A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING CITY COUNCIL POLICY NO. 84 (DEVELOPMENT
PROJECT PUBLIC INVOLVEMENT POLICY) TO CLARIFY EXISTING
REQUIREMENTS FOR STANDARD PUBLIC NOTICING WHILE EXPANDING THE
REQUIREMENTS FOR ENHANCED PUBLIC NOTICING FOR DEVELOPMENT
PROJECTS REQUIRING APPROVAL FROM THE PLANNING COMMISSION OR CITY COUNCIL (AMEND2024-0010 and PUB17Y-0021)
WHEREAS, public input contribute s to better decisions because the proce ss provid es decision makers with more complete information , and additional facts, observation s, and perspectives obtained through public input help development applicants better addre ss concern s and issues before decision makers consider their project s; and
WHEREAS, state law establi shes minimum noti cing and public meeting requirem ents in connection with local development review and approval processes and the City Council seeks to go beyond legal minimums and establish standard s that promote and encourage a more robu st and iterative public engagement and awarene ss proce ss for stakeholders; and WHEREAS, in respon se to community concern s about the lack of public outreach and stakeholder engagement involving a propo sed housing development project , the City Council on Sept. 24, 2024, directed staff to return to discuss possible option s to strengthen City Council Policy Statement No. 84 requirement s at a date certain of Nov. 12, 2024, for City Council discussion of possible changes that may strengthen the city's decision-making process; and WHEREAS, the City Council of the City of Carlsbad held a duly noticed meeting as prescribed by law to consider possibl e option s to enhance and increase public outreach requirement s for development project s; and
WHEREAS, at said meeting , upon hearin g and considering all testimony and argument s, if any, of all person s desiring to be heard, the City Council considered all factor s, including written public comment s, if any, related to the possible options to enhance and increa se public outreach requirement s for private development projects; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows:
1. That the above recitations are true and correct .
2. That the City Council hereby approves the amendments to City Council Policy Statement No. 84, attached hereto as Attachment A.
3. That the amendments to City Council Policy Statement No. 84, attached hereto as Attachment A shall become effective as of Dec. 9, 2024, and shall be applied to all applicable permit applications which are considered by Planning Commission or City Council and which are initially subm itted for processing on or after this date .
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the City of Carlsbad on the 12th day of November, 2024, by the following vote, to wit :
