Rec
ommended Action
Receive an informational report on the regulation of offshore and onshore oil drilling facilities within and near the City of Carlsbad, and direct staff as appropriate.
Executive Summary
The City Council approved a minute motion on Feb. 10, 2026, directing the City Manager to bring an item to a future City Council meeting for the City Council to have a discussion with staff about the city’s current codes and regulations governing on and offshore oil drilling, manufacturing and refining, and to hear from staff about whether there are any opportunities to strengthen those codes to ensure the safety and protection of our residents and environment. This staff report responds to this City Council direction.
Explanation & Analysis
Offshore oil drilling – regulation and enforcement
In general terms, offshore drilling is defined as the process of drilling into the ocean floor to explore for and extract petroleum and natural gas. It involves massive, specialized platforms or ships stationed in marine environments, which allow energy companies to access oil and gas reserves trapped beneath the seabed.
The sections below provide a summary of the jurisdictional authority and key statutes and regulations applicable to offshore drilling operations.
Federal government
The United States Department of the Interior’s Bureau of Ocean Energy Management regulates offshore energy leasing for oil, gas and wind projects and has the authority under the federal Outer Continental Shelf Lands Act to regulate oil drilling activities from 3 to at least 200 nautical miles offshore. In April 2025, the bureau initiated the process to develop the 2026-2031 National Outer Continental Shelf Oil and Gas Leasing Program. Once it is approved, the program is anticipated to begin in 2027, allowing exploration and production of oil and gas in ocean waters regulated by the federal government, including six lease sites, June 23, 2026

as shown in Exhibit 1, in the Pacific Ocean off the coast of California – one off the coast of northern California, two off central California and three off southern California.
Neither the City of Carlsbad, nor the State of California have the authority to impose restrictions, limitations or regulations on oil drilling operations or facilities in federal jurisdiction.
State government
Under the federal Submerged Lands Act, the State of California has authority to regulate offshore oil drilling activities from the mean high tide line out to three nautical miles offshore. While the state cannot directly ban offshore oil drilling in federal waters, it may prohibit state agencies from issuing new leases for related infrastructure such as distribution pipelines and piers needed to transport crude oil and natural gas to onshore refineries and storage terminals.
Additionally, after the 1969 Santa Barbara oil spill, the California State Lands Commission placed a moratorium on new offshore oil and gas leases in state waters. The state subsequently enacted the California Coastal Sanctuary Act of 1994, which prohibits new oil and gas leases in state waters subject to tidal influence except in extremely limited circumstances. In 2018, the state amended this act to prohibit the State Lands Commission from authorizing any new leases or new construction of oil and gas-related infrastructure on state tidelands or submerged lands. Then, in 2023, the state amended the California Coastal Act of 1976 to prohibit new or expanded oil and gas facilities from utilizing relaxed development policies for coastal-dependent industrial facilities and instead requires compliance with stricter development policies, including that all oil produced offshore in state waters be transported by pipeline only.
City of Carlsbad
The City of Carlsbad has jurisdiction over development inland, or eastward, from the mean high tide line and does not have any authority to restrict, condition or regulate federal or state offshore operations. However, the city has a long history of opposing offshore oil drilling proposals. City records dating back to 1974 indicate that the city has regularly opposed offshore oil drilling and exploration through such means as letters to the state and federal governments and, since 1988, the city’s legislative platform.
The most recent action taken by the City Council was on Aug. 28, 2018, in which the City Council passed a resolution, provided as Exhibit 2, stating the city’s opposition to the inclusion of any offshore drilling tracts in any outer continental shelf planning area on the Pacific Coast. The resolution applied to any outer continental shelf planning area on the Pacific Coast as proposed in the then-pending 2019-2024 National Outer Continental Shelf Oil and Gas Leasing Program “and any other future National Programs.” The resolution also updated the City of Carlsbad’s legislative platform to oppose offshore oil and gas leasing, drilling, and exploration in “all State of California and U.S waters in the Pacific Ocean.” The city has also taken a support position on pending Senate Joint Resolution 12, which expresses the state’s opposition to the 2026-2031 National Outer Continental Shelf Oil and Gas Leasing Draft Proposed Program, the federal government's latest five-year plan for holding offshore oil and gas lease sales on the Outer Continental Shelf. (Exhibit 3).

