Declaration of a Storm Related Local Emergency for repair of a sinkhole on Haymar Drive
All
Recommen
ded Action
Adopt a resolution confirming the City Manager’s declaration of local emergency for repair of a sinkhole in the area of Haymar Drive.
Executive Summary
On Saturday, March 18, 2023, at about 4:30 p.m., Transportation Department staff investigated a report of a sinkhole on Haymar Drive west of El Salto Falls Road. Staff determined the sinkhole was likely caused by a failed storm drain pipe carrying runoff water across Haymar Drive.
The Utilities Department staff was called in because the Vista-Carlsbad Sewer Interceptor pipeline is above the failed storm drain. This sewage line carries wastewater to the Encina Wastewater Authority’s Treatment Plant in Carlsbad. At the sinkhole site, the interceptor is a 36-inch diameter iron pipe that carries an average daily flow of 4.8 million gallons of wastewater per day and a peak wet weather flow of 14.7 million gallons per day. A pipe break in the V/C Interceptor would likely result in wastewater draining into the Buena Vista Creek, which is only 700 feet away, and the Buena Vista Lagoon, 2.4 miles away.
Exhibit 3 shows the location of the sinkhole, storm drain pipe and the interceptor pipeline.
The City Manager declared a local emergency to make immediate repair of the sinkhole six days later, on March 24, 2023. Staff are now requesting the City Council confirm the City Manager’s declaration of a local emergency so that the project can continue to be exempted from the city’s normal bidding procedures and the necessary repairs can be completed as swiftly as possible.

Item #7 Page 1 of 16
Construction projects that cost less than $200,000 can be awarded by the City Manager using informal bidding procedures under Carlsbad Municipal Code (CMC) Section 3.28.080 – Construction Projects, subsections (B) and (H), which implement California Public Contract Code Section 22032.
This project will likely cost more than $200,000. Carlsbad Municipal Code Section 3.28.110(A) implements Public Contract Code Section 22035 and provides for an exemption from formal bidding procedures for emergency construction procurements. To use the emergency exemption, CMC Section 3.28.120, as well as Public Contract Code sections 22035 and 22050, requires a declaration of a local public emergency by a four-fifths vote of the City Council and at the next regular City Council meeting.
Explanation & Analysis
Following the initial investigation into the sinkhole on March 18, 2023, staff placed temporary backfill to stabilize the sinkhole and traffic control around the damaged area. Three days later, staff used video equipment to examine inside a portion of an existing corrugated steel pipe culvert at the sinkhole location. This revealed a vertical separation in the pipe, which was the cause of the underground erosion.
The culvert crosses beneath the segment of the interceptor pipeline known as Reach VC1, which is owned and operated by the City of Vista and conveys wastewater flow from the northern half of Vista. The pipeline continues to run to the west and then south through Carlsbad to the Encina Wastewater Authority’s treatment plant. Staff were unable to view inside the remaining portion of the culvert to evaluate other potential problem areas.
Staff contacted the California Department of Transportation to inquire if they would be addressing the deteriorated steel culvert as a part of their larger project along State Route 78.
Although Caltrans has plans to rehabilitate the segment of culvert located within its right-of- way, it has no plans to repair the failed culvert located beneath Haymar Drive, which is in the City of Carlsbad. Caltrans provided documents on March 23 that indicate the state relinquished the property now occupied by Haymar Drive to the city in 1967. Caltrans asserts that the relinquishment included the storm drains. These documents are provided as Exhibit 4.
Staff met with four contractors to obtain bids for the culvert repair on March 24, 2023.
Three days later, staff received a bid from DB Pipeline, Inc., in an amount of $153,900. Using more durable PVC pipe to replace the entire length of corrugated metal pipe under Haymar Drive added $45,627 to DB Pipeline, Inc.’s bid for a total estimate of $199,527 or approximately $200,000.
One other bid was received in an amount of $414,290. A third contractor declined to submit a bid, and a fourth contractor did not submit a bid on time.
DB Pipeline, Inc. is a pre-qualified contractor that has successfully completed several utility Capital Improvement Program projects for the city. Considering that more rainstorms were forecast and concerned about the conditions around the critical interceptor pipeline and a possible spill, staff initiated the repair project with DB Pipeline, Inc. on March 27, 2023, based on a time and materials contract to accelerate the mobilization and begin work.
April 4, 2023
Item #7 Page 2 of 16
During the course of the work, staff determined that a repair process using corrugated metal pipe and cured-in-place pipe lining would provide an appropriate repair and was more feasible based on how close the break was to the active sewer line. Additionally, the complexity of replacing the existing pipe using the PVC pipe would have required opening up more of the street and taken longer to accomplish. However, with rain in the forecast for March 29, 2023, staff directed the contractor to proceed with an alternate plan that resulted in the pipe being laid, the sinkhole backfilled and the paving completed shortly before the start of the forecasted rain. The cured-in-place lining or an alternate method of repair will be carried out at a later date.
The declaration of a public emergency and the need for an emergency exemption are appropriate in this instance based on the following:
• Caltrans relinquished the right-of-way at the sinkhole site to the city in 1967 and has no plans to repair the culvert segment located outside of its right-of-way. • The sinkhole appears to be caused by a failed culvert located in the city right-of-way, which threatens to undermine a critical sewer pipeline. • Immediate repairs are needed to stabilize the sinkhole site and repair the failed storm drain line to prevent the potential spillage of almost five million gallons per day of untreated wastewater into the Buena Vista Creek and Buena Vista Lagoon.
Fiscal An
alysis
No additional appropriations are needed at this time. Funding for the estimated $280,000 repair project will come from the fiscal year 2022-23 operating budget – Storm Drain System Rehabilitation and Repair Program.
Options
Staff recommend the City Council confirm the City Manager’s declaration of a local emergency to complete the repairs the sinkhole in the area of Haymar Drive as swiftly as possible and prevent a potential sewage spill. Not confirming the declaration would likely result in delays and potentially more costs, with greater risk to the city and no benefits.
Next St
eps
Work to secure the interceptor pipeline and make immediate repairs to the storm drain has been completed. Staff have begun preparing the emergency contract, which will be presented for ratification to the City Council at a future date. The next phase of work to complete repair to the entire segment of the pipeline in the city right-of-way is expected to be completed in two weeks.
Haymar Drive Emergency Sinkhole Repair
Repair contract – DB Pipeline, Inc. $200,000
Design and administrative costs (5%) $10,000
Construction management and inspection (estimated) $20,000 Construction contingency (25%) $50,000
Total estimated project costs $280,000
April 4, 2023
Item #7 Page 3 of 16
Staff will return to the City Council on April 11, 2023, to review the emergency action and ask the City Council to determine by a four-fifths vote whether there is a need to continue it.
Environmental E valuation
The project has been determined to be exempt from the California Environmental Quality Act under CEQA Guidelines Section 15269, which applies to actions necessary to mitigate an emergency and to repair public service facilities necessary to maintain services essential to public health and welfare. Additionally, the project is also exempt under 15301(c), which apply to the operation, repair and/or maintenance of existing utilities involving negligible or no expansion of use.
