City
Council
Report
TITLE: Investment Report - Quarter Ending June 2023

RECOMMENDED ACTION
That the City Council approve the Investment Report for the quarter ending June 2023 and the report be noted and filed.

DISCUSSION
The City invests primarily in the State of California Local Agency Investment Fund (LAIF) and US Government Agency securities to preserve the safety of the City’s surplus funds while achieving a reasonable portfoli o return. The City’s strategy is one of buy-and-hold in which a portion of the portfolio is invested in fixed income securities of varying maturities providing sufficient cash flow to meet the City’s operational needs.

During the quarter, the City’s to tal pooled investment portfolio increased $4.2 million to $102.0 million The City purchased $2.0 million in securities; a $1.0 million fixed rate government agency FHLB bond with a 9 month maturity earning 5.1%, along with a $1.0 million FNMA with a 1.0 ye ar maturity earning 5.33%. A $1.0 million fixed FHLMC earning 5.6% was redeemed early. Interest earned for the quarter rose to $746,017and $11.1 million in property taxes were received during the quarter, up 5% year to year.

Outflows were relatively averag e with no particularly large expenditures. Please note that the City pools all cash for investment purposes, but accounts, reports, and tracks investment income, other revenue, and expenditures separately for each fund to properly meet the purpose and rest rictions of each funding source. This is common and appropriate practice used in public agencies to gain the benefit of economies of scale when investing.

All investments are made in accordance with the City's established Investment Policy (Approved by R esolution No. 12872 on August 16, 2022) or as authorized pursuant to bond covenants. Presented within this report are the following:
· Investment balance & earnings - Qtr. ending, June 2023 · Summary of investments by type - Qtr. ending June 2023 · List of investments by institution - Qtr. ending June 2023 · Reconciliation of pooled cash - Qtr. ending June 2023 · Summary of Total Cash Invested - Qtr. ending June 2023 · Monthly Schedule of Investments - Qtr. ending June 2023 Item: 4

Cash Flow
The cash flow projection reflects sufficient funds available to meet the City of Campbell’s anticipated expenditures for July 2023 through December 20 23. (Attachment B). When highly liquid LAIF funds ($75.0 million) are combined with actual cash on deposit ($5.5 million), the City has $80.5 million in actual liquid cash balances as of the end of June 30, 2023. The City’s managed liquidity is estimated t o decrease by $16.3 million down to $64.2 million by the end of December 2023, due to a projected 6 months cumulative $14.3 million negative operational cash flow as well as an estimated $2.0 million in new investment purchases drawn from LAIF. Expenditure s will be larger due to $5.1 million paid for the FY 2024 annual unfunded CalPERS liability prepayment, $1.4 million for the annual JPA insurance premium, $5.1 million in combined debt service for TARB, LRB and Measure O bonds as well as increased A/P activity consistent with seasonal trends. Staff expects property, sales and other economic activity -related receipts to continue growing year to year and investment interest income to be larger this year but will remain mindful and watch if signs start pointing to slower growth. Staff prioritizes safety, liquidity, and maximizing return, in that order.

Report
TITLE: Amendment to the Classification and Salary Plan - Unhoused Specialist (Resolution/Roll Call Vote)

RECOMMENDED ACTION
That the City Council adopt a resoluti on amending the Classification and Salary Plan to include the new classification of Limited Term Unhoused Specialist, adding a 1.0 full - time equivalent (FTE) to the City's approved position list for Unhoused Specialist, and implementing a corresponding bud get adjustment to shift funds from contractual services to salary and benefits accounts.

BACKGROUND
The Fiscal Year (FY) 2024 Adopted Budget includes funding for an Unhoused Specialist in the Community Development Department. This position would be a three-year limited-term position, contingent on the acceptance of a Capacity Building Grant from "Destination Home." The Community Development Department will be presenting to the Council the recommended acceptanc e of the Destination Home Capacity Building Grant, which will serve as the funding source for the Unhoused Specialist. Please note that in the FY 2024 Adopted Budget, this was intended to be a contractual outside service, fully covered by the Destination Home grant. However, based on needs and market conditions for contractual services of this nature, staff recommends changing this to a limited term benefited City position. Nevertheless, based on the recommended salary range for the Unhoused Specialist, s taff still expects that the full costs can be covered by the Destination Home grant.

DISCUSSION
The recommendation to hire an Unhoused Specialist emerged from an audit of the Housing Program, which was accepted by the City Council on May 16, 2023. This position is also identified as an actionable step in the City's approved Housing Element under Program H -5e. Reporting to the Housing Manager, the Unhoused Specialist will contribute to the City's efforts in implementing the 2020 -2025 Santa County Community Plan to End Homelessness, an initiative that received endorsement and support from the City Council on April 20, 2021.

