Se n ior P lanner Fama presented a staff rep ort dated January 22, 2024.

Mayor Landry asked about the walk way ar ound the drive way and if it was feasibl e to reduce the sidewalk to 10-feet.

Senior C ivil Engineer Storz stated generally the minimum drivewa y wi dth per C ity standards is 12-feet b ut there have been instan ces where the driveway was less .

He noted along the industrial frontage the sidewalk is only 3.5-feet wide and does not meet AD A requirements . Staff is request ing the applicant to widen the side walk to 5-f eet . The applica nt has also concurrently filed an easement vacation application as the sidewalk was in conflict with the proposed bui lding location. Mr. Stor z added that the City is remedying inconsistencies with the sidewalk s in th at area and as part of that project, staff has requested the applicant be consistent with those updates along the Kennedy frontag e.

He noted that widen ing an e xisting sid ewalk is problematic as it will end up separating or uplif ting and the only way would be to take out the e xisting sidewalk of 3.5 feet a nd replace with a 5-foot sidewalk attached to the existing sidewalk.

Mr. Caruso asked to speak and address staff ’s concerns.

Ma yor Landry re opened the public hearing and allowed Mr. Caruso to speak .

Mr. Caruso spoke to the side walk along Industrial Stree t, and that he believed there are ways to stabilize the sidewalk to widen it and that the soil reports show it could han dle a widen ed sidewalk.

Minutes of January 22, 2024 City Council Meeting Page 11 City Manager Loventhal advised that this is a pub lic right-of-way, a nd the liability and responsibility of the sidewalk would be on the City and advised the Council to follow staff ’s recommendations.

The Council discusse d if it was possible to leave the sidewalk along Kennedy as it currently exists . Staff stated that currently the City does not have the right-of- wa y for the existing sidewalk so the appl icant would need a con dition of approval to de dicate the right-of-way as necessary to make the existing improvements.

After discussion, Mayor Lan dry made a moti on th at the City Council adopt a resolution approving a Planned Development Permit w ith the revision of removing the detached sidewalk on Kennedy Aven ue.
