Subject: Agreement with the San Diego Humane Society for Animal Control Services

District: All

Recommended Action
Adopt a resolution authorizing the City Manager to execute an agreement with the San Diego Humane Society for Animal Control Services in an amount not to exceed $720,000 for Fiscal Year 2023-24.

Executive Summary
The San Diego Humane Society has satisfactorily provided animal control services in the city since it was awarded the contract in 2018. The city’s current contract with the Humane Society expires on June 30, 2023. Over the past five years, San Diego Humane Society personnel have demonstrated their competence and possess the professional qualifications necessary for the satisfactory performance of animal control services. Due to the Humane Society’s unique capabilities and service, the city has the option to select them under the sole source exemption from the standard bidding procedure to continue to provide animal control services.

The agreement requires the City Council’s approval under Chapter of the Carlsbad Municipal Code Section 3.28.040(D) because the cost to the city is more than $100,000 per agreement year. Section 3.28.110 allows for the “awarding authority,” which in this case is the City Council, to exempt certain purchases from the procurement provisions of Chapter 3.28, such as putting the procurement out to bid. Section 3.28.110 (B) exempts situations where services can only be reasonably obtained from a single source, as determined by the awarding authority.

The city’s Purchasing Officer has reviewed the proposed purchase and supports requesting an exemption. The City of San Diego released a request for information regarding animal control services in October 2022. The City of San Diego’s procurement manager advised that they only received one response from the San Diego Humane Society and awarded a sole source contract.

Explanation & Analysis
The city’s contract with the San Diego Humane Society is set to expire on June 30, 2023, and the Police Department wishes to continue to receive animal control services from the organization.

Animal control and sheltering are necessary and desirable services to provide to the community, and the Humane Society is uniquely qualified to provide these specialized, professional.

The complete scope of services is defined in Attachment A.

The non-profit San Diego Humane Society provides proper, humane, and efficient handling, adoption and treatment for dogs, cats and other domestic animals. It also ensures the enforcement of related state and city laws, ordinances and regulations. The society maintains animal shelters in Oceanside, Escondido, San Diego and El Cajon all of which are open to the public.

In addition to the services listed above, the Humane Society may routinely provide community engagement and services such as public education, community events, vaccinations and microchipping. The complete list of community engagement and services can be found in Exhibit A of Attachment A to Exhibit 1. San Diego Humane Society also categorizes their calls for service by priority and will respond within the times listed in Attachment A.

The city will continue to benefit from San Diego Humane Society’s Project Wildlife, where the goal is to return every animal treated back into their natural habitat. This service is essential in preserving the city’s local ecosystem.

The Humane Society has helped San Diego become the largest city in the country to keep healthy and treatable animals from being euthanized. In partnership with the San Diego Animal Welfare Coalition and rescue organizations, San Diego achieved zero euthanasia for healthy or treatable animals in 2015. The city is committed to staying at zero.

The Humane Society provides the Police Department with quarterly reports as well as an annual report. These reports include data on:
• Number of animals sheltered, including strays
• Community services provided, including licenses, vaccinations, microchips and spay and neuter surgeries
• Humane law enforcement, including the number and type of incidents or reports investigated as well as all administrative or criminal citations that were processed.

The city’s Housing and Homeless Services staff executed a separate agreement with the San Diego Humane Society to shelter animals of people experiencing homelessness. That agreement expires on June 30, 2023, and may be extended for another one-year term.

Fiscal Analysis
The fiscal year 2023-24 cost of this agreement is $720,000. The total amount will be appropriated from the Police Department’s requested operating budget for fiscal year 2023-24.

The annual net cost of the contract will be determined using a formula based on actual historical expenses including but not limited to animal intake, veterinarian-provided services, licenses issued and calls for service. The annual payments shall not increase by more than the June 6, 2023
Item #6 Page 2 of 24

annual increase in the Consumer Price Index for All Urban Consumers in the San Diego Area, plus 3%, unless agreed in writing by both parties.

The term of the agreement is for a period of 36 months, commencing July 1, 2023, and terminating June 30, 2026. The Humane Society and the city may extend the agreement for two one-year periods.

Options
Staff recommend the City Council approve the agreement so that the city can continue to provide animal control services. The Humane Society is uniquely suited to provide these specialized services, with the necessary expertise, resources and shelters. The San Diego County Department of Animal Control does not offer them to cities, as it did before 2018.

Next Steps
With the City Council’s authorization, the City Manager will execute the agreement and the San Diego Humane Society will provide animal control services to the City of Carlsbad from July 1, 2023-June 30, 2026.

Environmental E
valuation
This action does not constitute a project within the meaning of the California Environmental Quality Act under California Public Resources Code Section 21065 in that it has no potential cause to either a direct or physical change or a reasonably foreseeable indirect physical change in the environment.

To: Roxanne Muhlmeister, Assistant Finance Director/Purchasing Officer From: Amanda Baker, Management Analyst

Re: Bid Exemption Request for Animal Control Services (Districts – All)

This le
tter requests authorization for an exemption to the bidding process per Purchasing Code

3.28.110(B). The code provides a bidding exemption for goods, services and/or professional services that can be reasonably obtained only from a single source.

The police department is in the process of renewing our contract with the San Diego Humane Society for animal control services. City Council approved a sole source contract in 2018 and we have been contracted with San Diego Humane Society for the past five years. The contract is set to expire on June 30, 2022. The City of San Diego released a Request for Information regarding animal control services in October 2022. The City of San Diego’s procurement manager advised they only received one response from the San Diego Humane Society and awarded a sole source contract.

Since 2018, the San Diego Humane Society personnel have demonstrated their competence and professional qualifications necessary for the satisfactory performance of animal control services.

Due the unique capabilities and services of the San Diego Humane Society, the city has the option to sole source them to continue to provide animal control services. Animal control services are a necessary and desirable service to provide to the community. It is in the City of Carlsbad’s best interest to retain these specialized, professional services to provide animal control and sheltering services. The San Diego Humane Society ensures proper, humane, and efficient handling, ownership, treatment and disposition of dogs, cats, and other domestic animals. They also ensure the enforcement of laws, ordinances and regulations of the State of California and City of Carlsbad concerning the regulation, licensing, impounding and disposition of dogs, cats, and other domestic animals within the city. The complete scope of services is defined in Attachment A. In addition to the services listed above, the San Diego Humane Society may routinely provide community engagement and services such as public education, community events, vaccinations, and microchipping. The complete list of community engagement and services can also be found in Attachment A.

The contracted amount of $720,000 was included in the police department’s requested operating budget for FY23-24. The annual net cost of the contract will be determined using a June 6, 2023

formula based on actual historical expenses including but not limited to animal intake, vet provided services, licenses issued and calls for service. The annual payments shall not increase by more than the annual increase in the Consumer Price Index for All Urban Consumers (CPI-U), San Diego Area, plus 3%, unless agreed in writing by both parties.

Carlsbad Police Department requests a sole source exemption to execute a contract with the San Diego Humane Society. The term of the agreement is for 36 months, commencing on July 1, 2023 and terminating on June 30, 2026. The San Diego Humane Society and the city may extend the agreement for two one-year periods. If approved, Carlsbad Police Department will follow

3.28.050(D)(4) of the Carlsbad Municipal Code stating that City Council shall be the awarding authority for procurement of services and professional services for which the cost to the city is more than $100,000 per agreement year.
