1 COUNCIL AGENDA ITEM
August 13, 2024
TO: Mayor and City Council
FROM: Latisha Lamberth, Acting City Manager & Justin Vincent, Interim Fire Chief SUBJECT: The replacement of the end-of-life fire department Deputy Fire Marshal vehicle ulizing approved Proposion 64 funds.

SUMMARY/ DISCUSSION:

The California City Fire Department Deputy Fire Marshal vehicle has reached the end of its lifespan as serviceable city vehicle. This vehicle was previously purchased by the City at a discount as a used vehicle. This 2006 Ford Expedition has a current mileage that exceeds 139,000 miles and has a Kelly Blue Book Value of under $295.00** - 950.00 dollars.
** Per industry standard, the estimated value for used emergency services vehicles is set to the lowest trade-in value, as they are typically sold at auction as public surplus and Kelly Blue Book values are unable to take into account the internal and external body damage that is associated with the removal of the emergency lighting equipment, center command console, radios, and laptops that must be removed to legally transfer the vehicle to public auction. This vastly lowers the quality of the vehicle leaving gaps, holes, and body damage that affects the vehicle’s value at auction.

This vehicle was previously utilized as the fire department’s fire investigation vehicle. When the Fire Marshal position was introduced, this vehicle was repurposed for that position. Then when the Deputy Fire Marshal position was added with Proposition 64 funding, this vehicle was again repurposed for this current position. The vehicle is in disrepair, going in and out of service and had previously failed a smog test earlier in the year. The vehicle heater does not work, and the air conditioning functions intermittently, causing the cab of the vehicle to become unsafe and beyond OSHA safety limits for temperature exposure. The driver’s seatbelt with lock in place and not work on a regular basis. The passenger rear door no longer opens. The check engine light is now permanently on. Lastly, the mechanical condition of the vehicle has created an unsafe and unreliable situation for the fire department.

With this vehicle having served well beyond its’ expected lifespan, it is time that it is replaced with a safe and reliable vehicle that can meet the needs of both the department and the community. This 2 vehicle is set to be replaced with a Chevrolet Tahoe SSV (Special Service Vehicle) model vehicle.

Unfortunately, Chevrolet Special Service Vehicle (SSV) and Police Package Vehicle (PPV) Tahoes are built to order from the factory and not generally stocked by dealerships. Orders for brand new SSV and PPV vehicles from Chevrolet are typically only taken one time a year, in a three-week period in the fall, with a six month turn around for the order to be filled. This makes the acquisition of a new SSV or PPV Tahoe and the ability to get bids extremely difficult, if not impossible, until the dealerships release the MSRP for the new releases of these vehicles in the fall.

Staff was able to locate one company that has lightly used Chevy Tahoe PPV emergency response vehicles in Texas as well as one company in Pennsylvania that has some new 2024 Chevy Tahoe SSV’s available in stock. The advantage of the new vehicle purchase from the company in Pennsylvania is that it comes with a full Chevrolet new car warranty and no possible history of mechanical issues that one risks when purchasing a used vehicle. The turnaround time to receive the vehicle is expected to be near 90 days.

The cost for the brand new 2024 Chevrolet Tahoe SSV with the full build up of lights, sirens, radios, and other required emergency equipment is quoted at $91,468.96 (including taxes and shipping). The quoted cost for a used 2022 Chevrolet Tahoe with under 30,000 miles from the company in Texas is $76,687.00 (including shipping and excluding taxes). Based upon these two available quotes, and the inability to get a quote from any local dealerships in California until the fall, staff recommends that the City proceed with the purchase of the new vehicle from Pennsylvania as it will come with a new vehicle warranty and zero mileage.

The City of California City was awarded the Proposition 64 Cohort grant on April 13, 2023, for a contract term of May 1, 2023 to October 31, 2028. Staff has already received approval correspondence for 100% coverage and reimbursement from the Fire Department’s Proposition 64 grant for the full purchase price of the new 2024 Chevrolet Tahoe SSV for the Deputy Fire Marshal. A copy of the email pre-approval is attached. This means that this purchase will not have a negative impact on the general fund.
2024 Chevrolet Tahoe SSV model
3 FISCAL IMPACT: The fiscal impact would be limited to the fire department’s approved grant funding through Proposion 64 and will not have an impact on the General Fund or any other City fund.

RECOMMENDATION: Staff recommends that Council approve of a resoluon to purchase the replacement Deputy Fire Marshal vehicle ulizing the pre-approved grant funding from Proposion 64.

