Subject: Appointment to vacated seat on City Council
Agency: City of California City
Mr. Mayor, and members of City Council,
On behalf of the stakeholders, members of the community, taxpayers, and future residents, stakeholders and taxpayers, I am submitting herewith my letter of interest, together with BIO, letters of reference, media releases, draft policy recommendations, including alternative funding measures, strategic planning tools, among other resources which exemplifies forty year unique experiences as a leader in business development, administration, management, marketing, public policy advocacy, sourced data analysis, and draft policy recommendations.

I wish to thank those who have encouraged me to submit my letter of interest. I suspect in a community divided such as California City, there are few who have the where-with-all and leadership qualities necessary to improve the overall quality of life for all stakeholders – not just a few. In advance of your consideration, you can expect me to support whichever leader you may choose to fill the seat. I have a track record of supporting leader(s) who demonstrate the integrity and discernment required to build a better community - as I have strived to do throughout my professional career.

My purpose as a member of the community is to serve all – as I have for over a decade pro bono - with enthusiasm to correct failed economic policies – providing analysis, conclusions and recommended solutions for City Council consideration. As a public policy advocate, I am intimately familiar with the Administration and Management strengths, weaknesses, opportunities, and immediate challenges. While one or more of our City Council may perceive my public opinion as direct and pointed; there is good cause. All too often public officials banter publicly on critical issues and policies that impact our community outlook and vibrancy when they are not sufficiently educated with sourced data required to make best quality decisions.

When best quality decisions are made, I believe having the best source of information is very helpful to our elected/ appointed leaders. For your cumulative efforts, thank you.

The Citizens and Taxpayers Deserve Better!
I look forward to the opportunity to serve the community from the Council seat, if appointed. I believe you will find my leadership and faithful support of best practices helpful in achieving superior results given the immediate and long terms needs of the community.

Thank you for consideration,
Sincerely,
D.J. Twohig,

CB. Special Parcel Tax Discussion

1. Review Historical Perspective by D.J. Twohig

2. Consideration of Alternative Funding Scheme

3. Recommendation (possible follow up action items)
On behalf of taxpayers in the agency, my office has proposed a strategic plan to end the special parcel tax dependency scheme as it is presently designed in California City and replace the measure with alternative more appropriate and less destructive funding scheme(s).

Dependency Scheme is the most expensive, regressive and destructive in state history.

Tens of thousands of properties lost at tax sale is a plague on assets and far too destructive scheme to continue. Alternative funding schemes must be organized. As of 12.31.22, the delinquency rate on special parcel taxes (and general property * Communications

2 taxes) is over 16,630, or thirty-three percent (33%)1. Nearly a thousand more lose their properties each year at tax sale. Further anecdotal analysis can be found in resources attached.

I am requesting City Officials consider alternative, lawful funding schemes available to support general services as part of a fiscal sustainability model.

STOP THE IGNORANCE AND BIAS
City Council has a fiduciary duty to protect property owners from excessive, regressive, destructive parcel taxes!
Demonstrations of City Council glaring ignorance and bias are not reasonable leadership aptitudes. Facts matter! Pay attention to the facts! Check your ego!

CITY COUNCIL IS DERELICT OF DUTY
This sitting administration continues to erode trust of the voters, stakeholders and taxpayers of California City!

1. Multiple violations of the City Code of Ordinances 3-2.1.504 Measure C Special Parcel Tax Rate Reduction and 3-2.8 Cannabis Tax Collection have derailed economic policies previously adopted by Council to help establish the Cannabis Business Tax as a sustainable general tax revenue to help reduce and eliminate the special tax dependency scheme.

2. Failure to establish a strategic plan for fiscal sustainability and budget priority setting has led to budget inefficiencies and repeated fiscal insanity with taxpayer funds; high turnover, dysfunction in management, underserving the community.

3. Failure to establish economic development as a priority combined with the derelict of administration and management’s failure to expedite entitlements and permit processing historically has caused catastrophic erosion of industry attraction.

STOP REPEATING FISCAL INSANITY
I believe the only way to unify staff (including public safety), public, taxpayers, stakeholders is to organize a conscious, reasonable, and viable plan to sustain public safety in the general fund with general fund revenues – the direct result of improving economic policies and management team performances in industry attraction.

