CITY COUNCIL POLICY
Section: Community Development Date Adopted: June 14, 2006 Last Amended: May 26, 2021
Subject:Inclusionary HousingAffordable Housing Dispersion Number: 7.09 Page 1 of 2
PURPOSE
To establish guidelines for the inclusion dispersion of affordable housing within residential developments.
POLICY
Pursuant to the City’s General Plan Housing Element, each residential development will be reviewed to consider the inclusion of affordable housing units for a range of household incomes, including lower and moderate income households. These guidelines apply to new residential developments and the conversion of existing apartments to condominiums.
A. General Plan Housing Element
The General Plan Housing Element includes a number of programs that promote affordable housing for various household income categories. These programs include, but are not limited to:
1. Developing specific plans for residential communities to include a range of densities and land use types.
2. Providing density bonuses or reducing development standards in accordance with state law in order to provide affordable housing units.
3. Complying with the requirements of the Regional Housing Needs Allocation (RHNA).
4. Using funding sources such as Community Development Block Grant funds or state tax credit financing to help promote affordable housing programs.
As a result of current practices and future opportunities, the City will continue programs to provide affordable residential housing units within new specific plan areas, and within new developments that take advantage of density bonus practices as specified under state law and the City’s Housing Element.

Any new specific plan will include the exact number of affordable units that must be included in the development as a calculated percentage of the total number of units. Staff must require that the affordable units be built proportionately and concurrently with the phasing of market rate units as part of, and prior to the completion of the specific plan buildout.
The City Council may consider inclusionary affordable units, in whole or in part, by construction at a site other than the proposed residential development. This consideration is subject to findings that off-site development would be a more effective and feasible means of implementing the goals of the City’s Housing Element.
An affordability agreement must be recorded to maintain housing affordability in accordance with state and local requirements.
B. Design and Dispersal of Inclusionary Affordable Units In order to minimize the differentiation between affordable and market rate units, and to ensure that no portion of the city contains an overconcentration of affordable units, the City intends to encourage the building of affordable inclusionary housing units in all specific plans and other developments that include market-rate housing. In addition, the City will encourage require developers to design inclusionary housing projects with affordable units that are:
1. Dispersed throughout the development for which the affordable housing obligation is created, incentivized or otherwise induced, unless the developer can demonstrate that including the affordable units on-site makes the development economically infeasible.
2. Similar in exterior appearance to market rate units of like plan type (but may include alternate and having the same equipment and interior finishes to market rate units of the like plan type base model).
3. Available for occupancy at the same time market rate units are available for occupancy in each development phase.
4. Distributed among income groups, in accordance with the City’s density bonus ordinance, or as otherwise negotiated or incentivized.
5. Distributed among a range of unit sizes and types to address the housing needs of a diverse demographic.