Unhoused Specialist - Amendment to the Classification and Salary Plan Page 2 of 4 This strategic decision arises from the pressing need to address the city's housing issues effectively. It is crucial for executing t he approved Housing Element and fulfilling other significant responsibilities outlined in the job description.

The Unhoused Specialist, under the direct guidance of the Housing Manager, holds a central and multifaceted responsibility of overseeing and ha rmonizing diverse housing initiatives within the City focused on homelessness . This proactive approach, grounded in meticulous planning, empathetic engagement, and dedicated collaboration, positions the Unhoused Specialist as a driving force in achieving these crucial objectives.

Conducting a thorough total compensation analysis, the Human Resources Division engaged in a meticulous evaluation that involved comparing the position within benchmark cities as defined by the City's Memorandum of Understanding. In an effort to maintain competitiveness in the labor market, salary step ranges spanning from step 1 through 5 have been delineated. This strategic move aligns the City's total compensation framework with the labor market mean for the corresponding positions.

This particular role stands as a unique and distinct position, presenting comparability with only one other municipality within the spectrum of 11 benchmarked cities. This uniqueness stems from the specialized nature of the position, encompassing the delivery o f personalized one -on-one case management services to residents facing homelessness. TITLE: Salary Schedule Update - August 15, 2023 (Resolution/Roll Call Vote)

RECOMMENDED ACTION
That the City Council adopt a Resolution approving and confirming the S alary Schedule to comply with California Public Employees’ Retirement System (CalPERS) statutory and regulatory requirements for compensation earnable and publicly available pay schedules.

BACKGROUND
On November 4, 2016, the California Public Employees’ Retirement System (CalPERS) issued and distributed Circular Letter 200 -050-161. The subject of the circular is the “STATUTORY AND REGULATORY REQUIREMENTS FOR COMPENSATION EARNABLE AND PUBLICLY AVAILABLE PAY SCHEDULES”. This Circular Letter reinforces the r equirement under California Government Code (GC) section 20636(d) that “Notwithstanding any other provision of law, payrate and special compensation schedules, ordinances, or similar documents shall be public records available for public scrutiny”2. Additi onally, t he California Code of Regulations (CCR) 570.5 specifies the required elements necessary to meet the definitions of a publicly available pay schedule, and an overview of these requirements is as follows3:

1. Has been duly approved and adopted by th e employer's governing body in accordance with requirements of applicable public meetings laws;

2. Identifies the position title for every employee position;

3. Shows the payrate for each identified position, which may be stated as a single amount or as multiple amounts within a range;

4. Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;

5. Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website;

6. Indicates an effective date and date of any revisions;

7. Is retained by the employer and available for public inspection for not less than five years; and

8. Does not reference another document in lieu of disclosing the payrate.

On August 16, 2022, the City Council adopted resolutions ratifying successor Memorandums of Understanding (MOU)s, approving salary adjustments for unrepresented employees, and approving a revised Salary Schedule (City Council Resolutions 12877 through 12882) for employees within the following groups: Northern California Carpenters Regional Council (CARP), Campbell Police Civilian Employees Association (CPCEA), Campbell Municipal Employ ees Association (CMEA), unrepresented unclassified management, classified management, and Confidential Employees (CONF). Although the MOUs and resolutions included salary adjustments spanning a 3 -year period of time, the City of Campbell’s (City) Salary S chedule is updated annually and only covers salary rates for the upcoming Fiscal Year (FY).

Consequently, the revised Salary Schedule approved in August 2022 only included adjustments for FY 2 023. Salary adjustments for FY 2024 and so on require the Cit y Council’s approval of a revised Salary Schedule.

DISCUSSION
While the City of Campbell maintains a current and publicly available Salary Schedule on its external website , in compliance with legal requirements , the City Council ’s approval to update the City’s Salary Schedule on ly covers salaries for the upcoming year. As a result, the City Council must take action to update the Salary Schedule every year so that it is current and continues to comply with legal requirements.

City Council Resolutions 12877-12882 provide for a four percent (4%) salary increase in FY 2024 for employees in CARP, CPCEA, CMEA, unrepresented unclassified management, classified management, and CONF groups, effective from the first full pay period in July 2023. Therefore, to fulfill the requirements of both GC 20636(d) and CCR 570.5, staff is seeking adoption of the attached resolution to confirm the salary adjustments memorialized in the resolutions. This action does not alter any existing approvals. Instead, it confirms prior City Council approved pay increases.

