GPA SCOPE OF WORK
Pleasant Valley Road Bike Lanes Project
Pr
oject Understanding and History
The City of Camarillo (City) proposes to construct Class II bicycle lanes on approximately 1.6- mile portion of Pleasant Valley Road between approximately Las Posas Road on the west and 5th Street on the east in the city of Camarillo, California. The project would terminate within the city boundary prior to the railroad tracks on 5th Street.
The project is permitted under a 1602 Streambed Alteration Agreement Operation of Law from the California Department of Wildlife (CDFW) . A Section 401 Water Quality Certification from the Regional Water Quality Control Board (RWQCB) and a Section 404 Nationwide Permit verification from the United States Army Corps of Engineers are pending. The construction period is expected to be 11 months and is expected to be continuous.
Scope of Work
The following scope of work includes work to be completed during the pre- construction, construction, and post-construction phases of the project as part of the permit compliance for the project.
Task 1: Construction Support Project Management
GPA will manage the environmental monitoring and support services during the construction phase of the project, in coordination with the City . GPA will maintain a clear line of communication with the City throughout pre-construction, construction, and project closeout. GPA will conduct regular status checks to ensure all tasks are on schedule and within budget and will prepare a monthly progress report . GPA assumes the combined pre- construction, construction, and project closeout phases will last approximately 14 months. GPA assumes the construction phase will last approximately 11 months.
Deliverables: One electronic copy of up to 14 monthly progress reports Task 2. Construction Monitoring
Prior to construction, GPA will compile the California Environmental Quality Act ( CEQA), National Environmental Policy Act ( NEPA), and regulatory permit requirements and prepare a construction monitoring checklist that will be used to document compliance through the construction period. GPA will monitor specific activities as required by project permits such as oversight of flagging and staking of environmentally sensitive areas, implementation of Best Management Practices (BMP), initial clearing and grubbing, and installation/removal of the water diversion. GPA will conduct weekly spot checks to ensure that BMPs are in place and functioning properly and the project is in compliance with regulatory permits.
GPA estimates that up to 50 monitoring visits will be required . Each visit will be conducted by one biologist. GPA will summarize the results of each monitoring visit in a memo format for the project file.
Exhibit A
CC Agreement 2019-54B
GPA will coordinate with the City as needed to resolve compliance concerns during monitoring visits. GPA assumes that the pre- construction surveys will not identify a special -status species and therefore, full - time construction monitoring would not be required. If additional monitoring is requested or required, GPA will provide an additional scope and cost to support this effort.
Deliverables: One electronic copy of up to 50 construction monitoring logs Task 3. Regulatory Agency Submittals and Notifications
GPA will coordinate with the City to complete any required pre- construction submittals and notification s to the USACE, RWQCB, and CDFW as part of environmental approvals for the project . GPA will coordinate with the design engineer and the C ity to gather and/or prepare the necessary documentation and will submit the information to the agencies, as required.
During the construction phase, GPA will provide notification and/or reports as required to comply with permit requirements, including notification of installation/removal of the water diversion. Additional submittals may include notification of spills of hazardous materials.
Following construction, GPA will complete a survey to record post -construction conditions in the project area. GPA will take post-construction photos of the entire construction area to document that CEQA, NEPA, and regulatory permit requirements have been successfully implemented.
GPA will coordinate with the City to complete any required post-construction submittals and notifications to regulatory agencies as part of environmental approvals for the project. Post-construction submittals will include Notification of Project Completion. GPA will coordinate with the City to gather and/or prepare the necessary documentation and will submit the information to the agencies, as required.
GPA assumes up to six pre-construction, construction, and/or post-construction permit submittals may be required. Submittals will be minor and not include permit amendments or reporting.
Deliverables: One electronic copy of up to six required agency submittals and notifications; one electronic copy of post-construction survey report
Task 4: Environmental Commitments Record
GPA will create and maintain the Environmental Commitments Record (ECR) and will coordinate with the City to document completed environmental commitments throughout the pre-construction and construction phases. GPA will update and maintain an electronic copy of the ECR for City’s records.
