RESOLUTION NO. 2022-202
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD,
CALIFORNIA, APPROVING THE SUBMISSION OF A REQUEST TO THE
CALIFORNIA DEPARTMENT OF TRANSPORTATION TO CHANGE THE
FUNCTIONAL CLASSIFICATION OF PARK DRIVE BETWEEN MONROE STREET
AND HILLSIDE DRIVE AND AUTHORIZING THE CITY MANAGER OR DESIGNEE
TO SUBMIT THE REQUEST
WHEREAS, the City Council of the City of Carlsbad, California has determined that the section of Park Drive between Monroe Street and Hillside Drive is classified as a Major Collector on California Road System maps while it is classified as a Local/Neighborhood Street in the Mobility Element of the General Plan; and
WHEREAS, the section of Park Drive between Monroe Street and Hillside Drive is a residential street of mostly single-family homes that meets the definition of a "residence district" under California Vehicle Code Section 515; and
WHEREAS, the section of Park Drive between Monroe Street and Hillside Drive has a curb-to curb width that varies from 35 feet to 48 feet; and
WHEREAS, Section 40802 of the Vehicle Code defines a "local street" as having the functional classification of a local street on the California Road System maps or, among other requirements, as being a roadway that is 40 feet in width or less; and
WHEREAS, since the section of Park Drive between Monroe Street and Hillside Drive is wider than 40 feet, the posted speed limit of 25 miles per hour, or MPH, cannot currently be enforced by the Police Department; and
WHEREAS, submission of a request to the California Department of Transportation, or Caltrans, to change the functional classification of this section of Park Drive would change its classification from a major collector to local street and would, if granted by Caltrans, allow the Police Department to enforce the posted speed limit of 25 mph on this section of Park Drive.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows:
1.That the above recitations are true and correct.
2.That submission of a request to Caltrans to change the functional classification of Park Drive between Monroe Street and Hillside Drive from a major collector to local street on the California Road System maps is hereby approved.
3.That the City Manager or designee is authorized to submit the functional classification change request for Park Drive between Monroe Street and Hillside Drive to Caltrans.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 16th day of August, 2022, by the following vote, to wit:
