RESOLUTION NO. 2023-__

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF CAMARILLO APPROVING A REQUEST BY DENNIS

HARDGRAVE OF DEVELOPMENT PLANNING

SERVICES, REPRESENTING RIC (SPRINGVILLE), LLC

FOR AN AMENDMENT TO THE LAND USE ELEMENT

OF THE GENERAL PLAN INVOLVING
APPROXIMATELY 26 ACRES FROM COMMERCIAL TO

INDUSTRIAL (RESEARCH & DEVELOPMENT),

FURTHER DESCRIBED AS GENERAL PLAN
AMENDMENT GPA 2019-1

The City Council of the City of Camarillo resolves as follows:

SECTION 1. General Findings. The City Council of the City of Camarillo finds and declares as follows:

A. Dennis Hardgrave has submitted an application for a Gen eral Plan Amendment (GPA 2019 -1) seeking a change in the land use designation for approximately 26 acres of real property located south of the U.S. 101 Freeway, west of Springville Drive, north of the Camarillo Airport, just east of West Ventura Boulevard (the “Subject Property”).

B. The Subject Property has a General Plan designation of Commercial, is located within the Airport North Specific Plan, and is zoned Commercial Planned Development (“CPD”).

C. The proposed General Plan amendment will change the General Plan designation to Industrial (Research and Development).

D. Concurrent with the review of this Ordinance, the City Council considered an Addendum to a Subsequent Final Environmental Impact Report 2014-8 (“SEIR”) (SCH No. 2010081043).

E. The Planning Commission considered GPA 2019 -1 at their meeting of October 3, 2023, where the Planning Commission voted (4-0, Davidson absent) to recommend approval to the City Council.

A. Notice of Public Hearing before the City Council was duly given and published in the time, form, and manner as required by law; and F. On November 8, 2023, the City Council considered this Resolution. Its findings are made based on the entire administrative record including testimony and evidence presented to the Planning Commission on October 3, 2023, and to the City Council at its November 8, 2023, public hearing, including, without limitation, the staff report submitted by the Director of Community Development.

SECTION 2. Environmental Review . The City reviewed the environmental impacts of the Project under the California Environmental Quality Act (Public Resources Code §§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal.

Code of Regs. §§ 15000, et seq., the “CEQA Guidelines”). Pursuant to CEQA Guidelines § 15164, an addendum to a previously certified EIR must be prepared if some changes or additions are necessary but none of the conditions described in Section 15162 calling for preparatio n of a subsequent EIR have occurred. The City has prepared a CEQA checklist that evaluates the potential environmental impacts that may result from this activity and finds:
• The changes that are being proposed with this activity are minor in the sense and will not create potentially significant environmental impacts above and beyond those with which were contemplated in the Final SEIR 2014-8 for the Approved Project.
• This activity will not substantially increase the magnitude or severity of impacts that were previously identified.

Accordingly, an Addendum to a previously adopted Final SEIR 2014 -8 (SCH #2010081043) has been prepared and no further environmental review is required.

SECTION 3. Project Findings. The City Council, after review of the project, finds:

A. It is necessary to revert the general plan land use designation for the Subject Property to its original designation in response to market conditions and to ensure the timely development of an underutilized planning area.

B. The proposed General Plan Amendment is consistent with the General Plan Land Use Element, which includes the objectives of promoting industrial park concepts, visual improvement of industrial areas, and preventing the intrusion of incompatible uses because the project will allow the development of industrial parks that are designed to the Heritage Zone policy and the surrounding uses, to include the airport , are compatible industrial or commercial uses.

C. The proposed General Plan Amendment is consistent with the General Plan Camarillo Urban Restriction Boundary (CURB) Element because the project is within the Camarillo Urban Restriction Boundary and is vacant, undeveloped land as it has been since its annexation into the City when it was prezoned for industrial and/or commercial uses.

D. The proposed General Plan Amendment is consistent with the General Plan Housing Element because the project does not include any new residential development within the project area. The 2021 -2029 Housing Element of the General Plan identifies sufficient areas throughout Camarillo that will allow for the development of housing units to meet the requirements of the Regional Housing Needs Assessment, 6th Cycle.

E. The proposed General Plan Amendment is consistent with the General Plan Safety Element because the properties subject to the amendment w ill continue to be subject to the development requirements of the Camarillo Airport, and future projects will be reviewed as required in relation to hazardous materials handling, flooding, fires, and

geological/seismic concerns. Additionally, the properties are covered by existing emergency services.

F. The proposed General Plan Amendment is consistent with the General Plan Noise Element because the project location between the Airport and U.S. Highway 101 results in Contour Noise Equivalency Levels ranging from 60 dBA to 75 dBA. Per Figure 2 of the Noise Element, this level of noise is most suited to industrial uses.

G. The proposed General Plan Amendment is consistent with the General Plan Circulation Element because the existing circulation infrastructure p rovides adequate capacity that has been planned for current and future needs, maintains compatibility with the Camarillo Airport, and promotes the safe and efficient movement of goods.

H. The proposed General Plan Amendment is consistent with the General Plan Community Design Element because the proposed modification will provide for additional industrial uses, subject to development regulations and design standards of the Specific Plan intended to meet the City’s Community Design Element. Future development will be required to comply with the general placement of building s, as set forth in the Airport North Specific Plan to provide for setbacks to allow for viewshed and view access. Future projects will also have to comply with the City’s requirement to incorporate appropriate architectural styles, on-site landscaping, and other features to provide a complement to the area.

I. The proposed General Plan Amendment is consistent with the General Plan Recreation Element because the element does not identify a park site within the project area and the project does not introduce any new park sites. The proposed revision to the Specific Plan will not increase the use of existing neighborhood and regional parks or other recreational facilities, nor does the proposal require the construction or expansion of any recreational facilities.

J. The proposed General Plan Amendment is consistent with the General Plan Open Space and Conservation Element because t he 46.88 -acre project site is not classified as prime agricultural land, is not subject to the Williamson Act, and has no natural resources.

SECTION 4. Approval of GPA 2019 -1. The City Council approves GPA 2019 -1, based on the above findings for the subject site as shown in Exhibit A.

SECTION 5. Electronic Signatures . This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.

SECTION 6. Office of Record. The record of proceedings upon which this decision is based is located in the Department of Community Development, which is the office of record for the same.

SECTION 7. Construction. This Resolution must be broadly construed to achieve the purposes stated in this Resolution. It is the City Council’s intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.

SECTION 8. Limitations. The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitat ions of the analysis of the project is the City Council ’s lack of knowledge of future events. In all instances, best efforts have been made to form accurate assumptions. Somewhat related to this are limitations on the City ’s ability to solve what are in effect regional, state, and National problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.

SECTION 9. Severability. If any part of this Resolution or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.

SECTION 10. Execution. The Mayor, or presiding officer, is hereby authorized to affix their signature to this Resolution signifying its adoption by the City Council of the City of Camarillo, and the City Clerk, or duly appointed deputy, is directed to attest thereto.

Section 11. Effective Date. The Resolution is effective upon adoption , provided that the Addendum prepared pursuant to the CEQA Guidelines identified in Section 2 is adopted on the same date that this Resolution is adopted.

APPROVED, AND ADOPTED on November 8, 2023.
