COUNCIL AGENDA ITEM
Council Meeting November 25, 2024
PREPARED BY: Latisha Lamberth, Acting City Manager
SUBJECT: Resolution to Adopt Job Description for Police Commander and Update Salary Schedule
BACKGROUND
The Police Department has identified a need for a new Police Commander Position to enhance leadership capacity, improve operational efficiency and to provide a greater quality of public safety services. The need for increasing community safety needs necessitates this additional leadership role. The main role of this position is to improve leadership and oversight within the department.
The legalization of cannabis under Proposition 64 has provided new challenges for law enforcement. While the legal cannabis industry contributes positivity to the local economy, it also requires stringent enforcement and regulation to ensure compliance with state and local laws. The proposed Police Commander position will focus on enhancing enforcement effort and maintain public safety.
Separately, exhibit “B” to the above referenced resolution is the updated portion of the City’s salary schedule to provide the new steps for the Police Commander position. The California Public Employees’ Retirement System requires by regulation that all member agencies publish a salary schedule detailing all salary details for all authorized positions. This document ensures regulatory compliance by publishing the salary range for the Police Commander position.
FISCAL IMPACT
The new position will be funded 75 percent of the position salary and associated cost will be funded from prop 64 allocations, which is designed for public safety enhancement and community. The remaining 25 percent will be covered by the city’s general fund, reinforcing the city’s commitment to the public safety and compliance.
RECOMMENDATION
Staff recommends that the City Council: take action to approve the resolution as outlined in this report.

COUNCIL AGENDA ITEM
Council Meeting November 25, 2024
PREPARED BY: Latisha Lamberth, Acting City Manager
SUBJECT: Amendment to Include Holidays for the Director of Public Safety
BACKGROUND
The Director of Public Safety plays a crucial role in maintaining the safety and security of our community. Currently, the employment agreement for this position does not include paid holidays, which is inconsistent with the benefits provided to other employees in equivalent classifications.
This discrepancy can affect morale and employee satisfaction. To address this inconsistency, it is proposed that the employment agreement for the Director of Public Safety be amended to include the same paid holidays as other employees in this classification. This amendment aims to ensure fair treatment and maintain competitive employment terms. A review of employment agreements for similar roles within our organization and comparable organizations indicates that including paid holidays is a standard benefit. Aligning the Director of Public Safety's benefits with these standards is essential for maintaining equity and competitiveness.
FISCAL IMPACT
The financial impact of this amendment is expected to be minimal. The cost of providing paid holidays is a standard component of employee benefits and is already accounted for in the budget for similar positions.
RECOMMENDATION
Staff recommends that the City Council: take action to approve the amended agreement for Director of Public Safety.
1 AMENDMENT TO THE DIRECTOR OF PUBLIC SAFETY
EMPLOYMENT AGREEMENT
This Amendment to the Director of Public Safety Employment Agreement (“Amendment”) is entered into as of November 25, 2024, between the City of California City (“City”), a California municipal corporation and general law city, and Dr. Justin Vincent (“Employee”), an individual. Employee and the CITY may be individually described as “Party” or jointly described as the “Parties.” In consideration of the mutual promises and agreements set forth below, the Parties agree as follows:
RECITALS
A. WHEREAS, on November 18, 2024, the Parties entered into the Employment Agreement for the Position of Director of Public Safety (“Agreement”), wherein the City employed Employee for the position of Director of Public Safety effective November 18, 2024;
B. WHEREAS, Employee, upon closer review to the Agreement, noticed that he is not entitled to receive holiday pay under the Agreement. However, holiday pay is provided to all City employees, and the Parties agree that not including a holiday pay provision in the Agreement, consistent with the same manner as provided to other at-will management employees, was an oversight; and
C. WHEREAS, the Parties now wish to cure that oversight and also correct a numbering duplication in section 4 of the Agreement through this Amendment.
NOW, THEREFORE, in consideration of the promises herein, the Parties agree as follows:
OPERATIVE PROVISIONS
1. Section “4.0 Benefits” of the Agreement is amended to renumber the headings for subsections “4.9 Firearms/Holster reimbursement” through “4.16 Personal Liability Insurance” as follows:
“4.10 Firearms/Holster reimbursement; 4.11 Personal Retention of Memorabilia; 4.12 Incidental Expenses; 4.13 Certification Reimbursement;
4.14 Training; 4.15 Indemnification; 4.16 Bonds; 4.17 Personal Liability Insurance.”
2. Section “4.0 Benefits” of the Agreement is amended to add subsection “4.18 Holidays” as follows:
“4.18 Holidays
2 Employee shall receive paid City holidays in the same manner as other atwill management employees and such hours shall not be deducted from any leave bank.”
3. Except as specifically modified and amended in this Amendment, the Agreement remains in full force and effect and binding upon the Parties.
4. Effective Date. This Amendment shall be effective upon execution by the Parties.
IN WITNESS WHEREOF, the Parties have executed this Amendment.
