“Developer deposit accounts (DDA)" are used to recover costs for processing more- complicated applications. Staff estimates the number of hours of staff time that will be required to process the applications by task, such as meetings with the applicant and their representative(s); reviewing the application for completeness; coordinating the review of other agencies; preparing environmental documentation, public notices, reports, resolutions, and ordinances; attending public meetings and following up on application approvals. City of Calistoga

STAFF REPORT
To: Honorable Mayor and City Council
From: Nitish Sharma,
Meeting: City Council - Jun 06 2023
Subject: Requests for Housing Loan and Interest Payments Forgiveness DESCRIPTION:

Requests for Housing Loan and Interest Payments Forgiveness RECOMMENDATION:

Provide direction to staff regarding waiving interest and/or loans for various housing programs.

BACKGROUND/SUMMARY:

The City of Calistoga housing programs assist qualified residents and affordable housing organizations in their efforts to maintain their homes through a housing rehabilitation loan or allow qualified families the opportunity to become a homeowner to purchase their first home/residential unit in Calistoga. These funds are also designed to assist homeowners to correct existing code violations and to improve the conditions of their home. The City has a commitment to increase affordability, reduce blighted areas, and provide decent, safe, and sanitary housing inventory. The funding sources of these loans are from the State of California and/or the United States Department of Housing and Urban Development programs. The City currently contracts with the Napa Housing Authority to monitor and manage the affordable housing loans; including compliance with the regulatory agencies but neither the City nor the Authority have been able to locate all documentation from early loans.

The City has received two specific requests to waive the principle and/or interest of loans from the 1980's. Staff is seeking direction on these requests as well as direction as to whether or not you wish to have a policy related to such future requests that could be administered at the staff level.

ANALYSIS:

The City of Calistoga strides to provide affordable housing to its residents. The State and Federal government funding assists local communities in achieving this goal, however they are insufficient.

The intent of the affordable housing loan programs is to re-invest the principle and interest from past loans back into the program to create additional affordable housing opportunities.

Loan Portfolio Summary
The City’s Housing Programs includes the following funding programs:
• Community Development Block Grant (CDBG): This program provides an annual grant on a formula basis to the states, counties, and cities with a primary objective to develop viable urban communities by providing decent housing and suitable living environment, and by expanding economic opportunities, principally for low- and moderate- income persons.

Item #9.1.

Page 230 of 248 ends

The City of Calistoga has several loans made through this program dating back to 1984. The City tracked historical loans in a workbook that is attached to this report as Attachment 1.

Below is the summary of the historical loans:

Total Amount of the Original Loan:$1,542,030
Total Amount Paid Off: $992,172

It is important to note that these loans were made many years ago and the City does not appear to have all the records regarding these loans including the promissory note, payoff records or other relevant information. The City has been working with the County of Napa and the Napa Housing Authority on a case-by-case basis to assist with any loan payoff demand letter or other regulatory issues as brought forward to staff’s attention.

Payment Forgiveness Requests
The two specific forgiveness requests are summarized below:

Request #1 – Lisa Green, Loan #38-001-531 (Attachment 4). Lisa Green inherited a single-family dwelling from the original borrower (Henrika Dejong). Ms. Green requests the City forgive the loan and record a Substitution of Trustee and Full Reconveyance on the assertion that she repaid the loan.

The City has no corroborating evidence of payment.
• Date of Loan: November 16, 1983
• Deed of Trust to City of Calistoga: November 16, 1983. • Original Term of Loan: 5 years at 6% interest with extensions permissible. • Amount of Loan: $13,700
• Accrued Interest (through April 2023): $32,404
• Total Loan Payoff Amount: $45,282
• Source of funding: Community Development Block Grant
• Deferred Loan Status: Calistoga Loan Committee (November 10, 1983) approved deferred status every five years if owner met income guidelines. • Promissory Note Provision: the City forgave the first year of interest, and the interest may be forgiven for subsequent years if borrower met the income guidelines for the deferred loan program. No City records related to borrower’s income can be found. • City Records: Finance and Building Departments’ records provide no evidence that the loan was paid, nor any evidence recorded with Napa County by the City indicating its payoff.
• Payoff Demand. Issued by City staff on May 17, 2016, based on the fact that the City has no evidence that the note was paid.

Request #2 – Edyth Gangbin, Loan #38-013-54 (Attachment 5). In February 2021, Kamron Ganhbin inherited a single-family dwelling from his mother, the original borrower (Edyth Gangbin).

