AGENDA REPORT
Date: June 10, 2026
To: Honorable Mayor and City Councilmembers
From: Greg Ramirez, City Manager
Submitted by: Bradley Calvert, Director of Community Development Subject: Arneill Road Housing Project No. CUP-400 – Award Construction Contract
BACKGROUND
The City acquired the Arneill Road Property in 2017 using legacy Redevelopment Funds with the ultimate purpose of developing a 9-unit affordable housing project. Once approved by the Planning Commission in 2023, efforts began in earnest to secure grant funding for construction.
In late December 2024, the City was awarded an Encampment Resolution Fund (ERF) grant by the state Department of Housing & Community Development totaling $7,305,292 with $6,382,392 available to fund construction. Since then, the City Council awarded a $1,093,559.70 contract to S.L. Leonard to provide construction management, inspection services and materials testing for the project.
In March of 2026, the City Council approved the solicitation of bids for the construction of the Arneill Road Project.

Staff reviewed the low bid submitted by SBS Corporation (SBS) and all associated forms, investigated the contractor, and determined SBS to be responsive to the bid solicitation.
On May 19, 2026, the City received the attached bid protest from Riviera Construction Group claiming that SBS Corporation and McGillivray Construction submitted non- responsive bids.
On May 21, 2026, SBS Corporation submitted the attached letter to the City in rebuttal to Riviera Construction Group’s letter.
On May 27, 2026, the City responded with the attached letter to the bid protest submitted by Riviera Construction Group regarding SBS Corporation. For the reasons stated in the City’s response, staff recommend that the City Council reject the bid protest of Riviera Construction Group.
Staff recommend awarding a contract to the lowest responsive bidder, SBS Corporation, for the bid amount of $5,941,787.67 and authorizing a contingency in the amount of $891,268.15 (approximately 15%) for unforeseen additional work if required for a total agreement authorization of $6,833,055.82.
