City Council Meeting
Agenda Report
Agenda Item No. 8
SUBJECT: APPROVAL OF A COST-OF-LIVING ADJUSTMENT AND AN INCREASE

IN THE CAFETERIA PLAN BENEFIT ALLOTMENT FOR

MISCELLANEOUS CITY EMPLOYEES AND FIRE DEPARTMENT

EMPLOYEES AND ADOPTION OF REVISED SALARY SCHEDULES
MEETING DATE: June 20, 2022
PRESENTED BY: Bonnie Johnson, City Manager
RECOMMENDATION: It is recommended that the City Council adopt Resolution No. 2022-27 A Resolution of the City Council of the City of Calimesa, California Approving a Cost-of-Living Adjustment (COLA) and an increase in the Cafeteria Plan benefit allotment for Miscellaneous City Employees and Fire Department Employees and Adopting Revised Salary Schedules.

BACKGROUND AND DISCUSSION: Since Fiscal Year 2018-19, the City of Calimesa has consistently approved annual salary increases for its employees. This has been key to help keep pace with the public agency job market as well as recruit and retain quality people. It is important that, in addition to the opportunity to earn a merit increase on an annual basis, employee salaries be adjusted, as financially practicable, for cost of living and other appropriate adjustments.

As such, the 2022-23 Adopted budget contains a provision for a 3% COLA for all City employees (except the City Manager who is under a separate contract and expected to retire in the Fall). Although the City Council acknowledges that recent CPI increases are much higher than that, since 2018-19, the City has increased Miscellaneous employees’ salary ranges by approximately 16% and Fire Department salary ranges by approximately 29%, exclusive of reclassifications or changes affecting a single position/classification.

In addition, the 2022-23 Adopted budget contains a provision for an increase in the monthly Cafeteria Plan allotment paid by the City toward employee benefits – mainly health benefits. The amount is currently $850 per month which, in most instances, does not cover the employee’s monthly premiums particularly if the employee covers any dependents. Please note that this amount cannot be taken by the employee as compensation (in cash); it MUST be used monthly on an offered benefit. Benefits include choice of health, dental and vision plans, supplemental insurance coverages, a flexible spending account (FSA) that reimburses for out-of-pocket eligible expenses, as well as an option to put allotment in a deferred compensation plan for retirement.

Page 153 of 286 ends

As presented during the recent 2022-23 Budget approval process, the proposed resolution would:

1. Adopt revised salary schedules and implement a 3% COLA on July 2, 2022 (the first day of the first pay period in July) for all City employees and Fire Department employees exclusive of the City Manager, who is under a separate contract.

2. Implement a $100 per employee, per month increase in the City’s contribution to the Cafeteria (Employee Benefit) Plan.

FINANCIAL IMPACT: The approximate annual cost of the 3% COLA for Miscellaneous and Fire employees is approximately $60,000 (before unscheduled Fire Department overtime). In addition, the annual cost of the cafeteria benefit plan allotment increase is $36,000. These amounts total $96,000 and are incorporated in the recently approved 2022-23 Budget.

Agenda Item No. 9
SUBJECT: NINTH AMENDMENT TO AGREEMENT FOR PROFESSIONAL FINANCE

AND ACCOUNTING SERVICES BETWEEN THE CITY OF CALIMESA

AND MUNICIPAL FINANCE OF MERIDIAN ID LLC
MEETING DATE: June 20, 2022
PRESENTED BY: Bonnie Johnson, City Manager
RECOMMENDATION: It is respectfully recommended that the City Council Approve the Ninth Amendment to Agreement for Professional Finance and Accounting Services between the City of Calimesa and Municipal Finance of Meridian Id LLC and authorize the Mayor to execute the Agreement.

BACKGROUND: Dilu De Alwis of Municipal Finance of Meridian ID LLC (the Consultant) has been assisting City staff with finance related tasks and projects for the past 7 fiscal years. The Consultant has 25 years’ experience in municipal finance; 15 of which are as a finance director for a city. Staff is requesting that the agreement be extended to June 30, 2023. The consultant has provided needed support to the City Manager, and in the past year the Finance Director, in the Finance area which has facilitated the City’s timely year-end financial reporting, year-end audit, budget preparation and various other finance related tasks.

