Camarillo City Council

AGENDA REPORT
Date: June 26, 2024
To: Honorable Mayor and City Councilmembers
From: Greg Ramirez, City Manager
Submitted by: Dave Klotzle, Public Works Director
Subject: CPD-252 MJC Investment Property XV LLC - Resolution Approving Improvement Plans, and Acknowledging Receipt of Agreements, Securities and Other Necessary Documents

BACKGROUND
CPD-252 is the MJC Investment Property XV LLC development for an automotive fuel station located at 672 Las Posas Road. On November 1, 2022, the Planning Commission of the City of Camarillo approved CPD-252, project location as shown on the attached map (Attachment 1). The project was conditioned to construct public improvements for which agreements and securities are required.

DISCUSSION
The developer submitted improvement plans, agreements, securities and other necessary documents, and paid required fees and payments for CPD-252 and the attached resolution acknowledges receipt of these documents (Attachment 2).

The final improvement plans are now complete and ready for final City approval (Attachment 3). PC Resolution No. 2022-17, with project conditions of approval, is available for review in the office of the City Clerk.

Water Will-Serve Letter
The project applicant submitted a water supply study which concluded that there will be no net increase in the project’s water demand. A Water Will-Serve letter is needed for new service connections and the City will continue to serve water to CPD-252.

FISCAL IMPACT
There is no fiscal impact as a result of this action.

CEQA DETERMINATIONS
On November 1, 2022, the Camarillo Planning Commission adopted PC Resolution No. 2022-17 which found the project to be categorically exempt from the provisions of CEQA under Class 32, Urban In-fill Development (CEQA Guidelines Section 15332). Pursuant to CEQA Guidelines no subsequent CEQA review is required because there are no substantial changes to the project or the circumstances under which the project is being undertaken, and no new information of substantial importance regarding the project has come to light triggering the need for a subsequent CEQA review for the project.

RECOMMENDATION

1. Find that an EIR was previously approved and no further CEQA review is required pursuant to CEQA Guideline 15332; and

2. Adopt a Resolution approving improvement plans and acknowledging receipt of agreements, securities, and other necessary documents and payments for CPD-252.
