More importantly, if the proposed ADU is not intended to function as a legitimate accessory dwelling unit, but instead serves as a means to facilitate additional rooftop recreational space or to circumvent development standards, its approval would be inconsistent with both the intent and purpose of California’s ADU legislation and the City’s zoning regulations. ADU provisions were enacted to encourage the creation of needed housing not to provide a mechanism for exceeding lot coverage limitations, height restrictions, or other development standards.

The City has an obligation to apply its zoning ordinances and planning policies consistently and fairly. Approving a project that effectively uses an ADU to obtain development rights that would otherwise not be permitted would establish an undesirable precedent, weaken public confidence in the integrity of the City’s land use regulations, and invite similar proposals in the future.

We respectfully request that the City carefully evaluate whether the proposed ADU satisfies both the letter and the intent of applicable zoning ordinances, the General Plan, and the policies that have long guided preservation of Carmel-by-the-Sea’s unique residential character. If the proposed structure does not constitute a bona fide accessory dwelling unit or otherwise fails to comply with applicable development standards, the application should be denied.

Protecting Carmel’s historic neighborhoods requires consistent enforcement of the City’s planning and zoning regulations. We respectfully urge the City to uphold those standards and preserve the character, privacy, scenic resources, and quality of life that define Carmel-by-the-Sea.

Thank you for your consideration,
Pam and Bardin Bengard

Mr. Michael LePage
Chairman
City of Carmel-by-the-Sea Planning Commission
Regarding: McWhorter Project 2NE of Ocean Avenue
Mr. LePage,
My wife and I have been full time residents of Carmel since February 2013 residing at the Our friends, Bruce and Linda Taylor, live in an historic house located on Camino Real in Carmel. Their home provides sunset views and ocean sounds on their decks. They have done several major improvements to their home and have been totally faithful to maintaining the integrity of Carmel’s style. They believe, and I agree, that all new construction or remodels in Carmel should be equally faithful to Carmel’s style. New construction on neighboring properties should never change the views or sense of privacy that a longtime owner has enjoyed. That’s not fair.

The McWhorter project, as I understand it, will include a new 1BR 1bath house with an ADU that would have 2BR and 1 bath. The 2 structures will exceed the allowed lot coverage.

Perhaps with ADUs that’s allowed. Otherwise this must be addressed. However, the proposed roof top deck on the ADU cannot be allowed to be built. The precedent this would set has the potential to disrupt the privacy and serenity that all Carmel residents expect and enjoy.

I strongly oppose granting permits to build the structure proposed by the McWhorters. They should be required to redesign their home in such a way that the Taylor’s peace and quiet and views toward the Pacific Ocean are not impacted at all.

Thank you for considering this request.

Sincerely,
Tom and Julie Bryan

WHEREAS, the Planning Commission did hear and consider all said reports, recommendations, and testimony herein above set forth and used their independent judgment to evaluate the project.

NOW THEREFORE, BE IT RESOLVED, that the Planning Commission of the City of CarmelBy-The-Sea does hereby make the following findings and determinations:
a. The facts (“Facts”) set forth in the recitals above are true and correct and are incorporated herein by reference.
b. As demonstrated in Section 4 of this resolution, approval of the Project is Categorically Exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15302 of the CEQA Guidelines – Replacement and Reconstruction. policy and regulations.
f. Approval of the Design Study and Coastal Development Permit by the Planning Commission is appealable to City Council pursuant to CMC Section 17.54.040.C.

Section 1: FINDINGS REQUIRED FOR COASTAL DEVELOPMENT PERMIT (CMC Section

17.64.010.B).

1. Finding – Local Coastal Program Consistency: The project as described in the application and accompanying materials, as modified by any conditions of approval, conforms with the certified City of Carmel-by-the-Sea Local Coastal Program (LCP). a. Evidence: Land Use and Community Character Policies P1-37 through P1-54 relate to residential development in Carmel-by-the-Sea. These policies require Design Review permits for new buildings, additions, and remodels of homes.

Additionally, larger projects require a Preliminary Site Assessment. The purpose of the permit processes and policy consistency is to maintain neighborhood, forest, and street character, promote harmonious yet diverse designs, and ensure compliance with the Residential Design Guidelines. Design Study, DS 25019 (McWhorter), is for the demolition of an existing single-family residence and the construction of a 1,628-square-foot two-story residence, inclusive of an attached garage and associated site improvements. The proposed new construction conforms to all applicable zoning standards in the CMC Chapter

17.10, including but not limited to, setbacks, height, floor area and site coverage limits, and parking. As conditioned, the project complies with the Residential Design Guidelines. Further analysis of the project’s compliance with the Design Guidelines is included in the supporting evidence contained in Finding 3 in Section 2. The proposed work is compliant with the applicable policies in the Land Use and Community Character Element of the General Plan. b. Evidence: Circulation Element policies are not applicable to Design Study, DS 25019 (McWhorter). The project will include a standard parking space pursuant to CMC Chapter 17.10. The project will not have any effect on parking, circulation, or roadway safety in Carmel-by-the-Sea.
c. Evidence: Coastal Access and Recreation policies are not applicable to Design Study, DS 25019 (McWhorter). The project will not have any effect on vertical or lateral access to the beach in Carmel-by-the-Sea. The project will not have any effects on tourism or visitor accommodation.

boundaries, water drainage and quality, maintenance and preservation of the urbanized forest, and beach and shoreline maintenance. Objective O5-11 is to “Maintain, restore and enhance the upper and lower tree canopy of Carmel’s urbanized forest”. During the preliminary site assessment, the City Forester determined that 3 of the 6 trees located on or adjacent to the subject site are significant or moderately significant. The project includes retention of all 3 significant or moderately significant trees. In addition, 4 new trees are proposed to be planted (2 Monterey cypress, 1 Japanese maple, and 1 Tea tree). The City Forester has determined that this will be a sufficient mix of upper and lower canopy trees on site.

Policy P5-195 requires development to limit impervious surfaces to allow for efficient storm water management. DS 25019 (McWhorter) brings the site into compliance with site coverage limits, reducing the site coverage from 1,290 square feet of impervious site coverage to 520.9 square feet of site coverage with 76.8% of the proposed coverage being permeable, which will allow for increased storm water percolation. In addition, the project has been conditioned requiring the applicant submit a final drainage plan, for review and approval by Environmental Compliance, that demonstrates compliance with CMC Chapter

17.42 and the City’s drainage guidance, SOG 17.07, prior to building permit issuance.

No other policies, objectives, or goals in the Coastal Resource Management Element are applicable to DS 25019 (McWhorter). Due to the site’s location and project scope, the project will not have any effect on beach, ESHA, or coastal access.