Item #14 Page 2 of 14
Offshore oil drilling – opportunities to strengthen codes As stated above, the city does not have authority to regulate oil and gas drilling offshore seaward of the mean high tide line. The city’s options to oppose such offshore uses are therefore limited, but do include the following:
City’s Legislative Platform
The City Council Legislative Subcommittee was established by the City Council in 2019. Its duties include conducting an annual review of the city’s legislative platform and recommending amendments to the City Council, as needed. The city’s Legislative Platform includes the following position statements related to offshore oil and gas processing activities and facilities:
• Support legislation that requires double hulls for oil tankers • Oppose any new offshore oil and gas leasing, drilling and exploration in all State of California and U.S. waters in the Pacific Ocean
• Support decommissioning of existing offshore oil drilling and pipeline infrastructure in all State of California and U.S. waters off the California coast One option is to consider expanding legislative efforts from the city to more actively influence federal policy and/or advocate for federal programs that address them.
Resolution of opposition
The City Council can direct staff to prepare a resolution opposing offshore oil and gas leasing and drilling off the California coast, including the potential inclusion of California waters in the federal government’s next leasing program. This would reaffirm the city’s previous 2018 opposition and could be submitted to federal agencies as part of the public comment process. An example of such a resolution is the City of Coronado’s recent City Council resolution. (Exhibit 6).
Onshore oil drilling – Regulation and enforcement
Onshore oil drilling is the process of extracting petroleum and natural gas from reservoirs located beneath the Earth's surface on dry land. It is generally the most common, cost-effective and accessible method of oil extraction. Below provides a summary of the jurisdictional authority and typical regulations imposed on onshore drilling operations.
Federal government
The United States Department of the Interior Bureau of Land Management has authority over oil leasing on federal lands onshore in California, as well as state and private surface lands in California where mineral rights have been retained by the federal government.
There is no land in Carlsbad that is managed by the Bureau of Land Management.
Recently enacted Senate Bill 1137 establishes a health protection zone around sensitive uses. (The following “State government” section provides more information about Senate Bill 1137 and how it applies to Carlsbad). In January 2026, the Bureau of Land Management filed a federal lawsuit against California, claiming that federal laws override Senate Bill 1137 on federal land or leases. Although the Bureau of Land Management asked the court for a preliminary injunction to prevent the state from enforcing Senate Bill 1137 while the case is pending, the court denied the preliminary injunction and referred to Senate Bill 1137 as a June 23, 2026

