Camarillo City Council

AGENDA REPORT
Date: December 10, 2025
To: Honorable Mayor and City Councilmembers
From: Greg Ramirez, City Manager
Submitted by: Dave Klotzle, Director of Public Works
Subject: Pleasant Valley Road Bike Lanes Project No. ST-5006, CML- 5393(036) – Reject All Construction Bids and Re-solicit for Bids

BACKGROUND
The Pleasant Valley Road Bike Lanes – Project No. ST-5006, CML-5393 (036) (Project) will widen Pleasant Valley Road by approximately 15 to 20 feet and add striped Class II buffered bike lanes in both directions between Las Posas Road and Fifth Street, as shown on the Project Location Map (Attachment 1). Pleasant Valley Road currently has little to no paved shoulder area causing bicycles to share the travel lane with vehicles. Widening the pavement will allow for the addition of striped Class II bike lanes on both sides of Pleasant Valley Road with a 2-foot rumble strip buffer between the bike and vehicle lanes.

The widened bike lane shoulder area will also provide a recovery area for disabled vehicles to pull over away from the travel lanes. The Project will repave the entire road width and also improve the existing earthen roadside drainage ditch with concrete drainage features.

On December 11, 2024, the City Council adopted a resolution approving the Project plans, specifications, notice inviting bids, and authorized staff to solicit bids for construction.

DISCUSSION
Construction Bids
Staff issued a Notice Inviting Bids for the Project and on July 30, 2025, the City received five (5) bids for construction. Per the bid documents, the lowest bid was determined based on the total base bid as shown in the following table:

Name of Bidder & Location Total Base Bid Alternate Bid 1 Total Base Bid & Alternate Bid 1

$13,260,620.00 $1,225,000.00 $14,485,620.00
C.A. Rasmussen, Inc.
(Valencia, CA) $14,849,795.55 $2,020,000.00 $16,869,795.55 The Base Bid allowed for a 3-month full road closure on Pleasant Valley Road within the Project limits between Las Posas Road and 5th Street. Bid Alternate 1 included the additional cost if a 3-month road closure was not allowed, including additional traffic control to keep the road open to vehicular traffic at all times and all associated work. The top three bid amounts are very close and similar to the engineer’s cost estimate for the Project. The apparent low bidder is Bosco Constructors, Inc. (Bosco) and the apparent second low bidder is Toro Enterprises, Inc. (Toro), with the difference in those bids being less than 1 percent. Given the complexity of the Project and time required to fully analyze the bids, staff sent letters to all bidders requesting agreement to an extension of the contract award deadline to the end of December to allow for additional review time. Bosco, Toro, Granite, and C.A. Rasmussen agreed to the extension.

On August 5, 2025, the City received a bid protest from Toro regarding the apparent low bid received for the Project (Attachment 2) and on October 20, 2025, Toro submitted a supplemental bid protest to Bosco’s bid based on a change in the law by U.S. Dept. of Transportation’s (DOT) Interim Final Rule (IFR), and Caltrans guidance on the suspension on using Disadvantaged Business Enterprise Program (DBE) in contract awards (Attachment 3).

The Project is federally funded and the construction bid documents contained the standard federal funding requirements, including a DBE construction contract goal of 17 percent. This requires the bidders to use DBE firms for 17 percent of the total contract cost, or document that they have made an adequate Good Faith Effort (GFE) to meet the DBE contract goal. The apparent low bidder met the DBE goal by proposing to use 17.2% of DBE subcontractors, and the apparent second low bidder, Toro Enterprises, Inc. (Toro) proposed to use 10.1% of DBE subcontractors and included GFE documentation.

In light of the bid protests received, and after careful consideration and consultation with the City Attorney, staff is recommending to reject all bids and readvertise the Project for construction bids with DBE requirements and goals removed from the bid documents in conformance with DOT’s IFR.

Design Services for Bid Support
On July 24, 2019, the City Council awarded Professional Services Agreement No. 2019- 53 (Attachment 4) with Kimley-Horn and Associates, Inc. (Kimley-Horn) for design services for the Project in the amount of $444,829.41 with an authorized contingency of $66,725 for unforeseen additional services for a total agreement authorization not to exceed $511,554.41. On January 5, 2024, a first amendment to the agreement (Attachment 5) with Kimley-Horn was approved in the amount of $62,154.78 for a total agreement amount of $506,984.19 to provide additional design services for Water Quality Treatment and Green Streets.

The City is requesting execution of a second amendment with Kimley-Horn for grant support services, environmental support services, and additional design services needed to revise the plans and specifications, readvertise the Project, and provide design support during project bidding and award. The grant application assistance and environmental permitting support both required short turnaround times and Kimley-Horn responded quickly to meet the critical deadlines to maintain the project schedule. This effort resulted in the City securing $4 million in additional grant funding for construction through the Southern California Association of Governments (SCAG) Surface Transportation Block Grant (STBG) and Congestion Mitigation and Air Quality (CMAQ) program. The City also required design support during the environmental permitting process and to finalize the bid documents during the first bid solicitation. Additional design services are needed to finalize the bid documents and provide bid support during the second bid solicitation.

Therefore, staff recommends a second amendment to Agreement 2019-53 with Kimley- Horn in an amount not to exceed $194,851.54 for project design services, grant support, environmental permitting support, and bid support (Attachment 6) for a total agreement amount of $701,835.73 and re-establishing the contingency in the amount of $29,228 (approximately 15% of the second amendment amount) for a total agreement authorization of $731,063.73.

Environmental Mitigation
On April 13, 2022, the City Council adopted a Resolution approving a Mitigated Negative Declaration (MND) for the subject project in accordance with the California Environmental Quality Act (CEQA) and the City’s CEQA Environmental Guidelines. The Project also has coverage under the National Environmental Policy Act as it is partially funded with federal funds, with a designation of categorical exclusion.

Compensatory mitigation is required to offset permanent environmental impacts from the Project. The Regional Water Quality Control Board (RWQCB) has approved the use of rehabilitation credits and confirmed a total impact of 2.30 acres that can be offset by the Project No. ST-5006 - Reject Construction Bids and Re-Solicit December 10, 2025

credits. In coordination with our Environmental Consultant, GPA Consulting, staff identified available credits at the Petersen Ranch Mitigation Bank. The cost of mitigating

2.30 acres via rehabilitation credits is $602,000 (Attachment 7) which must be paid by the end of this calendar year to secure the cost and the credits.

Staff recommends authorizing the City Manager to execute a purchase agreement and any associated documents needed to purchase the mitigation bank credits in an amount not to exceed $602,000 to satisfy the Project’s permitting mitigation requirement.

FISCAL IMPACT
Funds for the Kimley-Horn amendment, mitigation bank credits, and to readvertise the Project are included in the Capital Improvement Projects Fund, Account No. 410-8510- 485.92-41 and Project ST-5006.

Staff will return to the City Council with a recommendation to award a construction contract after the Project is re-advertised and construction bids are received.
