In order to acquire the need,ed property rights, based on federal funding and Caltran·s rules and regulations, the properties to be acquired will. need to be appraised or ,valued. Based on the information provided, it' ~ppears that the needed temporary construction acquisitions are of nominal value and would have a-value under $10,000 per parcel. Given this information, and assuming that owners will be cpoperative in negotiations, and np condemnation proceedings will become necessary, we recommend using Waiver Valuations rather than formal appraisal and appraisal review services.;ut/lizing our in-house valuation service wili reduce total costs and time for appraisal services. However, if we are not able to reach amicable settlement with the owners, a formal appraisal ~ill -b~ needed before any condemnation and additional budget will be needed. This approach assumes that no structures will be impacted and that easement areaswill be designed so property O'(llners do not lose any access to their properties during construction. 3 'I
CC Agreement No. 2019-53
EXHIBIT A
Once the waiver valuation process is complete and the valuations .are pre-approved by you and the City, we would then prepare offer packages for each owner that will include an offer letter, Valuation Summary Statement, proposed Right of Way Agreement and Deed. These documents would be presented to you for your review and pre-approval prior to presenting offers to property owners. After offer presentation, we would pursue agreements with each owner to finalize the right of way transfers. As owner-signed agreements are obtained, we would process all documents for necessary City approvals, execution, and payments to property owners. No escrows or title insurance would be utilized or obtained on temporary rights. We will work with the City to facilitate and complete the right of way acquisi_tion process.
To assist you with these services, we propose to bill monthly in accordance with the terms and provisions of our current Time and Materials Fee Schedule, a copy of which is attached. We would work closely with you and your project team to ensure that we are investing our efforts in • accordance with·your needs .and preferences. In any case where one is working ,with people rather than completing an independently controllable task, it is always difficult to speculate in I • ' '
advance the specific amount of time that may be required to compiete our. gcials·. Our.efforts are largely impacted,by the level of accessibility and responsiveness of the property owners from whom we seek agreement. Obviously, some will require much :more time.than others in coming to terms and finalizing documents required for the purposes of the project. However, for your budgetary and confractual purposes, we recommend an allocation of 735 hours of HJA staff time and a budget fo~ the work described herein. . •
Task 1.6a: GeotechnicCJI Investigation ($37,340.50}
Based on our. understar:iding of the project, we propose the following work scope: permitting, field exploration, .laboratory testing, and geotechnical data summary.
Permitting and Project Initiation
We have assumed that the City will provide a no-fee encroachment permit for work within the , PVR right-of-way: (ge6technical drilling and/or ADL sampling). If the geotechnical drilling is performed within the farm ~aul roads rather than in the PVR travelled way, we assume the City will coordinate access at no cost to Oakridge Geoscience, Inc. (OGI). We also have assumed a permit will be required .fr,om the Ventura County Watershed Protection District for infiltration testing within the· dr~inage ditch.
Prior to field exploration, OGI will perform a site reconnaissance to locate and mark the exploration locations.(drill holes and ADL test sites) for coordination with Underground Service Alert. OGI will not be responsible for mislocated or unlocated utilities. We have included a task for a private utility lofator to locate utilities within PVR if the geotechnical drilling explorations are performed in th~ ioadway.(as required by our drilling subcontractor). 4 I
CC Agreement No. 2019-53
EXHIBIT A
Geotechnical Field Exploration
Based on the length of the proposed bike lane widening area, we will advance up to six ' • explorations (three on each side of the widening area) to depths of about 10 feet or refusal, I
whichever occurs first, The drill holes will be advanced by S/G Drilling of Lompoc, California, If the drill holes are performed .in PVR, the drilling will be conducted under lane-closure provided by Total Barricade Service of Oxnard. Additionally, we will perform a visual pavement evaluation of the existing PVR pavement along the project alignment'as part of the field study.
Relatively undisturbed, .and bulk samples will be collected from each drill· hole for laboratory . testing. Our field personal will log the recovered samples in general accordance with ASTM D2488 for visual soil classification. If groundwater or seepage is encountered daring excavation, it will be measured and recorded on the drill hole log.
Following completion at eac_h location, drill holes advanced within PVR will be backfilled with the cuttings mixed with Portland to create soil cement and the pavement patched with quickset cement. If the drill holes advanced within the haul roads will be backfilled with cuttings and tamped. We anticipate_ two field days to complete the drill holes, assuming encroachment permit working hours of 9AM to 3PM.
Geotechnical Laboratory Testing
We will perform geotechnical laboratory testing on the sampled soil materials. The laboratory testing program is expected. to consist of moisture content,' classification (grainsize and/or plasticity), shear strength, and R-value.
