Recommend
ed Action
Introduce an ordinance titled, “An Ordinance of the City Council of the City of Carlsbad, California Amending Title 2, Chapter 2.12, Section 2.12.010 of the Carlsbad Municipal Code relating to residency requirements of the City Manager.” Executive Summary/Explanation & Analysis
Chapter 2.12.010 of the Carlsbad Municipal Code currently states that residence in the city at the time a City Manager is appointed shall not be required as a condition of the appointment, but within 180 days after reporting for work, the City Manager must become a resident of the city unless the City Council approves his or her residence outside the city.
This provision has not been enforced since 2008 because Article XI, Section 10(b) of the California Constitution provides:
A city …, including any chartered city …, may not require that its employees be residents of such city …; except that such employees may be required to reside within a reasonable and specific distance of their place of employment or other designated location.
Staff are recommending amending the residency requirement in Section 2.12.010 to comply with the state Constitution. The proposed ordinance in Exhibit 1 amends Section 2.12.010 to require that the City Manager reside within 60 miles of City Hall, rather than within the City of Carlsbad.
Fiscal Analysis
The existing fiscal year 2024-2025 budget for the City Clerk’s Office includes sufficient funding for the cost of amending the referenced code section.

Next Steps
The City Clerk’s Office will prepare the ordinance for adoption at the next regular City Council meeting. Once adopted, the City Clerk will publish the ordinance or a summary of the ordinance in a newspaper of general circulation within 15 days. The ordinance will be effective 30 days following its adoption.
Environmental Evaluation
In keeping with California Public Resources Code Section 21065, this action does not constitute a project within the meaning of the California Environmental Quality Act in that it has no potential to cause either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment.

I am writing to express my objection to the City Manager's Tuesday Item 5 recommendation that we revise the City Charter to remove the requirement that the City Manager reside in Carlsbad . The reason for residence requirement is obviously so that this position understands and priorit izes the needs of Carlsbad, a perspective that only a Carlsbad resident would respect. 1 However, our $514,477 per year compensated City Manager does NOT represent Carlsbad well and has squandered millions in homeless grants to INCREASE Carlsbad homeless 87% this year. Instead, this guy imports homeless from where he lives in San Diego and puts them in District 1 's Windsor Pointe, which was supposed to help Carlsbad's homeless. However (as you know), this crime-ridden dumpster fire houses only 5 tenants with any Carlsbad affiliation out of 50 apartments and the same homeless sleeping in the streets of the Village and in cars on Palm Avenue are still there. And he refuses to remedy this.

The reason for residence requirement is obviously so that this position understands and prioritizes the needs of Carlsbad, a perspective that only a Carlsbad resident would respect.
However, our $514,477 per year compensated City Manager does NOT represent Carlsbad well and has squandered millions in homeless grants to INCREASE Carlsbad homeless 87% this year.

Mayor Blackburn and City Council
I'm writing to express my objection to the City Manager Tuesday Item 5 recommendation that we revise the City Charter to remove the requirement that the City Manager reside in Carlsbad. The reason for residency requirements is obviously so that the person who holds the position understands and prioritizes the needs of the residents of Carlsbad.
I am shocked that the present City Council approved a salary for this position that is 100K more than the salary of the President of the US. We need new leadership on our city council. When balance is lost corruption moves In.
