RESOLUTION NO. PC 2024-10

A RESOLUTION OF THE PLANNING COMMISSION OF

THE CITY OF CAMARILLO, APPROVING A REQUEST

FROM HOFMAN PLANNING ASSOCIATES FOR AN

INDUSTRIAL PLANNED DEVELOPMENT PERMIT (IPD-
413) FOR THE CONSTRUCTION OF A NEW 27,987-

SQUARE-FOOT INDUSTRIAL BUILDING AND AN
ADMINISTRATIVE MINOR MODIFICATION (IPD-413M(1))

FOR A REDUCTION OF THE REQUIRED FRONT YARD
SETBACK FROM 30 FEET TO 27 FEET, A REDUCTION IN

THE REQUIRED PERIMETER LANDSCAPING BUFFER
WIDTH FROM 5 FEET TO 4.5 FEET, AND A REDUCTION
IN REQUIRED PARKING STALL DEPTH FROM 20 FEET
TO 18 FEET FOR THE PRIVATE YARD PARKING STALLS
WITHIN THE LIMITED MANUFACTURING (LM) ZONE.

The Planning Commission of the City of Camarillo resolves as follows:

SECTION 1: General Findings. The Planning Commission finds as follows:

A. Hofman Planning Associates submitted an application for an Industrial Planned Development Permit (IPD-413) to allow for the construction of a new 27,987- square-foot industrial building and an Administrative Minor Modification (IPD-413M(1)) to allow a reduction of the required front yard setback from 30 feet to 27 feet, a reduction in the required perimeter landscaping buffer width from 5 feet to 4.5 feet, and a reduction in required parking stall depth from 20 feet to 18 feet for the private yard parking stalls on a vacant lot, located at the northeast corner of Pancho Road and Calle Quetzal (the "Property").

B. The Property is approximately 1.82 acres and is located within the Limited Manufacturing ("L-M") Zone with a General Plan Designation of Industrial; C. The Application was reviewed by the Director for, in part, consistency with the General Plan and conformity with the Camarillo Municipal Code ("CMC"); The Director completed the review and scheduled a public meeting regarding the application before the Planning Commission on August 20, 2024; Municipal Code section 19.28.040 assigns decision making authority to the Planning Commission for the requested IPD;
F. Municipal Code section 19.68.020.B assigns authority to the Director of Community Development ("Director") for review and determination of approval or denial for the Administrative Minor Modification. The Director refers the decision to the Planning Commission in accordance with CMC section 19.68.030.D;

G. On August 20, 2024, the Planning Commission opened the public meeting to receive public testimony and other evidence regarding the applications, including without limitation, information provided to the Planning Commission by the Applicant, and; H. The Planning Commission considered the information provided by City staff, public testimony, and the Applicant. This Resolution, and its findings, are made based upon the evidence presented to the Planning Commission at its August 20, 2024, meeting including, without limitation, the staff report submitted by the Director of Community Development.

SECTION 2: Environmental Review. The project was reviewed in accordance with the California Environmental Quality Act (CEQA) and the State CEQA guidelines, as well as the City's environmental guidelines, and was determined to be categorically exempt from the provisions of CEQA under Class 32, In-Fill Development Projects (CEQA Guidelines Section 15332), because the proposed project will result in a development within city limits on a site of no more than five (5) acres and has no endangered habitat or rare or threatened species. Additionally, the property is adequately serviced by existing utilities and public streets, and will not result in significant effects to traffic, noise, air quality, or water quality. With approval of the Administrative Minor Modification the proposed project is in conformance with the General Plan and Zoning Code. Therefore, no additional review is necessary.

SECTION 3: Industrial Planned Development Findings (IPD-413 AND IPD- 413M(1)). Pursuant to CMC 19.28.040 (Uses permitted), the Planning Commission, after reviewing the application and receiving evidence and testimony at a public meeting on this IPD permit, finds that the request may be approved based on the following findings:

That the degree of compatibility of property uses for which CMC Chapter

19.28 is intended to promote and preserve shall be maintained with respect to the particular use on the particular site and consideration of existing and potential uses of property within the L-M Zone and the general area in which the use is proposed to be located.