Infiltration Testing
We will perform borehole or test pit infiltration tests at two. locations within the drainage ditch in accordance with·ventura County Technical Guidance Manual for Stormwater Quality Control . Measures {2017). We anticipate the tests will be performed at a shallow depth of about two to , ' ' ' four feet below grade: • • '
Summary Report
Following completion of'the field exploration and testing, we will prepare a report that will summarize the following information as.requested by the project designers:
• Summary of soil types encountered in the. exploration locations; • Geotechnical laboratory test results;
• Geotechnical recommendations for the concrete channel slope improvements and asphalt pavement improvements;
• Summary _of pavement conditions based on observations; • Infiltration rates per County of Ventura Guidelines, and • Results of ADL testing.

An electronic draft copy (pdf) wil l be submitted for the draft report via email for review and comments. A pdf of the final report can be submitted within five working days of receiving commen ts.
Task 1.6b-Aerially Deposited Lead (AOL) Screening ($6,672.07) The PVR project is not a Caltrans roadway and is not anticipated to be subject to Caltrans AOL sampling criteria (tests at 300-foot maximum spacings). On that basis, we propo se to perform AOL testin g at about 1,000-foot interva ls (a total of seven locations) along the PVR widening alignment with sampling location s on both the north and south sides of road in the propo sed widening area. We propo se to conduct the AOL testing in hand-auger/power spade test holes conducted on the dirt area between the pavement and drainage ditch on the northern and southern sides of the road. The test holes will be advanced by one to two peopl e out of the trave lled way under "work ahead" type signage and delineator s; we have not provided for lane closure traffic control for this work.
The AOL testing will be conducted at seven locations consistent with standard Caltrans samplin g procedure s (i.e., in test holes advanced to a depth of about two to three feet depending on depth of disturbance of proposed construction activities, sampling at th ree intervals - 1) 0 to ½- foot, 2) ½- to 1-foot, and 3) 1 to 3 feet. Samples will be transported to Fruit Growers Laboratory in Santa Paula for Total Lead and pH testing. If Total Lead values exceed 80 parts per millio n, solub le lead testing wi ll be performed on those samples (a maximum of seven samples) in accordance with Caltra ns/ OTSC requirement s. We have assumed 21 total lead tests and seven samples tested for soluble lead. The AOL fie ld and laboratory test data will be included in the project report for the widening project.
Task 1.7: 30% Design and Contact Utility Owners ($47,885.06) Contact Utility Owners
The Kimley-Horn team will coordinate wit h the City to identify util ity agencies to send initial letter s ("A" Letters) to request utility as-built informatio n for the project location. Utilit y information will be incorpor ated into the proj ect base mapping.
Kimley-Horn will continu e with the utility noti fication process. Conflict lette rs ("B" Letter s) will be sent out to the approp riate utility agencies to reflect the propo sed improvement s and assess the location s of their faciliti es as incorporat ed into the base mapping. Potential confl icts will be identifie d and follow -up coordination will be conducted to resolve the conflict s or provide for relocation . If necessary, new or revised service location s will be coordinated with the various utilities for electri c and phone service. Noti ce to relocate letters ("C" Letters), if necessary, will be sent out to the appropriate utility agencies after final design is appro ved.
Deliverables :
• Revised Uti lity Base Map and Matrix

RE: Pleasant Valley Road Bike Lanes ST-5006
Additional Scope of Services – Water Quality Treatment and Green Streets Understanding
The purpose of this letter is to request an amendment to the current contract to allow Kimley-Horn to provide additional services required to complete the Pleasant Valley Road Bike Lanes Project (Project) per the City’s direction in the letter dated August 23, 2023. The timing is critical as the design needs to be completed and permits submitted prior to submitting the Request for Authorization in December 2023. As the Project has progressed there have been additional scope items that have been required.
These additional scope changes include conversion of the specifications to Caltrans format, investigation and analysis of Green Streets and Permitting requirements, revised water treatment and channel design, and additional analysis required to support the permitting applications.
Part of the scope changes were due to the administration change in Washington, which caused a shift in guidelines and regulations concerning the ditch jurisdiction causing permitting guidelines to become more restrictive. As a result, the ditch along the north side of Pleasant Valley Road became a Waters of the US channel, which GPA initially reported that it was not considered Waters of the US. This reclassification impacted the design direction of the channel and the recommended water quality treatment approach and measures to be implemented.
Initially, Kimley-Horn obtained design approval from the City’s Water Quality Team on 4/13/2022 and addressed the City’s 95% comments and submitted the 100% project plans, specifications and estimate to the City on 9/8/2022. At which point, the channel design plans, and design was altered by the City and multiple Water Quality and Permitting meetings were held to change the direction of the design.
Through the course of those meetings and final determination by the City as provided in the 8/23/2023 letter, the City has elected to install (18) 4 x 8 modular wetlands to fulfill the water treatment and Green Streets criteria. The City has provided this written direction for design approval and installation of the modular wetlands. Since the manufacturer was not recommending this scenario, the City will not be getting the manufacturer’s warranty for this installation.
As a result of the above project development, we have provided additional scope of services for your consideration.
Scope of Services
The following Tasks will be performed to provide additional support for the Plans, Specification, and Estimate package for construction.