2. Finding – Public Access & Recreation: The project is in conformity with the public access and recreation policies of Chapter 3 of the Coastal Act of 1976 (commencing with Sections 30200 of the Public Resources Code).
a. Evidence: The subject property is located at Carmelo St 2 NE of Ocean Avenue, APN 010-252-013-000 which is not between the first public road and the sea.

Therefore, this finding does not apply in this case.
b. Evidence: The project will not impact existing public access illustrated in LCP Coastal Access and Recreation Element, Figure 4.1. The subject property is not located at or along any beach access points, pathways, or stairs. See Section 1, Finding 1, Evidence “c”, regarding beach access.
c. Evidence: The project will not impact existing Parks, Open Space, Recreation and Community Facilities illustrated in LCP Coastal Access and Recreation Element,

Section 2: FINDINGS REQUIRED FOR DESIGN REVIEW (CMC Section 17.58.060).

1. Finding – General Plan and Local Coastal Program Consistency: The project conforms to the applicable policies of the General Plan and the Local Coastal Program. a. Evidence: As described in the supporting evidence for Finding 1 of Section 1, the project complies with applicable General Plan and Local Coastal Program policies.
b. Evidence: Housing Element policies are not applicable to Design Study, DS 25019 (McWhorter). The McWhorter project does not involve the development of any new market rate or affordable housing. The development will include an ADU that will be reviewed and approved under a separate permit. c. Evidence: Public Facilities and Services Element policies are not applicable to Design Study, DS 25019 (McWhorter). DS 25019 (McWhorter) does not relate to, and will have no effect on public health, safety, or recreation. d. Evidence: Open Space and Conservation Element policies are not applicable to Design Study, DS 25019 (McWhorter). DS 25019 (McWhorter) does not relate to, and will have no effect on water conservation, pollution, or parks and open space.
e. Evidence: Environmental Safety Element policies are not applicable to Design Study, DS 25019 (McWhorter). DS 25019 (McWhorter) does not relate to emergency preparedness, natural disasters, hazardous waste sites, or work in areas of excessive risk. The proposed project is for maintenance, repair, and remodeling an existing single-family residence.
f. Evidence: Noise Element policies P9-4 and P9-5 are applicable to Design Study, DS 25019 (McWhorter). P9-4 and P9-5 require construction noise to be minimized and monitored. DS 25019 (McWhorter) includes a construction management plan that provides best management practices to ensure construction produces the least amount of noise possible. Additionally, CMC Section 8.56.040 requires all construction noise to occur between 8:00 AM and 6:30 PM.

2. Finding – CMC Compliance: The project complies with all applicable provisions of the

Carmel-by-the-Sea Municipal Code.
a. Evidence: As demonstrated in Evidence “a” of Finding 1 of the Section 1, Design Study, DS 25019 (McWhorter) is compliant with the Carmel-by-the-Sea Municipal Code. As conditioned, this finding can be made.

3. Finding – Design Guidelines Consistency: The project is consistent with applicable adopted design review guidelines.
a. Evidence: Design Guidelines 9.5 encourages the use “natural” building materials and that stucco, in conjunction with some natural materials, may be considered depending on neighborhood character.
b. Evidence: The proposed finish details include:
i. Reclaimed cedar barn wood siding by Montana Timber Products in the Ranchwood Artisan Glacier Grey color.
ii. Stone veneer (Fon-Du-Lac Web Wall style from the Mosaic Collection by Buechel) for the garage, mechanical room, and a portion of the south elevation.
iii. Aluminum windows with a medium bronze finish (Arcadia). iv. Teak, stained wood and glass entry door.
v. A green roof, rooftop deck, and rubber membrane system flat roof for both the single story and two-story portions of the structure.

Condition of Approval #35 has been incorporated requiring the applicant to include a gravel or rock ballast on the rubber membrane flat roof portion of the roof or change the rubber membrane to a similar approvable material (tar and gravel, TPO with ballast, ETC). As Conditioned the proposed finished details comply with Design Guideline 9.5.
c. Evidence: The Residential Design Guidelines state that any material other than unclad wood windows is inappropriate. The Design Guidelines further states, “By far, wood frame windows are the most typical, but metal windows also are found, especially on some styles that reflect Modernist influences.” The Planning Commission has approved other materials in the past, allowing clad wood, aluminum, and Fibrex windows as acceptable deviations from the Residential Design Guidelines. Residential Design Guideline 9.11 states, “Window styles and materials should be consistent with the architecture of the building. Window styles and materials should be uniform throughout a building.” The applicant is proposing Aluminum windows with a medium bronze finish (Arcadia) throughout the property, matching the architectural style of the residence. Therefore, the window component of the project is consistent.

d. Evidence: Residential Design Guideline 9.14 states, “Skylights should not be visually prominent from the street or from neighboring windows.” The applicant modified the proposed skylights, removing the large skylight (3’-6” by 10’-2”) originally proposed and proposed three small skylights (3’-6” by 3’) ahead of the April 8, 2026, Final Details Planning Commission meeting. The applicant has further modified the proposed skylights and is now proposing two 2’ x 4’ skylights above the kitchen.
e. Evidence: The proposed project is consistent with the Residential Design Guidelines and therefore this finding can be made.

4. Finding – Zoning Standards and Permits: The project conforms with all zoning standards applicable to the site, or has received appropriate use permits, variances or exceptions consistent with the Zoning Ordinance.
a. Evidence: As demonstrated in the supporting evidence for Finding 2 and Finding 3 of this section, the project conforms to the applicable zoning standards.

5. Finding – Neighborhood Character: The project contributes to neighborhood character including the type of forest resources present, the character of the street, the response to local topography and the treatment of open space resources such as setbacks and landscaping.
a. Evidence: The project includes a reduction of the existing driveway size and adding informal landscaping in the right-of-way. The City Forester has reviewed the landscape plan and was supportive of the proposed plantings. Site improvements include removing thick ground cover and formal bushes on the front of the property and the public right-of-way. The proposed informal ground cover consists of plants, mulch, and a few bushes. The full list of plantings is included in the planting plan on sheet 10c. The applicant’s design meets the Design Guidelines, Carmel Municipal Code, and General plan policies, standards, and guidelines regarding right-of-way character, and therefore this finding can be made.

6. Finding – Natural Features and Built Environment: The project is compatible with, and sensitive to, the natural features and built environment of the site and of the surrounding area. The project respects the constraints of the site and avoids excessive grading, cuts and fills. Construction on steep slopes is minimized to the extent feasible and abrupt changes in grade is minimized or mitigated.
a. Evidence: The project scope for DS 25019 (McWhorter) is limited to

development within roughly the existing footprint. The project plans (Exhibit B) include preliminary grading plans, sheets 4a-4d. The largest portion of grading on site will be to accommodate the expansion of the garage for a mechanical room. The grading on site is not excessive and compatible with the site’s features. This finding can be made.

