Camarillo City Council

AGENDA REPORT
Date: November 8, 2023
To: Honorable Mayor and City Councilmembers
From: Greg Ramirez, City Manager
Submitted by: Dave Klotzle, Public Works Director
Subject: Annual Resurfacing (Project No. ST-5017) – Exonerate Warranty Securities

BACKGROUND
On July 28, 2021, the City Council accepted the public improvements and warranty securities for the Annual Resurfacing - Project No. ST-5017 (Project). Work was performed by Pavement Coatings Co. and consisted of slurry seal, asphalt-rubber aggregate membrane (ARAM), traffic control, striping and related work at locations shown on the attached location map (Attachment 1).

On September 28, 2022, the City Council adopted a resolution exonerating the Performance/Payment Bonds No 024238194 for the Project.

City Council adopted a resolution finding the Project exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guideline 15301 Class 1 when City Council authorized staff to solicit bids for Project construction on July 24, 2019.

DISCUSSION
The Ohio Casualty Insurance Company, Warranty Bond No. 024238194 in the amount of $280,000 to guarantee any defect in material or construction that appears within two (2) years from the date of Resolution No. 2021-77, July 28, 2021, have been held for the required maintenance period and may be exonerated.

CEQA DETERMINATIONS
The Project is not subject to CEQA review pursuant to CEQA Guideline Section 15301 Class 1, which exempts from CEQA review projects that involve existing facilities. This agenda item meets the criteria for this exemption because the project involved repair of existing streets and did not expand the perimeter of the existing facility.

RECOMMENDATION

1. Find that Project No. ST-5017 is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Article 19 Categorical Exemptions Section 15301 Class 1; and

2. Adopt a Resolution exonerating warranty securities for Annual Resurfacing - Project No. ST-5017 with Pavement Coatings Co.
