RESOLUTION NO. 2024-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMARILLO, CALIFORNIA, ADOPTING A SIGN REDEMPTION
FEE
The City Council of the City of Camarillo (“City”) resolves as follows:
SECTION 1. Findings. The City Council finds as follows:
A. City Council determines it is necessary to adopt a sign redemption fee to address the cost to the City for the retrieval and storage of political signs impermissibly left in the public right of way and public property.
B. Based on the staff report accompanying this Resolution, which is incorporated as part of this Resolution, the fee established by this Resolution does not exceed the estimated reasonable cost of providing the service for which the fee is charged and in fact, the fee is less than the actual cost of service.
C. On May 22, 2024, the City Council held a public meeting in compliance with Government Code Sections 66016(a) and 66018 where all interested parties were able to provide testimony.
SECTION 2. Adoption of Fee.
The City Council adopts the fee set forth in attached Exhibit “A”, which is incorporated by reference, for the Department of Community Development.
SECTION 3. Existing Violations. The repeal, whether express or implied, of any City regulation herein will not have the effect of releasing or extinguishing any penalty, forfeiture, or liability previously incurred, or of precluding prosecution and imposition of penalty with respect to any violation having occurred before the effective date of this Resolution. Any such regulation will be treated as remaining in full force and effect for the purpose of sustaining any proper action or prosecution for the enforcement of such penalty, forfeiture, or liability, or any prosecution and imposition of penalty with respect to any violation having occurred before the applicable effective date of this Resolution.
SECTION 4. Conflicts with Earlier Resolutions. To the extent any provision of this Resolution is incompatible or varies with any resolution previously adopted, this Resolution will take precedence, and all earlier resolutions will be interpreted to harmonize with and not change this Resolution.
SECTION 5. Effective Date. The following fee will be effective at the same time Ordinance _____________ is effective:
Exhibit A: Community Development – Fee number 55.1
SECTION 6. CEQA Exemption. The City Council finds that the setting of the fee pursuant to this Resolution is exempt from environmental review under Cal. Pub. Res.
Code § 21080(b)(8), which provides an exemption for the establishment or modification of charges by public agencies that the public agency finds are for the purpose of meeting operating expenses. Based on the record as a whole, the establishment of the fee, pursuant to this Resolution, is entirely for the purpose of meeting operating expenses in that the recommended fee would not recover more than one hundred percent of the cost incurred by the City to deliver the service provided.
SECTION 7. That the City Clerk is directed to certify the adoption of this Resolution.
PASSED AND ADOPTED May 22, 2024.