7. Finding – Modesty and Simplicity: The project maintains the City's principles of modesty and simplicity and preserves the City's tradition of simple homes set amidst a forest landscape. The project uses simple building forms and simple roof forms without complexity that would attract undue attention to the site. a. Evidence: The proposed structure will be U shape which is stated to be appropriate in Design Guideline 8.1, which encourages simple building shapes.

As demonstrated in Evidence “b” for Finding 3 in Section 2, the project modifications to the existing siding comply with the Design Guidelines and will be simple and modest. This finding can be made.

8. Finding – Mass and Bulk: The project does not present excess visual mass or bulk to public view or to adjoining properties. The project relates to a human scale in form, elements and in the detailing of doors, windows, roofs and walkways. a. Evidence: The proposed residence retains the same general layout of the current home, with the main house over an attached garage. The property complies with the applicable height standards in the Carmel Municipal Code.

As part of their redesigning of the property prior to the April 8, 2026, Planning Commission meeting, two new kitchen windows were added. The size of the entry window was reduced, but all the other windows remained the same size.

The “great room” door was reduced to 7’ – 6” and the remaining exterior doors remained the same size. Condition of Approval #34 has been incorporated requiring the applicant to reduce the size of doors to no greater than 6’ wide. As conditioned, the project would retain large areas of glazing to fit the style of the architecture but would reduce the size of the “great room” door to have appear less grand.

As conditioned this finding can be made.

9. Finding – Detail and Material: Project details and materials (e.g., windows, doors, chimneys, roofs, and stonework) are fully integrated and consistent throughout the design. Building materials are used in a manner that is visually consistent with the proposed architecture. All fenestration is appropriate in size and consistent with a human scale.

10. Finding – Forest and Open Space: The project is consistent with the City's design objectives for protection and enhancement of the urbanized forest and open space resources. Open space is distributed around buildings to provide visual relief from structural bulk and a distinct separation from buildings on adjacent sites. a. Evidence: As demonstrated in the supporting evidence for Findings 5 and 6 of this section, the project complies with applicable neighborhood character and natural features and built environment requirements. This finding can be made.

11. Finding – Simple and Modest Roof Forms: The design uses simple/modest building forms and a limited number of roof planes, and a restrained employment of offsets and appendages consistent with the City’s design objectives. a. Evidence: As demonstrated in the supporting evidence for Finding 7 of this Section, the project complies with modesty and simplicity design requirements.

This finding can be made.

12. Finding – Context: The mass of the building relates to the context of other homes in the vicinity that are in conformance with the City’s design guidelines related to mass and scale.
a. Evidence: As demonstrated in the supporting evidence of Finding 8 of this section, the property is in compliance with applicable Design Guidelines and Municipal Code standards. As conditioned, this finding can be made.

13. Finding – Size and Scale: The development is similar in size, scale and form to buildings on the immediate block and neighborhood.
a. Evidence: As demonstrated in the supporting evidence of Finding 8 of this section, the property is in compliance with applicable Design Guidelines and Municipal Code standards. As conditioned, this finding can be made.

14. Finding – Significant Trees: The development does not require removal of any significant trees unless necessary to provide a viable economic use of the property or protect public health and safety. All moderately significant trees have been protected to the maximum extent feasible. All buildings and structures will be set back a minimum of six feet from significant trees.

a. Evidence: No trees are being removed. This finding can be made.

Section 3: FINDINGS REQUIRED FOR FINAL DETAILS PHASE APPROVAL (CMC Section

17.64.080.B).

1. Finding – Character: The proposed architectural style and detailing are simple and restrained in character, consistent and well integrated throughout the building and complementary to the neighborhood without appearing monotonous or repetitive in context with design on nearby sites.
a. Evidence: As demonstrated in the supporting evidence for Finding 3, 5, 7, and 8 of Section 2, the new proposed residence is consistent with the neighborhood character while maintaining the architectural diversity. As conditioned, this finding can be made.

2. Finding – Materials and Design: The proposed exterior materials and their application rely on natural materials and the overall design will add to the variety and diversity along the streetscape.
a. Evidence: As demonstrated in the supporting evidence for Finding 3 of Section 2, the project complies with all material requirements and design guidelines in the Residential Design Guidelines. This finding can be made.

3. Finding – Design Elements: Design elements such as stonework, skylights, windows, doors, chimneys and garages are consistent with the adopted design guidelines and will complement the character of the structure and the neighborhood. a. Evidence: As demonstrated by the supporting evidence for Finding 3 and 8 of Section 2, the project meets applicable design guidelines and fits into the context of the neighborhood character. As conditioned, this finding can be made.

4. Finding – Visual Continuity: Proposed landscaping, paving treatments, fences and walls are carefully designed to complement the urbanized forest, the approved site design, adjacent sites and the public right-of-way. The design will reinforce a sense of visual continuity along the street.
a. Evidence: As demonstrated by the supporting evidence for Finding 2, 3, 5, and 6 of Section 2, the project complements the urbanized forest, the approved site design, adjacent sites and the public right-of-way. This finding can be made.

Section 4: CEQA FINDING – EXEMPT

1. Finding – Categorical Exemption: Approval of the Project is Categorically Exempt from the California Environmental Quality Act (CEQA) and no unusual circumstances were identified.
a. Evidence: CEQA Guidelines Section 15302 – Replacement or Reconstruction, categorically exempts reconstruction where the new structure will be located on the same site and will have substantially the same purpose and capacity of the existing.

The project is for the reconstruction, and associated site improvements, of a single family dwelling within a residentially zoned lot and within the same footprint.

Therefore, the project qualifies for this exemption.
b. Evidence: The exceptions to the exemptions listed in CEQA Guidelines Section 15300.2 do not apply in this case as explained below;
a. Location. The project is for the demolition of an existing single-family residence and the construction of a new single-family residence. The existing and proposed use as a single-family home is a permitted use for the site’s designated residential zoning district.
b. Cumulative Impact. Due to the size of the city, it is not unusual for construction projects to occur in proximity to other active projects. The project will not result in a cumulative impact because there will not be successive projects of the same type in the same location. c. Significant Effect. No significant trees or resources are proposed to be removed or demolished as part of the proposed work. The project will not have any negative significant effects on the environment. d. Scenic Highways. The project is not located on a scenic highway and will not result in any impacts to scenic highways or scenic resources. e. Hazardous Waste. The subject site will not have any effect on a hazardous waste site and is not a site listed pursuant to Section 65962.5 of the Government Code.
f. Historic Resource. The subject property was reviewed for historical significance January 17, 2025, and found ineligible for the Carmel Historical Inventory. The proposed project will not have any negative effects on a historic resource on or adjacent to the subject site.

promptly notify the Applicant of any legal proceeding and cooperate fully in the defense.