This proposed amendment is for the following areas:

1. Extend term to June 30, 2023 with automatic one year renewal if mutually agreeable.

2. Modifying billing rates for 2022-23 and extension period; now one flat per hour rate for all hours worked during 2022-23 and in the extension period.

3. Set total compensation at $45,000.

4. Add a provision to Exhibit A that further documents status as an independent contractor.

All other provisions remain the same as in the agreement approved on June 20, 2016 and amended through June 30, 2022. The current agreement, and related amendments, is on file in the City Clerk’s office.

Over the past several years, annual compensation under this agreement has ranged from $40,000 to $55,000 depending on need and level of in-staffing. The 2022-23 budget contains an allocation of $45,000 for these services.

FINANCIAL IMPACT: The 2022-23 Approved Budget reflects $45,000 for the contract which is sufficient funding.

City Council Meeting
Agenda Report
Agenda Item No. 10
SUBJECT: FIRST AMENDMENT TO CONTRACT WITH KIMLEY-HORN
ASSOCIATES, INC. FOR THE 2021-2029 6TH CYCLE HOUSING

ELEMENT UPDATE
MEETING DATE: June 20, 2022
PREPARED BY: Kelly Lucia, Planning Manager
RECOMMENDATION: It is respectfully recommended that the City Council approve the First Amendment to Agreement with Kimley-Horn and Associates for the 6th Cycle Housing Element Update.

BACKGROUND/DISCUSSION: As you may recall, on June 7th, 2021, the City Council approved an Agreement with Kimley-Horn and Associates for the 6
th Cycle Housing Element Update. City
Staff and Consultant have performed all required preparation and community outreach.

Subsequently, the Updated Housing Element was submitted to the State for approval.

Unfortunately, Calimesa, like a majority of other California cities, is still waiting for State approval.

As such the Agreement with the Consultant needs to be extended as the Consultant will also assist Calimesa in providing responses to State comments, if any, thus facilitating final approval of the document.

The original contract term was for one year and expired June 7, 2022. However, the scope of work has not been completed due to unforeseen delay in the State’s review. Given the unique circumstances (i.e., unforeseen State delay beyond our control) Staff recommends that the original contract, although expired 12 days ago, be reinstated, and extended through June 7, 2023 which should be ample time to complete the remaining scope of work. No additional compensation is being sought.

By way of background, a summary of the State requirements are as follows:

Since 1969, California has required that all local governments (cities and counties) adequately plan to meet the housing needs of everyone in the community. California’s local governments meet this requirement by adopting housing plans as part of their “general plan” (also required by the state).

General plans serve as the local government’s "blueprint" for how the city and/or county will grow and develop and include seven elements: land use, transportation, conservation, noise, open space, safety, and housing.

California’s housing-element law acknowledges that, in order for the private market to adequately address the housing needs and demand of Californians, local governments must adopt plans and regulatory systems that provide opportunities for (and do not unduly constrain), housing development. As a result, housing policy in California rests largely on the effective implementation of local general plans and, in particular, local housing elements.

Page 167 of 286 ends

Updating a jurisdiction’s housing element, while important to meeting one of the most basic needs of Californians, can be daunting, and a lot is at stake. Individuals and families are directly affected by each jurisdiction’s ability to plan for the housing needs of those who will live, work, and play in every community.

Those who build homes and apartments and help families become homeowners often rely on funding from state and federal housing programs administered by HCD and other state departments and agencies. In some cases, funding from state/federal housing programs can only be accessed if the jurisdiction has a compliant housing element. In other cases, a compliant housing element is not a requirement in order to apply for funding; however, those applying for funding will receive extra points on their application if they do have a compliant housing element (thereby increasing their chances in the competitive application process).

In order to create a housing plan (aka housing element) showing it could meet the local housing needs, a jurisdiction must first know how much housing it must plan for (and estimate how much will be needed at a variety of affordability levels in order to match the needs of the people who will live there). This is determined by a process called the regional housing needs assessment.

The Role of the California Department of Housing and Community Development The California Department of Housing and Community Development (HCD) plays the critical role of reviewing every local government’s housing element to determine whether it complies with state law and then submits written findings back to each local government. HCD’s approval is required before a local government can adopt its housing element as part of its overall General Plan.

