In preparation for this, the City is in the early stages of developing a comprehensive Request for Proposals (RFP) to solicit qualified consultants to assist in updating the Plan. The RFP was released to the public on May 1 at 12 p.m. and has been extended to expire on August 1 at 5 p.m.
2. Housing Element Update: The City has published the Second Draft Housing Element on its website and previously accepted public comments through July 18, 2025. COUNCIL AGENDA ITEM
August 12, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Victor M. Ponto, City Attorney
REVIEWED BY: Chistopher Lopez, City Manager
SUBJECT: DISCUSS THE CITY COUNCIL SEAT VACATED BY ELECTED MAYOR
PRO TEM JESSE HIGHTOWER AND ELECTED COUNCILMEMBER MICHAEL
KULIKOFF AND TAKE ACTION APPOINTING TWO NEW COUNCILMEMBERS TO
THE CITY COUNCIL
BACKGROUND: Councilmember Michael Kulikoff and Mayor Pro Tem Jesse Hightower were elected to serve a four (4) year term as City Councilmembers ("Councilmembers") in the November 2022 and 2024 general elections, respectively. At the July 8, 2025 Council Meeting, Councilmember Michael Kulikoff resigned, and on July 10, 2025 Mayor ProTem Jesse Hightower resigned. Due to the resignations, there are two vacancies on the City Council. Per the Government Code, the City Council must fill the vacancy either by appointment or by calling a special election by September 6, 2025.
RECOMMENDATION: It is recommended that the Council discuss, interview, and appoint two council members to the vacant seats.
LEGAL FRAMEWORK: California Government Code Section 36512 describes the actions to be taken in connection with a vacancy in an office. It states that if a vacancy occurs in an elective office the council shall, within 60 days from the commencement of the vacancy, either fill the vacancy by appointment or call a special election to fill the vacancy. If the council fills the vacancy by appointment, and the vacancy occurs within the first half of the term and at least 130 days prior to the next general election, the person shall hold office until the next general election, where the position will be up for election again and filled for the remainder of the term.
Therefore, the persons appointed to fill the seats will hold them until November 2026.
If the City Council chooses to call a special election to fill the vacancy, it must do so within sixty (60) days of the vacancy, that is, no later than September 6, 2025. Additionally, "the special election shall be held on the next regularly established election date not less than 114 days from the call of the special election.” In other words, the special election must be held: (1) on a regularly established election date pursuant to Elections Code section 1000, and (2) at least 114 days must elapse between the date the election is called and when it is held. Given the application of Government Code Section 36512 and related timing requirements, the special election would be held in April of 2026.
CITY OF CALIFORNIA CITY 08.13.2025 Page 18 of 247
DISCUSSION:
Consistent with Government Code section 36512, the City Council has sixty (60) days from the commencement of the vacancy, which occurred on July 8, 2025, to do the following:
1. Appoint someone to fill the vacancy; or
2. Call a special election.
Until such time the vacancies are filled, the effect of the vacancy on the City Council is such that the City's legislative body will be reduced from a five-person body to a three-person body.
A. City Council Appointment
The City Council has discretion to determine the process by which to fill a vacant City Council seat by appointment. Some options may include the following:
1. City Council direct appointment;
2. Accepting nominations and appointing someone from that process; or
3. Initiating an open call for applications to all eligible persons within the City.
There are no statutory requirements that define a specific process for how the City Council may decide to appoint an individual to fill the vacancy. The City Council has discretion to determine how it would like to proceed with the appointment process, should it elect to follow that path to fill the vacancy. The City Council has the discretion to determine how the City accepts applications and whether a specific number of applications must be received.
The City Council may directly appoint an individual to the vacancy without accepting applications. However, it is common in such situations for a city council to notice the vacancy and solicit applications from interested parties. The city council then reviews the applications and selects an individual to fill the vacancy by majority vote. If the City Council elects to interview applicants, it must be done at a public meeting, although the meeting can be held at any time, subject to any applicable requirements under the Ralph M. Brown Act. Filling the City Council vacancy is not a permitted closed session discussion or decision. The City Council must appoint a person who is at least 18 years old, a registered voter, and a resident of the City.
Previous Council Direction
At the July 14, 2025 Special Meeting of the Mayor and City Council, the Mayor and Council directed that the City undertake an application process and allow interested residents to apply for the two available seats.
Timeline for Applications

