AGENDA REPORT
Date: June 26, 2024
To: Honorable Mayor and City Councilmembers
From: Rachel Richman, City Attorney
Subject: Fourth Amendment to Employment Agreement with City Manager/District Manager
BACKGROUND
On July 1, 2020, the City and Gregory Ramirez entered into an Employment Agreement – City Manager (“Agreement”), which provided for Mr. Ramirez to commence services as City Manager as of July 1, 2020. The Agreement at Section 2 (b) provides for an annual adjustment in salary in the discretion of the City Council to be effective annually on July
1. The City and Mr. Ramirez entered into three subsequent Amendments to the Employment Agreement in 2021, 2022, and 2023.
DISCUSSION
On June 12, 2024, the City Council and District in closed session conducted a performance evaluation as well as contract negotiations for Mr. Ramirez. As a result of that closed session, the City Council is considering a Fourth Amendment to the Employment Agreement providing for a salary increase of 4%.
In accordance with Government Code section 54953(c), the City Council is to receive an oral report of the salary and compensation paid to any local agency executive prior to taking final action. Based on the above, the proposed Fourth Amendment to Employment Agreement will increase the salary of the City/District Manager by 4% from 301,729.58 to $313,798.78 to be effective July 1, 2024. This salary amount is also within the range of city manager salaries in Ventura County.
The City Council is also considering an amendment to Vacation Leave to be commensurate with Mr. Gregory Ramirez’ experience as a City Manager which is over 20 plus years. Section 3(h)(1) is drafted to modify accrual placement from “10-14 years
6.152 hours per pay period”, to “19+ years 7.696 hours per pay period”. Further, a vacation leave cash out option is applicable for up to 120 hours a calendar year as further described in the Amendment. Pursuant to the Government Code governing CalPERS regulations, vacation leave cash outs are not subject to CalPERS retirement obligations for the City.
