AGREEMENT NO. 2021-112B
SECOND AMENDMENT TO MAINTENANCE CONTRACT
This Second Amendment to Agreement No. 2021-112 is entered into between the City of Camarillo, a California general law city and municipal corporation (City), and West Coast Arborist, a California corporation (Contractor) collectively referred to as the "Parties". The effective date of this Amendment is February 26, 2025.
RECITALS
On June 9. 2021, the City Council approved Maintenance Contract No. 2021-112 wit Vest Coast Arborists for professional tree maintenance services in the amount o $2,174,490 for a three-year term effective July 1, 2021.
B. On June 26, 2024, the City Council approved a First Amendment to the Agreement with West Coast Arborist to continue professional tree maintenance services in the amount of $824,385 for a total agreement amount of $2,998,875 for a one-year term effective July 1, 2024.
C. Pursuant to Section 15.5 of the Agreement, the parties wish to enter into a Second Amendment in the amount of $42,307.70 to include additional services to be provided by West Coast Arborist as more fully described herein.
D. All capitalized terms not defined in this Amendment have the meaning set forth in the Agreement.
Section 1. Amendment. The Agreement is amended to add the following:
1. The Agreement is amended to add the Scope of Work included as Exhibit A to provide services for the removal of fire-impacted trees in Zone 2 along Vista Del Mar Ave due to the Mountain Fire in the amount of $24,900, and for the removal of fire-impacted trees and replanting of trees in Zone 2 along Ponderosa Drive due to the Mountain Fire in the amount of $17,407.70 for a total amount of $42,307.70.
Section 2. Compensation and Payment. This Amendment is for a not-to-exceed amount of $42,307.70 for a total agreement amount of $3,041,182.70.
Continuation of Terms of Agreement. Except as expressly modified by the terms and provisions of this document, the remaining terms and provisions of the Agreement remain in full force and effect.
THE AUTHORIZED REPRESENTATIVES of the Parties have caused this Amendment, Agreement No. 2021-112B to be executed as of the Effective Date. (See next page)
