ITEMS FOR COUNCIL CONSIDERATION
Approval and adoption of Ordinance No. 756, establishing a Library Advisory Commission in the Municipal Code.
STAFF RECOMMENDATION
1) Adopt Ordinance No. 756 (Attachment A) (second reading), which codifies the creation and rules governing the Carpinteria Community Library Advisory Commission and authorizes compensation for attendance and participation on the Commission, as read by title only.
Sample Motion: I move to adopt Ordinance No. 756, as read by title only (motion requires reading of ordinance title and roll call vote)
BACKGROUND
On May 23,2022, the first reading of Ordinance No. 756 was approved as well as Resolution No. 6136 (Attachment B), setting compensation for Carpinteria Community Library Advisory Commission members at $30 per meeting.
On October 11,2021, the Library Board of Trustees approved Resolution No. 6074 (Attachment C), establishing a Library Advisory Commission and adopting bylaws for its operation. As the Planning Commission and Architectural Review Board are established by ordinance, however, staff recommends that the Library Advisory Commission also be established by ordinance. Proposed Ordinance 756 (Attachment A) restates much of the bylaw provisions, primarily those related to the selection of members and rules governing their operation and will supercede Resolution No. 6074. ln addition, the ordinance incorporates a bylaw provision that provides the Library Advisory Commission with compensation to be established by the City Council by resolution (See Exhibit 1 of Resolution 6074 [Attachment C]). Consistent with the Second reading of Ordinance 756 - Library Advisory Commission June 13,2Q22
2022 0613 CC Staff Report for Ordinance 756 - second readinq.docx practice fixing compensation for members of the Planning Commission and Architectural Review Board by resolution, staff proposed a resolution setting compensation for the Library Advisory Committee.
DISCUSSION
The Library Advisory Commission will be a newly established Commission. The City Council asked staff to come back with information and recommendations regarding compensation for Library Advisory Commissioners, which it did at the May 23,2022 Council Meeting. Compensation for Library Advisory Commissioners was set at $30. per meeting attended.
Once the ordinance is adopted, the City will open recruitment for the five Carpinteria Community Library Advisory Commission members, to be appointed for two-year terms as established in the proposed ordinance.
This Ordinance serves to supercede previously adopted Resolution No. 6074 of June 14,2021.
POLICY CONSISTENCY
The Ordinance written for this report contains the work of the Library Ad Hoc Committee and Working Group, City staff, and Library Transition Consultant. lt is consistent with the City's annual work plan and actions of the City Council concerning the establishment of a municipal library.
ln the City work plan of June 2020, in a review of City policies, it was noted "in making appointments to various City boards, commissions, and committees, the City Council could consider reviewing and revamping its outreach, advertisement, and nomination process to ensure it is reaching diverse segments of the City's population and residents and/or incentivize youth and broader community involvement." FI NANCIAL CONSI DER.ATIONS
City Council approved Resolution No. 6136 as written, setting compensation for the Library Advisory Commission commensurate with ARB members at $30 per meeting, the Carpinteria Community Library budget would be impacted by approximately $1,800 annually, which assumes that all five Committee members attend twelve meetings over a year (once per month).
LEGAL AND RISK MANAGEMENT CONSIDERATIONS
Staff has consulted with the City Attorney's Office in order to ensure compliance with legal requirements and best practices.