Deliverables: One electronic copy of the ECR
Task 5: Pre-Construction Surveys and Reporting
Task 5.1 Nesting Bird Pre-Construction Surveys
If construction is initiated between February 1 and September 1, GPA will conduct nesting bird surveys no more than 72 hours prior to construction . Surveys will be conducted within 500 feet of the construction area to determine whether there are any nesting birds, including raptors, present. If any nesting bird is Exhibit A
CC Agreement 2019-54B
found in or within 500 feet of the construction area, GPA will coordinate with the City to develop and implement appropriate avoidance measures. If construction is delayed for three days or more during the nesting season (February 1 and September 1), an additional survey will be conducted. GPA assumes up to two pre-construction nesting bird surveys may be required. Surveys would be conducted by one biologist.
GPA will summarize the results of the surveys and any subsequent coordination in a memo format report for the project file.
Deliverables: One electronic copy of the Pre-Construction Survey Memorandums Task 5.2 Monarch Butterfly Surveys
If construction is initiated between September 1 and March 31, GPA will conduct monarch butterfly surveys focused on refuge sites (typically eucalyptus, Monterey pine, and Monterey cypress) in areas where vegetation removal or excavation would be conducted. Surveys will be conducted no more than 48 hours prior to initiation of vegetation removal or excavation to determine if monarch butterfly are overwintering within these areas. If monarch butterfly is identified overwintering in these areas, efforts would be taken to avoid these areas and GPA will coordinate with the City and regulatory agencies, if warranted, to develop and implement appropriate avoidance measures. Overwintering monarch butterflies would be allowed to finish overwintering and migrate out of the project area. Once the overwintering monarch butterflies have left the project area, avoidance measures will be removed. If construction is delayed for five days or more during the overwintering period (September 1 and March 31), an additional survey would be required. GPA assumes up to one pre-construction monarch surveys may be required. Surveys would be conducted by one biologist. GPA will summarize the results of the surveys and any subsequent coordination in a memo format report for the project file.
Deliverables: One electronic copy of the Pre-Construction Survey Memorandums Task 5.3 Daytime Bat Habitat Assessment
If the project is conducted during the maternal season for bats (typically late March through mid - September), a bat roosting habitat assessment will be conducted of all potential roosting habitat within 100 feet of construction activities. The survey will include a visual inspection to identify signs of roosting.
If needed emergence surveys will be conducted to confirm presence or absence of bats under the optional task below. GPA assumes the bat habitat assessment will be conducted in one day by two biologists.
Deliverables: One electronic copy of the Pre-Construction Survey Memorandum Task 5.4 Nighttime Bat Emergence Survey
If required based on the results of the habitat assessment, GPA will conduct nighttime emergence surveys of any trees that have potential bat roosting habitat to confirm presence or absence of bats.
The surveys will be conducted during the peak period of the bat maternity season (i.e., in June through early August) , if feasible, to allow for the detection of bat maternity colonies if present. During the nighttime acoustic and emergence survey, the trees would be monitored for emerging bats to confirm bat occupancy and ascertain which trees are occupied by bats , if present. The nighttime survey would begin Exhibit A
CC Agreement 2019-54B
approximately 0.5 hour before sunset and continue until approximately one hour after sunset. Night vision goggles (military-grade PVS -7, Generation 3) would be used to observe emerging bats after sunset. GPA estimates that four biologists would be sufficient to ensure adequate visual coverage of trees during the nighttime emergence surveys.
The number of nighttime surveys depends upon the number of trees containing suitable bat roosting habitat, which would not be determined until the habitat assessment has been conducted. For the purposes of this proposal GPA anticipates multiple eucalyptus (Eucalyptus sp.), Peruvian pepper ( Schinus molle), and other ornamental trees could contain suitable bat roosting habitat. Surveys would be conducted over two nights with four biologists each night.
