21 CALIFORNIA CITY STATEMENT IN REGARD TO THE OUTCOME OF A RECENTLY
COMPLETED ADMINISTRATIVE INVESTIGATIONS CALIFORNIA CITY IN
RESPONSE TO THE TITAN REPORT IN THE PRESS AND ANY OTHER MEDIA
PLATFORMS
CALIFORNIA CITY – At the August 18, 2026, special City Council meeting, City Manager Sean Grayson provided the following Statement in Regard to the Outcome of Recently Completed Administrative Investigations: An independent investigator was hired to investigate allegations of misconduct arising from a recorded conversation between Mayor Hawkins and Councilmember Smith that occurred in December of 2024, as well as other alleged misconduct. The investigation has concluded, and the investigator’s report did not make any findings of misconduct against Mayor Hawkins or Councilmember Smith. The City cannot comment on the details of personnel matters or other confidential processes and will have no further comment on the topic at this time.
Considering the recent release of the Titan Report in the Press and other media platforms:
The city needs to respond to the report. Subsequent investigations found an illegal recording and incorrect information in the report, making it inaccurate. To be clear, the City Council was found to have done nothing wrong. Appropriate staff have reviewed the report. Council was found to have done no wrongdoing, and subsequent investigations were concluded. Mayor and Council, I apologize for the reiteration, however I wanted to be clear for the record and note that the City cannot comment on further details of personnel matters or confidential processes and will have no further comment on the topic at this time.

SUBJECT: Crack Seal Projects Update
BACKGROUND/ DISCUSSION/ UPDATE:
At the August 8, 2026, City Council Regular Meeting, the City Council requested, by consensus, an update on road improvements and scheduled repair areas.
Street crews follow a schedule of dates and target areas that have been reported and/or identified.
Street crews seal cracks in the roads every Tuesday from 6:00 a.m. to 11:00 a.m. The crew is currently focusing on Redwood from Neuralia to Hacienda. The next scheduled road improvements are continuing on Neuralia.
Road repair and maintenance was temporarily delayed due to equipment failure. The crew could not seal cracks because the trailer's burners were not working. The trailer is under warranty, and the manufacturer repaired it; progress is underway.
ATTACHMENTS:
1. Updated schedule of dates, days, and costs to complete crack sealing on the streets on the current list.

53 COUNCIL AGENDA ITEM
September 22, 2026
TO: Mayor and City Council
FROM: Joe D. Barragan, Public Works Director
SUBJECT: Accept the bid from Kirk Construction Inc. for the Rancho Tract Water Mains Replacement Project, with a contract sum of $891,523.44, and to authorize the City Manager to sign the construction agreement.
BACKGROUND/ DISCUSSION:
Rancho Tract aging mains have experienced repeated leaks and failures, causing water loss, service disruptions, and higher maintenance costs. The proposed project will replace 6,865 feet of deteriorated water mains, 11 fire hydrants, and service laterals within the project area. Replacing this infrastructure will improve system reliability, reduce water waste, strengthen fire protection, and advance the City’s long-term water conservation and infrastructure management goals. EPA Water Infrastructure Community Grant funding awarded to the City will cover construction costs, limiting the financial impact on local ratepayers while addressing critical water system deficiencies.
On August 27, 2026, at 2:00 PM, the City Clerk opened eight sealed bids for the Rancho Tract Water Mains Replacement Project.
The following is the tabulation of the four lowest bids:
No. Bidder Total Bid
1 Kirk Construction Inc $891,523.44
2 Sandex Construction $903,586.50
3 Aventus NV $961,211.00
4 WM Lyles $992,540.00
The City Engineer, BHT Engineering, Inc., reviewed the bids and confirmed Kirk Construction as the lowest responsive, responsible bidder. The contractor must complete the project within 90 working days.

