RESOLUTION NO. 2024-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CAMARILLO SUPPORTING PROPOSITION 36 THE HOMELESSNESS,

DRUG ADDICTION, AND THEFT REDUCTION ACT
The City Council of the City of Camarillo resolves as follows:

SECTION 1: The City Council of the City of Camarillo finds and declares as follows:

A. On June 11, 2024, Proposition 36, The Homelessness, Drug Addiction, and Theft Reduction Act qualified for the November 5, 2024, election.

B. Proposition 36 seeks to amend measures implemented by Proposition 47, the Safe Neighborhood and Schools Act, in 2014, which modified theft and drug possession offenses from felonies to misdemeanors.

C. The California State Auditor found that individuals who were convicted four or more times of a crime under Proposition 47 increased by 12 percent.

D. Furthermore, the State Auditor found that theft convictions among those who reoffended four or more times increased by 14 percent after the period of implementation of Proposition 47.

E. The State Auditor made a recommendation to the California State Legislature to appropriate additional funds for services that eliminate the root causes of recidivism and increase penalties for individuals who are convicted of four or more repeat offenses.

F. The City of Camarillo has experienced a steady increase in shoplifting, organized retail theft, theft from vehicles and vehicle burglaries during the implementation period after Proposition 47.

G. Proposition 36 will reclassify certain categories of theft as jail-eligible felonies, allow aggregation of stolen goods, require treatment for drug offenses, enhance sentences for drug traffickers, and increases warnings and punishments for defendants trafficking drugs when someone dies or is seriously injured.

H. Proposition 36 will be another tool for law enforcement to combat the rise of theft across the State, maximizing accountability for repeat offenders, providing opportunities to lower recidivism, and protecting communities from serious crimes.

I. On July 25, 2024, the Policy Committee members directed staff to forward a SUPPORT recommendation to the City Council for discussion and approval.

SECTION 2: The City Council of the City of Camarillo hereby SUPPORTS the efforts of Proposition 36 to increase the levels of public safety in the community and increase the quality of life for all residents.

PASSED AND ADOPTED September 25, 2024.