3 In the event Parks or Streets seek a funding scheme, is best to seek those funding sources separately - they should be funded in the general fund. NONE are special projects proposed. FOCUS on strategic plans to sustain general services in the general fund - by investing in attraction of job creating industries and growing the tax base.

I am asking KernTax and Howard Jarvis Taxpayers Association to consider supporting i) the end of the current special parcel tax scheme in California City as it is designed for public safety, levied flat rate per parcel, and ii) support for alternative funding schemes; a) ramp up economic development and b) ballot support for a special parcel tax levy VARIED PER CLASS OR USE as described in Government Code 53978, options to consider below.

My conclusions and recommended actions follow:

All five marching orders identified below must be assigned to an accountable management team with implementation targets clearly established as part of a strategic fiscal sustainability plan (and be honored by City Council and management teams).
i) CBT tax administrator impose, collect and report (w accurate and timely records), per Administrative Scope already in the Code 3-2.8. ii) Economic Development on steroids - Fast Track implementation, project tracking, and updating council and public.
iii) Budget priority setting, using GFOA best practices as a guide, iv) Strategic fiscal sustainability plan,
v) Special Tax (ST) Rate Reduction plan2
vi) End the ST dependency scheme to help restore equity (the future investment) in real properties in California City,

4 Amend Section 3-2.1.503 – Maximum rate.

The rate of the tax against each lot and parcel in any tax year shall not exceed the varied rates per year identified in Subsection below, less the parcel rate reduction for that tax year calculated pursuant to Section 3-2.1.504 (corrected to eliminate ‘rounding down’ gimmicks).

Varied rate class (use) options (a-c) for consideration:
(a) i) $150 per improved parcel, and ii) $75 per vacant parcel, subject to reduction plan, initially generating estimated $3.25M annually, or
(b)i) $125 per improved parcel, and ii) $50 per vacant parcel, subject to reduction plan, initially generating estimated $2.3M annually, or
(c)i) $100 per improved parcel, and ii) $50 per vacant parcel (similar special parcel tax imposed by Desert Hot Springs), subject to reduction plan, initially generating $2.2M Amend Section 3-2.1.504 – Rate Reduction.

Eliminate goofy gimmicks such as “rounding down to the nearest cent” (a) For each tax year, the Finance Director shall calculate a per parcel varied (use) rate reduction. He or she shall present his or her calculation of the varied rate reduction to the City Council as part of the budget process and consistent with tax assessor’s timeline necessary to levy the tax.
(b) The per parcel varied rate reduction shall be the amount, calculated equally on a per parcel basis, that would be necessary to raise an amount of revenue equal to ninety percent of "new revenue."
(c) For purposes of this section, "new revenue" means the amount calculated by subtracting the "qualified revenue" collected in Fiscal Year 2023-2024 from the "qualified revenue" collected (or projected by the Finance Director to be collected less estimated property tax defaults and delinquencies) during the fiscal year immediately prior to the current tax year. For example, for purposes of calculating the rate reduction applicable to the tax levied in Tax Year 2025-2026, "new revenue" would be calculated by subtracting the "qualified revenue" collected in Fiscal Year 2024-2025 from the "qualified revenue" collected in Fiscal Year 2023- 2024.
(d) For purposes of this section, "qualified revenue" means all tax receipts from (i) the ad valorem property tax; (ii) the sales and use tax imposed pursuant to the Uniform Local Sales and Use Tax Law of the City of California City; and (iii) the cannabis business tax imposed pursuant to Section 3-2.8.050 of this Code.

Note: ** Do not confuse the importance of the past ballot measure rate reduction plan with the convoluted and irresponsible ‘invalid math formula’ used by FINANCE DEPT. Eliminating the “rounding down to the nearest cent” convolution (and amount projected to be collected) language cited during rate setting found in Code Section 3-2.1.504(b) will eliminate the invalid math formula used by 34 - 59 March 09, 2024

5 Finance, which is a clear violation of California Constitution. See KernTax letter to City Council and HJTA primer letter to City Council clarifying the same.

A preliminary redline draft of proposed corrections to Code 3-2.1 has been attached for reference.