63 Section 1: Executive Summary
This Construction Summary Report documents the major activities associated with the removal of two underground aviation-fuel storage tanks at the California City Airport in California City, California. The purpose of the report is to provide a chronological photographic record of the work performed and the observable site conditions during construction.
The documented work included pre-construction site assessment, demolition of the existing concrete pavement, excavation and exposure of the underground tanks, tank cleaning and preparation, tank removal, placement and compaction of backfill, and restoration of the disturbed area with concrete. Photographs of each phase are included to illustrate the progression of construction from the original site condition through final surface restoration. 64 Section 2: Construction Activities
1. Pre- Construction Conditions: The project area was photographed before construction began to document the existing pavement, aboveground fuel-system components, structures, and surrounding site conditions. This documentation established a visual record of the site before disturbance.
2. Demolition: The concrete pavement above and surrounding underground storage tanks were demolished and removed using hydraulic excavators and breakers. This work provided access to the underlying soil and allowed excavation around the tanks to begin.
Figure 2.2: Hydraulic breaker Figure 2.3: Hydraulic excavator Figure 2.1: Pre-construction condition of the

As defined by the California City Municipal Code (“CCMC”), the “SDI Advisory Committee” means the committee created to advise the City on compliance with this Chapter.” (CCMC §§ 1-2.07(x) and 9-6.102(e).) There is no language in the CCMC that vests the Committee with any duty or power, other than review of proposals, to make certain requests, and to provide advice to the Council relating to SDI matters.
III. Duties and Powers of the Committee
The Committee is governed by Sections 2-2.601-604 of the CCMC. Section 2-2.602(b) provides:
“The SDI Advisory Committee shall monitor the investment and expenditure of money in the SDI Fund as set forth in this chapter. The SDI Advisory Committee may consult with the City on land use issues affecting SDI Tracts …. The SDI Advisory Committee may request the city manager engage services of consultants to assist the SDI Advisory Committee in connection with its responsibilities defined herein. The City Manager shall act on this request within twenty (20) days.” Further, at Section 2-2.602(a), it lists appropriate requests of the Committee:
72 “The SDI Advisory Committee may request the City Council's review of:
(1) The policy for investment of SDI Fund money;
(2) Investment of SDI Fund money;
(3) The annual certification of the money available for maintenance of SDI Improvements;
(4) The decision of the City Council concerning the need for constructing SDI Improvements;
(5 ) Disbursements/expenditures from the SDI Fund;
(6) The hiring of consultants;
(7) Any other matter concerning the investment of the SDI Fund, disbursement from the SDI fund, or the development of or construction of improvements within the SDI tracts.”1
In addition, Section 2-2.603(a) provides guidance to the Committee on when its appropriate to seek judicial intervention which includes:
“(1)To overturn the City Manager's decision on a request for stay; or (2)To overturn the City Council's decision on the merits of the request for review; (3)To determine action or proposed comments to the SDI Agreements or this chapter;
(4)To obtain approval of amendments to this chapter;
(5)To resolve a dispute as between the two members of the SDI Advisory Committee as set forth in section 9-6.401(d).”
CCMC also addresses the Committee’s role when SDI improvements are proposed.
When/if there is a proposed SDI improvement, the City Engineer shall submit the proposal to the Committee and City Manager for review. (CMCC §§3-3.116(c) and 9-6.302(b).) “The SDI Advisory Committee and the City Manager shall evaluate the report of the City Engineer and make recommendations to the City Council concerning the construction of 1 CCMC Section 2-2.602(b) and (c) govern the process for the Committee requests, as well as the review by the City Manager and City Council.
73 the SDI Improvements as part of the annual budget process….” (CMCC §§3-3.116(d) and 9-6.302(c).)
Notably, there is nothing in the CCMC that permits the Committee to request or obtain status reports on City matters or to request access to privileged documents or draft documents.
IV. The Committee must comply with all Public Agency Laws including the Brown Act
The Committee must comply with all public agency laws and can only take action at a publicly noticed meeting wherein both members of the Committee vote to act. Section 2-
2.602(d) provides:
“The SDI Advisory Committee shall comply with laws affecting public agency committees, including conflicts of interest laws and secret meeting laws. At least two affirmative votes are needed for the SDI Advisory Committee to act. …” The California laws that are applicable to the Committee include but are not limited to the Brown Act, Political Reform Act, AB 1234 (ethics training), and Form 700 reporting requirements.
A. General Brown Act Compliance
Not only does the CCMC require compliance with the Brown Act, the Act provides that it applies to legislative bodies which includes “A commission, committee, board, or other body of a local agency, whether permanent or temporary, decision-making or advisory, created by charter, ordinance, resolution, or formal action of a legislative body.” (Government Code Section 54952.) As such, all activities of the Committee and Committee members must comply with the Brown Act. This means that the Committee members shall not discuss any Committee business unless a properly noticed Committee meeting has been agendized and both members are present. The Brown Act requires that at least 72 hours notice of the meeting be provided to the public. 2 Further, the Committee can only discuss and take action on the matters that have been agendized. In the event that the Committee members are discussing Committee business outside of a properly noticed meeting, the Committee members are in violation of the Brown Act and could be subject to criminal penalties. Further, if the Committee members take action outside of a notice meeting, that action can be nullified. 2 For Special Meetings the City must give 24 hours notice to the public. 74 COUNCIL AGENDA ITEM
September 22, 2026
TO: Mayor and City Council
FROM: John Paul Maier, Acting City Manager
SUBJECT: Consideration of a 60-Day Report from Donovan Golf Updating the Actions of the Golf Course Consulting Services Agreement BACKGROUND/ DISCUSSION:
On May 26, 2026, the City Council approved a 90-Day Golf Course Consulting Services agreement with Donovan Golf. The agreement's scope of work includes a 60-day report to the City Council. This action is the 60-day report. Mr. Donovan will provide the attached presentation at the City Council meeting.
On July 14, 2026, the City Council received a 30-day report. Since the previous 30-day report-out, Donovan has worked with staff to implement point-of-sale services at the golf course. The Finance Department contacted the bank, and staff established the point-of-sale process; however, staff identified a new concern: an unstable internet connection, which staff also noted affects the office computers. Technic is scheduled to visit the golf course on September 22, 2026, to assess the clubhouse equipment.
FISCAL IMPACT:
None in this action. The City Council approved the agreement at up to $19,500, and the 2026/27 preliminary budget includes it in the TDS Contracts account #40-4566-630.
RECOMMENDATION:
It is recommended that the City Council receive and file the report and provide any needed directions for the TDS golf course.