ITEM FOR COUNCIL CONSIDERATION
Closeout of 2021 Pavement Rehabilitation Project (City Project No. 15120)
STAFF RECOMMENDATION
Authorize the Mayor to sign the Closeout Agreement and Release of Claims for 2021 Pavement Rehabilitation Project (City Project No. 15120) with Toro Enterprises, lnc.
Sample Motion: I move to authorize the Mayor to sign the Closeout Agreement and Release of Claims for 2021 Pavement Rehabilitation Project (City Project No. 15120) with Toro Enterprises, Inc. (This motion requires a rollcallvote.)
BACKGROUND
On June 28,2021, the City Council awarded the construction contract to Toro Enterprises, lnc. in the Total Base Bid amount of $1,408,598.50. On July 6, 2021, the Notice of Award was issued to Toro Enterprises, lnc. in order to begin the process of executing the construction contract including furnishing the required performance bond, payment bond, and certificates of insurance and insurance endorsements. Staff confirmed the construction contract was fully executed and issued the Notice to Proceed to Toro Enterprises, lnc. for starting construction on September 7,2021.
The purpose of this agenda matter is for the City Council to authorize the Mayor to sign the Closeout Agreement and Release of Claims for 2021 Pavement Rehabilitation Project (City Project No. 15120\ with Toro Enterprises, lnc.
DISCUSSION
The general scope of work for the 2021 Pavement Rehabilitation Project included pavement rehabilitation of the following streets using the full depth reclamation (FDR) method:
Street Name 'Block Beqin Limit End Limit
Calle Ocho 5400 North end Concha Loma Drive intersection Calle Ocho 5500 Concha Loma Drive intersection South end Eiqhth Street 51 00 Maple Avenue Walnut Avenue
Eiqhth Street 5200 Walnut Avenue Palm Avenue
Elm Avenue 1000 Sawver Avenue Carpinteria Avenue
Fourth Street 4500 to 4600 West end Ash Avenue intersection Fourth Street 4700 Ash Avenue intersection Holly Avenue intersection Holly Avenue 500 to 600 Seventh Street Fifth Street
Third Street 4700 Ash Avenue Hollv Avenue
Third Street 4800 Holly Avenue Elm Avenue intersection
Third Street 4900 Elm Avenue intersection Linden Avenue Closeout ol202l Pavement Rehabilitation Project (City Prolect No. 15120) June 13,2022
Page2
Those street names labeled with the word, "intersection," means the limit of the pavement work included the entire street intersection. See Attachment A for location map.
The FDR method is a sustainable pavement method in which the full thickness of the old asphalt concrete pavement and a predetermined portion of the existing underlying aggregate base materials are uniformly pulverized and blended (i.e. reclaimed) to provide a homogenous base material ready for placing new pavement. Overall, the FDR method reduced the number of trucks that were used to export and import pavement materials which thereby lowered greenhouse gas emissions. ln this project, almost a total of 151,000 square feet of pavement was rehabilitated with the FDR method. ln addition to the above listed streets, the Public Works Director directed extra work for the pavement resurfacing of the 1300 and 1400 blocks of Cravens Lane (from northern City limit to approximately 500 feet south of the northern City limit). ln 2021, the private development of Tract Map 25,178 (also known as Seahouse Project) completed the pavement resurfacing of the street segment of Cravens Lane from Via Real to the development's frontage as fulfillment of its subdivision improvement agreement with the City. This extra work completes the pavement resurfacing of the remaining street segment of Cravens Lane from the development's frontage to the northern City limit.
During the course of construction, the following contract changes orders for extra work were directed by the Public Works Director:

2 Balancinq Contract Chanqe Order
The Balancing Contract Change Order is an account of the actual increases and decreases in quantity of bid items for the final amount of work.
Construction of lhe 2021 Pavement Rehabilitation Project was completed in April 2022.
The work was inspected by the City's consulting construction management firm of Davis CME and the consulting materials testing firm of Earth Systems, Inc. Both consulting firms verified the work is in conformance with the contract documents. The Public Works Director determined that the work is now complete, and the construction contract may Closeout of 2021 Pavement Rehabilitation Project (City Project No. 15120) June 13,2022
be closed out. With that, staff recommends for the City Council to authorize the Mayor to sign the Closeout Agreement and Release of Claims. See Attachment B.
POLICY CONSISTENCY
The recommendation is consistent with many goals, objectives, and policies in the Circulation Element of the General Plan and Local Coastal Plan including establishing and maintaining a roadway system capable of providing for the safe and efficient movement of goods and people through the community.
FINANCIAL CONSIDERATIONS
On June 28,2021, the City Council approved the appropriation of $2,752,000 as a part of the award of the construction contract for the 2021 Pavement Rehabilitation Project.
On October 25,2021, the City Council authorized the rollover of unused funds from the Fiscal Year 202Ol21Capital lmprovement Program Budget into the Fiscal Year 2021122 Capital lmprovement Program Budget.