In the event further analysis of VARIED RATE PER CLASS OR USE has merit to the City Council for consideration, a follow up discussion may be scheduled to review available analysis on the relevancy of proposed special parcel tax scheme as described in Government Code 53978, and the possible draft ballot measure and draft Ordinance corrections relating thereto.

I look forward to your insight and support in ending the special parcel tax dependency scheme and assisting with more appropriate revenue sources for general services including public safety.

Thank you for consideration,
Sincerely,

Almost a year ago, first draft Strategic planning tool developed in editable version for use by CM, given existing CM budget goals 20-21.

Unbelievable that a year later; there has been one hundred conversations related (including consensus for its implementation by CM in Vision 360); ongoing for hours… and NO ACTION! The city wide planning tool has far too much to offer to dismiss. Only a fool would dismiss the tool. The tool can be i) edit and ii) interpretive uses with priority setting, and so much more.

For these reasons, I believe should be written into Ordinance is required.

Anna,
Please see first draft budget tool with Budget Goals.

You will find columns with column notes found at bottom. I’ve condensed the font size (8) to fit on 1 page landscape (attached). However, the user may increase the font size or the excel table for a large screen presentation as should be presented to match the budget tools with the goals.

Literally, Council, staff and someday the public should give scoring to highest priority to help guide budget policy. I’ve made an effort to include/ table the budget tools ‘must have deliverables’, ‘first step’, ‘point person’, ‘start date’ and ‘quarterly reporting dates’.

I developed this budget tool in about 2.5 hours using your word document as the basis (column “E” in Excel). Imagine if you had a competent consultant who could assist driving these critical issues toward realistic solutions. I imagine, someone who would demonstrate accountability to CM and Council to perform these objectives as part of the budget process… wow! Talk about community buy-in?
44 - 59 March 09, 2024
2 Also, my edits are not added to be firm or un-editable. I’ve only added content in multiple columns to assist staff (CM) in the process of creating an effective budget tool (to be update by you and directed by Council).

Thank you for opportunity to provide a service,
Good luck,

Attn: Honorable Mayor Jeanie O’Laughlin, City Council members, RE: December 22, 2020 NB3. Special Tax – Council Kulikoff Y2024-25 Public Safety will need to be 100% sustainable in general fund.

You are likely aware, if you’ve been paying attention to City business, that my office and others, including KernTax and Howard Jarvis Taxpayers Association have expressly stated general taxes are designed for general services. Public Safety needs to be funded relative to general fund/ general taxes receipts.

BE THE VOICE OF CHANGE
For decades, idiotic economic policy and regressive tax policy has resulted in hundreds of millions in property valuation losses in California City. Stop the destructive aptitude of dependency on special parcel taxes. Do everything necessary to attract a general tax base to fund and sustain general services. Support general services sustainability with a comprehensive economic development plan concurrent with ending the special parcel tax dependency.

After Y2023-24 THE SPECIAL PARCEL TAX WILL EXPIRE (FOREVER) • Y2020-21 Property tax bills delivered is the third year of the six year levy! Only three years left.

A plan should be established to sustain general services without the parcel tax! Keep the promise! https://www.facebook.com/eyesonyou93505/videos/865881740288233 Current fiscal year should have 30% or more of Public safety funded by the general fund. • Y2021-22 Fiscal year should have 50% or more of Public Safety funded by the general fund. • Y2022-23 Fiscal year should have 70% or more of Public Safety funded by the general fund. • Y2023-24 Fiscal year should have 85% or more of Public Safety funded by the general fund.

Y2024-25 Public Safety will need to be 100% sustainable in general fund. See attached draft 1 table, Public Safety Sustainability

DEMONSTRATE TAX BASE GROWTH IN THE BUDGET REPONSIBLY
Any other rhetoric from any member of City administration is contradictory to effective economic policy. No more excuses!
54 - 59 March 09, 2024
The special parcel tax in California City is a scam preying upon those tens of thousands of vacant lot owners, who are disenfranchised by not including them in the vote to levy special parcel taxes. This is morally wrong! There should NOT ever be another special parcel tax ever! 55 - 59 March 09, 2024
DIVISION 5. - SPECIAL PARCEL TAX
Sec. 3-2.1.501. - Short title.

Sec. 3-2.1.504. - Rate reduction.