The proposed development of the Tesla EV collision center is an appropriate use in the L-M Zone and, with the approval of the Administrative Minor Modification, the development complies with the provisions of the CMC. The use of the property has been evaluated and determined to be appropriate and compatible with the general area where the project is located.

B. That performance standards and conditions shall be imposed upon uses which without such condition might become obnoxious, dangerous, offensive or injurious to the public health, safety, or welfare or a portion thereof by reason of the emission of noise, smoke, dust, fumes, vibration, odor or other harmful or annoying substances.

The project is adequately conditioned to prevent the use and development from becoming obnoxious, dangerous, offensive, or injurious. Furthermore, the project complies with the standards in CMC Chapter 19.28 including lot coverage, and the reduction in minimum Resolution No. PC 2024-10 IPD-413 and IPD-413M(1), Hofman Planning Associates

yard and landscaping area are permitted with an Administrative Minor Modification pursuant to CMC 19.68.020.B.

C. That there shall be maintained the integrity and character of the neighborhood in which the use will be located and the utility and value of property in the neighborhood and in the adjacent zones.

The project incorporates the use of appropriate colors, textures, materials, height, and massing. The project is consistent with the Camarillo Community Design Element Industrial Design Guidelines and is compatible with the surrounding use types, both in terms of design and use.

D. That the use shall be compatible with public interest, health, safety, convenience and general welfare.

The project meets all requirements of the CMC with an Administrative Minor Modification and will not be injurious to the public health, safety, convenience, or general welfare.

Furthermore, the project has been conditioned to ensure continued compatibility with public interest, health, safety, convenience, and general welfare.

The adjustments under the Administrative Minor Modification are necessary to make reasonable use of the land.

The adjustments requested in the Administrative Minor Modification will allow the facility operators to maximize the number of parking spaces on site and to enhance vehicle circulation on the site and within the building. This will help ensure the facility is able to operate without posing an impact on surrounding uses.

F. That the review will take into consideration the General Plan and the various elements, including but not limited to land use, circulation, scenic highways, public safety, community design, open space, and housing.

The proposed project was reviewed to ensure compatibility with the General Plan, including the individual elements and the project has been found by staff to be consistent with the City's General Plan and the Economic Development Strategic Plan including the following:

Land Use Element Industrial Standard: Large setbacks and landscaped front yards should be required to improve the visual quality of the industrial environment.

The submitted plans illustrate proposed landscaping coverage will exceed the 10% threshold for the L-M Zone by dedicating 13% of the lot to landscaping. The project will be conditioned to submit a landscaping plan in compliance with the City's Landscape and Irrigation Guidelines and CMC Chapter 14.14 - Water Efficient Landscapes. With the approval of the Administrative Minor Modification allowing a reduced landscape buffer width and yard setback, the project will meet the required landscaped area code requirements.

Land Use Element Industrial Standard: That uses which involve hazardous materials be reviewed with regard to impacts on adjoining residential uses and in accordance with the Safety Element of the General Plan and Zoning Ordinance. • The proposed project will establish an Electric Vehicle (EV) collision center. EVs are distinct from traditional gas-powered vehicles in that they do not have an exhaust system, fuel tanks, liquid fuel usage, and the non-utilization of new or used motor oil. The project will be conditioned to conduct all repair activities within the building and is surrounded by similar industrial uses and agricultural land. No residential uses are within proximity of the project site.

Community Design Element Objective Industrial Design Guidelines Al-1.3: Design to respect the scale and development character of adjoining sites and work to mitigate negative visual and functional impacts that arise from scale, bulk and mass inherent to larger industrial developments.
• The proposed design is in keeping with the scale and character of the adjoining sites because the surrounding buildings are similar in size and because the proposed bulk and mass are broken up by architectural elements such as entry architectural features, windows and glazing, building articulation, and the use of a variety of wall planes and building heights.