Jurisdictions can opt to update their housing elements every five years or every eight years. The option to use an eight-year schedule was created to better align with the schedule local governments (or COGs/MPOs) have to meet to update their Regional Transportation Plans (which are updated every four years) now mandated to align with housing plans in Regional Sustainable Communities Strategies.

Housing-Element Update Cycles
To date, there have been five previous housing element update “cycles.” California is now in its sixth “housing-element update cycle.”
Housing-Element Process
• Update previous housing element.
• Submit draft to the California Department of Housing and Community Development (HCD) for review/approval.
• Revise and adopt (or adopt without changes).
• Submit adopted housing element to HCD.

Sites Inventory
Government Code (GC) Section 65583(a)(3) requires local governments to prepare an inventory of land suitable for residential development, including vacant sites and sites having the potential for redevelopment, and an analysis of the relationship of zoning and public facilities and services to

Page 168 of 286 ends

these sites. That inventory must identify specific sites or parcels that are available for residential development. Pursuant to SB 6 (Chapter 667, Statutes of 2019), for a housing element or amendment adopted on or after January 1, 2021, the planning agency shall submit to HCD an electronic copy of its inventory of these parcels using standards, forms, and definitions adopted by HCD.

FINANCIAL IMPACT: The City allocated $50,000 in the FY 2020-21 budget (unused balance to be carried over to FY 2021-22) and an additional $150,000 in the FY 2021-22 budget to fund this contract. These amounts are in account 01-3000-7210. Any remaining funding will be carried forward into 2022-23. As such, no additional appropriation is necessary.

PLAN 6TH CYCLE HOUSING ELEMENT UPDATE

CONSULTING SERVICES BETWEEN THE CITY OF
CALIMESA AND KIMLEY-HORN AND ASSOCIATES, INC.
(“CONSULTANT”)
This First Amendment (herein “First Amendment”) is entered into this 20th day of June 2022 and is an amendment to that certain Agreement (herein “Agreement”) that was made and entered into on June 7, 2021 by and between the City of Calimesa, a California municipal corporation (“City”) and Kimley-Horn and Associates, Inc., a North Carolina corporation (“Consultant”).

R E C I T A L S
A. The City of Calimesa (“City”) has determined that it requires a consultant to provide planning and environmental consulting services.

B. Consultant represents that Consultant has the necessary education, experience, skills and expertise to provide the type of services needed by City to provide planning and environmental consulting services.

C. On June 7, 2021, the Parties desired to execute this Agreement pursuant to the authority and approval of the City Council.

D. The Parties now desire to enter into an amendment to extend the contract term due to a delayed timeframe in receiving final approval from the State of California on its Housing Element Update.

NOW, THEREFORE, the Parties agree as follows:

Section 1. Section 1 (Term) is hereby amended to read as follows:
“Subject to the terms and conditions set forth in this Agreement, the term of this Agreement shall continue through June 7, 2023 unless sooner terminated or renewed pursuant to the provisions of this Agreement.”
Section 2. Except as otherwise amended in this First Amendment, the remaining provisions of the Agreement shall remain in full force and effect.

SUBJECT: TRACT MAP NO. 26811 SINGLETON HEIGHTS: ACCEPTANCE OF

DRAINAGE AND LANDSCAPE LOTS
MEETING DATE: June 20, 2022
PREPARED BY: Michael Thornton, City Engineer
RECOMMENDATION: Staff recommends that City Council take the following actions:
• Accept the drainage and landscape lots in fee simple title • Authorize City Staff to execute the Certificate of Acceptance and forward the lot documents to the County Recorder’s Office for recordation
DISCUSSION: Tract No. 26811 includes 268 single family lots located east of the 10 Freeway at Singleton Road and Singleton Canyon Road. On April 18, 2005, City Council approved Final Tract Map No. 26811 which includes several lettered lots that have been annexed into the City’s Landscaping, Lighting & Maintenance District (LLMD) No. 2012-1.

The Developer has installed, and City Engineer has accepted, drainage and landscaping improvements within these lots as required by the project’s Conditions of Approval. Accordingly, the Developer has offered these lettered lots in fee simple title to the City of Calimesa for access and maintenance purposes.