Following the nighttime emergence surveys , GPA will prepare a brief memorandum summarizing the results of the surveys and documenting the numbers of any bats observed on site. The memorandum will also provide a figure showing the locations of identified roost sites . The memorandum will include recommendations for bat avoidance, minimization, and mitigation measures to minimize potential impacts.
Deliverables: One electronic copy of the Pre-Construction Survey Memorandum Task 6. Mitigation Coordination
The regulatory agencies are anticipated to require environmental mitigation for impacts on aquatic resources. GPA will conduct preliminary research to support potential options available to the City for compensatory mitigation compliance. If requested, GPA will reach out to CDFW, USACE, and/or RWQCB to inquire if a potential mitigation option would meet their approval. If requested, GPA will support the City to meet compensatory mitigation obligations by contacting the selected mitigation bank and/or In- Lieu Fee Program to provide the required information to initiate the credit purchase, and coordinate with the Bank and City to support City’s execution of the purchase.
GPA will provide up to 40 staff hours (16 project manager hours and 24 support staff hours) to support this effort. If additional hours are required, GPA will provide support in a separate scope and cost.
Deliverables: Up to 40 staff hours
Task 7. Water Quality Monitoring and Reporting
During construction, a cofferdam and pipe water diversion will be required. Per the 401 Wate r Quality Certification received for the project, a water quality monitoring plan shall be submitted to the Regional Water Quality Control B oard at least 30 days prior to dischar ge into the affected water body. GPA will prepare the water quality monitoring plan for submittal to the RWQCB. W ater quality monitoring is required daily for the first week and weekly thereafter. GPA assumes up to 52 days (5 days the first week and 47 weekly visits thereafter) of monitoring will be required. The results of the water quality monitoring will be provided in a monthly monitoring report and be submitted via email to the RWQCB. GPA assumes up to 11 monthly reports would be necessary during construction.
Deliverables: One electronic copy of the Water Quality Monitoring Plan and up to 11 monthly Exhibit A
CC Agreement 2019-54B
monitoring reports
Task 8. Water Quality Exceedance Reporting
If the results of the daily water quality monitoring identify exceedances of construction water quality thresholds included as a condition of the 401 Water Quality Certification issued for the project , GPA will prepare and submit exceedance reports to the RWQCB within three days of the exceedance. The exceedance reports will be submitted via email to the RWQCB. GPA assumes up to four exceedance reports may be necessary during construction.
Deliverables: One electronic copy of up to four exceedance reports Task 9. Lake and Streambed Alteration Notification
The project is currently permitted under a Section 1602 Operation of Law from CDFW. If the project design or timing changes from what was provided in the original 1602 Streambed Alteration Agreement Notification, a new notification will need to be submitted to CDFW. If required, GPA will prepare a Streambed Alteration Notification package for submittal to the CDFW through their online EPIMS portal.
The application will include a brief description of the project; an assessment of impacts on CDFW jurisdiction, proposed best management practices, and other pertinent project information, as required by the CDFW. GPA assumes up to one minor informational request would be required to obtain the agreement. GPA assumes no site visit or agency meetings will be required.
Deliverables: One electronic copy of the 1602 notification package Assumptions
This scope has been prepared based on the following assumptions:
▪ Permission to enter properties that require entry to complete biological surveys and/or monitoring would be provided by the City.
▪ GPA assumes up to 50 construction monitoring visits will be required. If additional monitoring visits are required, GPA will provide a separate scope and cost to support that effort. ▪ GPA assumes the combined pre -construction, construction, and post -construction phases will last approximately 14 months and up to 14 monthly progress reports will be needed. If project management and monthly progress reports are required beyond 14 months, additional budget may be needed.
▪ GPA assumes up to six agency submittals and notifications will be required. If additional submittals are required, additional budget may be needed.
▪ GPA assumes compliance with air quality and noise measures would be conducted by the contractor, and additional support from GPA would not be required. If required, this would be provided under a separate scope and cost.
▪ If unexpected cultural resources are discovered during construction, archaeological services would be provided under a separate scope and cost.
