ITEM FOR COUNCIL CONSIDERATION
Senate Bill 329 and potential adjustments to City Council compensation
STAFF RECOMMENDATION
Receive and file report, and direct staff as determined appropriate Sample Motion: I move to receive and file the report (and provide direction to staff as determined appropriate by the City Council.)
BACKGROUND
Carpinteria Municipal Code Section 2.04.620 pertaining to the compensation of City Councilmembers was last amended on June 25, 1990 by Ordinance No.462 (Attachment A) and states:
"Each councilmember shall be paid during his or her incumbency at the rate of three hundred ten dollars ($310.00) per month; provided, however, that any increase in compensation shall only become effective on the date of certification of a general municipal election at which time an elected councilmember takes office pursuant to Government Code Section 36516.5.'
On June 29,2023, Governor Gavin Newson approved Senate Bill No. 329 (SB 329) authored by Senator Bill Dodd, D-Napa (Attachment B). Like the current law, SB 329 sets the maximum city council salary amount based on city population, but increases that maximum from $300 per month to $950 per month. SB 329 also allows for specified inflation increases.
The purpose of this agenda matter is for the City Council to receive and file this staff report and direct staff as determined appropriate to consider a potential increase to City Council compensation in light of the recent passage of SB 329 and City Council's commitment to promoting diversity and equity within the city. 9"13!" DISCUSSION
On February 7,2023, Senator Dodd introduced legislation intended to boost diversity and participation on California city councils. Senator Dodd stated, "City council members serve long hours and make critical decisions for our communities. lt's a major commitment that's especially hard on working people and those from diverse or disadvantaged backgrounds who must balance jobs and family obligations."l The legislature has not increased the council salary ceiling since 1984, despite inflation rising over 300% during that time. SB 329 amends Government Code Section 36516 with the goal of attracting more diverse individuals to serve on city councils by having the pay reflect the time commitment necessary to serve.
The City Council's compensation of three hundred ten dollars ($310.00) per month ($3,ZZO annual), has remained unchanged since 1990 despite a more ihan M0% increase in inflation according to the Department of lndustrial Relations Consumer price lndex calculator for Urban Wage Earners and Clerical Workers in the Los Angeles - Anaheim region.
ln addition to a monthly stipend, many cities provide city council members with other benefits. ln Carpinteria, City Council members receive other benefits equal to Management personnel as outlined in Resolution 3057 (Attachment C) with one distinction that any cash received in lieu of health benefits must be placed into a deferred compensation account.
A city council compensation survey (Attachment D) was conducted, comparing Carpinteria to the same 16 cities utilized as benchmarks for the recent 2021 Total Compensation Study. The survey includes population size, monthly stipend amounts, and indicates whether council members are eligible to receive medical'coverage. ln addition to medical coverage, a partial analysis of benchmark cities showed th-at council members receive other benefits such as vision and dental insurance, and retirement systems. Amongst benchmark cities, the benefits provided to city councilmembers range from providing no additional benefits to full benefits.
Government Code Section 36516 as amended by SB 329 allows a city council to establish by ordinance a salary up to a ceiling determined by the city's population.
Councilmembers in cities up to and including 35,000 in poputation, iuch as Carpinteria, can approve a salary up to and including nine hundred fifty dollars ($gso.0o) per month.
The salary of council members may be increased beyondine popuiation-based salary caps by an ordinance or by an amendment to an ordinance, but the amount of the increase shall not exceed the greater of either of the following:
1 Senator Bill Dodd website (https://sdO3.senate.ca.oov/news/20230502-senate-approves-sendodd%E2%80%99s-city-councit-pav-cap-biil ) G:\CC Staff Reports\2024 0408\Final\CC Council Stipend\City Council Compensation_Staff Report.docx Senate Bill 329 and potential adjustments to City Council compensation April8,2024
(A) An amount equal to 5 percent (5%) for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted (non-cumulative).
(B) An amount equal to inflation since January 1, 2024, based upon the California Consumer Price lndex, which shall not exceed 10 percent (10%) for each calendar year.
The equation factoring 5o/o for each calendar year is non-cumulative. ln the case of the Carpinteria City Council, the amount calculates to $837.OO/month (Attachment E). The City Council may choose to increase the current compensation of $310.00 per month up to less than the maximum of $950.00/month based on population of cities up to and including 35,000. Should the Councilwish to increase the monthly compensation to an amount less than the population-based maximum, Option "A" may be used as a basis, or reference point, for an alternative amount.
ln preparation for the November General Municipal Election, staff is preparing the Election Fact Sheet, which contains information including candidate qualifications, filing instructions, and compensation amount. An increase to Council compensation could serve as an incentive for potential candidates who might not have considered running due to the significant time commitment and financial constraints associated with the role. lf the City Council directs staff to move fonruard with a stipend increase and it is subsequently approved, staff would update the Fact Sheet and utilize other means such as social media to announce the increase.
lf the City Council would like to increase compensation, a draft ordinance will be brought fonryard at a future meeting. Pursuant to Government Code section 36516.5, any council compensation increase takes effect only when at least one member of the city council commences a new term. Accordingly, any changes to council salary will not become effective until after the election in November 2024.
POLICY CONSISTENCY
The recommendation is consistent with other policies and efforts to promote a diverse, equitable, and just community within the City.
FINANCIAL CONSIDERATIONS
Currently, there is no request for additional funding appropriation. Should the council decide to propose an ordinance for the increase of the City Council compensation, staff will provide a budget impact cost-analysis based on the proposed recommendation.

An act to amend Section 36516 of the Government Code, relating to local government. pApproved by Governor June 29,2023. Filed with Secretary of State June29,2023.1
LEGISLATIVE COUNSEL'S DIGEST
SB 329, Dodd. Cities: city council members: compensation.
Existing law authorizes a city council to enact an ordinance to provide each member of the city council a salary based upon the population of the city, as specified. Existing law authorizes that amount to be increased by the city council by an amount that does not exceed 5o/o for each calendar year from the operative date of the last adjustment of the salary that is in effect when the increase is enacted. Existing law provides for the procedures by which a city may enact ordinances.
This bill would increase the maximum amount of salary based upon the population of the city, that may be approved by an ordinance passed by the city council, as specified. The bill would authorize the salary of council members to be increased beyond the specified maximums to an amount not exceeding the greater of either 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted, or an amount equal to inflation since January l, 2024, based upon the California Consumer Price Index, which shall not exceed llYo for each calendar year. The bill would require the city council to consider the adoption of an ordinance to increase council member compensation in open session during at least 2 regular meetings of the city council.
