Assessor's Parcel Numbers 156-0-200-015, 156-0-200-045, 156-0-200- 035, and 156-0-200-025
Dear Ramin Kianfar:

The Planning Division received your application on October 21,2024, for a Permit Adjustment to Planning Case No. PL19-0046 and Permit Adjustment Case No. PL23- 01g7. lt is our understanding that this request includes modifications to Conditions of Approval No. 34 (i.e., bus stop, turning lanes, sidewalks) and Condition No. 69 (i.e., traffic signal on State Route 34).

Environmental Review:

On February 2, 2021, the Board of Supervisors (Board) approved PL19-0046 a four-lot subdivision ind the construction and use of an affordable multi-family housing complex for farmworkers. As part of this action, the Board approved an Environmental lmpact Report (ElR) and Statement of Overriding Considerations prepared for the subject farmworker housing complex. The Board found that the EIR and Overriding Considerations satisfied the environmental review requirements of CEQA.

On January 23,2024, a Permit Adjustment (PL23-0137) was approved to change the time by which the Permittee must satisfy certain conditions of approval (Condition Nos. 34 and Ob). ffre requested Permit Adjustment(PL24-0116) is further extending the timeframe until December i1,2026. The proposed changes would not expand or increase the approved uses and/or development. Furthermore, the proposed changes would not reduce the efficacy of any mitigation measure included in the mitigation monitoring and reporting program that the Board adopted for the farmworker housing complex.

Given that no physical change to the environment would result from the proposed changes to the timing on the two conditions of approval, the requested Permit Adjustment is eligible for exemption from environmental review pursuant to Section 15061(bX3) of the CEQA Guidelines. This section of the guidelines exempts projects for which there is no possibility for a significant effect on the environment.

Therefore, pursuant to the authority granted by the Ventura County Administrative Supplement to the CEQA Guidelines (2010, Chapters 3 and 8), the Planning Director has determined that the proposed permit changes are exempt pursuant to $ 15061(bX3) of the CEQA Guidelines.

Findinqs:

Pursuant to Section 8111-6.1.1 of the Ventura County Non-Coastal Zoning Ordinance (NCZO), the Planning Director must make certain findings in order to grant a Permit Adjustment. Section 81 1 1-6.1.1 states:

Any change which would not alter any of the findings made pursuant fo Secfions 8111-1.2.1.1 through 1.2.1.6 or Secfion 8111-1.2.2.2, nor any of the findings contained in the environmental document prepared for the permit or variance, and would not have any adverse impact on surrounding properties, may be deemed a permit or variance adjustment and acted upon by the Planning Director or designee without a hearing...

The proposed changes to the project, that would be authorized by the requested Permit Adjustment, would not alter the administrative or CEQA findings made at the time the original permit was approved. As stated in this letter (above), the proposed changes to the conditions of approvalwill not make a change in the physicalenvironment, are exempt from CEQA, and do not require changes to the environmental findings for the EIR that the Board certified for the project. ln addition, the proposed changes would not have an adverse impact on surrounding properties. The proposed changes to the time by which the Permittee must satisfy certain conditions will not change the scope of the project.

Therefore, pursuant to Ventura County NCZO Section 81 1 1-6.1 .1 , the Planning Director hereby makes the required findings to grant a Permit Adjustment.

Determination:

As discussed in the Findings section above, the Planning Director made the required findings to grant a Permit Adjustment for the proposed project. The Permit Adjustment is hereby granted.

Conditions of Aooroval and Zoninq Clearance:

Conditions of Approval number 34 and 69 are hereby both modified as follows with language to be removed in strke-eut and new language added underlined:

1. Project Description:

This Planned Development Permit (PD) / Conditional Use Permit (CUP) has been granted, and the Tentative Parcel Map approved, for the project descri bed below consistent with the project plans approved by the Board of Supervisors at the February 2, 2021 public hearing, and subject to the conditions of approval set forth below. Any changes in the design or operation of the approved project must be reviewed and approved by the County. Project changes may require a modification of this permit in accordance with the provisions of the Non -Coastal Zoning Ordinance , Ventura County Subdivision Ordinance, and further environmental review pursuan t to the California Environmental Quality Act (CEQA). Any change in the approved project that is implemented without the required County review and approval may constitute a violation of the conditions of this permit and applicable law.

This permit authorizes a four-lot subdivision and the construction and use of an affordable multi-family housing complex for farmworkers ( “housing complex”) on three parcels of land that encompass a total of 18.43 acres. The fourth parcel will remain in agricultural crop production. The housing complex includes 360 dwelling units (apartments) and associated ancillary facilities. These ancillary facilities include a community wastewater treatment facility (CWWTF) that would provide sewer service to the housing complex and produce recycled water for use to irrigate adjacent agricultural fields. The primary components of the approved project are described below.