The following documents have been submitted for Council Acceptance as described below:
• Lot BB of Tract No. 26811 is located in the middle of open space Lot Y on the west side of the project and used to contain a cell tower. This cell tower has since been removed and it is logical to combine Lot BB with the surrounding open space area.
• Lots U V & Z of Tract No. 26811 consist of landscaped lots located along Singleton Road. • Parcel 1 consists of a 14,279- sf landscaped area located on the north side of Condit Avenue at the southeast corner of the debris basin.

Parcel 3 contains a water quality/retention basin and is located at the northeast corner of Singleton Road and Singleton Canyon Road

City Council Meeting
Agenda Report
Agenda Item No. 12
SUBJECT: PUBLICLY AVAILABLE SALARY SCHEDULES AS REQUIRED BY THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM
MEETING DATE: June 20, 2022
PREPARED BY: Bonnie Johnson, City Manager
RECOMMENDATION: That the City Council adopt Resolution 2022-28, a Resolution of the City Council of the City of Calimesa Adopting the Fiscal Year 2022-23 Publicly Available Salary Schedule Effective July 2, 2022, through June 30, 2023, and Retroactively Approving the Same for Fiscal Years 2015-16 through 2021-22, as Required by the California Public Employees’ Retirement System.

BACKGROUND/DISCUSSION: In 2011, the California Code of Regulations, Title 2, added Section 570.5 - Requirement for a Publicly Available Pay Schedule. The requirements are very specific. These are summarized as follows:
(a) For purposes of determining the amount of “compensation earnable” pursuant to Government Code Sections 20630, 20636, and 20636.1, payrate shall be limited to the amount listed on a pay schedule that meets all of the following requirements:
(1) Has been duly approved and adopted by the employer's governing body in accordance with requirements of applicable public meetings laws;
(2) Identifies the position title for every employee position; (3) Shows the payrate for each identified position, which may be stated as a single amount or as multiple amounts within a range;
(4) Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;
(5) Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website;
(6) Indicates an effective date and date of any revisions; (7) Is retained by the employer and available for public inspection for not less than five years; (8) Does not reference another document in lieu of disclosing the payrate.

Page 195 of 286 ends

(b) Whenever an employer fails to meet the requirements of subdivision (a) above, the Board, in its sole discretion, may determine an amount that will be considered to be payrate, taking into consideration all information it deems relevant including, but not limited to, the following:
(1) Documents approved by the employer's governing body in accordance with requirements of public meetings laws and maintained by the employer; (2) Last payrate listed on a pay schedule that conforms to the requirements of subdivision (a) with the same employer for the position at issue;
(3) Last payrate for the member that is listed on a pay schedule that conforms with the requirements of subdivision (a) with the same employer for a different position; (4) Last payrate for the member in a position that was held by the member and that is listed on a pay schedule that conforms with the requirements of subdivision (a) of a former CalPERS employer.

Although the City’s annual budgets, which are adopted by Resolution, have consistently contained both an authorized position list reflecting a salary range number for each authorized position, as well as a salary range table reflecting hourly, bi-weekly, monthly and annual rates for each range number, in order to ensure compliance with the above Regulation, staff is recommending that a single Salary Schedule that meets the above requirements (i.e., combines all required information in one schedule) be adopted for each fiscal year from 2015-16 through 2022-23.

In addition, annually hereafter the required schedule will be included as an additional page in annual budget document. Also, the annual schedule, along with any supporting documents (i.e., City Manager employment contract, etc.) will be posted on the City’s website as required.

Once approved, the City Clerk will post all information attached to this Staff Report on the City’s website.

City Council Meeting
Agenda Report
Agenda Item No. 13
SUBJECT: SECOND AMENDMENT TO AGREEMENT FOR ON-CALL

ENVIRONMENTAL CONSULTING SERVICES BETWEEN THE

CITY OF CALIMESA AND DUDEK
MEETING DATE: June 20, 2022
PREPARED BY: Kelly Lucia, Planning Manager
RECOMMENDATION: It is respectfully recommended that the City Council approve the Second Amendment to Agreement for On-Call Environmental Consulting Services between the City of Calimesa and Dudek and authorize the Mayor to execute the Agreement.