RESOLUTION NO. 24-3047

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

CALIFORNIA CITY, CALIFORNIA, AUTHORIZING THE USE OF
APPROVED PROPOSITION 64 GRANT FUNDS FOR THE

CALIFORNIA CITY FIRE DEPARTMENT TO ADDRESS A

CRITICAL VEHICLE REPLACEMENT NEED
The City Council of the City of California City (hereafter referred to as the “City Council”) does resolve as follows:

WHEREAS, the City has previously been awarded proposition 64 grant funding on April 13, 2023 to add the full-time position of Deputy Fire Marshal; and, WHEREAS, this grant allows for the request for necessary fixed assets as long there is a clear nexus to meeting the project’s goal & objectives; and, WHEREAS, the Proposition 64 grant administrators have determined that the purchase of a new vehicle for the Deputy Fire Marshal is an eligible expense for grant reimbursement and is aligned with the work outlined in the application; and, WHEREAS, the council has determined to approve the fire department to immediately replace the end-of-life 2006 Ford Expedition Prevention vehicle with a 2024 Chevrolet Tahoe SSV with emergency response upfit from Utilitac Emergency Upfitting at a cost of $91,486.96 with full reimbursement by the approved Proposition 64 Grant.

NOW, THEREFORE BE IT RESOLVED, DETERMINED, AND ORDERED BY THE

DEPARTMENT IS AUTHORIZED TO PURCHASE THE ABOVE OUTLINED CAPITAL EXPENDITURE.

Item No. NB6

COUNCIL AGENDA ITEM
Council Meeting August 13, 2024
PREPARED BY: Latisha Lamberth, Acting City Manager
SUBJECT: Ordinance change to create the position of Director of Public Safety

BACKGROUND
The current members of the City Council are well aware of the important role that Police and Fire Departments play in providing essential services to our community. However, with the current significant budget constraints, it has become increasingly evident that having an option for one individual to lead both, the Police and Fire Departments, is critical to continue providing essential services to our community while being mindful of our budgetary constraints.

Having one individual lead the Police and Fire Departments may improve operational efficiency and streamline decision making process across both departments. Therefore, this may also improve the quality of services provided to our citizens.

By adding the position of Director of Public Safety, the City would improve its infrastructure for effective management and accountability within the departments. This individual would be responsible for overseeing all aspects of the departments, including budget management, personnel supervision, and strategic planning.

Furthermore, with the addition of the Director of Public Safety, the departments would be better equipped to address the increasing demands and challenges of our growing City. They would be able to provide a more comprehensive and coordinated approach to service delivery, leading to improved efficiency and effectiveness.

Moreover, the Director of Public Safety would act as a liaison between the departments and the City Council, ensuring open communication and collaboration. This would also allow for better alignment of the Departments' goals and objectives with the City's overall vision.

The addition of a Director of Public Safety is crucial to the continued success and growth of our 4890-3072-5846 v1
City. I urge the City Council to consider amending the current ordinance to create this position. It is imperative that we take proactive steps to strengthen the organizational structure of the Police and Fire Departments and provide our citizens with the best possible services.

FISCAL IMPACT
Upon adoption of this Ordinance, the next step will involve adopting a job description and updating the City’s salary schedule to create the new Director of Public Safety position.

RECOMMENDATION
Staff recommends that the City Council: (1) take action to approve the proposed amendment to the ordinance as outlined in this report, or (2) take no action. 4863-8378-1077 v3
ORDINANCE NO. 24-816

AN ORDINANCE OF THE CITY OF CALIFORNIA CITY, CALIFORNIA AMENDING SECTIONS 2-2.504, 2-3.103 AND 2-3.307 AND ADDING SECTION 2-3.308 TO THE CALIFORNIA CITY MUNICIPAL CODE

RELATED TO THE POSITION OF DIRECTOR OF PUBLIC SAFETY
WHEREAS, the City of California City (“City”) is continuing its effort to resolve various fiscal constraints and has implemented various layoffs and consolidations to effectuate this goal; and
WHEREAS, the City Council recognizes that Department Director salaries incur a large burden on the City’s annual budget and has determined that consolidating, where possible, potential Director roles would result in significant cost savings; and WHEREAS, the City Council finds that creating a new “Director of Public Safety” position to fulfill the duties of the Police Chief and Fire Chief, if such qualified individual is available, furthers such cost savings; and
WHEREAS, the “Director of Public Safety” position does not replace the positions of Fire Chief and Police Chief, rather it provides the City flexibility in appointing one person to lead the police and fire departments, when such qualified person is available.

THEREFORE, THE CITY COUNCIL OF THE CITY OF CALIFORNIA CITY HEREBY ORDAINS AS FOLLOWS:

SECTION 1. Recitals
The City Council of the City of California City finds and declares that the recitals set forth above are true and correct and are incorporated herein by this reference.

The Director and Assistant Director shall, with the assistance of emergency services Departments and Kern County, develop emergency plans, manage the emergency Operating 4863-8378-1077 v3
Plan (EOP) of the City, and have such other powers and duties as are assigned by the City Manager.

SECTION 3. Amendment of California City Municipal Code Section 2-3.103 Title 2, Chapter 3, Article 1, Section 2-3.103, subdivision (a) is amended to read as follows:

Each department head shall serve at the pleasure of the City Manager, and shall be in positions of management.
(c) Each department head shall supervise their department to carry out the directives of the City Manager, subject to the requirements of law. (d) Department heads shall be reimbursed for actual expenses incurred while on City business at the direction of the Council or City Manager.

The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
