To: Honorable Mayor and City Councilmembers
From: Greg Ramirez, City Manager

Subject: Approval of Joint Stipulation Regarding Tolling Agreement between the City and Property Owners Located at 651 Corte Castano
DISCUSSION
Currently there is a pending dispute between the City and the owners of real property located 651 Corte Castano as it relates to unpermitted construction at the property. In order to assist in facilitating resolution of those disputed matters, the City and the Property Owners by entering into the Tolling Agreement, will permit the Property Owners further time to work on resolving outstanding issues at the Property, without having to file an appeal or appeals for a petition of writ of mandate with the Superior Court on the dispute for an additional 90 days from the current statute of limitations.
Accordingly, should the Property Owners’ appeal the administrative decision made by Hearing Officer Martinez or the denial of the Permit Application by the City Council in Superior Court on or before Monday July 10, 2024, the City will not oppose such appeal petition(s) on the basis of the statute of limitations.
FISCAL IMPACT
There is no budget impact as a result of this action.
RECOMMENDATION
City Council approve the Tolling Agreement with the Property Owners at 651 Corte Castano and authorize the Mayor to sign on behalf of the City.
