Subject: Accepting Bids, Denying Two Bid Protests and Awarding a Construction Contract for Phase 1 of the Village and Barrio Traffic Circles Project District: 1
Reco
mmended Actions
1. Adopt a City Council resolution accepting the bids, denying the two bid protests, awarding a contract to Palm Engineering Construction Company, Inc. for Phase 1 of the Village and Barrio Traffic Circles Project in an amount not to exceed $5,663,385, and appropriating additional funds in the amount of $260,000.
2. Adopt a Carlsbad Municipal Water District Board of Directors resolution authorizing the use of an amount not to exceed $2,516,925 from the Water System Rehabilitation and Replacement Program funds for Phase 1 of the Village and Barrio Traffic Circles Project.
Executive Summary
As part of an overall goal of improving traffic safety and walkability, the Village & Barrio Master Plan calls for adding traffic circles and other traffic calming features at several intersections in the Barrio area.
Phase 1 of the Village and Barrio Traffic Circles Project, Capital Improvement Program Project No. 4015, includes construction of five traffic circles and enhanced crosswalks. Based on community feedback, support from the Traffic Safety & Mobility Commission and City Council direction, this phase of the project was advertised for bids on March 4, 2025. As part of the bidding process, staff received two bid protests.
Staff recommend that the City Council accept the bids for construction of the Village and Barrio Traffic Circles Project, deny two bid protests, award a contract to Palm Engineering Construction Company, Inc. in an amount not to exceed $5,663,385, appropriate $160,000 from the Sewer Replacement fund for the sewer portion of the contract, and appropriate another $100,000 from the TransNet fund for the transportation improvements of the contract.
Staff recommend that the CMWD Board of Directors authorize the use of $2,516,925 from the Water System Rehabilitation and Replacement Program, Capital Improvement Program Project No. 3904-D, for the water portion of the contract.

JOINT CITY COUNCIL AND
CARLSBAD ,MUNIC I PAl WATER DIS Rl 1CT
Staff Report
Staff obtained $4 million in federal funds to construct this phase of the project.
The City Council and the CMWD Board’s approvals are required for all formally bid contracts when the value exceeds $220,000 under Carlsbad Municipal Code Sections 3.28.080(C),
3.28.080(E) and 3.28.080(I)(6).
As part of the construction, aging water and sewer utilities will be replaced and relocated to comply with current standards and improve reliability. The costs to replace the water distribution lines are to be funded by the Carlsbad Municipal Water District (CMWD) as part of the Water System Rehabilitation and Replacement Program.
Explanation & Analysis
Given its flat terrain and proximity to the beach, Village area and Coastal Rail Trail, the Barrio is a neighborhood ideal for walking and biking. That is why the Village & Barrio Master Plan, approved by the City Council in 2019, recommended adding traffic circles and other design features that would slow down traffic, encourage safer driving behaviors and make walking and biking more inviting.
Phase 1 covers the following intersections:
• Pine Avenue and Harding Street – Traffic circle with public art • Oak Avenue and Jefferson Street – Traffic circle
• Pine Avenue and Madison Street – Traffic circle
• Chestnut Avenue and Madison Street – Traffic circle
• Chestnut Avenue and Roosevelt Street – Traffic circle • Oak Avenue and Roosevelt Street – Enhanced crosswalks Phase 2 of the project, which is currently in the design phase, will include curb extensions at the intersections at Palm Avenue and Harding Street and at Magnolia Avenue and Madison Street.