In the future, as new MOUs and pay rates are agreed upon and ratified by the City Council, any necessary updates to the Salary Schedule will be presented to the City Council for approval, thus ensuring the City's o ngoing adherence to GC 20636(d) and CCR 570.5.
*Unhoused Specialist – The attached Salary Schedules includes salary information for a newly created Unhoused Specialist position; pending Council approval of the Unhoused Specialist job specification and sal ary step levels at the August 15, 2023 meeting. Should the accompanying action not be approved, the Unhoused Specialist salary information will be removed from the Salary Schedule. 8 Packet Pg. 50

FISCAL IMPACT
There is no fiscal impact associated with this action sinc e no payrates are being modified as a result of this action. The cost escalation resulting from the four percent (4%) CPI adjustment was encompassed within the FY 2024 Operating Budget , previously approved by the City Council.

ALTERNATIVES

1. Do not approve staff recommendation to update the Salary Schedule to be reflective of the CPI increases for previously approved MOUs for CARP, CPCEA, CMEA, unrepresented unclassified management, classified management, and CONF. This will put the City out of compliance w ith the MOUs resolutions and CalPERS Statutory and Regulatory Requirements.

2. Recommend alternative options to staff.

TITLE: FY 2022 Annual Report of the Citizen's Bond Oversight Committee for Measure O

RECOMMENDED ACTION
That the City Council receive the FY 2022 Annual Report of the Citizen's Bond Oversight Committee for Measure O.

BACKGROUND
On November 6, 2018, City of Campbell voters approved Measure O with a ‘Yes’ vote of 69.5% by the citizens that voted in the General Election. Measure O authorized the City to issue general ob ligation (GO) bonds in an aggregate principal amount of up to $50 million. The first series of Measure O Bonds was issued for a principal amount of $20 million in August 2020. The second (and final) series of Measure O Bonds was issued for a principal amou nt of $30 million in June 2022. As a condition of Measure O voter authorization and in order to ensure accountability for the expenditure of bond proceeds, the City established a Citizens’ Bond Oversight Committee (Committee).

This committee was formally appointed by the City Council on November 2, 2021.

Current Committee Members include the following Campbell residents:
• Al Bito, Chair (District 5)
• Anne Souza, Vice Chair (At Large)
• Paul Russell, Committee Member (District 4)
• Doris Quai Hoi, Committee Member (District 2)
• Steven Saunders, Committee Member (District 3)
• Terry Hines, Committee Member (District 1)
A primary duty of the Committee is to review expenditure reports produced by the City to verify that bond proceeds were expended only for the purpos es set forth in Measure O and to report to Council annually on their findings . This normally includes a review of annual audited financial statements as it relates to Measure O bond proceeds and project expenditures and any supporting documentation as requ ested. This item will present the second annual report of the Committee for FY 2022.

ANNUA
L REPORT OF THE MEASURE O CITIZENS’

OVERSIGHT COMMITTEE OF THE CITY OF CAMPBALL
FOR FISCAL YEAR (FY) 2021-22
Introduction. The Citizens’ Oversight Committee of the City of Campbell (the “COC”) was formed pursuant to Measure O for the purpose of actively reviewing and reporting on the expenditure of Measure O bond proceeds. The COC is required to advise the public, through at least one report per year, as to whether the City is in compliance with Article XIIIA of the California Constitution and Measure O.

Public Meetings. During the previous year, the COC has met on the following dates and locations:

Meeting Date and Time Meeting Location
August 30, 2022 – 4:00pm City of Campbell – Police Department City of Campbell – Library
July 13, 2023 – 4:00pm City of Campbell – Council Chambers Eac
h meeting has been held in compliance with the Ralph M. Brown Act , in that the meetings were formally scheduled with agendas duly posted and noticed and open to the public. Minutes were taken and when approved at the subsequent meeting were posted on the City’s web page via the link to information relating to Measure O and shown as Attachments C and D.

City Support. The City has, without spending bond funds, provided the COC with the administrative support it needs to meet and to perform its review and reporting duties.

Activities
Rev
iew of Expenditures. The COC was provided detailed expenditure reports, prepared by City staff, for FY 2021-22 at its July 13, 2023 meeting. Those reports are shown as Attachment B of the main Council report ; with minutes shown as Attachment C. At the meeting, the COC reviewed the expenditure reports. Members of the COC had the opportunity to ask City staff questions regarding the projects and expenditures. No irregularities or concerns were identified in the detailed expenditures reports, but the COC did request the following items and had the following questions:
• REQ
UEST – For informational purposes only, the COC requested an ongoing comparison of actual expenditures by project (Public Safety Building and Library) to budgeted expenditures by project. Staff will send the COC updated current reports to meet this request in the near future as well as ongoing and updated reports at each annual meeting. Please note though that the responsibility for budgetary control remains with the City Council.
• REQ
UEST – The COC requested copies of all vendor contracts related to each project.