EXHIBIT A
CC Agreement 2019-53A
kimley-horn.com 660 South Figueroa Street, Suite 2050, Los Angeles, CA 90017 213 261 4040 Task 1: Specifications
Task 1.1 Specification Conversion (National Highway System) The scope of this work is to convert the roadway specifications from Greenbook standards to Caltrans Standards. The draft 100% specifications were completed in Greenbook format, however since then, Caltrans has reinforced that all plans and specifications for roadways on the National Highway System be completed in Caltrans format. Kimley-Horn will prepare project technical specifications in Microsoft Word format for incorporation into the City’s boilerplate.
Deliverables:Final specifications in Caltrans format.
Task 1.2 Specification Updates Attributed to Design Changes The scope of this work is to update the 100% Project Specifications to reflect the design changes as described in Task 2, including the addition of modular wetlands.
Task 2: Green Streets Post 100% Design Analysis
Task 2.1 Water Quality and Permitting Meetings
The team attended the following water quality scope meetings with the City and Water Quality team following water quality design approval on 4/13/2022.
04/13/2022 Meeting with City and Water Quality Team
10/27/2022 Meeting with City and Water Quality Team
11/30/2022 Meeting with City and Water Quality Team
04/26/2023 Meeting with City and Water Quality Team
06/01/2023 Meeting with City and Water Quality Team
As a result of these meetings, Kimley-Horn analyzed multiple scenarios and provided details and summaries to gain City acceptance. Task 2.2 summarizes these efforts.
Task 2.2 Water Quality and Permitting Analyses and Design The team held meetings with the City and Water Quality Group on 10/27/22 and 11/30/22 to discuss the infiltration trench, assess suitable pretreatment options, and the best implementation for Green Streets. Following these meetings, Kimley-Horn conducted extensive research on innovative pretreatment and feasible Green Streets solutions and explored options related to ditch pre-treatment and non-concrete ditch lining alternatives. The team examined design sections with and without the infiltration trench and coordinated with vendors for fabric and GeoWeb lining applications. The findings of these investigations were included in the memorandum submitted on 1/16/23, which also compared the cost implications of concrete-lined channels versus high-performance mat or GeoWeb lined channels.
CC Agreement 2019-53A
kimley-horn.com 660 South Figueroa Street, Suite 2050, Los Angeles, CA 90017 213 261 4040 On 4/26/23, a meeting was held with the City to discuss permitting requirements. During this meeting, the City confirmed that processing the permits under Waters of the US jurisdiction was the correct approach and requested all treatment options within the channel be eliminated. The City also reviewed the Green Street options presented in the 1/16/23 memo and requested alternative options be explored.
Per the City’s direction, Kimley-Horn conducted additional research on Filterra/modular wetlands and permeable pavement, submitting an additional memorandum to the City on 5/19/23. The memorandum included a cost summary of the options presented.
After a meeting with the City and Water Quality team on 6/1/2023, Kimley-Horn submitted a final memorandum to the City on 6/6/2023. This memorandum provided detailed information on all studied Green Streets options and conducted an in-depth assessment of Modular Wetlands and Permeable Pavement. A cost summary of the options was included alongside the memorandum.
The City has decided to proceed with the Modular Wetland Options along with a concrete-lined channel and possibly the inclusion of native vegetation at the bottom of the channel. The City issued a letter authorizing the incorporation of modular wetlands and will accept maintenance responsibility of the proposed design related to manufacturers recommendations. Irrigation is not included in this design scenarios and the City will determine the best way to maintain vegetation planted along the corridor in the Modular Wetlands. Kimley-Horn will incorporate these changes into the Final Plans, providing Modular Wetland details, landscape details, and revised channel cross-sections and transitions accordingly. Additionally, plan callouts, specifications, and estimates will be updated to reflect the design modifications described above. Coordination with Contech will be carried out by the Team to confirm proposed locations, sizes, and custom modular wetland design. It is anticipated that a custom modular wetlands design will be required to meet the falling head requirement, as discussed in the 6/6/2023 Green Streets Memorandum and per previous discussions with the manufacturer. The City will work with the manufacturer on best maintenance practices for this installation.
Task 2.3 Landscaping Services
Kimley-Horn will provide landscape architecture services to select planting material for modular wetlands. Planting selection will include limits of planting, plant types, quantities, size, details, and notes. All proposed plantings will comply with the State's Water Efficiency, Ordinance. No irrigation will be provided beyond the plant establishment term in the construction contract.
Task 3: Permitting Support
Task 3.1 1602 Permit Support
On 1/5/23, GPA informed Kimley-Horn that the California Department of Fish and Wildlife changed the way it defined “projects” on the 1602 Permit application and that once a design decision was reached, the 1602 Permit Application would need to be revised and broken down into smaller “projects.”
Due to the change, Kimley-Horn will support the permit application by revising the quantities, cost, written description, and list of equipment used per the following breakdown:
·Excavation and grading in the north channel (1 project) ·Lining north channel (1 project)
·Culvert replacement for driveways (9 projects)
