PROCLAMATION
Proclaiming February 2026 as Safe Surrender Baby Awareness Month in California City
WHEREAS, the City of California City proclaims February 2026 as Safely Surrendered Baby Awareness Month and advises all community members of planned events to highlight the importance of the Safely Surrendered Baby Law; and
WHEREAS, the Safely Surrendered Baby Law responds to the increasing number of newborn infant deaths due to abonnement in unsafe locations. First created in January 2001, the law’s intent is to save the lives of newborn infants at risk of abandonment by encouraging parents or persons with lawful custody to safely surrender the infant within 72 hours of birth, with no questions asked.
WHEREAS, since 2006, Kern County has had 105 babies safely surrendered; and WHEREAS, in Kern County, a newborn baby can be safely surrendered into the hands of any hospital emergency room or Fire Station staff. The Safely Surrendered Baby Coalition, under the coordination of the Department of Human Services, works to educate Kern County residents about this important law; and
WHEREAS, the February 2026 Awareness Campaign will alert the community about the Safely Surrendered Baby Law as a much better option than abandoning a baby; NOW, THEREFORE, I, Mayor Marquette Hawkins, on behalf of the City Council of the City of California City do hereby proclaim February 2026, as SAFELY SURRENDERED BABY AWARENESS MONTH.

CITY COUNCIL AGENDA ITEM
February 24, 2026
TO: Mayor and City Council
FROM: Joe Barragan, Public Works Director
SUBJECT: A Public Hearing to Adopt A Resolution of the City Council of the City of California City Determining that California City has No Unmet Transit Needs That Cannot Reasonably Be Met by the Existing System
BACKGROUND/ DISCUSSION:
The Transportation Development Act of 1971 (“TDA”) (Pub. Util. Code, § 99200 et seq.) provides two funding sources:
1. Local Transportation Fund (LTF) which is derived from a ¼ cent of the general sales tax collected statewide.
2. State Transit Assistance fund (STA), which is derived from the statewide sales tax on gasoline and diesel fuel.
The TDA funds a wide variety of transportation programs, including planning and program activities, pedestrian and bicycle facilities, community transit services, public transportation, and bus and rail projects.
In order to qualify for funding under TDA, a transit claimant must maintain a ratio of fare revenues to operating cost at least equal to the ratio it had during 1978/79, or 10 percent, if the claimant is in a non-urbanized area, whichever is greater.
Public participation is a key component of TDA. Public meetings are held in eligible counties to discuss transportation needs and hear concerns.
In particular, Public Utilities Code section 99401.5, a provision of the TDA, requires at least one public hearing to determine to identify unmet transit needs within the City and those needs that are reasonable to meet.
The proposed Resolution would adopt a finding by the City Council that the City has no unmet transit needs that are not reasonably met by the existing system.
PH 1
FISCAL IMPACT:
The current TDA/LTF fund balance for California City is being verified and will be provided as soon as it is available. The City will be updating its backlog of TDA audit submissions to KernCOG as part of the fiscal year 2024-25 audit process.
RECOMMENDATION:
Conduct the Unmet Transit Needs public hearing and adopt a resolution determining that the City has no unmet transit needs that cannot reasonably be met by the existing system.
ENVIRONMENTAL IMPACT:
None.

WHEREAS, in addition to annually holding its own public hearing (as required by the TDA), KCOG requires all agencies intending to file claims to use TDA funds for street and road projects to hold a public hearing to identify transit needs within their respective jurisdictions; and
WHEREAS, on February 24, 2026, the City Council of the City (“City Council”) held a duly noticed public hearing at which all persons desiring to comment on transit needs were given the opportunity to address, and were heard by the City Council; and

