Adopt a resolution accepting bids and awarding a contract to L.C. Paving & Sealing, Inc. for the 2023 Concrete Repair Project as part of the Concrete Repair/Replacement Program, Capital Improvement Program Project No. 6013-23, in an amount not to exceed $933,826.
Executive Summary
The project will replace damaged concrete such as sidewalk, curb and gutter, cross gutters, and Americans with Disabilities Act- compliant curb ramps throughout the city and is part of the city’s ongoing Concrete Repair/Replacement Program, Capital Improvement Program Project No. 6013.
The city established the Concrete Repair/Replacement Program to address miscellaneous concrete repairs to sidewalks, curb and gutter, ADA-compliant curb ramps, driveway approaches and cross gutters citywide. Staff have identified damaged, deteriorated, cracked and otherwise unusable concrete facilities within the city’s right-of-way. The proposed locations are provided in Exhibit 2.
Staff have reviewed the bids and recommend the City Council approve accept L.C. Paving & Sealing, Inc.’s $933,826 bid and award it the contract for the project. Carlsbad Municipal Code sections 3.28.080(I) and 3.28.080(I)(6), which provide for the purchasing of construction contracts, require the City Council’s approval for all formally bid contracts when the value exceeds $200,000, making the project subject to this requirement.
Explanation & Analysis
The City Council approved the project’s plans and specifications and authorized advertising for construction bids on April 11, 2023 (Resolution No. 2023-106). The project was then advertised using the city’s formal bidding procedures.

Staff received four bids for construction of the project on May 16, 2023. Staff completed review of the bid documents and determined that L.C. Paving & Sealing, Inc. is the lowest responsive and responsible bidder with a bid in an amount of $933,826.
Staff recommend accepting the bids and awarding the construction contract to L.C. Paving & Sealing Inc. for the project in an amount not to exceed $933,826.
Fiscal Analysis
Sufficient funding has been appropriated for this project from gas tax and Road Maintenance and Rehabilitation Account funds. The available funds and estimated construction costs for the project are shown in the following table:

Next Steps
Once the City Council accepts bids and awards the construction contract to L.C. Paving & Sealing, Inc., staff will issue a purchase order, schedule a pre-construction meeting with the contractor and issue a notice to proceed for construction of the project, which is expected to commence in mid-2023.
The duration of the construction contract is three months, not including rainy days and delays from change orders that may extend the contract duration. Upon successful completion of the project, which is expected to be by the end of 2023, a notice of completion will be recorded to release bonds issued for the project.
Environmental E valuation
The City Planner has determined this project is exempt from the California Environmental Quality Act under CEQA Guidelines Section 15301(c), which provides for the repair of existing public structures and facilities, including streets, sidewalks, and gutters, involving negligible or no expansion, and no exception to the exemption as set forth in CEQA Guidelines Section 15300.2 applies.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A CONTRACT TO LC.
PAVING & SEALING, INC. FOR THE 2023 CONCRETE REPAIR PROJECT AS PART
OF THE CONCRETE REPAIR/REPLACEMENT PROGRAM, CAPITAL
IMPROVEMENT PROGRAM PROJECT NO. 6013-23, IN AN AMOUNT NOT TO EXCEED $933,826
WHEREAS, the City Council of the City of Carlsbad, California has determined it necessary, desirable and in the public interest to replace damaged and unusable concrete as part of the city's Concrete Repair/Replacement Program, or Program; and
WHEREAS, on April 11, 2023, the City Council adopted Resolution No. 2023-106, approving the plans, specifications and contract documents and authorizing advertisement of the 2023 Concrete Repair Project, Capital Improvement Program, or CIP, Project No. 6013-23, or Project, for construction bids; and
WHEREAS, on May 16, 2023, staff received four bids for construction of the Project; and WHEREAS, LC. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That the lowest responsible and responsive bid of $933,826 submitted by LC. Paving & Sealing, Inc. for construction of the 2023 Concrete Repair Project, CIP Project No. 6013- 23, is accepted, and the Mayor is authorized to execute the contract for the Project.
3. That the City Manager or designee is authorized to approve construction change orders up to $188,000 for the Project.
4. That the award of this contract is contingent upon LC. Paving & Sealing, Inc. executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within 20 calendar days after adoption of this Resolution. The City Manager may grant reasonable extensions of time to execute the contract and assemble the required bonds and insurance policies.