Somis Ranch Farmworker Housing
Tentative Parcel Map/Planned Development Permit/Conditional Use Permit, PL19-0046 Conditions of Approval

Page 3 of 48 ends

Housing Complex:

The approved 360-unit housing complex include s a variety of one -, two -, and three - bedroom apartments, and associated ancillary facilities such as community centers, play fields, tot lots/playgrounds, a basketball court, a community garden area, and a network of meandering pedestrian walkways. The project includes community centers and 28 residential building types consisting of a mix of one, two and three stories with a maximum building height of 35.0 feet measured from ground level. The architectural style of the residential buildings will be Spanish Colonial.

Vehicle access to the housing complex will be provided by two driveways connected to Somis Road. The southern driveway will be located within an existing 40 -foot-wide easement where an existing road provides access to the City of Camarillo Desalter Facility. This southern driveway will include a bicycle/pedestrian pathway. The eastern driveway will be installed within a 50-foot wide easement located north of the existing Bell Ranch residences and agricultural buildings. This eastern driveway will traverse a 0.42- acre area outside of the project parcels. The housing complex will include an internal, looping access road to facilitate emergency access. The driveways and internal access road will be designed and constructed in conformance with Ventura County Fire Protection District standards. The applicant will further coordinate with Caltrans to determine whether a traffic signal could be installed on State Route 34 at the eastern access to the project. If allowed, the applicant would fund the signal (see also Condition No. 69).

The housing complex will include 655 vehicle parking spaces (19 of which designated as disabled accessible) and 379 bicycle parking spaces.

The housing complex will include community spaces such as play fields, a community garden, playgrounds, and community centers. Internal meandering pathways will provide pedestrian circulation . The housing complex would be surrounded by a 29 -foot-wide landscaped area along with landscaped areas dispersed throughout the complex. A total area of approximately 395,460 square feet will be landscaped with drought-tolerant tree and shrub species. A weather -sensing “smart controller” w ill be used to manage daily water consumption. Landscaping will be irrigated using bubblers, drip irrigation, or other water-efficient irrigation systems.

Two stormwater detention basins will be installed on the east side of the project site.

Runoff from impervious surfaces within the housing complex w ill be conveyed into the stormwater detention basins. Outflow from the basins would be released into an existing drainage channel located along the western side of the project site.

The housing complex will be served potable water by Ventura County Water Works District No. 19. Electrical service will be provided by Southern California Edison. Cable and telephone service will be provided to the housing complex by Spectrum. All electrical Somis Ranch Farmworker Housing

utility lines, except necessary access ports and wiring within structures, shall be installed underground. The applicant will consider adding a backup generator capable of providing power to the farmworker housing complex for a minimum of 24 hours and up to 48 hours, if possible (see also Condition No. 70).

Community Wastewater Treatment Facility (CWWTF):

The authorized CWWTF will be located on an approximately 7,000 - square-foot area in the northwest corner of the project site. This CWWTF will be comprised of a conventional membrane bioreactor package plant and would treat all wastewater generated by the housing complex. The CWWTF will be designed to treat wastewater (sewage) generated by the housing complex to achieve tertiary treatment standards for water quality . An operator fully licensed by the State of California will be responsible for operation of the CWWTF. Treated wastewater effluent (i.e., recycled water) will be beneficially reused for offsite agricultural irrigation to the extent feasible. Excess recycled water will be dispersed (disposed) by injection into a series of seepage pits installed along the western boundary of the housing complex property.

Construction Phasing:

The housing complex will be constructed in three phases as follows:

• Phase 1 will include 200 units
• Phase 2 will include 160 units

The CWWTF will be constructed as part of Phase 1 and expanded to accommodate the needs of the housing complex as additional apartments are constructed during Phases 2 and 3. Construction of all project phases will involve approximately 1,500 cubic yards (cy) of cut and 35,100 cy of fill. Thus, approximately 33,600 cy of soil will be imported to the project site. No soil export is required. A temporary construction staging area will be installed on the project site.

Approved plans:

All construction and use shall conform to the approved project plans incorporated herein as Condition of Approval No.68

The grading, development, use, and maintenance of the property, the size, shape, arrangement, and location of structures, parking areas and landscape areas, and the protection and preservation of resources shall conform to the project description above and all County-approved Project plans and the other conditions of approval below.