“reasonable environmental regulation” with an “obvious and important purpose” of protecting people from direct health impacts from proximity to oil extraction.
State government
The State of California has the authority to impose restrictions and limitations on the operation and location of onshore drilling and gas facilities. The more significant state laws include the following:
• Senate Bill 1137, passed in 2022, created health protection zones that prohibit new oil and gas production facilities that are located within 3,200 feet of a “sensitive receptor,” e.g., housing, schools, parks, daycare centers, community resource centers, healthcare facilities, and buildings with businesses open to the public.
Exhibit 4 shows that all areas in the City of Carlsbad are within 3,200 feet of a sensitive receptor, so no new oil and gas production facility is permitted in Carlsbad. • Assembly Bill 3233, passed in 2024, gives cities and counties greater authority to impose restrictions on oil and gas operations, including by limiting or prohibiting new oil and gas developments in their jurisdictions.
• Assembly Bill 1866, passed in 2024, increases fees on idle wells and establishes stricter regulations to ensure that oil companies are held responsible for maintaining and safely plugging idle wells, preventing leaks and contamination.
In January 2026, the State of California also sued the federal government to prevent its approval to restart two oil pipelines in central California.
City of Carlsbad
In Carlsbad, onshore oil and gas facilities1 are only allowed within the city’s industrial zones, which include C-M – Heavy Commercial-Limited Industrial, M – Industrial, and P-M – Planned Industrial. (See Exhibit 5). These regulations were established in 1989. At that time, limiting the location of these facilities was considered more defensible than an absolute prohibition of them. The regulations were modeled after regulations in other cities that had not been successfully challenged.
In addition to limiting where onshore oil and gas facilities can be located, the city’s Zoning Ordinance also limits the scale and scope of such facilities and requires that the following findings be made for the City Council to approve the permit that would authorize their use:2 • Approval of the project and facilities will pose no danger to life and property to residents of the neighborhood, community or city
• Approval of the project will not pose a potential threat of damage or injuries to nearby residents
1 Onshore oil and gas facilities as defined include, but are not limited to, processing plants, refineries, storage facilities, transfer stations, pipelines, warehouses, offices, tanker terminals, and helicopter pads.
2 These are the findings to approve a conditional use permit to authorize onshore oil and gas facilities, in accordance with Carlsbad Municipal Code Section 21.42.140(B)(95).
June 23, 2026
Item #14 Page 4 of 14
• The benefits of the project clearly outweigh the possible adverse environmental effects
• There are no feasible alternatives to the proposed project • The location and approval of the onshore facilities at the particular location clearly outweigh any potential harm to public health, safety, peace, morals, comfort and general welfare of persons residing or working in the neighborhood or community and will not be detrimental or injurious to property in the neighborhood, community or to the general welfare of the city
There are currently no operational onshore oil or gas facilities in Carlsbad. According to the California Department of Conservation Geologic Energy Management Division’s website, there is one former oil and gas well located near the southeast corner of El Camino Real and Dove Lane. According to the division’s data, the well status is “idle,” the well classification is “no viable operator – inaccessible,” and there is no active permit for the well. The site was developed as a commercial center in the 1980s and now contains a bank, restaurants and other businesses. The well is not within an industrial zone and is within the SB 1137 health protection zone and therefore is not permitted to operate as an oil or gas well.
Opportunities to strengthen codes – onshore oil drilling As stated above, oil and gas facilities are conditionally permitted in the city’s industrial zones.
Below are options the City Council may consider regarding the city’s current regulations:
No change
Under the city’s current regulations, no onshore oil and gas facilities have located in the city. Also, because of the scope and application of SB 1137 in the city (Exhibit 4), no oil and gas facilities are allowed to locate in Carlsbad.
Change the city’s current regulations
The City Council can direct staff to prepare an amendment to the Carlsbad Municipal Code and the Local Coastal Program, the planning document for the city’s Coastal Zone, to prohibit onshore oil and gas facilities in any zone in Carlsbad. This option is authorized by Assembly Bill 3233 and would ensure there is no possibility that an onshore oil and gas facility can be located in Carlsbad, without the need to rely on the location restrictions of SB 1137.
However, since the location and maintenance of onshore oil and gas support facilities are subject to health protection zones under 1137, this option adds no regulatory benefit since such onshore facilities are already prohibited.
Fiscal Analysis
Receiving this report has no fiscal impact.

Environmental Evaluation
This is a discussion item only. Pursuant to California Public Resources Code section 21065, this action does not constitute a "project" within the meaning of the California Environmental Quality Act, or CEQA, in that it has no potential to cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment, and therefore, does not require environmental review. Because the request involves only information sharing and discussion on the regulation of offshore and onshore oil and gas facilities, this item does not have a legally binding effect on any possible future discretionary action. Any direction by City Council that results in subsequent actions related to the regulation of oil and gas facilities would be evaluated in accordance with CEQA at the same time any amendments to the Carlsbad Municipal Code would be considered.

Re: S
enate Joint Resolution 12—Proposed 2026–2031 National Outer Continental Shelf Oil and Gas Leasing Program: opposition—SUPPORT (As Amended March 16, 2026) De
ar Senator Laird,
On
behalf of the City of Carlsbad, I am writing in support of Senate Joint Resolution (SJR) 12, which strongly and unequivocally opposes any new offshore oil and gas drilling, opposes the federal government's proposed 2026- 2031 National Outer Continental Shelf Oil and Gas Leasing Program, and declares support for the current federal prohibition on new oil or gas drilling in federal waters offshore of the Pacific coast.
Th
e City explicitly opposes any new offshore oil and gas leasing, drilling, and exploration in all State of California and U.S. waters in the Pacific Ocean, and supports the decommissioning of existing offshore oil drilling and pipeline infrastructure off the California coast. SJR 12 directly reflects these positions.
As
a coastal community, Carlsbad has an acute interest in protecting California's ocean ecosystems, beaches, and coastal economy. The proposed federal leasing program would permit 34 potential offshore lease sales across more than one billion acres of federal waters, including six new leases in northern, central, and southern California -- areas where no new offshore leases have been executed since the Reagan administration. The history of major spills along the California coast, from the devastating 1969 Santa Barbara blowout to the 2015 Refugio spill and the 2021 San Pedro pipeline spill, demonstrates the very real and lasting harm that offshore drilling poses to coastal wildlife, marine ecosystems, fishing industries, and tourism.
Th
e City supports funding and legislation that promotes the restoration, preservation, and enhancement of beaches and coastal resources, as well as climate change adaptation efforts and the transition to renewable energy. Expanding offshore fossil fuel production runs counter to all of these priorities. The City further supports measures that preserve and extend the authority of cities over land use regulations concerning onshore facilities that service offshore oil drilling, and Carlsbad strongly believes that California must continue to lead the nation in protecting its coast from the risks of oil spill damage and the broader harms of continued fossil fuel dependency.
Th
e City of Carlsbad urges the Legislature to advance SJR 12 and calls on the federal Bureau of Ocean Energy Management to remove California from the proposed leasing plan, prepare a full programmatic environmental Exhibit 3