ITEM FOR COUNCIL CONSIDERATION
Fiscal Year (FY) 2022123 Budget Overview
STAFF RECOMMENDATION
Action ltem X ; Non-Action ltem _
Receive the staff report, open the public hearing and receive public comment, provide staff with direction concerning Budget Funds, and continue the public hearing to the Special City Council meeting of Thursday, June 23,2022,3pm.
Sample Motion: I move to (insert any general direction concerning Budget Funds), and continue the public hearing to the Special City Council meeting of Thursday, June 23, 2022.
BACKGROUND
The preparation of the budget document is a process that includes estimates of the current year-end revenues and expenditures (as affected by experience and changes approved by Council during the fiscal year), estimates of costs associated with the City's Annual Work program (approved in January), budget requests from Department Heads related to specific programs and services, estimates of contract services costs and other capital and operating costs, meetings with the City Council Finance/Budget Committee (Councilmembers Clark and Carty) and review by City Council.
On June 9,2022, the City Finance Committee reviewed the FY 2021122 Estimated Actual year-end budget and proposed budget information for FY 2022123. The Committee reviewed the reports and provided direction to finalize the budget with the proposed estimates for both fiscal years. The draft budget is scheduled to be available to the public beginning Friday, June 10, 2022. Once approved by the City Council the budget document will be published in its finished format. Each year the City posts the adopted budget on-line at the City's website and makes hard copies available for public use at City Hall.

June 13,2022
The review of the Budget is scheduled over three meetings: Budget Overview on June 13; Budget Hearing and possible adoption on June 23 (Special Meeting starts at 3pm); and, if needed, review and adoption on June 27 , at the regular City Council meeting. The Council will receive and consider public comment at each of the Budget hearings. After deliberating, the City Council may provide direction concerning the draft Budget or, beginning at its June 23 meeting, take action to approve the budget.
DlscusstoN
Projected revenues and expenditures included in the budget will permit delivery of the City's annual work program and the carrying out of a number of significant projects, programs and services. The Proposed Budget projects approximately $31.8 million in total expenditures on revenues of approximately $26.9 million. The difference primarily influenced by projected one-time capital project spending. The City's current and projected financial condition is affected significantly by both the recovery of major revenues affected by the pandemic, federal government financial assistance provided through the American Recovery Plan Act (ARPA), and an aggressive capital improvemenUmajor maintenance prog ram.
ln particular, transient occupancy tax, i.e., the hotel bed tax, and sales tax revenues contributing to the General Fund have recovered to exceed pre-pandemic levels. Major one-time or unique expenses include significant advanced planning work and capital project planning and/or construction. Significant increased recurring expenses include costs for the law enforcement services agreement and employee compensation. Other important expenditures include ongoing support for local health and humans service providers, $200,000, annual funding to support the Director of Community Partnerships position at the Carpinteria Children's ProjecUFamily Resource Center, $20,0000, and a $250,000 allocation for mid and long-term small business pandemic recovery support.
POLICY SISTENCY
The annual municipal budget is presented in compliance with Carpinteria Municipal Code section 2.08.110(H), which establishes the preparation and submittal to the City Council of the annual budget as a duty of the City Manager. City policies related to annual budgeting, including the Cost Recovery provisions of the Municipal Code and its lnvestment Policy. Accounting and financial practices of the City influence the organization of the budget and how information is reported are a part of City accounting Policies.
The City's Mission Statement reads, in part, that the City shall make judicious use of its limited resources to promote the highest possible quality of life for all of Carpinteria's residents and that the City's budget shall reflect the goals and priorities of the majority of the City residents and shall be managed in a professional and business-like manner.
Also, the City operates under several informal budgeting policies that can be articulated as goals. A goal of the City's budget is for the City to live within its means, effectively, G :\EVE RYON E\Bud g el 2022-23\Bud get Ove rview Staff Repo ft FY 2022-23. docx Budget Overview, FY 2022123

