AGREEMENT NO. 2023-51B
AMENDMENT TO MAINTENANCE CONTRACT
SPECIFICATION NO MC-2023-4
This Amendment to Agreement No. 2023-51 (Amendment) is entered into between the City of Camarillo, a California general law city and municipal corporation (City), and United Storm Water Inc., a California corporation (Contractor), collectively referred to as the Parties. The effective date of this Amendment is March 13, 2024.
RECITALS
A. On September 13, 2023, the City Council approved a Maintenance Contract with United Storm Water, Inc. for ditch, culvert, and detention basin maintenance in the amount of $79,512. The Parties entered into a written agreement entitled Maintenance Contract, Specification No. MC-2023-4, Ditch, Culvert, and Detention Maintenance Agreement No. 2023- 51 effective September 13, 2023 (Agreement).
B. On December 15, 2023, a first amendment to the Agreement was approved to amend the scope of work to include cleanout of an additional storm drain channel located at the end of Cervato Drive in the amount of $4,490.40 for a total Contract amount of $84,002.40.The Parties entered into a written agreement entitled Maintenance Contract, Specification No. MC- 2023-4, Ditch, Culvert, and Detention Maintenance Agreement No. 2023-51A effective December 15, 2023.
C. The Parties desire to modify the Scope of Work in accordance with Section 16.5 of the Agreement.
D. All capitalized terms not defined in this Amendment have the meaning set forth in the Agreement.
Section 1. Amendment. The Agreement is amended to add the following:
A. The term of the Agreement is extended from March 13, 2024, through June 13, 2024, to include the maintenance of 40 additional ditches, culverts, and detention basins per Exhibit A.
The additional work is anticipated to be completed by June 13, 2024.
Section 2. Compensation and Payment. This Amendment is for a not-to-exceed amount of $85,750, for a total agreement amount of $169,752.40.
Section 3. Continuation of Terms of Agreement. Except as expressly modified by the terms and provisions of this document, the remaining terms and provisions of the Agreement remain in full force and effect.