impact statement, and provide the public a meaningful opportunity to comment on any potential offshore oil and gas leasing affecting California's coast.
For these reasons, we are pleased to support SJR 12 and thank you for your leadership on this most important issue. Should you have any questions, please contact our legislative advocate Sharon Gonsalves with California Public Policy Group at 916-974-9270.

Mayor and city council members,
The federal administration is doing all it can to negate California's clean energy goals by buying out wind farm leases and selling offshore oil drilling leases. We cannot allow this to happen. All of California, and particularly its coastal cities, must fight this shortsighted greed which only harms our land, waters and people. I know the council is in support of this position. Please do all you can to prevent this from happening.
Thank you.
Sincerely,
Paige DeCino

Attached are five pages, 71 signatures, that I have collected from people who want to stop the offshore drilling in California. They are aware of the destruction of marine habitat and Wildlife, incursion into existing marine protected areas, oil spills which could be up to 48%, which impact birds and sea mammals from normal insulation and wash up onto beaches. More problems are the water contamination – surface pollution and seepage into groundwater used for drinking water. Local communities affected would be the fishing industries that can suffer from oil spills, loss and revenues from tourism, and toxic onshore processing facilities are typically found in communities of color. Also, climate change from the generation of more greenhouse gas emissions. Renewable energy is now cheaper than fossil fuels and creates less pollution and has fewer negative environmental effects. Thank you for your attention to this matter.

Dear Mayor Blackburn, Mayor ProTem Bhat-Patel and City Councilors,.
I am asking your support of Agenda Item 14 which determines the City of Carlsbad's supporting opposition to off-shore drilling. The Carlsbad Sierra Club and other groups are circulating petitions locally to sign on indicating opposition to drilling of our coast. The threat of oil spills remains an issue because of the harm that results to our beaches and biodiversity.
the governor signed AB3233 in 2024 cqn the city of bill AB3233 (signed by ). Kevin plans to cite the AB3233 for our city to act as guidance for opposition. The federal government needs to hear our concerns.

Dear Mayor Blackburn, Mayor Pro Tem Bhat-Patel, and City Councilors, I am writing to ask for your support of Agenda Item 14, which establishes the City of Carlsbad’s formal opposition to offshore drilling.
The Carlsbad Sierra Club and other local organizations are currently circulating petitions to demonstrate community-wide opposition to drilling off our coast. The threat of oil spills remains a significant concern due to the potential harm to our local beaches and biodiversity.
Additionally, we suggest using Assembly Bill 3233, signed by Governor Newsom in 2024, as guidance for our city's actions. It is vital that we voice these concerns to the federal government to protect our coastline.
Thank you for your consideration.

Hi, I’m requesting your vote of yes on Agenda Item 14, which establishes the City of Carlsbad’s formal opposition to offshore drilling.
I’ve seen remnants of oil droplets on the state beach (off of Poinsetta , north of the staircase of main entry) on my daily beach trash pick up walks starting around the May timeframe.
They were about the size of a quarter & this is a cause of concern (in addition to all the plastic I pick up from the beach) hence why I think opposing offshore drilling is key.
Also the town of Summerland (borders Santa Barbara) their beach smells of oil & their beach is oil laden. Preventing off shore drilling in our area would stop this from ever happening on our beaches.
Thanks , Diana Aguirre
