10. PUBLIC HEARING: ZTA 25-01- AMENDING CHAPTER 17.15 OF TITLE 17 (SUBDIVISIONS) AND CHAPTERS 18.10, 18.15, 18.20, 18.25, 18.28, 18.35, 18.39, 18.40,
18.45, AND 18.125 OF TITLE 18 (ZONING, LAND USE AND DEVELOPMENT
REGULATIONS) OF THE CALIMESA MUNICIPAL CODE TO IMPLEMENT HOUSING ELEMENT PROGRAM ACTIONS H-1.4, H-2.8, H-2.11, H-3.14, H-3.15, H-3.19, AND H-4.4 OF THE CITY OF CALIMESA SIXTH CYCLE 2021-2029 HOUSING ELEMENT.
City Council Action Minutes of the Regular Meeting of
February 2, 2026
RECOMMENDATION: That the City Council conduct a first reading by title only of Ordinance No. 419 approving Zone Text Amendment (ZTA) 25-01, which updates various sections of Chapter 18 and Chapter 17 as part of the 2021-2029 Housing Element Implementation Program (Project), and find the Project categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines 15601(b)(3) and 15282(h).
Mayor Cervantez opened the Public Hearing at 6:27 p.m.
Senior Planner Sevilla introduced the staff presentation and consultant Bryant De la Torre of Kimely Horn who presented a power point presentation for Zone Text Amendment (ZTA 25-01) updating various sections of Chapters 17 and 18 of the Calimesa Municipal Code as part of the Housing Element Implementation Program.
City Clerk Gerdes stated that one public comment was received via email from resident Bill Thomas and a copy was provided to the City Council. Mr. Thomas’s comments were not read into the record at the meeting, but are included in the written minutes as follows:
Please read the following into the record for this evenings City Council Meeting: Item 10 Ordinance 419 Page 471 of 545. The in Lieu fee is language from and in support of the recently approved Ordinance 418 on 12-01-25. The issue at hand is that the lower-income units from Oak Valley Specific Plan will migrate to old Calimesa on the North Side of I-10. Yucaipa is already loading up their side of County Line Road with lower-income housing. The ordinance 418 and now this language in 419 allow a developer to pay a fee to transfer the lower-income housing to another developer. We need to make sure that developers do not take advantage of this ordinance to take the funds form the City and build lower-income housing in the older sections of Calimesa. My request for the public record is to add to somewhere in section 18.130.070 to legally address the prohibition of migrating Lower-Income housing from Oak Valley Specific Plan to the North side of I-10 in Calimesa. Why is this important. Locating all of the lower-income housing North of I-10 will impact property values, Blight and crime. Thank you for your attention.
Mayor Cervantez closed the public hearing.
Council Member Garcia questioned the height of the ADU’s and requested that heights be balanced. Consultant DelaTorre stated that the height limit is set at 18 feet.
After Council discussion the following action was taken:

ELEMENT IMPLEMENTATION PROGRAM (PROJECT), AND FIND THE PROJECT
CATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA GUIDELINES 15601(B)(3) AND 15282(H).

Agenda Item No. 5.
SUBJECT: Notice of Completion for Calimesa Library ADA Improvement Project (Bid No. 2023-09)
MEETING DATE: February 17, 2026
PREPARED BY: Mari Shakir, Public Works Director
RECOMMENDATION:
That the City Council:
1. Accept the completed work by VAN Engineering, Inc. for the Calimesa Library ADA Improvement Project, Project No. 2023-09.
2. Authorize the City Clerk to file the Notice of Completion with the County Recorder's Office.
3. Authorize the release of the retention in accordance with state law upon the expiration of the 35-day lien period.
BACKGROUND:
On September 15, 2025, the City Council awarded a construction contract to Van Engineering, Inc. in the amount of $41,610 for the Calimesa Library ADA Improvement Project. The project was partially funded through Community Development Block Grant (CDBG) funds and is subject to applicable Federal and State labor and procurement requirements.
As part of the award action, the City Council approved a ten percent (10%) construction contingency to address potential changes in quantities and field conditions that could not be fully determined prior to construction.
The project scope included, but was not limited to, removal and replacement of concrete sidewalks, curb and gutter, construction of ADA-compliant curb ramps, driveway approaches, and related appurtenances at the Calimesa Library located at 964 Calimesa Boulevard.
DISCUSSION:
Construction of the Calimesa Library ADA Improvement Project has been completed in accordance with the approved plans, specifications, and contract documents. During
construction, actual field conditions and varying quantities of work items—such as concrete removal, sidewalk replacement, and ADA ramp construction—required adjustments to the original estimated quantities. These quantity adjustments were necessary to properly complete the improvements and ensure full ADA compliance. As a result, the final construction cost exceeded the original contract amount. However, the total final cost remains within the ten percent (10%) contingency previously approved by the City Council. No change orders exceeded the authorized contingency amount, and no additional Council action beyond acceptance of the project is required.
Public Works staff has inspected the completed improvements and determined the work to be satisfactory and complete. Filing the Notice of Completion will formally accept the project, establish the commencement of the statutory lien period, and allow for the release of retention and processing of final payment in accordance with the contract.
FISCAL IMPACT:
The original contract amount for the Calimesa Library ADA Improvement Project was $41,610.
The final construction cost is $42,869, which is within the Council-approved ten percent (10%) contingency.

The City Council of the City of Calimesa does ordain as follows:
Section 1. Recitals
A. The City of Calimesa’s (“City”) Sixth Cycle 2021-2029 Housing Element of the General Plan (“Housing Element”) requires the City to implement program actions within the timelines established in Section 4: Housing Plan of the Housing Element.
B. Section 4, “Housing Plan,” of the Housing Element establishes program actions that require the City to adopt Zoning Text Amendments to comply with state housing laws.
C. The City desires to remain compliant with state housing laws and is adopting Zone Text Amendment 25-01 to implement Housing Element program actions.

At the conclusion of the Planning Commission hearing and after due consideration of the testimony, the Planning Commission adopted Resolution No. 2026-01 recommending that the City Council approve the Ordinance.
E. On February 2, 2026, the City Council of the City of Calimesa held a duly noticed public hearing on the Ordinance, at which time all persons interested in the Ordinance had the opportunity and did address the City Council on these matters.

Section 4. Pursuant to the California Environmental Quality Act (“CEQA”) and CEQA Guidelines, the City as Lead Agency determined that the proposed Zone Text Amendment 25-01, proposed amendments to the Calimesa Municipal Code, is covered by the Implementing State Statutes (CEQA Guidelines Sec. 15282(h)), which provides that and action is exempt if the zoning amendment is required to implement a State Housing law, and common sense CEQA exemptions (CEQA Guidelines Sec. 15061(b)(3)), which states that CEQA applies only to projects which have the potential for causing a significant effect on the environment, respectively. Since the City is proposing Zone Text Amendment 25-01 to implement State Housing laws and no development project or other physical change to the environment would be approved by the adoption Zone Text Amendment 25-01, the City Council finds that it can be seen with certainty that there is no possibility that adoption may have a significant effect on the environment and therefore is not subject to CEQA.