DISCUSSION: Dudek (the Consultant) was chosen as one of the City’s on-call environmental consultants through a competitive process that took place in late 2018. The related Agreement was approved by City Council in February 2019. The City Council approved the First Amendment to the Agreement in February 2020 to include the preparation of regulatory permits related to County Line Transportation Corridor project. The Agreement and First Amendment to the Agreement are in effect until June 30, 2022.

Staff is now requesting approval of the Second Amendment to the Agreement (See Attachment A) to extend the term and set compensation. If approved, the Agreement shall be for a period of one year commencing on July 1, 2022, with the option of two one-year extensions, through June 30, 2025, at the sole discretion of the City. Compensation for the initial 2019 Agreement was set at not to exceed $25,000 but was later increased to $44,290.00. Due to a steady increase in development activity and City capital projects, the Consultant’s total maximum compensation for the Second Amendment is proposed to be an annual amount of $50,000 (plus potential adjustments noted in the fiscal impact section). In addition, the Second Amendment contains a provision that provides an approval process for requested increases in billing rates, not to exceed 3%, which will not exceed each year’s maximum compensation without Council approval.

FISCAL IMPACT: The adopted 2022-23 budget contains an appropriation in the Planning Department budget of $50,000 for CEQA consultant services. The City currently has two on-call CEQA consultants. However, please note that a majority of work undertaken by the CEQA on-call consultants, collectively, is not billed through the Planning Department budget, but to specific project applicants (i.e., to deposits from development applications). Each contract specifies a not-toexceed amount of $50,000 for all services rendered inclusive of charges passed through to project applicants. In other words, it is anticipated that as much as $100,000 may be charged by CEQA consultants Dudek and Webb but Planning Department charges will not exceed the appropriation of $50,000.

Page 230 of 286 ends

The maximum annual compensation for each year may be increased up to 10% at the sole discretion of the City Manager. If the City Manager approves a 10% increase each year, the maximum annual fiscal impact could be as high as follows: FY July 2022-June 2023: $55,000; FY July 2023-June 2024: $60,500; and FY July 2024-June 2025: $66,550. Also, the Agreement states that “any such one-year extension shall be conditioned upon the City Council’s prior approval of the additional required funding for such additional one-year Term, and the City Manager’s prior authorization.”

City Council Meeting
Agenda Report
Agenda Item No. 14
SUBJECT: FIRST AMENDMENT TO AGREEMENT FOR ON-CALL

ENVIRONMENTAL CONSULTING SERVICES BETWEEN THE

CITY OF CALIMESA AND ALBERT A WEBB
MEETING DATE: June 20, 2022
PREPARED BY: Kelly Lucia, Planning Manager
RECOMMENDATION: It is respectfully recommended that the City Council approve the First Amendment to Agreement for On-Call Environmental Consulting Services between the City of Calimesa and Albert A Webb and authorize the Mayor to execute the Agreement.

DISCUSSION: Albert A Webb (the Consultant) was chosen as one of the City’s on-call environmental consultants through a competitive process that took place in late 2018. The related Agreement was approved by City Council in February 2019. Staff is now requesting approval of the First Amendment to the Agreement (See Attachment A) to extend the term and set compensation.

If approved, the Agreement shall be for a period of one year commencing on July 1, 2022, with the option of two one-year extensions, at the sole discretion of the City, through June 30, 2025.

Compensation for the initial Agreement was set at not to exceed $25,000. However, due to a steady increase in development activity and City capital projects, the Consultant’s total maximum compensation for the First Amendment is proposed to be an annual amount of $50,000 (plus potential adjustments noted in the fiscal impact section). In addition, the First Amendment contains a provision that provides an approval process for requested increases in billing rates, not to exceed 3%, which will not exceed each year’s maximum compensation without Council approval.

In other words, it is anticipated that as much as $100,000 may be charged by the two CEQA consultants, but City funds will be used to pay only a portion of such charges and in no event will not exceed the appropriation of $50,000.

Also, the Agreement states

that “any such one-year extension shall be conditioned upon the City Council’s prior approval of the additional required funding for such additional one-year Term, and the City Manager’s prior authorization.”