CITY COUNCIL AGENDA ITEM
February 24, 2026
TO: Mayor and City Council
FROM: Joe Barragan, Public Works Director
SUBJECT: A Resolution of the City Council of the City of California City Authorizing Acceptance of Completed Work by Zenitram Inc. DBA ANM Construction for Splash Park Phase 1
BACKGROUND/DISCUSSION:
On March 11, 2021, the American Rescue Plan Act was signed into law, and established the Coronavirus State Fiscal Recovery Fund and Coronavirus Local Fiscal Recovery Fund, which together make up the Coronavirus State and Local Fiscal Recovery Funds (“SLFRF”) program. The City of California City received allocation of $3,396,463 from American Rescue Plan Act (ARPA).
The Splash Park Phase 1 project is eligible under Title I of the Housing and Community Development Act of 1974 which is part of the statutory eligible uses of the SLRF award funds guidelines.
On November 12, 2024, Zenitram Inc., doing business as ANM Construction (“ANM”), received a contract from the City Council valued at $824,241.00. The final project cost amounted to $857,921.84, reflecting a $33,680.84 increase because adjustments to the main electrical trench were needed to avoid the Skate Park. This change represents a 4% rise over the original contract, which is still within the 10% contingency limit previously approved by the City Council.
On December 5, 2025, the Engineering Department reviewed the project and informed Public Works that everything meets the required plans and specifications.
The proposed Resolution would authorize acceptance of the completed work on the Project, direct the City Clerk to file a Notice of Completion for the Project with the Kern County Recorder, and authorize payment of the retention funds owed to ANM.
FISCAL IMPACT: The proposed Resolution would result in the expenditure of a total of $857,921.84 in ARPA funds.
Funding: ARPA Funds $ 857,921.84

COUNCIL AGENDA ITEM
February 24, 2026
TO: Mayor and City Council
FROM: Sean Grayson, Interim City Manager
SUBJECT: Fiscal Distress Update and Authorization to Implement and Employee Early Retirement Incentive Program
BACKGROUND/ DISCUSSION:
On January 27, 2026, the City Council determined that the City was experiencing fiscal distress.
They adopted a modified Resolution 26-3207 and gave direction to the City Manager to reduce overall general fund expenditure authorization for fiscal year 2025/26 by $1,200,000. On February 10, 2026, the City Council approved the City Manager’s proposed budget reduction including departmental reductions, contract reductions, and position layoffs. The approved recommendation included an Employee Early Retirement Incentive Program (program) to return to the City Council for approval.
The proposed program is modeled after similar programs enacted by other California cities experiencing financial distress. It is simple in concept and easy to apply. Qualifying employees would be eligible for a lump sum payment of $25,000 if they voluntarily chose to separate from employment with the City. It would be applicable to all current employees that meet the following criteria:
• A regular, full-time employee of the City.
• Eligible by age for retirement from CalPERS (minimum age varies by plan).
The proposed program would be capped at twelve (12) total participants on a first come, first served basis. The maximum total cost to the City would be $305,000 inclusive of the lump sum payments and related employer obligated employment taxes. Employees would be required to submit a voluntary separation agreement no later than April 15, 2026.
This would create a one time financial impact with salary savings in future years by either not replacing the retiring employee or by replacing the retiring employee with a lower cost position or classification.
FISCAL IMPACT:
The fiscal impact of this action would be a maximum of $305,000 in fiscal year 2025/26 using general fund balance. No expenditure of reserve funds ARE NOT authorized in this action.

RECOMMENDATION:
Staff recommends that the City Council approve the Employee Early Retirement Incentive Program and provide any needed direction