Bidding process
• The City Council and the CMWD Board approved the plans, specifications and contract documents and authorized advertising Phase 1 of the project for construction bids on March 4, 2025, with the adoption of Resolution Nos. 2025-059 and 1764. • The project was then advertised using the city’s formal bidding procedures. • Staff received four bids for construction on May 7, 2025. • Staff reviewed the contract documents and found that Palm Engineering Construction Company, Inc., was the lowest responsible bidder, with a responsive bid in an amount of $5,663,385.
• Palm Engineering was found to be responsive because its bid meets the requirements of the bidding documents and responsible because it submitted a list of similar projects to show its capability and qualification to perform the specified work.
Staff received two bid protests from Tri-Group Construction and Development, Inc. regarding the apparent low bidder, Palm Engineering. After evaluating both protests, one concerning subcontractor licensing and the other regarding lobbying disclosure, staff determined that the protests were unsubstantiated and that Palm Engineering had submitted a responsive bid in full compliance with the requirements.
Staff recommend that the City Council deny the two bid protests and award a contract to Palm Engineering Construction Company, Inc.
Fiscal Analysis
The project, Capital Improvement Program Project No. 4015 includes $4 million in federal grant funding for transportation improvements.1 Other funding sources include the gas tax, TransNet2 and general capital construction and sewer replacement funds.
Of the total contract amount, $3,286,860 is allocated for transportation improvements. An additional appropriation of $100,000 from the TransNet fund to Project No. 4015 is required to fully fund the transportation improvements. Sufficient funding is available in the TransNet fund.
Any unexpended federal grant funding may be used for the Barrio Lighting project.
Of the total contract amount, $579,600 is allocated for sewer improvements, which will be funded by the sewer replacement fund. The total amount to be funded by the sewer replacement fund is $811,440, including construction contingency and construction management and inspection. Staff request an additional appropriation of $160,000 from the sewer replacement fund for the sewer improvements. Sufficient funding is available in the fund.
The total appropriation needed this fiscal year for Project No. 4015 is $260,000 as detailed in the table below.
Of the total contract amount, $1,796,925 is allocated for water improvements, which will be funded by the Water System Rehabilitation and Replacement Program, Capital Improvement Program Project No. 3904-D. The total amount to be funded by Project No. 3904-D is

In the fiscal year 2025-26 Capital Improvement Program budget, $1.825 million in additional TransNet funding has been designated for construction of the Phase 2 improvements of this project.
Next Steps
Once the City Council accepts the bids, denies the two bid protests and awards the construction contract to Palm Engineering Construction Company, Inc., staff will issue a purchase order, schedule a pre-construction meeting with Palm Engineering Construction Company, Inc., and issue a notice to proceed for construction of the project.
Construction is expected to commence in fall 2025 with a duration of about 12 months and an estimated completion date of fall 2026.
Environmental Evaluation
In accordance with the California Environmental Quality Act (CEQA) and the Environmental Protection Act, the project was previously evaluated in Final Initial Study/Mitigated Negative Declaration (Final IS/MND) State Clearinghouse (SCH) No. 2016021056, dated April 2018, as part of the City of Carlsbad Village & Barrio Master Plan. The Final IS/MND evaluated the potential environmental effects of the project components described in the master plan. The project is within the scope of the Final IS/MND and no further CEQA documentation is required under CEQA Guidelines Section 15162. All applicable mitigation measures contained in the prior environmental document have either been satisfied previously, or will be incorporated into the project, or are conditions of approval for the project.
The project is exempt from National Environmental Policy Act (NEPA) review as outlined in NEPA Regulation 23, which applies to federally funded projects receiving less than $5 million or with a total estimated cost of not more than $30 million. Caltrans’ determination of exclusion is recorded in a categorical exclusion determination form dated May 5, 2023. Additionally, the categorical exclusion determination was revalidated on March 27, 2024, to verify the environmental documents and the decisions remained valid.

On page 3 of the staff report under bidding process, the report includes:
• The City Council and the CMWD Board approved the plans, specifications and contract documents and authorized advertising Phase 1 of the project for construction bids on March 4, 2025, with the adoption of Resolution Nos. 2025-059 and 1764.
In the March 4, 2025 staff report, there were a total of 46 parking spaces listed to be eliminated by this project. After further analysis, staff found that eight of these spaces should not have been counted because they have existing red curbs. Therefore, the updated total loss of parking spaces in the project area is revised to 38 spaces. Of the 38 specific parking spots that would potentially be removed by City Council approval of this item, 11 of those same spots would no longer be available for parking regardless of how the City Council votes on Item No. 8 due to the State of California's daylighting law1.

Please reject any and all bids for traffic circles in the Village. For that matter scrap the entire idea! The expense is outrageous. Those funds could be used to upgrade areas of our aging Village. Drive around the Village and Barrio in the evening and look at all the cars parked on the streets. Traffic circles will take away much needed parking as density increases. I cannot even imagine the issues that will arise with vehicles, pedestrians, bicycles, and e-bikes navigating these circles.

Teri Jacobs