City Council Meeting
Agenda Report
Agenda Item No. 15
SUBJECT: COUNCIL CONSIDERATION OF OPPOSITION LETTERS REGARDING AB 2237, AB 2438, AND AB 1778
MEETING DATE: June 20, 2022
PREPARED BY: Bonnie Johnson, City Manager
RECOMMENDATION: That the City Council consider the letters of opposition at the request of the Riverside County Transportation Commission (RCTC) regarding AB 2237, AB 2438 and AB 1778 and provide the City Manager direction.

BACKGROUND: Council Member Molina, as the City’s representative to RCTC, made a request that these draft letters be placed on the agenda for Council consideration. Anne Mayer, Executive Director of RCTC is encouraging each City to approve a letter of opposition for the following bills:

AB 2237 (Friedman): This bill would require projects funded by local tax measures to align with CAPTI and regional Sustainable Communities Strategies (SCS) and prohibit county transportation commissions from funding a project or program determined to be inconsistent with its most recently adopted SCS or the state’s climate goals by ARB.

AB 2438 (Friedman): This bill would require projects funded by specified state transportation funding programs to align with state climate goals.

AB 1778 (Garcia): This bill would halt highway expansions in disadvantaged communities – the very communities that rely on them to get to work.

These bills have all passed the Assembly and are headed for Senate Committee hearings on the following dates:

AB 2237 – June 22, 2022
AB 2438 - June 28, 2022
AB 1778 - June 28, 2022
As such, given the hearing dates, time is of the essence for City Council to provide direction regarding the proposed letters.

Attached are background documents, including the current text of the respective bills and voting record for Assembly Members representing areas in Riverside County.

Joint City Council & Successor Agency to the
Calimesa Redevelopment Agency Meeting
Agenda Report
Joint Meeting Agenda Item No. 1
SUBJECT: SECOND AMENDMENT TO THE AMENDED AND RESTATED

AGREEMENT FOR LEGAL SERVICES
MEETING DATE: June 20, 2022
PREPARED BY: Bonnie Johnson, City Manager
RECOMMENDATION: That the City Council and Agency Board of Directors approve the Second Amendment to the Amended and Restated Agreement for Legal Services with Richards, Watson & Gershon.

BACKGROUND: The City’s and Successor Agency’s legal services agreement with the law firm of Richards, Watson & Gershon (RWG) was entered into in October 2004. In June 2017, an Amended and Restated Agreement was approved. Pursuant to the latter agreement, RWG is able to provide the City and the Successor Agency with a wide range of legal services.

The proposed Second Amendment adjusts the rates for compensation by the change in CPI in accordance with Section 5B of the Amended and Restated Agreement which reads as follows:

Section 5B:

Adjustment in Rates by Change in CPI. Commencing July 1, 2019, and annually thereafter, the hourly rates set forth on Exhibit A, shall be reviewed annually in relation to the percentage change in the Consumer Price Index (All Urban Consumers; Los Angeles-Riverside-Orange County). The calculation shall be made using the month of April over the month of April in the prior year. Any such annual adjustment and any other adjustments in the rates, shall require prior written approval of the City Council.

It should be noted (see Attachment A) that RWG deferred both the 2021 and 2022 increases due to the COVID-19 Pandemic and related financial uncertainty facing many cities. As such, the proposed increase, as reflected as an attachment to the proposed Resolution, incorporates an increase for 2020-21 and 2021-22. If the adjustment is approved, Exhibit A to Section 5A of the Amended and Restated Agreement – Compensation Rate Schedule, will be revised accordingly. A revised Exhibit A is attached to the proposed Second Amendment.

Therefore, the CPI change calculated in accordance with Section 5B of the Amended and Restated Agreement is 3.61% for 2020-21 and 7.87% for 2021-22. The cumulative change will result in an approximate 11% to 12% increase in rates. The calculation is attached to the staff report as Attachment A.

Page 274 of 286 ends

FISCAL IMPACT: The Adopted 2022-23 General Fund budget contains an allocation for City Attorney services of $185,000. No adjustment is being recommended at this time. Staff is currently monitoring costs and believes that much, if not all, of the increase can be absorbed in the new budget.

In addition, a significant portion of current services are charged to development related services which are offset by deposits or fees from development applications which further lessens the direct impact to the General Fund. Any costs for the Successor Agency, other than costs directly associated with the outstanding bonds, will likely also be paid by the General Fund due to reduced funding from the State. These costs are expected to be minimal.