The City may, at its sole discretion, participate in any such legal action, but participation shall not relieve the Applicant of any obligation under this condition. Should any party bring any legal action in connection with this project, the Superior Court of the County of Monterey, California, shall be the situs and have jurisdiction for resolving all such actions by the parties hereto.

17. Driveway. Prior to the issuance of a building permit, the Applicant shall clearly identify on the construction drawings the driveway material and asphalt connection to the paved street edge. The driveway material shall be extended beyond the property line into the public right-of-way to connect to the paved street edge. A minimal asphalt connection at the street edge may be required by the Superintendent of Streets or the Building Official, depending on site conditions, to accommodate the drainage flow line of the street. If the driveway material is proposed to be sand set, a dimensioned construction detail showing the base material shall be included in the construction drawings.

18. Hazardous Materials Waste Survey. Prior to the issuance of a demolition permit, the Applicant shall submit a hazardous materials waste survey to the Building Division in conformance with the Monterey Bay Unified Air Pollution Control District.

19. Cultural Resources. Throughout construction, all activities involving excavation shall immediately cease if cultural resources are discovered on the site, and the Applicant shall notify the Community Planning & Building Department within 24 hours. Work shall not be permitted to recommence until such resources are properly evaluated for significance by a qualified archaeologist. If the resources are determined to be significant, prior to the resumption of work, a mitigation and monitoring plan shall be prepared by a qualified archaeologist and reviewed and approved by the Community Planning and Building Director. In addition, if human remains are unearthed during the excavation, no further disturbance shall occur until the County Coroner has made the necessary findings regarding origin and distribution pursuant to California Public Resources Code (PRC) Section 5097.98.

20. Truck Haul Route. Prior to the issuance of a building permit, the Applicant shall submit for review and approval by the Community Planning & Building Director, in consultation with the Public Works and Public Safety Departments, a truck-haul route and any necessary traffic control measures for the grading activities. The Applicant shall be responsible for ensuring adherence to the truck-haul route and implementation of any required traffic control measures.

22. Conditions of Approval. Prior to the issuance of a building permit, the Applicant shall print a copy of the Resolution adopted by the Planning Commission and signed by the property owner(s) on a full-size sheet within the construction plan set submitted to the Building Safety Division.

Landscape Conditions

23. Tree Planting Requirements. Prior to issuance of a building permit, the Applicant shall identify on the landscape plan the location, size, and species of required tree plantings.

All new trees shall be installed prior to the final inspection. Trees shall be recorded and monitored for at least five years to ensure their establishment and growth to maturity.

Trees that do not survive or are removed shall be replaced with new trees that are equivalent in size to the measured or projected growth of the original trees and shall be planted in the same location unless otherwise directed by the City Forester or Forest & Beach Commission.

24. Tree Removal Prohibited. Throughout construction, the Applicant shall protect all trees identified for preservation by methods approved by the City Forester. Trees on or adjacent to the site shall only be removed upon the approval of the City Forester or Forest and Beach Commission.

25. Tree Protection Measures. Requirements for tree preservation shall adhere to the following tree protection measures on the construction site. x Prior to grading, excavation, or construction, the developer shall clearly tag or mark all trees to be preserved.
x Excavation within 6 feet of a tree trunk is not permitted. x No attachments or wires of any kind, other than those of a protective nature, shall be attached to any tree.
x Per Municipal Code Section 17.48.110, no material may be stored within the dripline of a protected tree, including the drip lines of trees on neighboring parcels.
x Tree Protection Zone. The Tree Protection Zone shall be equal to dripline or 18 inches radially from the tree for every one inch of trunk diameter at 4.5 feet above the soil line, whichever is greater. A minimum of 4-foot-high transparent fencing is required unless otherwise approved by the City Forester. Tree protection shall not be resized, modified, removed, or altered in any manner without written approval. The fencing must be maintained upright and taught for the duration of the project. No more than 4 inches of wood mulch shall be installed within the Tree Protection Zone. When the Tree Protection Zone is at or within the drip line, no less than 6 inches of wood mulch shall be installed 18 inches radially from the tree for every one inch of trunk diameter at 4.5 feet above the soil line outside of the fencing.
x Structural Root Zone. The Structural Root Zone shall be 6 feet from the trunk or 6 inches radially from the tree for every one inch of trunk diameter at 4.5’ above the soil line, whichever is greater. Any excavation or changes to the grade shall

be approved by the City Forester prior to work. Excavation within the Structural Root Zone shall be performed with a pneumatic excavator, hydro-vac at low pressure, or another method that does not sever roots.
x If roots greater than 2 inches in diameter or larger are encountered within the approved Structural Root Zone, the City Forester shall be contacted for approval to make any root cuts or alterations to structures to prevent roots from being damaged.
x If roots larger than 2 inches in diameter are cut without prior City Forester approval or any significant tree is endangered as a result of construction activity, the building permit will be suspended, and all work stopped until an investigation by the City Forester has been completed, and mitigation measures have been put in place.

26. Foundation Work Near Significant Trees. All foundations within 15 feet of significant trees shall be excavated by hand. If any tree roots larger than two inches (2”) are encountered during construction, the City Forester shall be contacted before cutting the roots. The City Forester may require the roots to be bridged or may authorize the roots to be cut. If roots larger than two inches (2”) in diameter are cut without prior City Forester approval or any significant tree is endangered as a result of construction activity, the building permit will be suspended and all work stopped until an investigation by the City Forester has been completed. Six inches (6”) of mulch shall be evenly spread across the inside the dripline of all trees prior to the issuance of a building permit.

Environmental Compliance Conditions

27. Drainage Plan. Prior to the issuance of a building permit, the Applicant shall submit for review and approval by the Community Planning & Building and Public Works Departments a drainage plan that meets the requirements of the City's drainage guidance, SOG 17-07. At a minimum, new and replaced impervious area drainage must be dispersed around the site rather than focused on one corner of the property; infiltration features must be sized appropriately and located at least 6 feet from neighboring properties. The drainage plan shall include information on drainage from new impervious areas and semi-pervious areas.

28. BMP Tracking Form. Prior to issuance of a building permit, the Applicant shall submit for review and approval by the Community Planning & Building and Public Works Departments a completed BMP Tracking form.