WHAT DO YOU FEEL ARE YOUR MOST IMPORTANT QUALIFICATIONS FOR APPOINTMENT TO THE CITY COUNCIL?
CITY OF CALIFORNIA CITY 08.13.2025 Page 77 of 247
The ability to see things in a way which others tend to overlook. A common vision for my community that I presume, local government leaders share. The potential for economic growth and the strong future for Cal City is most promising with dedicated and responsible leadership.
(Attach additional pages as necessary.)
WHAT DO YOU HOPE TO ACCOMPLISH WHILE A PART OF THE CITY COUNCIL? Bringing moral values in decision making in order to achieve a strong economic future and a safe community, with less crime, and more family involvement. Providing more business opportunities, retail stores and food establishments.
WHAT PROBLEMS, ISSUES, OR CONCERNS DO YOU SEE FACING THE CITY
OF CALIFORNIA CITY AND HOW WOULD YOU PROPOSE THEY BE
ADDRESSED?
The city has struggled through financial difficulties in the recent past. We must find new ways to increase revenue. Bringing back more festivities to the park. Maybe, opening up the park lake for paddle boats, or light shows on the water, movies in the park, community picnic events for a small fee, and advertise recreational activities at a broad scale to bring in more guests from our neighboring communities. Advertising our off road activities in the desert more broadly. Advertisement for lodging and gas from the 58 and 14 fwy so we bring in travelers who spend money at our businesses which in turn brings in more local tax revenue. These are just a few ideas, but the potential is there. It’s important to apply more effort in order to fullfill the long term goals.

COUNCIL AGENDA ITEM
August 12, 2025
TO:
FROM:
SUBJECT:
Mayor and City Council
Christopher Lopez, City Manager- Joe Barragan, Public Works Director A Resolution of the Mayor and the City Council of the City of California City approving the award of the contract to Rain Deck, LLC. for the equipment and installation services associated with the commercial recirculating Splash Pad Project with a total value of $397,889.70
BACKGROUND:
On March 11, 2021, the American Rescue Plan Act was signed into law, and established the Coronavirus State Fiscal Recovery Fund and Coronavirus Local Fiscal Recovery Fund, which together make up the Coronavirus State and Local Fiscal Recovery Funds (“SLFRF”) program. The City of California City received allocation of $3,396,463 from American Rescue Plan Act (ARPA).
The Splash Park and Skate Park projects qualify under Title I of the Housing and Community Development Act of 1974, meeting SLRF fund guidelines. The skate park is finished; construction on the splash pad restroom, flatwork, and lighting will be done by July 30, 2025.
To ensure the project is fully operational, the city must advance to phase two, which involves procuring splash pad equipment and coordinating its installation by specialized contractors. On February 18, 2025, the City issued a Request for Proposals (RFP) to solicit bids for this component; Rain Deck, LLC was the sole respondent to the RFP.
Splash Pad Features $169,218.00
Construction and installation $228,671.70
TOTAL CONTRACT AMOUNT $397.889.70
This project will contribute to the beautification of this area, and it will be a focal point for the many visitors the city attracts throughout the year.
Staff also recommend approving a $23,873.38 (6%) construction contingency for unforeseen work during the project. This amount is not to be exceeded without additional Council authorization. Along with awarding the Construction contract, staff will use an additional $15,915.60 for a task order with BHT Engineering, Inc. for Construction Management, Staking, and Geotechnical services. This ensures that the city receives work meeting the required standards. BHT and its geotechnical subcontractor will provide ongoing inspection, materials sampling, and testing under the City's Quality Assurance Program to confirm compliance with contract plans and specifications.