Community Design Element Objective Industrial Design Guidelines Policy IA-1.6.1:

The industrial performance standards contained in the Zoning Ordinance are to be complied with to insure that the use will not be detrimental to other adjoining land uses. • The proposed project complies with the industrial performance standards contained in the Zoning Ordinance. The proposed project will not be detrimental to other adjoining land uses as the proposed project will develop the last vacant parcel within the industrially zoned area south of Adohr Lane and is surrounded by other existing industrial uses.

Community Design Element Objective Industrial Design Guidelines Policy IA-1.6.2:

The City shall continue to apply the standards contained in the L-M, M-1 and M-2 Zoning Regulations.
• The proposed project was evaluated by City Staff and was found to comply with the Limited Manufacturing (L-M) Zoning Regulations for new development.

Economic Development Strategic Plan 4E, Office/Business Park Capacity:

Maximize options for future office/business park development to accommodate business expansion in targeted industries.
• The proposed project will develop a currently vacant parcel with a new building and parking lot that could be adapted to other uses in the future. Additionally, the Electric Vehicle (EV) industry is an industry that will diversify the City's economy. This will be the first Tesla owned and operated collision center in Camarillo and the greater Ventura County area, drawing in business from other jurisdictions.

Resolution No. PC 2024-10 IPD-413 and IPD-413M(1), Hofman Planning Associates

Page 4 of 6 ends

Economic Development Strategic Plan 5A, Talent Retention/Recruitment: Prioritize EDSP strategies that focus on creating residential options and employment opportunities attractive to young professionals and technology workers. • The proposed project will create employment opportunities in EV which is a unique field of work in emerging technology.

SECTION 4. Approval of IPD-413 and IPD-413M(1). Based on the above findings, the Planning Commission approves IPD-413 and IPD-413M(1), including the plans labeled, Exhibit A, subject to the conditions labeled, Exhibit B, which are attached and made a part of this resolution, as well as all applicable general Municipal Code requirements and development standards.

SECTION 5. Office of Record. The record of proceedings upon which this decision is based is located in the Department of Community Development, which is the office of record for the matter.

SECTION 6. Construction. This Resolution must be broadly construed in order to achieve the purposes stated in this Resolution. It is the Planning Commission's intent that the provisions of this Resolution be interpreted or implemented by the City and others in a manner that facilitates the purposes set forth in this Resolution.

SECTION 7. Reliance On Record. Each and every one of the determinations in this Resolution are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the matter. The determinations constitute the independent findings and determinations of the Planning Commission in all respects and are fully and completely supported by substantial evidence in the record as a whole.

SECTION 8. Limitations. The Planning Commission's analysis and evaluation of this matter is based on the best information currently available. It is inevitable that in evaluating the matter that absolute and perfect knowledge of all possible aspects of the matter will not exist. One of the major limitations on analysis of the matter is the Planning Commission's lack of knowledge of future events. In all instances, best efforts have been made to form accurate assumptions. Somewhat related to this are the limitations on the City's ability to solve what are in effect regional, state, and national problems and issues.

The City must work within the political framework within which it exists and with the limitations inherent in that framework.

SECTION 9. Preservation. This Resolution does not affect any penalty, forfeiture, or liability incurred before, or preclude prosecution and imposition of penalties for any violation occurring before this Resolution's effective date. Any such amended part will remain in full force and effect for sustaining action or prosecuting violations occurring before the effective date of this Resolution.

SECTION 10. Severability. If any part of this Resolution or its application is deemed invalid by a court of competent jurisdiction, the Planning Commission intends Resolution No. PC 2024-10 IPD-413 and IPD-413M(1), Hofman Planning Associates

Page 5 of 6 ends

that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Resolution are severable.

SECTION 11. Effective Date. This Resolution is the Planning Commission's final decision and will become effective immediately upon adoption and will remain effective unless the action is appealed within ten days pursuant to CMC § 19.28.315.

SECTION 12. Electronic Signatures. This Resolution may be executed with electronic signatures in accordance with Government Code §16.5. Such electronic signatures will be treated in all respects as having the same effect as an original signature.

SECTION 13. The Planning Commission Chair, or presiding officer, is hereby authorized to affix their signature to this Resolution signifying its adoption by the Planning Commission of the City of Camarillo, and the Planning Commission Secretary is directed to attest thereto.