29. Semi-Permeable Surfaces. Prior to issuance of a building permit, the Applicant shall submit for review and approval by the Community Planning & Building and Public Works Departments cross-section details for all semi-permeable surfaces.

CITY OF CARMEL-BY-THE-SEA
City Council
Staff Report
August 31, 2026

ORDERS OF BUSINESS
TO: Honorable Mayor and City Council Members
SUBMITTED BY: Marisa Bermudez, Acting Assistant City Administrator APPROVED BY: Brandon Swanson, Acting City Administrator SUBJECT: Resolution 2026-064 authorizing the City Administrator to purchase a G2 Fire Station Alerting System from U.S. Digital Designs for a cost not to exceed $174,000.

RECOMMENDATION:

Adopt Resolution 2027-064 (Attachment 1) authorizing the City Administrator to purchase and install a G2 Fire Station Alerting System from U.S. Digital Designs in an amount not to exceed $174,000.

BACKGROUND / SUMMARY:

The City’s current fire station alerting system requires replacement to ensure continued reliable operation and integration with the County's new digital emergency dispatch and alerting system. The existing system is approximately 15 years old and is no longer supported. ComTech, the manufacturer of the existing system, ceased operations in 2022, many replacement parts are no longer manufactured, and other vendors contacted by the City are not sufficiently familiar with the legacy ComTech system to ensure that they can reliably address the system's current issues.

A fire station alerting system provides immediate notification to firefighters when they are dispatched to an emergency call. Because alerts must be received throughout the fire station, the system includes equipment installed in multiple areas of the building and interfaces directly with the emergency dispatch system through which calls are received. The proposed system includes lights, display signs, and 24 speakers strategically located throughout the Fire Station to provide comprehensive alerting coverage.

Page 208 of 239 ends

U.S. Digital Designs, a Honeywell company, specializes in fire station alerting technology. The proposed G2 Fire Station Alerting System is designed to integrate with the County's dispatch infrastructure and will provide a modern, supported platform for receiving and distributing emergency alerts. This integration will help ensure that emergency alerts are received promptly, reliably, and completely, reducing the risk of delays or incomplete notifications to responding personnel.

The purchase will be made using competitively solicited pricing available through Sourcewell (Attachment 2), a cooperative governmental purchasing organization of which the City is a member. The proposed system is also consistent with systems installed in the Cities of Pacific Grove, Monterey, Seaside, Marina, and Salinas. Using a common system provides operational consistency and facilitates coordinated maintenance and technical support across the fire stations managed by the City of Monterey.

Based on the cooperative purchasing pricing, the specialized nature of the system, compatibility with the Countywide dispatch infrastructure, and consistency with systems used by neighboring jurisdictions, Fire Department staff recommends that the City Council adopt the attached resolution authorizing the purchase and installation of a new G2 Fire Station Alerting System from U.S. Digital Designs at the Carmel Fire Station.

The current estimate for the purchase and installation of the system is $157,785.27.

Staff recommends including an approximately 10% contingency to accommodate incidental additions, modifications, or other unforeseen needs that may arise during installation and system configuration, for a total authorized amount not to exceed $174,000.

The system upgrade was approved as part of the Fiscal Year 2026-2027 Capital Projects Budget under CIP Project No. 274208, with an approved project budget of $200,000.

FISCAL IMPACT:

Purchase and installation: $174,000. Annual warranty and support costs: $6,200 (after year 1). Funding Source: CIP Project 274208.

PRIOR CITY COUNCIL ACTION:

On June 2, 2026, Council adopted the 26-27 FY budget and CIP plan.

Mountain Standard Time, the replacement Hardware will be shipped on the next business day. All RMA requests are processed on the business day on which the request was received, excluding holidays. Included with the shipped package will be return shipment instructions and a pre-paid return shipping label for the Hardware that the Customer is returning. The original Hardware must be returned in the shipping box provided by Honeywell. No goods will be accepted for exchange or return without a pre-approved RMA number, nor will goods which have not been properly packaged in Honeywell’s shipping box, as proper packaging ensures that goods are not damaged during the shipping process. The original Hardware must be shipped back within 10 days of receiving the replacement Hardware. Failure to return the original Hardware or failure to return the original Hardware in an appropriate manner will cause Customer to incur a replacement charge equal to full market value of the replacement Hardware.

9.5. No Fault Found. Customer understands that this fee is intended to discourage return of Products prior to proper troubleshooting or return because the product is “old.” Product returns will not be allowed if, upon examination of the returned Product, it is determined that the Product was subjected to accident, misuse, neglect, alteration, improper installation, unauthorized repair, improper testing, or poor packaging upon return. In such event, Honeywell shall invoice Customer for the full market value of the replacement Product.

9.6. WARRANTY EXCLUSIONS & DISCLAIMERS.

9.6.1. Honeywell does not warrant that the operation of its Products or any related peripherals will be uninterrupted or error-free. Honeywell further does not warrant nor support any system configuration that deviates from this specific quote’s documented station system design file number.

9.6.2. Honeywell does not warrant or support any system not installed by G2 Trained & Certified Installation technician (installer). If Customer intends to tie this system into any 3rd-party system or devices, Honeywell will be unable to warrant or support the Products unless Honeywell has had a chance to review documented engineering assumptions and approve system integrity, performance, and reliability expectations

9.6.3. Honeywell is not responsible for damage arising from Customer’s failure to follow instructions relating to the use of the Products.

This Warranty does not apply to any Products, including the hardware or software, not used for its intended purpose.

9.6.4. Honeywell cannot warrant nor support any system not using Honeywell-approved Uninterruptable Power Supply Battery Backup.

This Warranty does not apply to monitors or televisions manufactured by third parties. Repair or replacement of such components shall be subject exclusively to the manufacturer’s warranty, if any. Recovery and reinstallation of hardware and user data (including passwords) are not covered under this Warranty.

9.6.5. This Warranty does not apply: (a) to consumable parts, such as batteries, unless damage has occurred due to a defect in materials or workmanship; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports; (c) to damage caused by use with non-Honeywell products; (d) to damage caused by accident, abuse, misuse, flood, lightning, fire, earthquake or other external causes; (e) to damage caused by operating the Product outside the permitted or intended uses described by Honeywell; (f) to damage or failure caused by installation or service (including upgrades and expansions) performed by anyone who is not a representative of Honeywell or a Honeywell authorized installer or service provider; (g) to a Product or part that has been modified to alter functionality or capability without the written permission of Honeywell; (h) to Software (as defined below); (i) to any other damage caused by an event or action outside of Honeywell’s control, including, without limitation, Customer’s failure to apply required or recommended updates or patches to any Software or Product; or (h) if any serial number has been removed or defaced.