Client agrees to pay an additional sum for these additional items and/or any associated changes as an additional cost to the contract price.
Grading and drainage beyond the splash pad area is the responsibility of the Client.
Excess soil will NOT be removed and will remain on the property unless otherwise specified in writing by Client before start of excavation.
With the exception of minor grading for the splash pad, Contractor is not responsible for supplying fill dirt or providing excessive grading unless specified in the contract.
Contractor agrees to construct the splash pad diligently, but Contractor shall not be responsible for delays or damages caused by failure to perform work or furnish materials or equipment due to acts of God, conditions created by threat or of inclement weather, war, riot, or other civil disturbance, strike, government prohibition, delays caused by Client, non issuance of all required permits affecting the splash pad, availability of construction material, or other reasons beyond its control.
Requests for any changes or additions to this agreement desired by the Client shall be made in writing at a price as mutually agreed and signed by both parties and shall become part of this agreement.
Contractor shall have the right to stop work and keep the job idle if payments are not made when due.
Contractor assumes no responsibility or liability for work performed by the Client, equipment or materials supplied by the Client.
In the event the payments required hereunder are not paid in accordance with the requirements of this agreement, a credit service charge of one and one-half percent (1-1/2%) per month, which is eighteen percent (18%) corresponding annual percentage rate, will be applied from the date such payment becomes due.
In the event Contractor shall be required to employ an attorney to enforce collection of any payment required to be made by Client to Contractor under this agreement, Client agrees to pay to Contractor a reasonable amount for attorney’s fees although legal action either was not instituted or not completed to judgment.
This agreement together with the signed Splash Zone Proposal constitutes the full agreement between the parties. The parties are not bound by any other statements or representations or oral expression by any agent or person purporting to act for or on behalf of either party.
Should any part on this agreement be declared invalid for any reason, such decision shall not affect the validity of any remaining portions and shall remain in force and affect as if the invalid portion had been eliminated.
Client agrees to allow Contractor to place a Splash Zone sign on Clients property during construction and use pictures of splash pad taken before, during and after construction in marketing and other material unless otherwise specified in writing.
When the splash pad is completed (surface material applied and start-up orientation) this contract shall have been completed.

ChlorKing’s Sentry Aqua Guard PVC-CR ultraviolet light systems are leading the way to better, safer water. Their unique, forwardthinking design employs high output amalgam technology for better chloramine control and inactivation of chlorine resistant bacteria. Sentry Aqua Guard systems are designed for commercial pools and spa’s, and they pay for themsleves through lower cost of operation and a longer lasting system.
Custom high output amalgam lamps used in the SAG PVC series are proven to be the most e!ective lamps used in the aquatic industry. Low heat generation allows these UV system to operate in a variety of aquatic facilities and not destroy free chlorine , while still reducing chloramines for indoor air quality enhancement.
LONGEST LAMP LIFE
Our 13,000 hour amalgam lamps sets the standard for the aquatic industry, with cost e!ective, easy to replace lamps.
SECONDARY DISINFECTION
SAG systems have been third party validated by NSF to con"rm a minimum inactivation equivalent of 3 log (99.9%) cryptosporid -ium parvum in accordance with NSF 50 and the US EPA UV DGM.
SAG systems have also met the requirements of NSF/ANSI 50, Anex H.1 Disinfection e#cacy for a minimum of a 3 log (99.9%) reduc -tion of enterococcus faecium and pseudomanos aeruginosa.

leads the way in commercial saline chlorination and is consistently seeking new frontiers in sanitizing solutions including ultraviolet light technology and their NEXGEN®
pH onsite chlorine generators. These environmentally friendly solutions are changing the way we treat H2
O.

All communication should be directed to him.

SPLASH ZONE AND THE LOCAL ECONOMY
Why Choose Splash Zone?
As the only company in the United States specializing exclusively in installing splash pads, Splash Zone is uniquely positioned to competitively bid on projects nationwide. We understand that local towns and cities often prefer to use local contractors, which makes perfect sense. We agree that municipalities should prioritize what is best for their community. Here’s how choosing Splash Zone benefits your local community:
1. Cost Efficiency
- Our specialization in splash pad installations allows us to operate with exceptional efficiency. Bulk supplier purchasing enables us to be financially competitive, saving taxpayers money while providing a high-quality product for community enjoyment.
2. Supporting Local Suppliers
- We work with local suppliers for plumbing supplies, fittings, and other project materials. All concrete is sourced from local plants, and equipment rentals such as tractors and jackhammers are also done locally whenever possible.
3. Engaging Local Contractors
- For forming and finishing work on splash pad surfaces, we employ local contractors, ensuring that local expertise and labor are utilized.
4. Boosting Local Economy
- During construction, our crew stays at local lodging establishments and dines at local restaurants. This additional expense, included in our project logistics, directly benefits the local economy.
We appreciate the opportunity to bid on this project and are confident that your residents will love the new splash pad addition. Regardless of who is chosen as the successful bidder, we thank you for considering Splash Zone.
Sincerely,
The Splash Zone Team