PROJECT CONDITIONS
In addition to all applicable provisions of the Camarillo Municipal Code (CMC), Hofman Planning Associates (the "Applicant"), agrees to comply with the following conditions of approval ("Project Conditions") for Construction of Industrial Planned Development Permit IPD-413.

Unless the contrary is stated or clearly appears from the context, the construction of words and phrases used in this Conditions of Approval use the definitions set forth in the CMC.

The applicant must comply with the following conditions before the City issues the grading permit, unless otherwise specified.

STREETS
** Trees and Landscaping:
a. The applicant must plant private trees based on an approved landscape plan or at 40-foot intervals along Pancho Road and Calle Quetzal. Trees must be of the species and size as required by the City. All required trees will be private and must be planted before occupancy of the first building.

The landscape plan must be coordinated with the grading plans to avoid conflicts of trees with BMP's for stormwater quality and with storm drains.

The applicant must install private landscape/hardscape features, and irrigation systems within Pancho Road and Calle Quetzal right-of-way adjacent to the project, as required by the Community Development and Public Works Departments.

The applicant/owner must enter into a License Agreement with the City of Camarillo for the Owners to own, operate and maintain the private landscaping, private trees, and private irrigation system within the public right-of-way parkways.

All required landscaping, trees and irrigation within the public right-of-way will be private. The applicant must prepare and submit required legal descriptions, and sketches.

All street or road improvements adjacent to the project boundaries must be as directed and approved by the Department of Public Works. Sidewalks must be constructed contiguous to the curb where required.
* Project Condition Modified CS - City Security Required ** New Condition SS - Sanitary Security Required
MC - Mitigation Condition GS - Grading Security Required MS - Maintenance Security Required
IPD-413 and IPD-413M(1). Hofman Plannina Associates - 08/20/24 Page 1

3. Before the City issues the grading permit, traffic circulation and control on adjacent streets, including all curb openings, control signs for regulation, warning, and guidance of traffic, must be designed as required by the City Traffic Engineer. These include, without limitation, stop signs, speed signs, turn prohibition signs, one-way signs, parking signs, together with required pavement striping, raised pavement markers, and road symbols.

Traffic circulation and control onsite must meet the approval of the Director of Community Development and the City Traffic Engineer.

4. Before the City issues a certificate of occupancy, all signs must be installed, and before final acceptance, the City may require the applicant to add traffic control devices, such as signing and striping, the need for which is not apparent at time of plan approval but which are warranted due to actual field conditions. The applicant must install the traffic control devices before final acceptance.

Ramps and other accessible path of travel elements (sidewalk, walk, appurtenances) must be constructed in locations specified by the City Engineer and the Director of Community Development. Accessible facilities must be constructed and existing facilities reconstructed within and adjacent to the limits of the project limits as necessary to comply with California Title 24 accessibility requirements of the California Building Codes and Americans with Disabilities Act (ADA).

All underground irrigation, water, and other pipes or openings which are encountered during construction of site and street improvements must be removed or sealed in a manner satisfactory to the Department of Public Works.

Before the City issues the grading permit, the applicant must design and, before occupancy, provide intersection visibility as set forth in CMC § 19.38.050 and in a manner acceptable to the City Traffic Engineer. The sight distance requirements will also apply to industrial driveway intersections with public streets.

Before the City issues the grading permit, the applicant must design frontage landscaping that will not obstruct a motorist's line of sight above three feet nor below seven feet within the corner cutoff area of an uncontrolled intersection, or within the sight triangle of a controlled intersection.

The applicant must plant trees based on an approved landscape plan or planted parallel to the street centerline along the sidewalks with a 15-foot setback and medians. All trees within the corner cutoff area of an uncontrolled intersection or within the sight triangle of an uncontrolled intersection must be spaced no closer than 40 feet apart to avoid creating a "fence post condition that may restrict a driver's vision." The road construction (paveout) policy of the City will apply: (CS) a. The applicant must remove and reconstruct any existing public improvements adjacent to the limits of the project found to be damaged before or during the construction of this project.
* Project Condition Modified CS - City Security Required ** New Condition SS Sanitary Security Required
