CLOSED SESSION:
City Attorney Cindie McMahon read the City Council into Closed Session.
Council adjourned into Closed Session at 3:16 p.m. pursuant to the following:
1. CONFERENCE WITH LEGAL COUNSEL REGARDING INITIATING LITIGATION: That the City Council, by motion, authorize a closed session to consider initiation of litigation of one case, pursuant to Government Code Section 54956.9(d)(4).
Council Action: City Attorney Cindie McMahon announced, that in a closed session, the City Council considered whether to initiate litigation against or accept a settlement from SureTec Insurance Company for $42,562.33. City Attorney McMahon added that the City Council voted unanimously to accept the settlement. City Attorney McMahon also added that the settlement, together with developer cash deposits forfeited to the city, fully reimburses the city for the direct cost of constructing public improvements in the Highland View Homes development after the developer, Carlsbad Coastal Views, LLC, defaulted on its obligation to construct the public improvements.
2. CONFERENCE WITH LEGAL COUNSEL REGARDING INITIATING LITIGATION: That the City Council, by motion, authorize a closed session to consider initiation of litigation of one case, pursuant to Government Code Section 54956.9(d)(4).
ACTION: No reportable action.
3. PERFORMANCE EVALUATION OF APPOINTED PUBLIC EMPLOYEES AND CONFERENCE WITH LABOR NEGOTIATORS: That the City Council, by motion, authorize a closed session regarding personnel matters pursuant to Government Code Sections 54957 and 54957.6 as follows:
