other municipal agencies, the City Council believes Ms. Martinez will be a good fit for the California City community and will work well with City staff and City Council.

Further, the City’s salary schedule currently lists three separate positions related to the City Manager classification. This gives the impression that there are three separate authorized position for City Manager:
“Acting City Manager,” “City Manager Contract,” and “City Manager.” The City only needs one listing for the City Manager classification on its salary schedule. Under the California Public Employees’ Retirement Law (“PERL”) regulations require that the publicly listed salary schedule lists all authorized positions at a public agency, such as the City, and for such schedule to accurately reflect the salary range for each classification.

DISCUSSION
-After contract negotiations, the City and Ms. Martinez now wish to memorialize the terms and conditions for Ms. Martinez’ employment as detailed in the “Employment Agreement for Position of Interim City Manager” (“Agreement”). The proposed Agreement, attached hereto, is for an open ended term beginning NB 2.

November 14, 2023 70 - 112
November 14, 2023.. The Agreement will remain in effect until the City hires a permanent City Manager, but in no case will end before December 14, 2023, unless otherwise terminated by either the City or Ms.

Martinez. In addition to the standard terms and conditions, the Agreement provides for the following salary and benefits:
• Annual salary of $185,000.00 until December 13, 2023, and $200,000.00 effective December 14, 2023; • 40 hours of sick leave and 40 hours of vacation leave; • 81 hours of executive leave; and
• Automobile allowance at $150/month
- The City will pro-actively continue its recruitment process for a new permanent City Manager during the duration of Ms. Martinez’ interim appointment.

To effectuate Ms. Martinez’ appointment consistent with PERL regulations and avoid confusion as to the authorized position under the City Manager classification, the City needs to revise the salary schedule to eliminate reference to the “Acting City Manager” and “City Manager Contract” positions. The City should modify the City Manager position on the salary schedule to “City Manager (set by contract).” The range for the position should be revised to $185,000.00-$200,000.00, consistent with the proposed Agreement.

RECOMMENDATION
Staff recommends that the City Council
(1) Approve the draft Employment Agreement for Position of Interim City Manager that has been negotiated and published, and is included as Exhibit A, and the revised salary schedule included as Exhbit B;
(2) Direct staff to continue negotiations based on feedback during open session deliberations; (3) Reject the Agreement, terminate Ms. Martinez’ appointment, and appoint an acting City Manager. .

2 1.3 At-Will. Employee acknowledges that she is an at-will, temporary employee of City who shall serve at the will and pleasure of the City Council at all times during the period of her service hereunder. The terms of CITY’s personnel manual, rules, policies, regulations, procedures, ordinances, and resolutions (collectively “Personnel Policies”), as they may be amended or supplemented from time to time, shall not apply to Employee, and nothing in this Agreement is intended to, or does, confer upon Employee any right to any property interest in continued employment, or any due process right to a hearing before or after a decision by the City Council to terminate her employment, except as is expressly provided in Section 1.2 [Term] or Section 4 [Termination] of this Agreement. Nothing contained in this Agreement shall in any way prevent, limit or otherwise interfere with the right of City to terminate the services of Employee, as provided in Section 1.2 [Term] or Section 4 [Termination]. Employee waives and agrees not to assert any rights or privileges conferred under paragraph (b) of Section 2-3.212 of the City’s Municipal Code providing that a city manager may not be removed, other than for misconduct in office, for a period of ninety (90) days following any municipal election at which a member of the City Council is elected or appointed to office in the City. Nothing in this Agreement shall prevent, limit or otherwise interfere with the right of Employee to resign at any time from this position with City, subject only to the provisions set forth in Section 1.2 [Term] or Section 4 [Termination] of this Agreement.

This at-will Employment Agreement shall be expressly subject to the rights and obligations of City and Employee, as set forth in Section 1.2 [Term] or Section 4 [Termination] below.

1.4 Duties. Employee shall serve as the Interim City Manager and shall be for the term of this Agreement vested with the powers, duties and responsibilities of the City Manager as set forth in ordinances and resolutions of the City, including without limitation, those set forth in the City Manager job description, the City’s Municipal Code and to perform other legally permissible and proper duties and functions as the City Council may from time to time assign. It is the intent of the City Council for the Interim City Manager to function as the chief executive officer of the City. Employee shall provide such other services as are customary and appropriate to the position of Interim City Manager.

Employee shall devote her best efforts and attention to the performance of these duties.

1.5 Hours of Work. Employee shall devote the time necessary to adequately perform her duties as Interim City Manager. The Parties anticipate that Employee will work approximately forty (40) hours per week allocated between regular business hours and hours outside of regular business hours including, without limitation, attendance at regular and special City Council meetings, attendance at such community events and City functions as the Council may direct. Employee agrees to devote additional time as is necessary for the full and proper performance of the Interim City Manager duties, and that compensation provided in this Agreement includes compensation for performance of all hours worked. Toward that end, Employee shall be allowed reasonable flexibility in setting her own office hours, provided the schedule of such hours provides reasonable availability to the City Council, City staff, and members of the community during regular City business hours and for the performance of her duties and of City business. The Parties agree that Employee may work remotely on Thursday and Friday of each week, however, Employee agrees to remain accessible by telephone for consultation and advice November 14, 2023 73 - 112
3 when working remotely. Employee also agrees to promptly respond to the City in case of emergency, even if such emergency occurs outside of regular working hours.

1.6 Other Activity.

1.6.1 In accordance with Government Code Section 1126, during the period of her employment, Employee shall not accept, without the express prior written consent of the City Council, any other employment or engage, directly or indirectly, in any other business, commercial, or professional activity, whether or not to pecuniary advantage, that is or may be competitive with City, that might cause a conflict-of-interest with City, or that otherwise might interfere with the business or operation of City or the satisfactory performance of Employee’s duties as Interim City Manager.

1.6.2 Notwithstanding the foregoing, the City Council acknowledges that at the time of the execution of this Agreement, Employee has existing business commitments that Employee intends to fulfill and City Council agrees that fulfilling these commitments does not violate this Section 1.6. Employee will ensure that her existing business commitments do not interfere with her ability to perform her duties as Interim City Manager. Specifically, City Council acknowledges that Employee will continue to hold her position and perform her responsibilities as special master for the City of Los Angeles and the County of Los Angeles. City Council also acknowledges that Employee will continue to work with her client, Verizon Communications, through her consulting company, Emergent P4 Advisors, LLC.

Employee shall be paid in accordance with the City’s established protocols and procedures used for City Employees. Employee shall not be entitled to any portion of the annualized salary for any period of time for which she is not actively employed as the Interim City Manager.

Employee shall not be entitled to any additional compensation or any severance pay upon termination of this Agreement.

2.1.2 If the term of this Agreement continues beyond December 14, 2023, as provided in Section 1.2 [Term] above, then compensation under Section 2.1.1 above shall cease and instead, for all services performed by Employee as the Interim City Manager under this Agreement, the City shall pay Employee compensation at an annualized base salary of two hundred thousand dollars and zero cents ($200,000.00), minus any applicable deductions, as may be elected by Employee and as may be required by state, federal, and local law. Employee shall be paid in accordance with the City’s established protocols and procedures used for City Employees. Employee shall not be November 14, 2023 74 - 112

2.3Adjustment to Compensation. In the event this Agreement is still in effect on February 14, 2024, the City shall evaluate Employee’s performance and consider whether an adjustment to Employee’s rate of pay is warranted at its regularly scheduled City Council meeting following February 14, 2024.