9.6.6. The System is designed to generate and transmit signal-based outputs solely to supported third-party integrations (e.g., gas shutoff systems, apparatus bay doors, and similar connected equipment).

9.6.7. Customer acknowledges and agrees that the System’s functionality is strictly limited to the initiation and transmission of such signals. The System does not control, monitor, verify, or guarantee the execution, performance, or outcome of any action by third-party systems, devices, or integrations.

9.6.8. USDD by Honeywell warrants and supports only the transmission of signals from the System itself. Any actions taken (or not taken) by third-party systems in response to such signals are outside of USDD by Honeywell's control and responsibility.

9.6.9. USDD by Honeywell shall have no responsibility or liability for:
- The failure, delay, malfunction, or improper operation of any third-party system or device; - Any damages or losses arising from the actions or inactions of third-party integrations; - Any uses of the System beyond its intended signal-transmission function.

9.6.10. All other functions, uses, or integrations not expressly supported by the System are outside the scope of this Agreement and are not warranted or supported in any manner.

10. LIMITATIONS OF LIABILITY. TO THE EXTENT PERMITTED BY LAW, THE LIMITED WARRANTY IN SECTION 9 OF THESE TERMS AND

CONDITIONS AND ANY OTHER REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL OR WRITTEN, STATUTORY, EXPRESS OR IMPLIED. AS PERMITTED BY APPLICABLE LAW,

HONEYWELL SPECIFICALLY DISCLAIMS ANY AND ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION,

WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND WARRANTIES AGAINST HIDDEN OR LATENT DEFECTS. If Honeywell cannot lawfully disclaim statutory or implied warranties, then to the extent permitted by law, all such warranties shall be limited in duration to the duration of this express Warranty and to repair or replacement service as determined by Honeywell in its sole discretion. No reseller, agent, or employee is authorized to make any modification, extension, or addition to this Warranty. If any term is held to be illegal or unenforceable, the legality or enforceability of the remaining terms shall not be affected or impaired.

EXCEPT AS PROVIDED IN THE LIMITED WARRANTY IN SECTION 9 OF THESE TERMS AND CONDITIONS, AND TO THE EXTENT

PERMITTED BY LAW, HONEYWELL IS NOT RESPONSIBLE FOR INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL

DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR CONDITION, OR UNDER ANY OTHER LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOSS OF USE; LOSS OF REVENUE; LOSS OF THE USE OF MONEY; LOSS OF ANTICIPATED SAVINGS; LOSS OF GOODWILL; LOSS OF REPUTATION; AND LOSS OF, DAMAGE TO OR CORRUPTION OF DATA. HONEYWELL IS NOT RESPONSIBLE FOR

ANY INDIRECT LOSS OR DAMAGE HOWSOEVER CAUSED, INCLUDING THE REPLACEMENT OF EQUIPMENT AND PROPERTY, ANY

COSTS OF RECOVERING PROGRAMMING OR REPRODUCING ANY PROGRAM OR DATA STORED OR USED WITH HONEYWELL PRODUCTS, AND ANY FAILURE TO MAINTAIN THE CONFIDENTIALITY OF DATA STORED ON THE PRODUCT.

ALL PRODUCT CLAIMS ARE LIMITED TO THOSE EXCLUSIVE REMEDIES SET FORTH IN THE LIMITED WARRANTY IN SECTION 9 OF THESE TERMS AND CONDITIONS. HONEYWELL’S AGGREGATE LIABILITY IN CONNECTION WITH THEREWITH SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCTS PAID BY CUSTOMER TO HONEYWELL FOR THE PRODUCTS GIVING RISE TO THE CLAIM.

Honeywell disclaims any representation that it will be able to repair any Hardware under this Warranty or make a product exchange without risk to or loss of the programs or data stored thereon.

11. SERVICE AGREEMENT. The Product being purchased hereunder is not subject to any post-Warranty service agreement or maintenance program unless specifically contracted for between Honeywell and Customer. Honeywell offers a comprehensive post-Warranty Service Agreement at additional cost. Customer should contact Honeywell regarding its Service Agreement and costs associated therewith.

12. SOFTWARE PRODUCTS. All software Products delivered by Honeywell to Customer or for which Honeywell provides access, including, without limitation, Honeywell’s mobile application software and Products with embedded software or firmware (collectively, “Software”) are not sold and are licensed. At all times that Customer is in compliance with the terms of these Terms and Conditions and any other agreement between the parties, Customer shall have a non-exclusive, non-transferable, fully paid license to use the Software, but only in conjunction with the Products provided by Honeywell and Customer’s fire station alerting system (the “License”). The terms of such Software License may be set forth in a separate software license agreement or end user license agreement provided by Honeywell with such Software. In no event shall Customer have any right to (or authorize or allow any third party to) distribute, sell, lend, rent, transfer, or convey the Software; grant any sublicense, lease, or other rights in the Software; decompile, disassemble, reverse engineer, or otherwise attempt to reconstruct, identify, or discover any source code, underlying user interface architecture or techniques, or algorithms of the Software by any means; or take any action that would cause the Software or any portion of it to be placed in the public domain. In the event of a conflict between the terms of any Software license terms provided upon download or purchase a purchase and these Terms and Conditions, the relevant Software license terms shall control solely with respect to such Software.

13. INTELLECTUAL PROPERTY: Customer hereby agrees and acknowledges that Honeywell owns all rights, title, and interest in and to the Intellectual Property (as defined below). Customer agrees to not remove, obscure, or alter Honeywell’s or any third party's copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through Honeywell’s Product (as defined below). Nothing herein shall be deemed to give, transfer, or convey to Customer any rights in the Intellectual Property other than the License, as set forth above. For purposes of this Section, "Intellectual Property" means any and all rights of Honeywell related to Honeywell’s Products existing from time to time under patent law, copyright law, trade secret law, trademark law, unfair competition law, and any and all other proprietary rights, and any and all derivative works, work product, applications, renewals, extensions and restorations thereof, now or hereafter in force and effective worldwide.

14. FIRST ARRIVING MOBILE APP. If Customer wishes to use its First Arriving Mobile App (“First Arriving”) with the System being acquired from Honeywell, Customer agrees to the following:

14.1 Customer acknowledges that it bears full responsibility for complying with applicable law and regulations, including all privacy requirements, and for providing any required notices and obtaining all required consents in order for Honeywell to transmit alert to First Arriving. Customer also acknowledges that Honeywell bears no responsibility for any service failure by First Arriving, nor is Honeywell responsible for supporting First Arriving’s services or platform. Honeywell is offering to transmit alerts that are transmitted through its Honeywell service to First Arriving merely as a courtesy to Customer.