Flagged for awareness, not for approval.
General Pump Company previously quoted a full booster pump replacement — FloWise 9HC bowl assembly, column pipe, stainless line shaft, refurbished discharge head, and field installation — at a lump sum of $17,951.82.
That quote has aged. It is included so the Council is aware the underlying issue has been outstanding for some time. It is not part of this authorization request.
Whether a booster replacement is actually needed — and at what price against current market — will be determined by the Rain For Rent diagnostic. Any replacement work would come back as a separate authorization once findings are in hand.

BACKGROUND:
On October 14, 2025, the Mayor made appointments of Councilmembers to various committees, boards, and activities both internal and external to the City. The City Council ratified the Mayor’s appointments.
On July 14, 2026, City Councilmember Shawn Bradley was sworn in, having been elected in a special election in June of 2026. With an additional City Councilmember seated, the Mayor may wish to update the committee appointments.
On September 8, 2026, Mayor Pro Tem requested to bring the report back to provide updates to the Appointments List, and by consensus, the City Council agreed to direct staff to provide a report at a future City Council Meeting.
FISCAL IMPACT:
There is no direct fiscal impact from this action. The dues, fees, and costs for participation on the selected work have been accounted for in the various budgets within the Fiscal Year 2026/27 Preliminary Budget.
RECOMMENDATION:
It is recommended that the Mayor and City Council discuss, appoint, and ratify the appointment of City Councilmembers to serve on committees and boards.