funding ongoing expenses with ongoing revenues. Another goal of the budget is to support the City's effort to provide continuity in high quality services that meet community needs and expectations. The proposed budget includes funding sufficient to carry out the City's work program and other important projects, programs and services, and to comply with the City's reserve policies.
Finally, the Budget serves to implement policies of the City's General Plan / Local Coastal Plan, the adopted Capital lmprovement Program and the Annual Work Plan. Examples include General Plan policies related to Library services and the City's Sustainability Policy,
FINANCIAL CONSIDERATIONS
The largest of the 19 Funds managed by the City and accounted for through the Budget is the General Fund.
The 2021122 Estimated Actual Budget projects a year-end General Fund operational excess of just over $1.5 million. The excess resulting primarily from American Rescue Plan Act (ARPA) funds, but also contributing is reduced personnel costs due to vacancies throughout the fiscal year and consultant services work that was deferred. The FY 2021122 Estimate Actual Budget ending available fund balance (AFB) is projected at approximately $2.8 million.
The 2022123 Proposed Budget projects a year-end General Fund operating deficit of ($916,000). The deficit result from both one time and ongoing cost increases. Ongoing cost increase drivers include projections for personnel cost increases, approximately $445,000, and law enforcement services, just under $600,000. One-time cost increase drivers include restoring Reserves to policy levels, $1.6 million, and various consultant services, the largest for the General Plan Update work, $310,000. The FY 2022123 ending available fund balance (AFB) is projected at $590,137
All Funds
Total projected FY 2022123 revenues of $26,864,900 are about 30% or approximately $6.3 million, more than current year Estimated Actual current year-end revenues. The most significant contributions to this increase are the ARPA payment and grant funding related to capital projects.
Total FY 2022123 budgeted appropriations for all municipal funds are $3'1,831,600, an increase of approximately 42o/o ot $9.38 million from Estimated Actual current year-end expenditures. Total expenditures are influenced heavily by the size and number of capital and major maintenance projects the City undertakes during the fiscal year and such projects are primarily funded through grants and other dedicated funding sources. The following table is the proposed budget of all funds and estimated ending fund balances.

small businesses, impacted industries, nonprofits, and the public sector recover from economic impacts.
Provide premium pay for essential workers, offering additional support to those who have and will bear the greatest health risks because of their service in critical sectors.
lnvest in water, sewer, and broadband infrastructure, making necessary investments to improve access to clean drinking water, to support vitalwastewater and stormwater infrastructure, and to expand affordable access to broadband internet.
The City experienced negative financial impacts from the pandemic due to reduced revenues and response costs. The City estimates that from FY 2019120 lo FY 2020121, it lost approximately $2.4 million in tax and fee revenues and $3.5 million in expenditures related to pandemic response. The $3.2 million received by the City will be used to replace lost revenues and offset response costs. The revenues will be reimbursed in FY 2021122 and FY 2022123 to all funds (General Fund, Measure X, Park Maintenance, etc.) by a percentage of payroll.
Special Revenue Funds
The City funds street and park & recreation maintenance and operations through, in large part, Special Revenue Funds that can only be used for specific purposes, e.9., street right-of-way assessment district revenues pay for street right-of-way maintenance. These Special Revenue Funds have very little, if any, potential for growth without voter approval and have not been adjusted since 1995.
The City will begin running City Library operations on July 1,2022, with costs funded from General and Measure X Funds, a County per capita allocation and donations. The first fiscalyear Library budget includes $857,850 in expenditures that reflect a combination of capital projecUmajor maintenance work on the building and operating costs. City revenues are nearly entirely from the Measure X Fund, with a small General Fund contribution. The Library also benefits from a $50,000 contribution from the Carpinteria Friends of the Library and $147,100 from the County.
General Fund subsidies are required in order to balance several of the Special Revenue Funds annually. The Special Revenue Funds requiring General Fund and Measure X subsidies in the proposed budget are:

Reserves/Fund Balance
For FY 2022123, the total General Fund balance is projected to decrease by $9t6,000 to $9,252,340. That portion of the total General Fund balance held in Committed Reserves established by policy or in response to state law is estimated at $7,223,240 million, an increase of $1 ,295,297. This increase reflecting restoration of reserves to policy level that were drawn down during the pandemic and for capital project. All of the Reserves may be used at the discretion of the City Council with the exception of the Non-Spendable Statutory Reserve. Currently there is only $350 in the Non-Spendable category.
The following Committed Reserves have been established by City Council policy, are a part of the General Fund and are accounted for annually through the Annual Consolidated Financial Report (ACFR) but are not a part of the Municipal Budget. The most recent audited reserve balances (for the year ended June 30,2021) are as follows on the table below under Prior Year Actuals FY 2021:

Staffing
The proposed budget expense projection includes funding for all approved positions, and including adjusted compensation pursuant recommendations of the recently completed Total Compensation Study. Several significant staffing related expenses also included in the proposed budget are increased Law Enforcement Services Agreement cost and new Library program expenditures. The estimated total compensation expenditure at $7,292,400 is a $1,025,650 increase over the Estimated Actual for year-end, which has been affected by numerous vacancies throughout the year.
Gapital lmprovement Projects
Capital lmprovement Program budget for the FY 2022123 fiscal year is projected at $11,589,400. Funding for Capital Projects includes special funds such as Measure A, Measure X and Development lmpact Fees, as well as grant funding. This represents a continuation of the City's aggressive effort to address capital improvement needs and deferred maintenance. The projects will be carried out by the Public Works and Parks, Recreation and Public Facilities Departments.
Capital project highlights include work on the update of the City's General Plan / Coastal Plan and other advanced planning projects, work on the Skate Park, Concha Park, trail connections along the Coastal Vista Trail, East Via Real Stormwater project, and two pavement maintenance projects. Capital projects are funded largely through intergovernmental funding, e.9., the City's annual Measure A sales tax allocation and/or state and federal grants. Such intergovernmental funds often require a match from the General Fund or are simply not adequate and therefore the Council can authorize use of the General Fund revenue to close a funding gap.

Community Promotion and Support
The City of Carpinteria supports business and community service groups both with direct financial support and indirectly. By far the largest funding in support of the local economy comes in the form of program funding for maintenance and improvements of streets and sidewalks, street sweeping, parkway landscaping, and street furnishings. The budget also funds improvement and maintenance of a system of parks, beaches and open spaces, all of which support property values and contribute to making Carpinteria attractive to businesses and visitors.
The Community Services Support Program provides funding for grant programs and contract services that are provided through various organizations that serve the Carpinteria community. Funding for this program has increased in recent years as the Council has sought to adjust contributions for the effects of inflation and to address specific needs of community-based organizations such as HELP and the Carpinteria Children's Project. Notably, the proposed budget no longer includes Library support for the County of Santa Barbara as the City Library will is budgeted as a separate program.
A table showing current year and proposed Community Service Support Program Funding as well Fund sources is attached to this Report.
LEGAL AND RISK MANAG MENT CONSIDERATIONS
The preparation and presentation of the budget is consistent with Carpinteria Municipal Code Section S.08.1 10(H), concerning duties of the City Manager. The City Attorney will be in attendance at the meeting to advise the City Council on legal issues and/or questions it may have related to the budget and budget approval process.
PRINCIPAL PARTIES EXPECTED AT MEETING
Representatives of entities requesting funding from the City and other interested parties may be in attendance.