14.2 IN NO EVENT SHALL HONEYWELL BE LIABLE TO CUSTOMER FOR ANY CLAIMS, WHETHER ARISING FROM ANY INDEMNIFICATION

OBLIGATION HONEYWELL MAY HAVE OR THAT ARISE FROM A BREACH OF CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE),

OPERATION OF LAW, OR OTHERWISE, AND EVEN IF THE PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF THE LIABILITY OR THE

LIABILITY IS OTHEWISE FORESEEABLE, FOR ANY LOST PROFITS OR REVENUE, SPECIAL, INCIDENTAL, INDEIRECT, CONSEQUETIAL,

EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND (INCLUDING ALL DAMAGES DUE TO BUSINESS INTERRUPTION, LOSS OR CORRUPTION OF DATA, OR LOST USE OF ANY PROPERTY OR CAPITAL) THAT RELATE TO OR ARISE OUT OF HONEYWELL’S TRANSMISSION OF ALERTS TO FIRST ARRIVING. FURTHER HONEYWELL’S AGGREGATE LIABILITY IN CONNECTION WITH ITS

TRANSMISSION OF ALERTS TO FIRST ARRIVING WILL BE LIMITED TO THE GREATER OF THE AMOUNT PAID BY CUSTOMER TO HONEYWELL IN ORDER FOR HONEYWELL TO TRANSMIT ALERTS TO FIRST ARRIVING OR $100. 15 REMOTE ACCESS TO THE SYSTEM.

PROPRIETARY and CONFIDENTIAL STANDARD Ts&Cs Page 8 of 10 ATTACHMENT 2

Page 219 of 239 ends

15.1 Remote Access. Honeywell requires remote network access to the Customer’s Products through Secure Shell (SSH) to perform implementation and support tasks under this Agreement. To enable remote network access, the Customer will provide Honeywell support personnel VPN or similar remote network access to the Products for Honeywell support personnel (“Customer Support”) to effectively troubleshoot critical or complex problems and to expedite resolution of such issues. Remote network access is also used to install core software upgrades and customized software. Honeywell will only access Customer’s Products with the knowledge and consent of Customer. Honeywell will not access any other systems or data.

15.2. Alternative to Network Access. If the Customer elects not to provide remote network access to the Products, then Honeywell may not be able to perform some support functions. Customers that elect not to routinely provide network access may temporarily reinstate this access to allow Honeywell to perform the above services. The following services will not be performed without this access: Product software upgrades; Product software customization; Network troubleshooting assistance including packet capture and network monitoring on Honeywell devices; Detailed log analysis; Bulk updates to certain Product database tables; Troubleshooting that requires low-level system access or large file transfer.

15.3. Timely Access. Customers much ensure that remote access is available prior to notifying Honeywell of a support request. In the event that the Customer is unable to provide remote access, Honeywell will not be required to provide support outside those tasks that do not require remote access, and any corresponding resolution response times will not apply.

15.4. Physical Security Tokens. Honeywell has multiple software engineers that provide after-hours support and these engineers do not typically take security tokens from the Honeywell office. If the customer requires the use of physical security tokens, this may delay after hours service.

16. GOVERNING LAW. This proposal and any contract or agreement resulting therefrom will be governed by and construed according to the laws of the State of Arizona without regard to its conflicts of law principles.

17. DISPUTE RESOLUTION/ARBITRATION. Before either Honeywell or Customer initiate any dispute resolution process related to the Agreement, they must schedule an executive resolution conference to be held within thirty (30) days of receipt of the other party’s written request. The conference must be attended by at least one executive from each party. At the conference, each party will present its view of the dispute in detail and the executives will enter into good faith negotiations in an attempt to resolve the dispute. If the dispute is not resolved within fifteen (15) days of the end of the conference or if one party refuses to attend the executive resolution conference, then Honeywell and Customer further agree that any remaining dispute between them arising out of or relating to this Agreement will be settled by litigation with jurisdiction being Maricopa County, Arizona.

18. FORCE MAJEURE. Except for Customer’s duty to pay sums due hereunder, neither party will be liable to the other for any failure to meet its obligations due to any Force Majeure Event. As used herein, a “Force Majeure Event” is one that is beyond the reasonable control of the non-performing party and may include, but is not limited to: (a) delays or refusals to grant an export license or the suspension or revocation thereof, (b) embargoes, blockages, seizure or freeze of assets, or any other acts of any government that would limit a party’s ability to perform the Contract, (c) fires, earthquakes, floods, tropical storms, hurricanes, tornadoes, severe weather conditions, or any other acts of God, (d) quarantines, pandemics, or regional medical crises, (e) labor strikes, lockouts, or pandemic worker shortages, (f) riots, strife, insurrection, civil disobedience, landowner disturbances, armed conflict, terrorism or war, declared or not (or impending threat of any of the foregoing, if such threat might reasonably be expected to cause injury to people or property), and (g) shortages or inability to obtain materials or components. The party unable to fulfill its obligations due to Force Majeure will promptly (i) Notify the other in writing of the reasons for its failure to fulfill its obligations and the effect of such failure; and (ii) Use all reasonable efforts to avoid or remove the cause and perform its obligations.

If a Force Majeure Event results in a delay, then the date of performance will be extended by the period of time that the non-performing party is actually delayed or for any other period as the parties may agree in writing. In the event that a Force Majeure Event is ongoing for a period of time which is sixty (60) days or longer, Honeywell may provide notice to Customer that it is cancelling its Order.

19. ACCEPTANCE OF TERMS. This proposal shall become a binding contract between the Customer and Honeywell when accepted in writing by the Customer. Without limiting the foregoing, issuance by Customer of a purchase order to Honeywell for any of the goods or services herein described shall constitute acceptance.

19.1 CUSTOMER CAUSED DELAYS. If the Products and/or Services purchased by Customer hereunder are part of a new system or station implementation project (the “Project”), Honeywell and Customer shall mutually develop a project schedule or timetable (“Project Schedule”). Each party shall use commercially reasonable efforts to perform its obligations in accordance with the Project Schedule, subject to adjustments for reasonable changes or unforeseen events.

Honeywell shall not be liable for any delay, increased cost, or failure to perform to the extent caused by: (i) delays in obtaining parts, materials, equipment, services, or software from any Customer designated supplier; (ii) Customer’s failure to timely provide required information, approvals, access, or resources; or (iii) any other act, omission, or circumstance caused by or within the reasonable control of Customer (each, a “Customer Caused Delay”).