Mr. Gangbin, who paid off the loan amount in full (on June 28, 2022), requests the City refund the interest amount of $56,175.48 asserting that Ms. Gangbin met the income guidelines specified in the Promissory Note during the term of the loan.
• Date of Loan: November 6, 1984
• Deed of Trust to City of Calistoga: November 6, 1984. • Original Term of Loan: 5 years at 6% interest with extensions permissible. • Amount of Loan: $30,000
• Accrued Interest (through payoff date May 12, 2022): $56,175.48 • Total Loan Amount (paid off May 12, 2022): $86,175.48 • Source of funding: Community Development Block Grant
• Promissory Note Provision: the City forgave the first year of interest, and the interest may be forgiven for subsequent years if borrower met the income guidelines for the deferred loan program. No City records related to borrower’s income can be found.

City Council Options
Options for addressing both the above requests as well as future requests include the following:
1) Seek Full-Repayment: In this option the City will continue to receive all principal and interest in accordance with any original loan parameters and deposit the funds back into eligible housing programs. Most often this will occur at the time the property changes ownership. For loans originating decades ago, if the City or Agency has no records that any funds were previously re-paid, the owner/seller will be required to provide such records or the City will seek full repayment. Alternatively, the City could proactively immediately seek repayment of loans older than a certain period of time (for example more than 10 years old) to try to clean up older loans and stop interest from continuing to accrue. The mechanism to enforce this if payments are not made is foreclosure. 2) Forgive Interest Payments: This action will allow staff to write off the accrued interest on the outstanding loans while re-investing the principal back into the program. In the above two requests the amount is approaching $90,000. The total amount owed for the entire portfolio is in the millions. 3) Forgive Loan Principle: This action will allow staff to write off the original loan amount in the event ownership changes, the property is refinanced, and or transferred to the beneficiaries but still collect the interest. The advantage of this action allows new owners to have a clean title on the property. The disadvantage of this action is that the City may suffer a huge loss in program income in the event the property is sold or refinanced or passed to beneficiaries. The total exposure to program income for individual residential loans only (not including non-profits) is approximately $1.4 million.

The commercial loans principal balance total approximately $3.2 million. 4) Forgive Both Loan and Interest Payments: Either when requested or proactively, the City Council could choose for forgive both loan principal and interest payments. This will result in the loss of millions of dollars available to reinvest in housing programs.

Council can provide different direction as desired for individual loan recipients and for non-profit entities.

CEQA STATUS:

This action is not defined as a “project” by the California Environmental Quality Act (CEQA).

ATTACHMENT 5
To the City Council Members of Calistoga,
I’m asking for the City of Calistoga to accept my payment of $30,000 for the unpaid loan of my mother Edyth Gangbin. I’m also asking for the refund of $56,422 for the payment of interest accrued.

In the early 80’s my father left my mom with 8yr & 10yr old kids. My dad left the house half renovated with no doors, windows or indoor plumbing. My mom tried her best to care for us while working full-time at the juvenile hall in Napa, but we quickly had to rely on getting food from the church, food stamps also the food program at school. It wasn’t long before the teachers at school had concerns about our welfare.

When child protective services visited the home they found us all sleeping on one mattress with a blanket covering the front door in the middle of winter. We were placed in foster care until my mom could update the house to reasonable living conditions.

I thank God for the intervention of the City of Calistoga. If the City of Calistoga had not offered my mom this loan she would had never recovered custody of her children. The City of Calistoga was quick to offer my mom a $30,000 loan to upgrade the house to make it safe for the kids. The language of the loan read that as long as she remained financially unstable the payments could be deferred and would not accrue interest. This was to be reevaluated on an annual basis. She remained on LIRA financial assistance offered from the City of Calistoga until She passed away unexpectedly February 2021.

The reason I am asking to pay the $30,000 loan without interest is because that was the intent of the loan. In the four corners of the contract with the language drafted by the City of Calistoga was that “They may forgive the payment of interest for any year in which the owner meets the income guidelines for the Deferred Loan program as determined by the City Loan Committee”
“ City of Calistoga agrees that for Owners on a fixed income, whose source of income does not change, income shall be reverified every five (S) years and the loan term extended.”
The big question now is how much interest if any is reasonable. Looking at the intention of the loan it’s clear that it was intended to help not make money. Based on the situation I cannot imagine the City of Calistoga ever wanting to profit off my mom’s vulnerability.

Item #9.1.

In closing what I’m asking for will not cost the City of Calistoga money.

It’s just a refund of my money that I paid in confidence that you would see it the way it was intended in 1985.

Thank you,
Kamron Gangbin

In closing what I’m asking for will not cost the City of Calistoga money.

It’s just a refund of my money that I paid in confidence that you would see it the way it was intended in 1985.

Thank you,
Kamron Gangbin