This was a previous request and staff will send the COC vendor contracts to meet this request in the near future.
• REQ
UEST – The COC requested that the next annual meeting be tentatively held in January 2024 once the City’s FY 2022-23 financials are completed and that a scheduling poll be sent the group in December 2023 to set the date . Staff will do so and also tentatively set the next COC presentation to Council in March 2024. • QUE
STION – The COC inquired as to what caused the delay in issuance of annual expenditure and audit reports for FY 2021- 22. Staff responded at the meeting that this

9.a
Packet Pg. 67
Attachment: Measure O Oversight Committee FY 2022 Annual Report (Annual Report of the Measure O Citizen’s Oversight Committee) 2 was due to a time consuming unrelated prior period adjustment in the City’s main financials that caused all financial reports to be delayed in their issuance until April 2023. • QUE
STION – The COC inquired as to the nature of $11,312.50 expenditure reclassification in FY 2021- 22 and steps being taken to ensure it doesn’t occur again .

Staff responded at the meeting that the vendor in question worked on a number of City projects and an unrelated invoice was inadvertently coded to the Measure O projects at time of payment. Staff has been advised to review all Measure O invoices more carefully in the future to ensure that only related project expenses are charged to Measure O bond proceeds.

Rev
iew of City’s Annual Report . In addition, the City provided the COC with copies of the annual bond report for FY 2021-22, prepared by an independent auditor and also shown in Attachment B of the main Council report. No irregularities or concerns were identified in the Annual Reports.

Tour of
Bond Facilities. The COC toured the existing Campbell Police Department and Library on August 30, 2022, as allowed by the COC Bylaws. Minutes for this meeting are included with Attachment D.

Conclusion. Based on the foregoing review of expenditures and other activities, t he COC concludes that bond proceeds spent to date have only been spent for the acquisition and construction of real property for City facilities, as identified in the project list presented to voters, and as a result the City has complied with California Constitution Article XIIIA Section (1)(b)(3) and the text of Measure O.

TITLE: Accept Grant from Destination Home for Capacity Building Grant to Fund an Unhoused Specialist Position (Resolution/Roll Call Vote)

RECOMMENDED ACTION
That the City Council adopt a Resolution accepting a Capacity Building grant from Destination Home in the amount of $450,000 to fund an Unhoused Specialist position for a period of three years.

BACKGROUND
At the May 16, 2023, meeting, the City Council authorized the City Manager to apply for, negotiate, and execute a Capacity Building Grant with “Destination Home ” for an Unhoused Specialist position. The City subsequently applied for the Capacity Building Grant from Destination Home on May 24, 2023, and on June 14, 2023, received an award notification from Destination Home.

DISCUSSION
The Capacity Building grant will fully fund all staff costs associated with hiring an Unhoused Specialist for a three-year term and does not require any match funding from the City. The hiring of an Unhoused Specialist was recommended through an audit of the Housing Program that was accepted by the City Council on May 16, 2023, and is identified as an implementation item in the City’s adopted Housing Element under Program H-5e). The Housing Specialist will also support the City in implementing the 2020-2025 Santa County Community Plan to End Homelessness , that was endorsed and supported by the City Council on April 20, 2021.

Destination Home staff have provided a Capacity Building grant agreement (Attachment B) which outlines key obligations and terms of the grant . Per grant agreement, the Unhoused Specialist will need to perform and report on the following activities:
• Initiate Housing Problem Solving at the local level through the Unhoused Specialist by building relationships and trust with Unhoused residents and conducting service navigation on their behalf.
• Develop and launch a local implementation plan for Campbell with specific targets and outcomes for each of the three Community Plan strategy areas referenced in the Community Plan within the first year.

Item: 10
Category: UNFINISHED BUSINESS

In tandem with acceptance of the Destination Home grant, Human Resources staff have prepared a job specification for the Unhoused Specialist for presentation to Council, and following acceptance of the grant and creation of the position, will proceed with the recruitment process. Per the prop osed Job Specification for the position , the Specialist will be responsible for the following (consistent with the grant obligations):

Plans and organizes homeless services and activities on behalf of the City’s Housing Division including providing inte nsive, one -on-one case management for the City’s residents experiencing homelessness and assisting unhoused residents gain access to needed services to locate and secure affordable housing opportunities, including temporary, transitional, and permanent solutions.

FISCAL IMPACT
Acceptance of the Destination Home Capacity Building Grant to fund an Unhoused Specialist would not have a fiscal impact on the City.