If a Customer Caused Delay occurs, Honeywell shall be entitled to equitable adjustments to the price, delivery dates, milestones, and any other affected terms to account for increased costs, delays, or other adverse impacts incurred by Honeywell. Such adjustments may include, without limitation: (a) increases in material or component costs required to complete the Project; (b) costs associated with buy out or long lead items, including additional costs due to currency exchange rate fluctuations; (c) increases in labor, mobilization, or installation costs; and (d) costs associated with pre building, warehousing, storage, handling, insurance, or preservation of equipment, at Honeywell’s discretion.

If performance of the Project is delayed for a cumulative period exceeding six (6) months beyond the scheduled Project completion date due to Customer Caused Delays, Honeywell may, upon written notice to Customer, (i) suspend performance of the affected Products and/or Services until such delays are remedied, (ii) invoice Customer for reasonable costs incurred as a result of the suspension, and/or (iii) require renegotiation of pricing, schedule, and other affected terms as a condition to resuming performance.

PROPRIETARY and CONFIDENTIAL STANDARD Ts&Cs Page 9 of 10 ATTACHMENT 2

Page 220 of 239 ends

Further, if either (a) the Project is not completed within six (6) months of the scheduled Project completion date due to Customer Caused Delays, or (b) Honeywell and Customer have not mutually agreed upon the required adjustments to price, delivery dates, and other affected terms within sixty (60) days following the expiration or continuation of such delays, Honeywell may, upon written notice, terminate or cancel any affected outstanding Customer Orders, in whole or in part, without liability. Such termination shall be without prejudice to Honeywell’s right to recover amounts due for Products delivered, Services performed, and any reasonable costs incurred as a result of the Customer Caused Delay, including demobilization, storage, and restart costs.

20. SEVERABILITY. In the event any provision or portion of a provision herein is determined to be illegal, invalid, or unenforceable, the validity and enforceability of the remaining provisions shall not be affected and, in lieu of such provision, a provision as similar in terms as may be legal, valid, and enforceable shall be added hereto

21. WAIVER. The failure of either party to insist upon strict performance of any provision of these Terms and Conditions, or to exercise any right provided for herein, shall not be deemed to be a waiver for the future of such provision or right, and no waiver of any provision or right shall affect the right of the waiving party to enforce any provision or right herein.

22. NO JOINT VENTURE. The parties acknowledge that they are independent entities and nothing contained in these Terms and Conditions shall be construed to constitute either party hereto as the partner, joint venturer, employee, agent, servant, franchisee, or other representative of the other party hereto, and neither party has the right to bind or obligate the other, except as otherwise provided herein.

Furthermore, nothing contained in these Terms and Conditions shall be construed to constitute Customer as an exclusive purchaser of the Products in any respect.

CITY OF CARMEL-BY-THE-SEA
City Council
Staff Report
August 31, 2026

ORDERS OF BUSINESS
TO: Honorable Mayor and City Council Members
SUBMITTED BY: Nova Romero, City Clerk
APPROVED BY: Brandon Swanson, Acting City Administrator SUBJECT: Resolution 2026-062 Appointing Three Members to the Building Code Board of Appeals for terms starting September 1, 2026 RECOMMENDATION:

Consider adoption of Resolution 2026-062:

1. Appointing current Disabled Access Member Gail Lehman to the Core Member/Layperson seat;

2. Appointing _________________ to the Core Member/General Contractor seat; and

3. Appointing Gerry Paratore to the Disabled Access Member seat.

BACKGROUND / SUMMARY:

Executive Summary
The Building Code Board of Appeals (BCBOA) is composed of five Core Members and two Disabled Access Members. Under Carmel Municipal Code Section 15.04.180, the five Core Member positions must include one architect or licensed engineer, one general contractor, one member with expertise in fire protection systems, one member with expertise in fire prevention, and one additional member who may have expertise in the construction or building field or may serve as a layperson.

The Board currently has vacancies that must be filled to bring its membership into alignment with the requirements of the Municipal Code. Staff is recommending that current Disabled Access Member Gail Lehman be appointed to the vacant Core

Page 223 of 239 ends

Member/Layperson seat. This reassignment would create a vacancy in a Disabled Access Member seat.

The City recently conducted a public recruitment for the vacant General Contractor Core Member position and a Disabled Access Member position. Following a public recruitment and candidate interviews, the Mayor and Mayor Pro Tem recommend appointing ______________ to the General Contractor Core Member seat and Gerry Paratore to the Disabled Access Member seat. The name of the applicant recommended for appointment to this seat will be provided at the meeting, as the interviews were still being conducted at the time of writing this staff report.

Adoption of the Resolution (Attachment 1) by a majority vote of the City Council is required to confirm the appointments.

Background
The Building Code Board of Appeals hears appeals from decisions of the Building Official, including matters involving the Building Code and accessibility requirements.

Members are appointed by the Mayor with the consent of the City Council and serve at the Mayor's pleasure.

In 2018, the Municipal Code was amended to establish the Board's current membership structure of five Core Members and two Disabled Access Members. The five Core Members consist of:
• One architect or licensed engineer;
• One general contractor;
• One member with expertise in fire protection systems; • One member with expertise in fire prevention; and
• One member with expertise in the construction or building field, or a layperson.

The Disabled Access Members participate in appeals involving access to public accommodations by persons with disabilities. At least four Board members must reside within the City or its Sphere of Influence.

The Board was inactive for several years following the 2018 amendments and has recently resumed activity. As a result, vacancies remain to be filled under the current membership requirements.

Gail Lehman currently serves as a Disabled Access Member but originally applied for a Core Member position based on her experience. Staff recommends appointing Lehman to the vacant Core Member/Layperson seat, for which no specific professional qualification is required. This appointment would allow the newly recruited Disabled Access Member to fill the seat currently held by Lehman.

Page 224 of 239 ends

Application and Recruitment Process
The City Clerk conducted a public recruitment for one General Contractor Core Member and one Disabled Access Member. The Mayor and Mayor Pro Tem reviewed the applications and interviewed candidates on August 24 and 26, 2026. Redacted copies of the applications received for Contractor Core Member and ADA Access Member are included as Attachment 2.

Following the interviews, the Mayor and Mayor Pro Tem recommend the following appointments, effective September 1, 2026:

Core Member – Layperson
Gail Lehman
Core Member – General Contractor
_______________
Disabled Access Member
Gerry Paratore
Adoption of the attached Resolution would confirm all three appointments.

FISCAL IMPACT:

None for this action.

PRIOR CITY COUNCIL ACTION:

In 2018, the City Council adopted Ordinance 2018-03, which established the current membership requirements for the Building Code Board of Appeals.
