City
Council
Report

TITLE: Heritage Theatre General Fund Policy (Resolution/Roll Call Vote)

RECOMMENDED ACTION

That the City Council adopt a resolution eliminating the $200,000 General Fund subsidy limit for the Heritage Theatre operations effective FY25.

BACKGROUND

When the City planned for the opening and operation of the Heritage Theatre in 2004 it was generally accepted that the Theatre would not generate enough revenue to cover all its operational costs and expenses. During the restoration process money was set aside in a Theatre Reserve for operations . This reserve functioned to provide the difference each year between program revenues and expenditures for the first few years and was fully expended in FY09. With the funds being expended , staff was charged with presenting alternatives to the Council on how to address the ongoing need for support.

On March 10, 2010, staff presented strategies to help offset the need for General Fund assistance to operate the Heritage Theatre. At that meeting the City Council authorized staff to pursue the following:

1. Change the name of the ticket surcharge from Preservation and Enhancement Fee to “Facility Fee”;

2. Increase the Facility Fee to $2.00/patron for shows with ticket prices of $30 or more, but continue to provide staff with the discretion to negotiate this fee with returning rental clients;

3. Effective FY 2011, utilize a portion of the Facility Fees collected annually to offset Theatre operation so that the General Fun d subsidy does not exceed $100,0 00 per year; and

4. Continue to mentor the Theatre’s non -profit support group in their fundraising efforts so that they may become a more significant financial support for Theatre programs and operations.

Staff also proposed that the following procedures for the enactment of the above listed strategies which included:

1. Council to establish a maximum subsidy level for the Heritage Theatre;

2. Staff to re-evaluate the subsidy level every two years;

3. Staff perform a review of the P&E Reserve Cash Flow Analysis every four years Item: 14
Category: NEW BUSINESS
Meeting Date: June 4, 2024
14 Packet Pg. 314

to determine cash flow needs and confirm availability of funds for projected major Theatre maintenance, improvement or enhancement projects for the next five years.

4. Annually, during the budget process staff shall determine an appropriate amount of the Facility Fees collected to go to the P&E Reserve to maintain an adequate balance for future needs. The balance of the funds collected annually would be used to offset the need for General Fund subsidy to the amount below the determined maximum subsidy.

At the conclusion it was decided to provide $100,000 in General Fund annually to support the Heritage Theatre.

On February 17, 2015, staff presented to Council to adjust the policy associated with the Heritage Theatre to the following:

1. Increase the General Fund subsidy level to $200,000 effective FY 2016;

2. Establish a target fund balance of $375,000 for preservation and enhancement;

3. Revenue generated from the facility fee in account 101.529.4633 goes into operating revenue;

4. Revenue generated from the facility fee in account 101.529.4632 goes into the Preservation and Enhancement fund and withdrawals are made as needed to balance the budget.

DISCUSSION

It has been nine years since this policy was brought forward to Council for review. The grid below illustrates the General Fund subsidy since it was revised in 2015. The Preservation and Enhancement revenue (P&E rev.) was sufficient to offset the $200,000 subsidy while still adding to the reserve for the first two years and then began to shift where all revenue collected during the fiscal year for the reserve was being used to offset the General Fund subsidy. In FY 2020 the pandemic set in which created a large need for General Fund support for the next two fiscal years. A grant from the Shuttered Venue Operators Grant (SVOG) helped to offset huge impacts to the General Fund during that time. In FY 2022 the Theatre was able to reopen in a limited capacity and in FY 2023 no funds were added to the reserve and an additional $35,000 was withdrawn from the reserve to meet the General Fund subsidy policy. The balance of the Preservation and Enhancement Fund was $233,382 at the end of FY 2023.

When the business plan was developed in 2001 and updated in 2004 , one of the financial assumptions at the time was a planned annual subsidy of $250,000 from the City’s General Fund based on the economic conditions at that time. The economy has fluctuated significantly since the early 2000’s and the Theatre has continued to stay within this assumption until the onset of the pandemic.

The pandemic presented a lot of challenges for the arts industry and has been slow to recover. As illustrated in the grid above, the last several fiscal years have been challenging to stay within the $200,000 subsidy level while trying to build a reserve for preservation and enhancement.

In light of the slow recovery staff felt it necessary to bring this policy to Council for further discussion. In projecting outward, it is anticipated that the revenue collected annually for the preservation and enhancement fund will continue to be used to offset the difference of program revenues and expenditures. Additionally, it is expected that additional withdrawals from the fund will need to be made, drawing down the balance even further. With a current balance of $233,382, a continued annual reduction will leave the Theatre vulnerable to not being able to respond quickly to any equipment failures or preservation needs that may arise. As illustrated in Attachment B – Heritage Theatre Equipment Schedule, the highlighted items total $350,000 in potential equipment replacement needs over the next few years. The goal of this reserve was to have the funds available to replace equipment quickly to keep the Theatre operational for all scheduled events. A depletion of this fund would require projects to be submitted annually through the budget process and compete for capital funds or General Fund dollars and would delay the replacement which depending on the need can make the Theatre non-functional.

The Heritage Theatre has proven over the last twenty years to be a valuable asset to the community, the City and to the Recreation and Community Services Department. It has contributed to the overall well -being and vibrancy of our community and has demonstrated its ability to bring people together. Rather than imposing strict subsidy limits on an individual division within the Recreation and Community Services Department, it would be more effective to focus on the financial sustainability and efficiency across the entire Recreation and Community Services Department. The elimination of the subsidy limit doesn’t remove control from Council, but it allows flexibility in an unpredictable industry and places value on keeping the preservation fund healthy and available. The Heritage Theatre is one division of a larger department, by focusing on a more holistic approach the City can ensure that all its recreational and cultural assets, including the Heritage Theatre are well supported and positioned to thrive in the long term.

FISCAL IMPACT

Heritage Theatre General Fund Policy Page 4 of 4
Eliminating the General Fund subsidy limit could have a fiscal impact to the General Fund, but the actual level of subsidy will be reviewed and approved by Council annually through the budget process.

ALTERNATIVES

1. Increase the General Fund Subsidy policy as determined by the Council; or

2. Leave the General Fund Policy as is.
