CITY COUNCIL AGENDA ITEM
December 22, 2025
TO: Honorable Mayor and Members of the City Council
FROM: Victor Ponto, City Attorney and Christy Marie Lopez, Assistant City Attorney SUBJECT: Consideration of Resolutions Calling a Special Election For Filling a Vacancy on the City Council

BACKGROUND
Councilmember Michael Hurles was elected to serve a four (4) year term as a City Councilmember in the November 2024 general election, On October 11, 2025, Councilmember Hurles resigned. Due to his resignation, there is a vacancy on the City Council. Per the Government Code, the City Council must fill the vacancy by calling a special election.

DISCUSSION
California Government Code Section 36512 describes the actions to be taken in connection with a vacancy in an office. It states that if a vacancy occurs in an elective office, the Council shall either fill the vacancy by appointment or call a special election to fill the vacancy. However, in the event that the appointment would result in a majority of the members serving on the Council having been appointed, the City Council call a special election. (Government Code Section 36512(d)(1).)
It should be noted that Government Code Section 36512 provides when the City fills the vacancy by special election, the “person elected to fill a vacancy holds office for the unexpired term of the former incumbent.” (Government Code Section 36512(b)(1).) Councilmember Hurles’ term would have expired in January of 2029.

Based on the foregoing, it is recommended that the City Council adopt the following proposed resolutions: (1) Resolution calling the Special Election to fill the vacancy and to be held on June 2, 2026; (2) Resolution requesting that this Special Election be consolidated with the Statewide Primary Election being held by the County on June 2, 2026; (3) Resolution concerning procedures for candidate statements; and (4) Resolution concerning procedures in the case of a tie vote.

Page 27 of 83 ends

RECOMMENDATION
Adopt resolutions calling for a special municipal election to fill the vacancy on the City Council and authorize the City Clerk as follows:

1. Resolution calling the Special Election to fill the vacancy to be held on June 2, 2026; and

2. Resolution requesting that this Special Election be consolidated with the Statewide Primary Election being held by the County on June 2, 2026; and

3. Resolution concerning procedures for candidate statements; and

4. Resolution concerning procedures in the case of a tie vote; and

5. Authorize the City Clerk to finalize and make such modifications to these Resolutions as may be required by Kern County and applicable law, subject to the City Attorney’s approval as to form.

FISCAL IMPACT
The approximate costs for a special election to fill the vacancy that is consolidated with the Statewide Primary Election held by the County on June 2, 2026 is approximately $25,000 including printing costs.

ENVIRONMENTAL REVIEW
The adoption of the proposed resolutions are exempt from the California Environmental Quality Act (“CEQA”) because it does not qualify as a “project” pursuant to Public Resource Code section 21065 and CEQA Guidelines Sections 15320, 15378 and 15061(b)(3) since it can be seen with certainty that there is no possibility that the City’s action would cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment.

C. The City Clerk, or their designee, shall then draw from the container one piece of paper for the particular office to be filled by the candidates who have tied.

D. The candidate(s) whose name(s) appear(s) upon the drawn piece(s) of paper shall be deemed elected.

E. This process shall be repeated for each particular office to be filled at the June 2, 2026, Special Municipal Election.

SUBJECT: A Resolution Adopting a Job Description for the Position of Deputy City Manager/City Clerk
BACKGROUND:

After experiencing a vacancy in the City Clerk’s Office in 2024, staff has advertised the position numerous times. With such a critical function provided through a professional City Clerk, the city has been inundated with a significant amount of Public Records Act (PRA) requests requiring the City to provide responses to requests for information. This has resulted in the City Manager’s Office involvement in gathering documents to be provided to various individuals who have requested records.

Additionally, there is a need to have additional help in the City Manager’s Office for higher level responsibilities. Currently, there is no additional staff help provided to the City Manager’s Office.

This position will help alleviate the workload in the City Manager’s Office and will also ensure that the City has a City Clerk that can focus on the needs of the organization.

The attached job description has been prepared in consultation with the Attorney’s Office to ensure all mandated requirements under the law are incorporated into the job description. This position’s salary range is aligned with the Director of Human Resources and will be updated in a separate agenda item.

It is recommended that the Council adopt the resolution adopting a job description for the position of Deputy City Manager/City Clerk.