1 COUNCIL AGENDA ITEM February 24, 2026
TO: Mayor and City Council
FROM: Joe D. Barragan, Public Works Director
SUBJECT: A Resolution to Accept the Bid from J.L. Plank Inc. Dba Cen-Cal Construction for the New Bus Turnout Project at the California City Blvd and Yerba Blvd.
Intersection, with a Contract Sum of $184,481.00, to Authorize Contingency and Project Management Costs and to Authorize the City Manager to Execute the Construction Agreement
BACKGROUND/ DISCUSSION:
The Transit and Intercity Rail Capital Program (TIRCP) is a major California state funding program that pays for rail and transit infrastructure projects aimed at reducing greenhouse gas emissions, improving mobility, and expanding passenger rail service.
The funding comes from Senate Bill No. 125, which is a California law that provides large, formula-based funding to public transit agencies to stabilize and modernize transit systems after COVID ridership losses.
The TIRCP is overseen by California State Transportation Agency (CalSTA) and implemented by Kern Council of Governments in partnership with local agencies.
The City of California City will receive approximately $380,000 from TIRCP for the new bus turnout project at the California City Boulevard and Yerba Boulevard intersection (the “Project”) in Fiscal Year 2023-2024.
This Project entails the removal of existing pavement, curbs, gutters, sidewalks, and medians within the designated turnout limits, followed by the construction of a bus turnout and associated roadway. The scope of work for the Project also encompasses key improvements in areas adjacent to the High School to enhance pedestrian safety.
On February 5, 2026, at 2:00 PM, the City Clerk opened seven sealed bids for the New Bus Turnout Project.
The following is the tabulation of the bids:
No. Bidder Total Bid
1 Cen-Cal Construction $184,481.00
2 Griffith Company $187,443.00
2 3 Burtch Construction $226,419.00
4 Advance Engineering $226,419.00
5 R.C. Becker Inc $229,325.66
6 Bowman Asphalt $232,250.00
7 Coast Construction $279,030.18
The City Engineer (BHT Engineering, Inc.) has approved J.L. Plank, Incorporated dba Cen-Cal Construction (“Cen-Cal”) as the lowest responsible bidder. The contractor has twenty working days to finish the project.
In addition to the bid award, City staff also recommend approval of $18,448.00 (10%) for construction contingency and $27,672.00 (15%) for project management, materials sampling, and testing. These amounts are "not to exceed" without further Council approval. Contingency funds cover unforeseen construction needs.
The proposed Resolution would accept the bid by Cen-Cal, authorize the above-specified contingency and Project management costs, and authorize the City Manager to execute a construction agreement with CenCal in a form approved by the City Attorney.
FISCAL IMPACT:
The total Project costs, including recommended contingency and Project management costs, will be $230,601.00 and funding for the Project will come from TIRCP, as further set forth below.
Costs: Bid Construction Total: $ 184,481.00
Contingency 10%: $ 18,448.00
Construction Management and Materials
Sampling & Testing 15%: $ 27,672.00
Total Construction Phase Cost: $ 230,601.00

COUNCIL AGENDA ITEM
February 24, 2026
TO: Mayor and City Council
FROM: Sean Grayson, Interim City Manager
SUBJECT: Approval of Clean-Up Activities at Central Park Including the Central Park Lake to be Performed by Volunteer Forces
Provide by Mr. Leland Krelle of West Coast Realty
BACKGROUND/ DISCUSSION:
The Mayor received communication from Mr. Leland Krelle the Broker/Owner of West Coast Realty of Mr. Krelle’s interest in using personnel from his company to complete a clean-up of Central Park including cutting the reeds within the lake. Specifically, Mr. Krelle proposes to use her personnel to operate the City owned reed cutter boat as part of the effort. Mr. Krelle has indicated he has training and experience in the operation of the boat. Staff confirmed Mr. Krelle’s offer and seeks authorization from the City Council to approve the activity. Staff will work with the City Attorney’s Office to develop an agreement that includes authorization to operate the City owned boat as well as standard hold-harmless language for volunteer activities.
FISCAL IMPACT:
There is no direct financial impact with this action. The City anticipates less than $100 in indirect costs from the activity related to fuel and other operations expenses for the boat.
RECOMMENDATION:
Staff recommends that the City Council approve the activity in concept and authorize the Interim City Manager to execute any needed documents as approved by the City Attorney.
